Eggsmart #eggsmartcracking Instagram Repost Contest – Official Rules

Contest Description:

Contest Period: The Eggsmart #eggsmartcracking Instagram contest begins Monday, September 14, 2015 commencing from the time the photo for reposting advertising the Promotion (the “repost”) is posted online and ends on Friday, September 18, 2015 at 9 a.m. Eastern Time. Sponsor reserves the right to shorten or extend the Sweepstakes Period due to events beyond its control or for reasons set forth herein.

Prize: One (1) prize will be awarded, consisting of a $50 Eggsmart Gift Card. Prize must be accepted as awarded and is not convertible to cash.

Eligibility: Entrants must be at least eighteen (18) years of age. Employees, officers and directors of Eggsmart ® and its advertising, promotion or production agencies, distribution or sales representatives, and web masters/suppliers and marketers and each of their immediate family members and individuals residing in the same households (whether or not related) are not eligible to participate. Void where prohibited, or restricted by law. All federal, provincial and local laws and regulations apply. Open to legal Canadian residents of Ontario only, and void where prohibited by law. 

Contest Entry: To enter the contest, participants must have an Instagram ® account that is open to the public. Before entering the Contest, the “Photos are Private” option in your Instagram ® account settings must be set to “OFF”. There is no cost to register for an Instagram ® account.

1) Follow Eggsmart on Instagram ® at @eggsmart_can (https://instagram.com/eggsmart_can/)

2) Repost the contest photo posted by our Instagram account to your Instagram account

3) Tag the photo you reposted with hashtag #eggsmartcracking and mention @eggsmart_can in the comments.

Photo must be uploaded in accordance with the Instagram ® Terms of Use (http://instagram.com/about/legal/terms). Limit of one (1) entry per Instagram account per person during Promotion Period. Entries may only be submitted by a single registered Instagram ® user, group submissions are not permissible. Multiple entrants are not permitted to share the same device or email address. Normal internet access and Device usage charges imposed by your on-line service will apply.

Entry Requirements: ANY ENTRY DEEMED INAPPROPRIATE OR UNSUITABLE, IN SPONSOR’S SOLE DISCRETION, WILL BE DISQUALIFIED.

*The photo used for Submission must be photo that shows on our Instagram account.*The Submission cannot have been submitted previously in a promotion of any kind.*The Submission must not contain material that violates or infringers another’s rights, including but not limited to privacy, publicly, or intellectual property rights, or that constitutes copyright infringement;*The Submission must not disparage Sponsor, other companies or their products, or any other person with the Contest; *The Submission must not contain brand names or trademarks other than those owned by Sponsor, which entrant has a limited license to use to incorporate in his/her Submission in this Contest *The Submission must not contain images or artwork not created by entrant*The Submission must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, or libellous*The Submission must not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and*The Submission must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where submission is created

Winner Selection/Judging: Entries will be judged by representatives of Sponsor. After the Entry Period, one (1) potential winner will be selected at random among all eligible Entries received to win a prize. All decisions of the Sponsor representatives are final and binding.

Notification: Winner will be contacted via Instagram ® Via Comment by Sponsor (@eggsmart_can) promptly following selection. Instructions will be given on how to email Sponsor and the Sponsor should be emailed by winner within seventy-two (72) hours. Failure to respond by direct message (email) to the Eggsmart ® Administrator within seventy-two (72) hours of attempted notification may result in forfeiture of the prize and, the selection of an alternate winner. Winner may be required to execute an Affidavit of Eligibility, a Liability Release and Publicity Release. If any winning Entrant does not return all required documents within five (5) days of prize notification, or is otherwise found to have not complied with these Contest Rules, the Winner may be disqualified and an alternate winner may be selected. 

Publicity Release: By acceptance of a Prize, Winners irrevocably grant to Eggsmart ® and its successors, assigns and licensees the right to use the Entrant’s name, address and likeness, for any commercial, publicity or promotional purposes (including, without limitation, advertising and/or promotional purposes in connection with the Contest, the Eggsmart ® Instagram ® page, Eggsmart ® goods or services or other promotions) without further compensation, review or approval, worldwide and in perpetuity, in any

and all forms of media, now known and hereafter devised, and hereby releases Eggsmart ® from any liability resulting therefrom.

Release and Indemnification of Sponsor:

1) By entering the Contest, each entrant agrees to:

A) Release Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers and agents from any and all actions, causes of action, liability, claims and demands, loss or injury, howsoever caused, which may be suffered or incurred by entrant in consequence of the awarding of a prize to entrant or in any manner related to the Contest, including without limitation, personal injury, death or property damage, resulting in whole or part, directly or indirectly, from acceptance, possession, use or misuse of any Prize, participation in this Contest, breach of any of these Contest Rules, or in any Prize-related activity; and

B) Indemnify and save harmless Sponsor and its directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, and agents from any and all claims by third parties related to this Contest, without limitation. 

Personal Information: By entering into the Contest, Entrant agrees to Eggsmart ® collection and use of their personal information in connection with the Contest. Entrant agrees that he or she has read and accepted Eggsmart ® Terms of Use and Privacy Policy, at http://www.eggsmart.ca/privacy/
