How is the regulation of managers in Denmark?

• No regulation of the profession as property manager– Individual property managers– Property management businesses

• Anybody can act as property manager– No legal requirements as regards education– No legal requirements as regards the legal entity of the

business. It can fx be a limited (liability) company (A/S), a private (limited liability) company (ApS), Partnership etc.

• Despite this the property managers are very professional

How is the regulation of managers in Denmark?

• Heavy regulation of the issues that the property managers deal with in their businessess. That is– Regulation of rental of premises for residental purposes

– Regulation of rental of premises for office/stock/industrial purpose etc

– Regulation of cooperative flats (Andelsboliger)

– Regulation of owner-occupied flats (Ejerlejligheder)

– Regulation of social housing (Almene boliger)

• A consequence of the heavy regulation is that the property management business is focused on Denmark only

Education

• Public education– AP in Financial Management (AK) (Finansøkonom (AK))

• A part of their education is a practial experience with a property manager, which often leads to a job with a property manager after finishing the education

• Eureduc schools/CEPI Eur label• Require more education within property management after

finishing their AP in Financial Management

Education

• Public education– Academy Profession (AP) Degree in Business (AU i

Finansiel Rådgivning)• This is a part time education and the student works with a

property manager at the same time• ED has designed two of the modules in property management

together with the organization of social housing• Require more education within property management after

finishing their AP Degree in Business

• Private education– Semester courses at Ejendomsforeningen Danmark

• This is part time education with exam and the student works with a property manager at the same time

• Covers the following areas:– Regulation of rental of premises for residental purposes

– Regulation of rental of premises for office/stock/industrial purpose etc

– Regulation of cooperative flats (Andelsboliger) and owner-occupied flats (Ejerlejligheder)

– Finance management (Ejendomsregnskab)

– Other courses at Ejendomsforeningen Danmark

Code of conduct

• New code of conduct as of 1 January 2007 • Why new code of conduct ?

– New CEPI code of conduct that had to be incorporated

– Guidelines for our members

– A danish project-group discussed the possibility of establishing a joint code of conduct for the private and social housing sector. The discussion is still open

– Society is getting more and more regulated, and we prefer to make our own codes of conduct instead of having the government making such rules for us

Code of conduct

• What is new in the codes of conduct– The rules should be easy to read for property managers

and customers

– We have defined who can make a complaint according to the rules

– We have a more stringent way of handling complaints according to the codes of conduct. A decision may result in

• A reprimand or• That the member is expelled from ED

• What is new in the codes of conduct (continued)– Insurance: Shall be in the amount as specified in the CEPI

code of conduct

– Emphasis on education of employees

– Non-discriminination

– Information of the property manager and his/her business

– Fees of property managers – the calculation of the fees should be more clear for the customer

– Sharing of experiences between property managers

Issues going on now

• Recruiting– Very difficult to recruit new employees

– We are launching a campaign in august to get more people interested in becoming property managers. However, we have some hurdles as for example:

• Image• What does a property manager do in his/her work ?• How do we get the message to young people that this is an

exiting area ?

The legal services of ED

• Hotline with legal advice every afternoon• We write books on administration of different kinds of

property– Management of rental of premises for residential purposes

– Management of rental of premises for business purposes

• Internet-base with legal information, law reports, draft contracts, drafts letters etc. (ED-lovportalen)

• Education• Legal magazine (huset jura)
