I. INTRODUCTION

A. Project Description

1. Government of Madhya Pradesh (GoMP) through Government of India (GoI) is

negotiating with Asian Development Bank (ADB) for the proposed Madhya Pradesh

Urban Services Improvement Program (MPUSIP), referred further as ‘the Program’.

MPUSIP will improve the urban water supply services resulting in better living conditions

in 128 tier II towns in the State. MPUSIP will also improve sewage and drainage

management in four (4) of the Program towns. The Program also includes non-physical

investments to strengthen and build capacity of urban institutions’ management and

financing capacity for ensuring long term sustainability of the services.

2. The State’s Urban Development and Environment Department (UDED) is executing

agency (EA) and Madhya Pradesh Urban Development Company Limited is the

implementing agency (IA). A central Project Management Unit (PMU) attached to

MPUDC will be responsible for implementing the MPUSIP. The PMU will be supported

by 13 Program Implementation Units (PIUs) with a flexibility to redeployment depending

upon the implementation requirements.

A. Coverage. MPUSIP will cover about 128 urban local bodies (ULBs) of the total

378 ULBs in the State. It will be implemented in two Trench with about 50 towns covered

in the first Trench and the remaining 78 towns to be undertaken in the second Trench.

B. Components. MPUSIP’s physical component includes:

(i) 24/7 metered water supply for domestic, institutional and commercial users in

128 towns, including water resource identification and treatment, water storage

tanks, distribution pipes and metered connections to each household; and

(ii) integrated storm water and wastewater management in 4 towns (Khajuraho and

Rajnagar, Sanchi and Maihar), including wastewater collection, treatment and

safe disposal.

3. MPUSIP is expected to have minimal impact on land acquisition and resettlement. The

planning and designing of sub-projects will involve process and action to avoid, minimize

and mitigate potential risks arising from land acquisition and involuntary resettlement.

Rehabilitation of existing infrastructure facilities will be tried to be accommodated within

the existing premises and therefore will not involve land acquisition and resettlement.

Efforts will be made on best endeavor basis towards identifying sites for new facilities

within available vacant government lands. For unavoidable exceptional cases if new

facilities are set up on government lands or ROWs already encroached upon, such

cases will be entitled for compensation.

4. The Resettlement Framework (RF) outlines the objectives, policy principles and

procedures for land acquisition, if any, compensation and other assistance measures for

Displaced Persons1 (DPs)/Affected Persons (APs), if any. This framework is developed

based on prevailing law on the Right to Fair Compensation and Transparency in Land

Acquisition, Rehabilitation and Resettlement Act 2013 (LARR2013), state policies on

land acquisition and resettlement and ADB’s Safeguard Policy Statement (SPS), 2009

and any other relevant social safeguard guidelines.

II. Scope of this Report

5. This land acquisition and resettlement Due Diligence Report (DDR) is prepared for

the proposed Susner Water Supply subproject in Susner town, District Agar of

Madhya Pradesh. The proposed subproject will focus on metered water supply for

domestic, institutional and commercial users, including water resource identification

and treatment, water storage tanks, distribution pipes and metered connections to

each household in the towns covering a population of 16432 in Susner (population

as per census 2011) and estimated population on which it is designed for the year

2048 is 27000 all the municipal wards of the town are covered in the project

6. A due diligence process was conducted to examine the land acquisition and

resettlement issues in detail, in line with ADB SPS 2009. This report describes the

findings and provides copies of relevant documents, resolutions, minutes of meetings

and photographs. This land acquisition and resettlement due diligence report needs

to be read along with the Resettlement Framework prepared for MPUSIP.

7. Upon project implementation, the Social Safeguards Personnel at PMU,MPUDC will

be required to undertake a review of this due diligence report, prepare a confirmation

letter or report documenting any modifications for the subproject and submit to ADB;

and receive a ‘no objection’ confirmation from ADB prior to start of construction in the

subproject.

III. POLICY FRAMEWORK, AND ENTITLEMENTS

8. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives, principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR 2013 as well as national and state laws for protection of street vendors. Until recently, all activities related to rehabilitation and resettlement in the State of MP had been based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GoMP adopted LARR 2013 on 3rd October, 2014 with some specifications for operationalizing its implementation in the state2. Details of policies are in the Resettlement Framework for MPUSIP.

IV. SUBPROJECT DESCRIPTION

9. Project area: . Susner geographically lies at 230-56’N Latitude&760-05’E Longitude.It

is situated 32 Km from the District headquarters. The total municipal area is

approximately 11.5Sq.Kms&thetown is 460 m above mean sea level. The Municipal area is being divided in 15 wards for civil administration. The town has 29% residential,4% transportation, 37% public semi-public and 2% commercial land use.Agricultural land is22% and the rest 6% comprises the River Kanthal and nallahs. The present population of city as per last census is 16,432.

A. Existing Water Supply

10. Total installed capacity of the present water supply of Susner is almost 0.50

MLD. Presently town is getting water from the 4 no. Tube wells, 50 hand pumps and 3 no. Open well. There is no water treatment plant & intake well. Water from tube-wells is either pumped into OHT or supplied directly to the residents of Susner after adding bleaching powder.

11. Presently the town has one OHT of capacity 450 KL with staging height 15 m. The OHT situated at Janpath office having capacity450 KL. It was constructed in the year 1995 and is in a good condition. One more OHT of 450 KL in the incomplete structure near Police Ground is in a bad condition. Hence it has been discarded in the proposed project. And a sump well of 60 KL is in use inside the municipality limit.

12. The existing rising main is of 150 mmdia. having length of 3000 m comprising of CI pipe the pipes are not in a good condition. Hence shall be not used in the proposed project. The OHTs are being filled by 4 Tube wells fitted with 10.00 HP - 15.00 HP motor pumps. There is no filtration plant as on date. The existing distribution system comprises of CI and GI pipes having diameters of 100 mm - 250 mm & total length of 25.00 KM. The pipes are not in a good condition and need to be replace.

13. The existing distribution system comprises of GI pipes having diameters of 100 mm-250 mm & total length of existing distribution system is approximately 25.00 Kms. The pipes are being laid in the year 1980 to 2005

14 Presently there are 1325 domestic connection and 50 non domestic connections are in

Susner and only few non domestic connections are in use.

B. Proposed Water Supply

15. The proposed Susner Water Supply Improvement Project aims to bridge the gap in

urban demand, set right the inadequacies in the existing system and provide a safe,

reliable, sustainable and increased access to improved water supply service for the

city’s residents. The primary objective of the proposed

(i) service improvements is to achieve safe and sustainable water services both in

terms of services to residents and cost recovery

(ii) conservation of precious water resources. The project envisages providing 100

percent coverage of population with continuous, pressurized and safe drinking

water services and achieving progressively increasing cost recovery by expanding

the coverage and increasing operating efficiency.

16. The subproject component proposed for Susner water supply will include –

(i) construction of raw water intake facilities,

(ii) construction of water treatment plant,

(iii) construction of treated water booster pumping stations,

(iv) construction of 1 OHT and pumping station,

(v) construction of elevated service reservoirs (ESRs),

(vi) laying of transmission network

(vii) laying of distribution network

V. FIELD WORK AND PUBLIC CONSULTATION

Public Consultation 17. Consultations were undertaken with key stakeholders in line with ADB’s requirements

pertaining to environment and social considerations. Tools used for consultation were stakeholder meetings and focus group discussions (FGD). Consultant has carried out extensive consultations with affected communities, municipalities and stakeholders, including individual face to face interviews and public consultations.

The major stakeholders are:

(a) The municipalities, its elected members and staff who will be required to oversee the construction of the distribution networks and WTP as well as be directly responsible for the maintenance of the installations (b) Local residents who will take initiative to connect their houses with the water distribution line. (c) Local business people and traders

(d) School Students and College Students (e) Community whose livelihood is related to the river e.g., Washer men, boatmen

(f) The opinion makers are intimately acquainted to and well regarded by the community. They need to be enlisted in spreading environmental awareness within the community as well as in conveying the benefits of the project.

18. Field visits were made to all proposed sites and pipeline alignments and the potential impacts and mitigation measures discussed with stakeholders. These consultations helped identify the felt needs/concerns and apprehensions of the communities related to the project and priorities of concerned stakeholders. Discussions were held with people residing at and/or having businesses at/near the proposed subproject locations. Consultations revealed that people are aware of the problems of the existing water supply system in the city and are willing to cooperate in the proposed project. The field visits and interactions helped ascertain that no further survey and inventories are required. The following table 2 provides a summary of consultations and discussions held.

VI. INVOLUNTARY RESETTLEMENT SAFEGUARD PRINCIPLES

Based on the ADB’s SPS, 2009 and LARR Act, 2013, following core safeguard principles

govern the MPUSIP :-

VII. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

A. Water Supply

19. No land acquisition or resettlement impacts are anticipated for any of the proposed civil

works for Susner water supply subproject. WTP is proposed within the same site (having

old WTP ), the old WTP get dismantled as new get constructed or before it. The Susner

WTP/DTW land is now in the government’s possession/ownership. The permission from

Water Resource Department for extraction of water from Keetkhedi dam is under

consideration, but indicated its conditions for granting of NOC. As other sites are coming

in the jurisdiction of MP Govt. land so only transfer is required from Revenue

Department and laying comes under jurisdiction of Susner Municipal Parishad.

20. In Susner town raw water abstraction will be done from Keetkhedi Dam, then treated and

supplied to the town. Construction of Intake well, raw water pump house, the proposed

water treatment plant (WTP) will be undertaken on land belonging to Water Resource

Department (WRD) and Government of Madhya Pradesh. The site for the proposed

WTP will be set up on land adjacent to under constructed OHT,it will be dismantled and

new OHT also constructed along it. The raw water rising mains will be laid underground

from the intake well to WTP site along an existing road belonging to State highway.

21. Total land requirement for the proposed WTP is 1.5 ha; as the land parcel belongs to

GoMP, The ULBs shall apply for No Objection Certificate (NOC) from WRD for raw

water extraction and construction of Intake well at source. The land for WTP has been

in the Revenue Department’s possession for many years and was not acquired in

anticipation of ADB funded MPUSIP, as revealed through discussions with the Revenue

officer of Revenue Department that it belongs to department as Susner nagar parishad

established.

22. New distribution pipelines (33036m) are proposed to be laid along existing State

Highway-14 road ROWs. Proposed pipe diameters range between 90 mm and 400 mm.

Pipe laying activity on roads in the most congested market areas and densely built-up

areas has been carefully planned to avoid IR impacts including temporary economic

impacts to hawkers, shops and businesses.

23. Measures will be taken to minimize excavation, disturbance to pedestrians and traffic and avoid income loss to businesses, while minimizing road reconstruction costs. Temporary impacts to traffic/access to shops and residences due to digging of pits for trenchless pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. Mobile hawkers will be assisted to move to places nearby, to ensure their earnings are not affected. or

24. The weekly market day will be avoided for construction. Only mobile vendors will be shifted to a nearby location during the period of construction and assistance to shift will be provided by the contactor. No income loss is anticipated.

25. House Service connections: Providing house service connection tapping from a distribution main/ sub-main including one tapping saddles, elbows, service pipe from tapping point to the chamber near property boundary or inside the property boundary as per the direction with U-ball valve, using 20mm Medium Density Polyethylene pipes (MDPE) pipe 5 m long. The work shall include excavation, road restoration, etc complete. The connection shall have:- i)Electro Fusion Tapping Ferrule of PN 12.5 PE 80 compatible to the HDPE Mains of

various diameters. The outlets should be reinforced with female threaded metal inserts of SS 304, metal inserted male thread elbow, MDPE PE 80 Blue pipes, 90 deg double compression elbows, UPVC ball valves of required sizes. The outlet size shall be either 15mm, 20 mm depending upon the type of Service Connection. ii)Electro fusion Tapping Ferrule shall be provided with a SS-304 Brass cutter with cutting edges for making hole / tapping on the Mains and Fusion joint in such a manner that the 20-63mm diameter outlet depending on requirement of the house service connections rotatable 3600 to the axis of pipeline. The town is having total number of households 1325.So all the connections are considered in this project. iii)Domestic water meters: Supply and installation of AMR compatible water meters for each house service water connections 1325 nos. 15 mm size, brass body, horizontal inferential multi jet type, magnetic drive with anti-fraud shield and dry dial with IP 68. Meter shall be made of copper or any other suitable anti corrosive metallic

26. Site inspections and transect walk was carried all along the proposed laying of clear

water feeder mains (75.00 m and 1100.00).The proposed pipeline for clear water feeder

mains will be laid along the tow of the existing village road ROW(75m common pipeline )

and 1100.00m along ROW of state highway); the clear water feeder mains to be laid in

Susner will be along the Nagar Parishad roads.The 33036 m distribution network

pipelines in Susner will be laid along the roads of the respective Nagar Parishads.

in Appendix 1.

27. The distribution network will pass through a Mandi in old Susner and weekly vegetable

market area in ward number 7 (every Tuesday) approximately spread over a stretch of

50 m. The Nagar Parishad officials suggested that it can be temporarily shifted to a

vacant place in front of Mandi area, such that no income loss takes place due the civil

work involved for laying of pipelines for distribution or The weekly market day will be

avoided for construction. Only mobile vendors will be shifted to a nearby location during

the period of construction and assistance to shift will be provided by the contactor.

table 2. provides the list of stakeholders and community people consulted.

28. Among linear component, laying of Clear Water Feeder Mains for the water supply

project is proposed to be laid mostly along the existing government (PWD) roads RoW.

The common feeder mains carrying clear water from the WTP to the service reservoirs

of the respective town are :

29. New distribution network improvement pipelines laying & jointing 33036 meter of are

proposed to be laid underground along the existing public roads belonging to Nagar

Parishad road RoWs. Proposed pipe diameters to be laid range between 110 mm to 315

mm depending on the width of the roads that vary between 3 to 15 m. Distribution lines

are proposed on both sides of the Nagar Parishad roads that are of greater width and

within the tarmac where the road width is narrow.

30. Civil works in the project include linear excavation for laying pipes along the roads,

placing pipes in the trench and refilling with the excavated soil. The trenches will be of

0.4 m – 0.7 m wide and 0.8 to 1 m depth. Subsequent to completion of works, road

reinstatement will be undertaken by the contractor as part of the civil works. The roads

in the core city area of towns are slightly narrow and congested with pedestrians and

vehicles, while the roads in outer areas are wide. No necessity for full closure of roads is

identified. Proposed distribution pipe-laying on roads in most part of the town will not

have any permanent or temporary IR impact.

31. Hawkers and vendors have been witnessed along the road side for most part of the

distribution network pipe-laying. Laying of transmission mains and distribution network

pipelines in the project area has been carefully planned to minimize disturbance to

pedestrians and traffic and avoid income loss to businesses.

32. Potential temporary impacts to traffic/access to shops and residences due to digging and excavation for pipe laying are possible during construction; however, these will be mitigated by ensuring access to properties through provision of pedestrian planks, provision of adequate signage, and careful traffic management. Though there are no mobile hawkers along the internal roads where the water works will be implemented, if any such cases are reported, they will be assisted to move to nearby location to ensure that their business remains uninterrupted or In case temporary shifting of vendors with temporary structures is necessary, such shifting will be undertaken on a weekly holiday, to avoid income loss on the day(s) of shifting. The vendors will be assisted to shift and will be able to continue plying their trade during the construction period at the alternative location. No income loss is anticipated.

VIII. CONCLUSIONS

A. Summary and Conclusions

33. No significant IR impacts are assessed at identified sites for sub-project components, as adequate vacant land is available for the proposed facilities, within the compounds of government lands. The site for new WTP & OHT at susner was owned by Revenue and Intake well is constructed on Water Resource Department Land NOC for that is under approval. The sites for two OHT (Police Ground and Janpad ground ) are proposed on government land for construction of Susner water supply facilities; the details of acquisition/transfer if any, of these sites, shall be appended to the updated DDR. For linear components (pipe laying) or those proposed along government road ROWs, temporary disruption to road users, pedestrians and community members will be avoided In the most congested zones of Susner Safety measures and mitigated during construction by the contractor through simple measures such as provision of planks for pedestrian access to shops and traffic management. A budgetary provision is made for costs likely to be incurred for updating of this Project Table:8 Budget for Replenishment
