ORDER
WHEI\EAS under the Government of West Bengal, Labour Department Order
No.B67-1R dated 19/08/2002 the Industrial Dispute between M/s. Associated
Pigments Ltd., 26(), B.T. Road, P.O.-Sukchar, Dist.-24 Parganas(N) and Shri Shashi
Bhusan Sinha, 260, B.T. Road, P.O.-Sukchar, Dist. 24 Parganas(N) regarding the issue
mentioned in the said order, being a matter specified in the Second/Third Schedule In
the Industrial Disputes Act, I 947 (14 of 1947), \',I(1S referred for adjudication to the
Judge, Seventh Industrial Tribunal, West Bengal.
AND \VHEREAS the Judge of the said Seventh Industrial Tribunal, vvest
Bt'ngal, hC1S su bmitted to the State' Government its award on the said lndustrial
Dispute.
NOW, THEREFORE, in pursuance of the provisions of Section 17 of the
Industrial Disputes Act, 1947 (14 of 1947), the Governor is pleased hereby to publish
the said award as shown in the Annexu re hereto :

This industrial dispute between Shri Shashi Bhusan Sinha, 260, B.T. Road, P.O.Sukchar, Dist. 24-Parganas(North) and Mis. Associateel Pigments Limited. 260. B.T.Road, P.O. Sukchar, Dist. 24-Parganas(North) has been referred by the Govt. of WestBengal, Labour Department vide Order No. 1367-I.R. dated 19.08.2002. to this Tribunalfor adjudication of the following issues:-

a) Whether the dismissal of Shri Shashi Bhusan Sinha from his service is justified?
b) What relief, if any, is he entitled to?
* * * * * *Today is fixed for order. The record is put up today for necessary order.
Perusing the materials on record it appears that the present reference bearing G.O.
No. 1367-I.R. dated 19.08.2002 under Sec. 10 read with Sub-section 2A of the Industrial
Disputes Act, 1947 for adjudication has been registered on 05.09.2002 vide Order No.1
and notice upon the parties were duly served. It also appears that in this case hearing was
going on on the point of interim relief, but several dates were adjoumed for non
appearance of the workman at the stage of argument. The argument on behalf of the
company was heard but the workman did not come forward to argue on his part. Several

applicant. In spite of show-cause notice the applicant did not turn up and the notice has
been returned to this Tribunal as unserved with the postal remark 'Left' on 30.03.2017.
From the conduct of the workman I think that it is a fit case to pass a 'No Dispute
Award' under Rule 22 of Industrial Disputes Rules, 1958, the industrial dispute by and
between the parties being treated as non-existent.
Accordingly 'No Dispute Award' under Rule 22 of West Bengal Industrial
Disputes Rules, 1958 is passed,
