GENERALIt is impossible for an underwriting guide to cover everyaspect that might affect the acceptance of a risk.Therefore, the company must remain the final authority inthe acceptance or continuation of any risk.

EXCEPTIONSOur program is designed to write a specific risk. Pleaserefrain from putting our staff in the uncomfortableposition of having to trade off program guidelines (whichimpact program affordability and stability) against theirdesire to meet your individual requests.

SPECIAL PROVISIONSNo coverage is provided: While auto is being used for delivery of goods or

persons for a fee; While in commission of a felony or with intent to

injure a person or property; While attempting to elude arrest; In cases involving fraud or material

misrepresentation.

POLICY TERM Policies are issued for a one-month, three-month or

six-month term; All service and billing fees charged will be the

maximum allowed by the Texas Automobile Rulesand Rating manual;

Payment options include paid in full or direct bill;

THEFT PREVENTION FEEIn accordance with Rule 15 in the Texas AutomobileRules and Rating Manual, all auto policies providingprimary liability coverages are subject to the AutomobileTheft Prevention Authority Fee. The fee will not becharged on the one-month policies. This fee is fullyearned and is charged on both new and renewal policies.

BINDING & COVERAGE DATESApplications for coverage must meet the requirementslisted in the underwriting guidelines and produceragreement. The Declarations and ID Card(s) should beprinted after upload and given to the Insured along withany other documentation.

If system problems prevent uploading the application,immediately fax application along with supportingdocumentation to the Company with a note as to why youare unable to upload.

APPLICATIONAll applications must be completed in their entirety andsigned by both the applicant and producer. Fax or Mailthe application and all supporting information includingacceptable discount proof, EFT form, inspection form andphotos to the Company within three business daysfollowing the successful transmission of the application tothe Company. Another option over faxing or mailing isto scan the documentation and attach it to theassociated policy within the Company’s system.

Failure to provide the Company with all necessaryinformation in a timely manner may result in the policybeing suspended, canceled or up-rated.

ENDORSEMENTSPolicy change requests should be submitted online usingthe Company website. Any endorsement that requires asignature or inspection and photos must be faxed or mailto the Company within three business days following thesuccessful transmission of the endorsement to theCompany. Another option over faxing or mailing is toscan the documentation and attach it to the associatedpolicy within the Company’s system.

Only the insured or spouse may request a change to thepolicy.

A down payment is required on ALL additionalpremium endorsements. IT IS IMPERATIVE THAT ADOWN PAYMENT FOR ENDORSEMENTS ISCOLLECTED AND REMITTED TO THE COMPANY.

The Company will require a signed request for thefollowing: Deletion of UM, PIP or OTC/COLL coverages; Excluded Driver (signed 515A); Insured Request to Cancel; Modification of PIP, UM or OTC/COLL coverages.

The Company will require a vehicle inspection and photosfor the following: Addition of OTC/COLL or UMPD coverage to an

existing vehicle Additional vehicle with OTC/COLL or UMPD

coverage

E&O Carriers recommend agents obtain a signed requestfor any policy change.

GENERAL ENDORSEMENT RULES Return premium endorsements will apply to the next

unbilled installment; All premium change endorsements will reflect the

rates in effect at the inception of the policy; A drivers age cannot be changed during the policy

term; No suspension of coverage will be permitted; The Company will not remove driver surcharges

during the policy term for accidents or violations that“drop off”;

Prohibited vehicles, either added or replacing anexisting vehicle, will be surcharged appropriately andflagged for non-renewal;

Photos and inspection forms are required to besubmitted

Registered owner must be added or excluded

RENEWAL AND NON-RENEWALSBoth renewal offers and non-renewal notices will be sentprior to the policy expiration date.

LATE FEEA late fee will be charged if an installment payment ispostmarked more than 5 days after the due date.

CLAIMS PROCEDURESAll claims should be reported directly to the Company’sClaims Service Center as soon as possible. TheCompany’s Claims phone number is 866-424-9514.

CANCELLATIONSFLAT CANCELLATIONFlat cancellations are not permitted except for thefollowing reasons: Insufficient funds tendered for the Down Payment Duplicate Coverage (a copy of declarations page

showing effective date and coverages is required). Unacceptable Risk (any Vehicle or operator that does

not meet the company’s guidelines).INSURED’S REQUEST Requests must be in writing and signed by the named

insured. The effective date of cancellation may not be earlier

than the date your agency is notified by the insured.All cancellations will be calculated on a pro-rata basis.

PERSONAL INJURY PROTECTIONPersonal Injury Protection will be written on all autoscovered for liability unless rejected in writing by thenamed insured.

OTC/COLLISSIONVehicle inspection forms must be signed by both theinsured and producer and become part of the application.A Vehicle inspection form and two photographs arerequired on all vehicles covered for Collision and OTCcoverages. OTC & Collision cannot be written withoutliability. OTC & Collision are not available separately.

Only one (1) lien holder per vehicle is permitted.

MEDICAL PAYMENTSMedical Payments Coverage may be written only if PIPhas been rejected and will be written on all vehicles.

NON-OWNER COVERAGENot WrittenRENTAL REIMBURSEMENTRental Reimbursement is an optional coverage and canonly be written on vehicles with physical damagecoverage. If selected, coverage must be written for allvehicles carrying physical damage.

SPECIAL EQUIPMENT COVERAGEStandard equipment installed by the auto manufacturer iscovered under physical damage coverage. Equipmentoptions or furnishings, including customization packages,installed after leaving the factory, as well as those optionsnot considered part of the standard equipment package,are considered additional equipment.

It is the agent’s responsibility to ask the applicant aboutadditional or custom furnishings and equipment whencompleting the application.

To obtain coverage, special equipment must be listed onthe vehicle inspection form and an additional premiummust be paid. Increasing the vehicle symbol does notcover special equipment.

The following non-manufacturer and dealer parts areacceptable for Special Equipment Coverage if they arepermanently installed:

pickup bed or pulled behind a vehicle Permanently installed sound reproducing equipment over

Premium Calculation: Six-month premium equals $10.00 per $100.00 value; Maximum total value eligible for coverage is $3000; Minimum premium charge for Special Equipment

Coverage is $100.00.

DISCOUNTSThe maximum discount is 40%.The following discounts apply to BI, PD, OTC andCollision Premium only. Verification must be receivedwith the application for the discount to apply. If discountproof is not submitted with the application, the applicablecredit will not be applied any earlier than the date theverification is received by the Company.

MULTI-CAR DISCOUNTA discount will be applied on each vehicle with likecoverage regardless of driver class.

EXAMPLE: If vehicle #1 has liability, OTC andCollision coverage but vehicle #2 has liability only, thediscount would apply only to the liability coverage oneach car.

PRIOR DISCOUNTApplies to all policies where the named insured providesproof of six-month’s of continuous coverage with nomore than a 30-day lapse in coverage. Also, the namedinsured must be claim/accident free for the past twelvemonths leading up to the application with the Company.Proof of prior must accompany the application and issubject to verification. No hand-typed or agency-generated ID cards are accepted.

One of the following is permitted at time of application: Declaration Page Renewal Declaration or Certificate Renewal or Non-Renewal Notice Confirmation letter from prior carrier Company generated ID Card.

SAFE DRIVER DISCOUNTThe named insured and all listed drivers must be accidentfree (includes collision with animal) at least 18 monthsprior to inception.. If in any policy term following therenewal the named insured or any listed driver is involvedin an at fault accident or any major violation, all safedriver discounts that have been earned will be removed.

ROLLOVER DISCOUNTThe discount will apply after six months of continuouscoverage with the Agency, during which there have beenno claims and with no more than a 30-day lapse incoverage. Copy of Dec page from agency mustaccompany the application and cannot be combined withprior or Renewal discount.

RENEWAL DISCOUNTAfter six months of continuous coverage with theCompany, during which there have been no claims andwith no more than a 30-day lapse in coverage, a renewaldiscount will apply. This process will be continued untilthe maximum discount is reached.

HOMEOWNER DISCOUNTVerification is required to qualify for this discount andmust be received with the application. Evidence ofownership includes a copy of homeowner or dwellingpolicy and/or tax statement.

DRIVER EXCLUSIONS (515A)The following rules apply:

The registered owner of the vehicle must be thenamed insured;

The Named Driver Exclusion (515A) must becompleted for all regular operators and residents ofthe household age 14 or older, whether licensed ornot, who are not listed as a driver on the policy;

A spouse may be excluded if the named insuredprovides proof of marriage.

DRIVING SURCHARGESSurcharge points apply to BI, PD, OTC and Collisionpremiums.MAJOR VIOLATIONS-6 PTS DWI, DUI, Education program required or failure to

undergo testing under implied consent law; Possession of an illegal substance; Felony with a motor vehicle; Any other Major Violation not listed above.

INTERMEDIATE VIOLATIONS1ST–3 PTS, 2ND–4PTS, 3RD-INELIGIBLE Driving on a suspended license; Driving the wrong way; Racing; Reckless driving; Or any other intermediate violation not listed above.

MINOR/INTERMEDIATE VIOLATIONS1ST–1PT, 2ND & SUBSEQUENT–2PTS Speeding; Failure to yield right of way; Unsafe lane change; Failure to drive in single lane; Any other Minor Violation not listed above.

MINOR MOVING VIOLATIONS1ST–NO CHARGE, 2ND & SUBSEQUENT–1 PT Excessive acceleration; Defective equipment; Any other Minor Violation not listed above.

ACCIDENTS1ST– 4PTS, 2ND & 3RD–3 PTS All accidents are considered at fault unless proof of

no negligence is submitted.

NO SURCHARGE FOR THE FOLLOWING No motor vehicle inspection sticker; Citation for no evidence of liability insurance; No seat belt; Violated driver license restriction.

OTHER SURCHARGESBUSINESS USEWhen the business use of a private passenger vehicleconsists solely of carrying tools and supplies between thenamed insured’s residence and a job site, The Companywill accept the risk if: The vehicle is individually owned; The vehicle is operated solely by the named insured

and covered family members; The named insured has no more than one vehicle in

this category; The vehicle travels no more than 100 miles per day;

Unacceptable Operator(s)Driver(s) added during the policy period that would havebeen otherwise unacceptable.

Unacceptable Vehicle(s)Vehicle(s) added during the policy period that would havebeen otherwise unacceptable.

Foreign Driver’s LicenseAny driver who is not licensed in the US but does hold aforeign license is acceptable with a surcharge. Copy oflicense must accompany application.

ELIGIBLE OPERATORSAll regular operators and residents of the household mustbe listed on the application and rated or excluded from thepolicy. Rated operators must meet all underwritingguidelines, must be permanent residents of Texas andhave a valid driver’s license.

“MARRIED” means married or common-law andRESIDING in the same household at the inception date ofthe policy.

PROHIBITED OPERATORSThe following operators are unacceptable:Operators who, in the prior 3yrs, have: More than 10 points; More than one major violation.Any operator who: Does not have a valid driver’s license; Is an entertainer, celebrity, detective, private

investigator and/or bail bondsman; Is a transient or migrant worker; lives or works in

Mexico; Is without a garaging address; Is residing outside Texas; Is under the age of 16 years; Students residing/attending school outside of Texas;

PROHIBITED USAGEVehicles used in any of the following are unacceptable: Vehicles leased or rented to others by the applicant; Vehicles used for pick-up or delivery of any type; Vehicles available to multiple drivers for sales, farming or

commercial use (e.g. pooled vehicles); Vehicles used as a residence; Vehicles used by students attending school outside Texas.

PROHIBITED VEHICLESThe following vehicles are unacceptable. Do not bindcoverage on the following risks: Antique, classics, custom built or obsolete vehicles; Vehicles constructed of fiberglass or kit cars; Vehicles titled or garage outside of Texas; Vehicles with a load capacity in excess of 1 ton; no 1 ton

vans will be accepted Vehicles equipped with cooking equipment or bathrooms; Any vehicle modified to affect performance including

altered suspensions; Commercial or emergency vehicles, taxis, rental cars or any

vehicle for hire including limousines; Flatbed trucks, step vans, panel vans, box vans or cut-away

vans; Government-owned vehicles; Vehicles used for racing or speed contests; Any vehicle with more or less than 4 wheels; Any vehicle with a ISO symbol greater than 20 for

OTC/Collision; Any vehicle with an ACV of $35,000 or more; Any vehicle with a salvage title for OTC/Collision Any vehicle older than 40 years; OTC and collision coverage on vehicles over 20 years old; More than 5 vehicles per policy/insured Any of the following vehicles:

RATINGASSIGNMENT OF DRIVERSThe highest rated operator is assigned to the highest ratedvehicle. If there are more vehicles than operators, theunassigned vehicle will be written at UD driver class, 0points. The number of vehicles cannot exceed the numberof drivers by more than two. All policies will be issued atthe correct rates based on the information from theapplication and investigative reports.

The experience period for both new and renewal businessshall be 36 months prior to the effective date of thepolicy.

AUTOMOBILE SYMBOLSThe Company uses ISO symbols to rate all private-passenger automobiles.

REINSTATEMENTSNON-PAYMENT CANCELLATION:Non-payment cancellations will be reinstated only if thepayment is postmarked prior to the effective date ofcancellation. If the payment is not postmarked before theeffective date of cancellation, coverage will terminate. Alate fee applies on all payments that are made after thedue date.

UNDERWRITING CANCELLATION:Policies canceling for lack of information may bereinstated only if all requested information is postmarkedor received prior to the effective date of cancellation andpayments are current.

If funds are collected after the effective date of thecancellation, the policy must be rewritten.

REWRITESPolicies that have cancelled for nonpayment may beeligible for Rewrites up to 30-days after cancellation. Anew policy will be issued with the rules and rates that arein effect at time of the rewrite. The rewrite policy will beissued with the same drivers, vehicles and coverage’s asthe prior policy.

RETURNED CHECKSIf the insured’s check for an installment payment,deposited by the Company, is returned NSF by the bank,the insured will be charged an NSF fee for the returnedcheck and the policy will be canceled back to the originalcancellation date.

SR-22 FILINGThe following conditions will apply for any SR-22accepted by the Company: The Company cannot file SR22’s for any other state

other than Texas; The Company is not responsible for any delays or

lack of processing of the SR22 and/or reinstatementof a driver’s license.

It is the insured’s responsibility to make sure thefiling fees are sent to the Texas Department of PublicSafety directly and the license is reinstated.

NO SR22A FILINGS ARE ALLOWED.
