>%($)(p) the @olice +ct empowers the minister for internal aAairs to make

regulations for the control of @4Hs. The regulations control the establishment

and operations of @4s! but apply only to @4s registered in ,ganda. The +ct

and the regulations are implemented by the police who have designated a

commissioner of police as overseer. @olice activities are overseen by the

minister for internal aAairs.

The ;inistry of 1nternal +Aairs is reviewing the framework to address gaps

and inconsistencies. + /ational =egistration and icensing ommittee has

been proposed to handle the registration! licensing! supervision and control

of @4Hs. The regulation of @4Hs is largely eAective! because the laws set the

minimum criteria for operating a @4H! establish mechanisms for controlling

private security services. The demand has been growing and continues to

grow due to a number of factors! including the fact that @4Hs undertake to

compensate for losses that their clients may incur while the contract with the

security company is in force. Fut to safeguard the rights of the clients and

uality of service due to them and also national security concerns! the

government nds it inevitable that the operations and operational standards

of @4Hs be subect to strict regulation! a function that it exercises through

the @olice.

The instrument that contains a set of obligations to be fullled by the @4Hs if

they are to remain in business has been circulated to all stakeholders. They

touch on recruitment and management of operational personnel!

management and procurement of rearms and maintenance of uality

operational standards. The @olice on its part is expected to monitor and

maintain the standards of training and recruitment procedures that the @4Hs

are reuired to adhere to.

@4Hs among other things must provide uality service to their clients.

times ensure that the operational staAs of these private organiBations

@4Hs must pay the wages and allowances to their employees promptly.

to ensure they are complying with this reuirement.

@4Hs are /HT allowed to deduct any money from guards to cater for

the uniforms and other euipment that they use. This transfer of such

cost to employees is strictly forbidden.

The employers must take out appropriate insurance cover for their

employees. @olice is expected to check that all guards are insured dueto the nature of the risks involved in their work.

The @4Hs must obtain and have all the necessary licenses stipulated in

the law before engaging in security operations.

1t is also a reuirement for @4Hs to report to the district 18 oCcer anyinvestigations they may be conducting of a criminal nature! and to give

a nal report at the end of every investigation.

The @4Hs are also reuired to ensure strict observance of human rights

by their employees.

and keep them safely. The 13@ must also ensure that @4H personnel meet

minimum standards of operational capability and discipline. The =@s and

8@s carry out the day to day functions of overseeing the @4Hs on behalf of

the 13@. *very year! the 13@ must issue an assessment certicate for each@4H in the country.

The 13@ must set standards of training and performance and ensure

that they are adhered to.

1t is the duty of the 13@ to ensure that @4Hs use! store and dispose of

rearms properly. 8@s must check continuously on the maintenance

standards for rearms. -ensure minimal risk to employs of @4Hs.

1t is the 13@ to approve all arms held by every @4H. +ll arms purchases

and importation must follow the procedures spelt out and conrmed by

the 13@ before authoriBation by the minister of international aAairs.

+s a rule! all rearms held by a @4H must be checked every four

+ll @4H personnel using rearms must be trained according to

standards set by 13@! and they must be approved! certied and

have his rearm license on him at all times that he is carrying an arm.
