INTRODUCTION

The purpose of this manual is to present in brief outline form the procedures used by the New YorkState Department of Transportation in determining the acceptability of materials arriving at theproject site.

Additionally, the manual is used to determine the acceptability of component materials of productsfabricated prior to project site supply. These component materials are used in the production ofproducts at steel fabrication shops, portland cement concrete producers and hot mix asphaltproducers, precast/prestressed concrete facilities, epoxy coating facilities, etc. under theadministration of the Department.

Detailed information relative to these procedures will be found in the referenced specifications andin Materials Methods or other documents as listed in the subsequent pages titled, “RelatedInstructional Procedures.”

The appendices included at the end of this manual are:

BUY AMERICA

The “Buy America” requirements are detailed in the “Standard Specifications,” Sections 106-11,“Buy America.” For evidence of acceptability of “Buy America” requirements, see “II. Inspection andDocumentation” that follows.

The "Buy America" provisions restricts the use of foreign steel, foreign iron, and items containingforeign steel and iron on the projects.

I. DEFINITIONS

All Steel - any and all steel material of any type, including welding rod.

All Iron - any and all iron material of any type, including cast and ductile iron. Pig iron is NOTincluded.

Fabrication of Any Product Containing Steel and/or Iron - any and all items, products,materials containing any amount of steel and/or iron materials; e.g., a metal pipe may be steelor iron, a reinforced concrete pipe contains steel, a prestressed beam contains steel, ironcastings are iron, a steel beam is steel and steel laminated bridge bearings contain steel.

Domestic - The 50 States, the District of Columbia, Puerto Rico, or in the territories andpossessions of the United States.

Foreign - Any location other than those defined as Domestic.

All Manufacturing Processes - all steel and/or iron manufacturing processes must bedomestic; e.g. manufacture, fabrication, grinding, drilling, welding, finishing and coating. Ore,scrap, and pig iron may be foreign or domestic; however, transformation into steel and/or ironand all subsequent processes and fabrication must be domestic.

II. INSPECTION AND DOCUMENTATION

Inspection and documentation requirements for steel and/or iron products are needed to provideassurance that the domestic origin requirements of the contract documents are fulfilled.

For contracts that require materials that contain steel and/or iron, and for those materials whichare not specifically referenced in MIM and MURK, the engineer shall utilize judgement to verifythe domestic origin of materials that are in whole or part steel or iron.

For contracts that specify materials that contain steel and/or iron, the following is applicable toall Materials that are steel and/or iron, as appropriate:

• Wherever Manufacturer's Certification or Material Supplier's Certification appearsunder Evidence of Acceptability, the requirements of that certification are expanded toinclude a statement of domestic origin as indicated in Appendix 2 of this document.

Exception: For Bar Reinforcement, Grade 420, §709-01, the location of the fabricatorindicated on the Reinforcing Bar Shipment Certification and the location of the RollingMill indicated on the Approved List shall be used to assure domestic origin.

• Wherever BR195 (Shipment Authorization) is indicated under Evidence of Acceptability, theexecution and validation of the BR195 shall have implicit in it the acceptability (includingdomestic origin where applicable) of the material shipped to the project.

• Wherever BR97 (Shipment Certification) is indicated under Evidence of Acceptability thereshall be a statement as to domestic origin of the steel and/or iron material included on theBR97.

• Wherever under Evidence of Acceptability it is required that project samples be submittedfor testing, the contractor shall provide the Engineer with a manufacturer's certification asto the domestic origin of the steel and/or iron material. The engineer shall include astatement of domestic origin in Box 16 of the BR240 (Sample and Acceptance TransmittalForm) to be submitted along with the samples.

• Wherever B&GC4 (Report of Shipment of Structural Material) is indicated under Evidenceof Acceptability, the execution of the B&GC4 by the Department Representative shall haveimplicit in it the acceptability (including domestic origin where applicable) of the materialshipped to the specific project.

• Wherever a letter from Deputy Chief Engineer (Structures) is indicated under Evidence ofAcceptability, the letter will include a definite statement as to the acceptability of the materialregarding domestic origin.

WAIVERS

In some instances it may be necessary for the Contractor to request a waiver from the BuyAmerica provisions. These circumstances include: If it can be demonstrated the use ofdomestic steel would be inconsistent with the public interest, such materials and products arenot produced in the United States in sufficient and reasonably available quantities and ofsatisfactory quality. The cost of the materials or products are typically not considered. Thecontractor was provided the opportunity to submit a bid based on the use of steel to beconsidered if the total foreign bid decreases the total contract cost by more than 25%.

Provided one or more of the above requirements are met, the Contractor may submit a requestfor a waiver to the Engineer-in-Charge. The request shall include copies of all documentationverifying the unavailability of the material or product, and/or justification of the application for awaiver.

The Engineer-in-Charge will conduct a general review for completeness and consistency withthe contract documents before forwarding the package to the Regional Materials Engineer(RME) with a copy to the Regional Construction Engineer. The RME will confirm that the claimis consistent with the MIM and forward the package to the Materials Bureau. The MaterialsBureau will coordinate the approval process with support from the Structures Division and theConstruction Division.

The review conducted in the Main Office will consist of contacting several Material Suppliersand/or Manufacturers to verify the unavailability of the material or product. Contact with theappropriate industry organization may be made also. If the request for a waiver from the BuyAmerica provision is found to be valid, the request will be forwarded to the Construction Divisionwith recommendation for final approval. If the request is found to be invalid, and sources for thematerial or product are found, the request will be forwarded to the Construction Division withrecommendation for denial. Waiver approval will be made by the FHWA for federal-aid projects,and by Director, Construction Division for non federal-aid contracts.

The Construction Division will notify the Contractor of the final decision with copies to theappropriate Main Office organizations, the Regional Construction Engineer, the RegionalMaterials Engineer (RME) and the Engineer-in-Charge.

INSPECTION AGENCIES

In this manual an acceptance stamp of the Inspection Agency is mentioned in regardto the “Evidence of Acceptability” of various materials received at the project site; e.g.Item 715-01 Structural Steel and 716-04 Steel Laminated Elastomeric BridgeBearings. Currently the three nationwide inspection agencies that we employ are TheRobert W. Hunt Company, Pennoni Associates Inc., and Non-Destructive TestingGroup (NDT). Below are the typical imprints of the stamps for each of the aboveagencies to help in your identification of the acceptability of the various products.

Throughout this Manual references are made to a “Manufacturer's Certification” as anevidence of acceptability of specific materials or products.

A “Manufacturer's Certification” can only be properly executed by the manufacturer orproducer of the product. Some manufactured products are subsequently provided bya Material supplier other than the manufacturer. When a product is provided by aMaterial supplier, a “Material Supplier's Certification” is required in addition to the“Manufacturer's Certification.”

If the material or product certification does not properly identify conformance to thespecification, the product shall be rejected and removed from the project site. If however themanufacturer and/or Material supplier requests to leave the product in place and provide arevised certification only, the revised certification must be accompanied with a letter ofexplanation to the satisfaction of the Engineer in-Charge. The explanation shall indicate thebasis for using the revised certification rather than the original supplied. The letter shall alsoinclude corrective action to assure that future certifications will be representative of thematerial or product supplied. The letter must be signed by a company representative that canlegally bind the firm.

When shipments are made directly to a project site by the manufacturer or producer,the essential components of a “Manufacturer's Certification” include:

1. IDENTIFICATION OF THE MANUFACTURER OR PRODUCER

Name of company and the address of its manufacturing or producing facility.

2. IDENTIFICATION OF THE MATERIAL OR PRODUCT

Generic name of the material or product and NYSDOT materials designation(700 item number).

3. IDENTIFICATION OF THE SHIPMENT

Sufficient detail to describe the quantity content of the shipment and its projectdestination including a date of shipment.

4. STATEMENT OF CONFORMANCE

A. A definitive statement that the material contained in the shipment meets therequirements of the Department's Specification under which it is to be usedor a specific specification of another agency as stated in the DepartmentSpecification (i.e. - ASTM, AASHTO, etc.).

B. A statement as to the domestic origin of all steel and/or iron or materialscontaining steel and/or iron. An acceptable statement regarding domesticityis: “Conforms (or does not conform) to the Domestic Requirements ofNYSDOT's Standard Specification, 106-11, Buy America.”

5. IDENTIFICATION OF PERSON EXECUTING THE CERTIFICATION

The certification must be signed by a person who will legally bind the companyindicated by a statement or title/position in the company. It is not necessary thatsuch a signature be notarized.

When the shipment is made to a project site by a Material supplier other than themanufacturer or producer, the “Manufacturer's Certification” should beaccompanied by the “Material Supplier's Certification.” The essential componentsof a “Material Suppliers Certification” include:

1. IDENTIFICATION OF THE SUPPLIER AND MANUFACTURER OR PRODUCER

Name and address of the Material supplier as well as the name and address ofthe manufacturing or producing facility.

2. IDENTIFICATION OF THE MATERIAL OR PRODUCT

Generic name of the material or product and NYSDOT materials designation(700 item number).

3. IDENTIFICATION OF THE SHIPMENT

Sufficient detail to describe the quantity content of the shipment that is clearlyrepresented by the quantity included on the accompanying “Manufacturer'sCertification.” In addition, the shipment's project destination and date ofshipment shall be included.

4. STATEMENT OF CONFORMANCE

A. A definitive statement that the material contained in the shipment isrepresented by the accompanying “Manufacturer's Certification.” In addition,if the product supplied has been altered subsequent to the certification bythe manufacturer, a definite statement that the material contained in theshipment meets the Department's Specification under which it is to be usedor a specific specification of another agency as stated in the DepartmentSpecification (i.e. - ASTM, AASHTO, etc.)

B. If the material shipped by the Material supplier contains steel and/or iron,a statement that any additional manufacturing processes performed,conform or do not conform to the Department's domesticity requirements.An acceptable statement regarding domesticity is: “Conforms (or does notconform) to the Domest ic Requirements of NYSDOT's StandardSpecification, 106-11, Buy America.”

5. IDENTIFICATION OF PERSON EXECUTING THE CERTIFICATION

APPENDIX 3SECURITY SEALS

There are several types of security seals which are an integral part of the Department’sQuality Assurance Program for materials. These include red and green tape seals andred and green metal seals which are used to assure that certain materials arriving atproject locations have been sampled, tested and accepted.

These security seals are the explicit property of the Department and since they areoften the sole evidence of acceptability for various materials on which they are used,every precaution must be taken to keep them out of the hands of persons other thenDepartment employees or authorized representatives.

It is imperative that Department inspectors receiving materials on which these sealsare used should make certain that they are intact and that the package and materialremain secure. Upon opening the package or using the material, each seal should bebroken or destroyed in order that it may not be reused. For those containers which arerecycled for future use by the Material supplier, it is especially important that all sealsare removed and destroyed.
