New Business Rules that Impact Course Providers

• EMS will track state-specific PE/CE requirements

• Courses will need to be submitted/approved down to agency level • IN-DFI and IN-SOS • CA-DOC and CA-DRE • TX-SML and TX-OCCC • SC-BFI and SC-DCA • UT-DRE and UT-DFI

• OH will be tracked by License Type: OH-OMBA and OMLA

State Agencies will be able to set/change education requirements • 90 day advance notice to inform providers/industry • MLOs will not have to retroactively complete additional PE/CE



New Business Rules that Impact Course Providers

• 90 day advance notice to inform providers/industry

• PE compliance is tracked at time of application • If PE requirements change after application, MLO will not have to Complete the new requirements.

• CE compliance will be tracked at time of licensure • If CE requirements change mid-year and MLO has already completed CE they will have to meet the new requirement



New Business Rules that Impact Course Providers New Uniform CE Policy: As a condition for license renewal, an MLO is required to complete at least eight (8) hours of CE in the same year in which he/she is placed in an approved license status by a state agency, with the following exception:

• An MLO who has completed his/her pre-licensure education (PE) course requirements in the same year in which the license was approved, is not required to complete CE.

In the event an MLO had a requirement to complete CE and failed to do so, and as a condition for renewal or reinstatement, “Late CE” is required to be completed to satisfy CE for the last year in which the MLO was in a renewable status. “Late CE” courses are those courses which have been specifically approved and configured, so that upon completion, course credit will be retroactively applied to the appropriate previous year. Additionally and in accordance with the Model State Law (MSL), an MLO who subsequently becomes unlicensed must complete the CE requirements for the last year in which a license was held prior to the issuance of a new or renewed license.



Long Transition Period • To assist course providers to learn the new system, NMLS has

elected to employ a staggered launch strategy:

• Beginning in May and continuing through June, specific work processes will be “turned-off” in PULSE and “turned-on” in the EMS.

• Least used processes will transition first • Credit banking will transition last • No course offerings will transition to new EMS

• Course providers will have to interact with both PULSE and the EMS in May

and June.

• BaseCamp will continue to be used for document management

• Exact transition dates will be communicated in March


Education and the Uniform State Test (UST)

Agencies currently considering making changes to PE/CE: • HI, TX-SML, TX-OCCC, VT, WA • No effective date of change for the five agencies has been established

• NMLS will release an “Education Notice” informing course provider at

least 90 days prior to effective date of change. • Notice will state required number of hours (by subject area) • Course content requirements • State law/statute reference list • Effective date

• On the effective date, existing state-specific courses for that agency will

be inactivated, and only new course may be taken to meet the new requirement.

• UST= Uniform State Test • High level state content • Content taken from SAFE Act and Model State Law • UST is integrated in the National Test Component • UST section is 25 add’l questions • Total test length is 125 questions (115 scored) • UST stand-alone component is 25 questions

UST Implementation

• January – April, 2013: Transition period – UST development completed – No early enrollment – Communication

• April 1, 2013: UST Launch – National Test with UST (National Test retired) – Stand-alone UST – 20 States adopt (those state tests are retired)

• July 1, 2013 – 4 States adopt


Candidate Scoring - Summary

• Stand-alone UST score will be combined with the candidate’s passing score on the National Test Component.

• The Stand-alone UST score added to the score

of the National Test must equal AT LEAST 87 out of the 115 scored items on the test (75%).


Candidate Scoring - Agnes

• Agnes PASSED the National Test 80% (72 correct / 90 scored)

• Takes Stand-alone UST gets 15/25 correct

• UST results are added to Nat’l results

• 72 + 15 = 87 correct; 87/115 = 75%

• Agnes’ UST result is a PASS


Candidate Scoring - Bruce

• Bruce PASSED the National Test 75% (68 correct / 90 scored)

• Takes Stand-alone UST gets 12/25 correct

• UST results are added to Nat’l results

• 68 + 12 = 80 correct; 80/115 = 69%

• Bruce’s UST result is a FAIL

• BUT, Nat’l results remain a PASS


Candidate Scoring - Carol

• Carol has not taken the National Test

• Takes National Test with UST

• Gets 85 correct; 85 / 115 = 73%

• Result is a FAIL on the National and UST


Candidate Scoring - Doug

• Doug has not taken the National Test

• Takes National Test with UST

• Gets 91 correct; 91 / 115 = 79%

• Result is a PASS on the National and UST

• SAFE Test Compliant for any UST State

• Must take state specific for non-UST State


Candidate Scoring - Elaine

• Elaine took the National Test with a score of 82%, result is a PASS on the National Test

• Elaine does not take the Stand-alone UST Test during its administration

• Elaine takes the National with UST and scores a 71% (82 correct / 115). She receives a FAIL for UST but retains her PASS for the National.

• She must retake the National with UST to achieve compliance for the UST.


Candidate Scoring - Fred

• Fred took the National Test and scored 77% with a result of PASS

• Fred does not take the Stand-alone UST Test during its administration

• Fred takes the National with UST and scores a 81% (94 correct / 115). He receives a PASS for UST and is compliant for any state which requires the UST.
