Meet Aaron Shayne AndersonAaron was scheduled to arrive onJune 8th, but in the first of many surprises,he decided to join us onJune 1, 2009. We had an exciting middle ofthe night drive to the hospital and welcomedour long-awaited son while grinning fromear to ear. Several hours later, a pediatricianinformed us that the hospital nurses suspected Aaron had Downsyndrome. We sat there stunned and in disbelief. As the long twoweeks passed, we found a way to completely deny the obvious.

Finally, on June 15th we had the confirmation. Aaron has Downsyndrome. We were entering a world that we were not familiarwith and did not want to understand. We were lucky, though, since our tour guide of this new land was happy and healthy andglad to be here. Aaron gazed at us in amazement and wonder andfrom day 1 began teaching us lessons in love and faith andhappiness.

Aaron spent his baby year as any other baby would - eating, sleeping, playing and learning. He reached many milestones earlyor on time and, much to our amazement, was rolling over at threemonths! Of our three kiddos, Aaron was by far the most laid backand peaceful baby. We always feel that he knows something aboutlife that we don’t completely understand! Aaron’s only hospitalstay was a week for RSV in January. Once he figured out that thenurses would speak to him in a high-pitched baby voice, he was inheaven. He has been a ladies’ man from the very beginning!

Now Aaron is 16 months old andtrying to keep up with his bigsisters, Allie Mae (5) and AshlynIrene (4). He is pulling up andtrying to get the hang of walking. We can tell he really wants to bepart of the daily action of theAnderson household. Aaron

loves to eat so we have to monitor his intake or he will literally eathimself sick! He receives physical and speech therapy from ECIand, being the great sleeper that he is, often takes an extra-longnap on those days. He’s obsessed with a red shaky egg and a toyhammer, though his favorite activity is Kindermusik with Kat. As agift from dear friends, we began enrolling Aaron in this musicprogram at 6 months, and it has helped his developmentexponentially. He loves the interaction with other kiddos and clapsand sways side to side with the music.

Aaron is definitely developing opinions and coming into his owndistinct personality. He screams “out” (sounds like “at”) when he isready to get up in the morning and loves to make raspberries atpeople. If we are out and about, he will stare someone down untilthey look at him. He will then flash his bright smile and move onto the next person.

These are all just physical accomplishments. Aaron’s real gift hasbeen the immediate transformation of hearts and minds in thegroup of extended friends in our community. Over the last yearand a half, we have answered countless questions and tried toeducate people as much as we can on the positive experience weare having raising our son. We feel blessed to have the chance tolearn from Aaron and to be surrounded by such an amazingsupport group of family and friends. We are looking forward toseeing Aaron grow and achieve all of his potential. Although weare still learning and unsure of where we are going, our littleAaron will most definitely lead the way!

Adult Matters!by Julie Cheatwood - Adult Matters! Director

Adult Matters! is a social program specifically designed for ouradults with DS ages 18 and older. The focus is on providing anenvironment to help them further develop their social skills, buildfriendships among other adults with DS, and offer them safe andappropriate interactions within the community. In order to fosterthat environment, we encourage them to invite an age-appropriatepeer (another adult with special needs) to participate with them.DSA will pay the participation fee for both of them as well as a 1:4chaperone ratio. We realize that our adults depend on family andfriends for transportation to and from these activities, so we willalways try to plan activities that offer a place whereparents/guardians can gather nearby (restaurant, coffee shop, etc.)and visit with each other during the event. 1. How long have you lived in San Antonio?I have lived in San Antonio since 1999 with

my family; however, I lived here when I was a kid beginning in7th grade and graduated from MacArthur High School. I wasmarried at Randolph AFB.

2. Please tell me about your family and where you grew up?I am a military child so I lived in Alabama, Colorado, Alaska andTexas. I lived in West Virginia where I attended graduate schoolbefore moving back here. I am married to Keller Drozdick andhave 2 kids, Hayley (12) and Aidan (9). My parents and sisteralso live in San Antonio.

3. Do you have a child with Down syndrome, or if not, what areyour ties with the Down syndrome community?I do not have a child with Down syndrome. I am good friendswith Bill and Patty Cade and have known Billy Jr. for 6 years. Wehave supported them and the DSASA each year at Buddy Walk.My first clinical experience was working with the adult dayprogram at the San Antonio State School in the early ’90s inwhich several of the adult members were individuals with Downsyndrome. Over the years, I have worked with several individualswith Down syndrome and their families and feel a strong tie tothe DSASA.

4. Please tell me what you and your family like to do?We enjoy hiking, camping and spending time as a family.Reading is a particular shared interest though we also enjoytraveling and try to see as many sites within driving distance aswe can. My son plays soccer and loves video games. My daughterparticipates in choir and is an avid reader. Both our kids areactive in scouting, as well.

5. How do you want to help the Down Syndrome Association ofSan Antonio?I would like to help with the medical outreach program, helpingdoctors obtain the information and training to provide the bestdiagnosis and care to individuals with Down syndrome and theirfamilies. I also enjoy taking the notes at the meetings andkeeping the group organized, at least on paper.

6. What do you think the goal of the Association should be?The main goal should always be the provision of social, educational, and support services to individuals with Downsyndrome and their families. The social programs providedthrough the DSASA are amazing and provide so manyopportunities for families and individuals to participate. I wouldlike to see the adult tutoring program grow and become a vitalpart of the community, as well.

7. What do you see as the future for a Down syndrome child?I think the answer to this question would be different for eachchild. Each child has different interests and skills and possessesunique strengths. As we come to recognize individual’s strengthsinstead of focusing on weaknesses, I think each child will be ableto reach their full potential. Unfortunately, many of the servicesand supports needed to help individuals with Down syndromereach their full potential are not available or are only available toa limited number of individuals. This is changing, and I think theDSASA provides many of the services that are filling this gap.

Looking Ahead ...PLANNING FOR YOUR CHILD’S FUTURE . . .What Every Family of a Child with Special Needs Ought to Know

Every parent worries about providing for their children over thecourse of their lives, and for parents of children with special needs, this feeling can often be even more acute. But because planningdecisions can be difficult, families sometimes put them off, focusinginstead on the many other challenges of daily life.

Establishing an estate plan is an important step in ensuring that yourloved one with special needs is taken care of for as long as they needsupport. This is true whether the child with special needs is still aminor or is now an adult. Planning is especially important when achild is receiving needs-based public assistance, or may require suchbenefits in the future.

Every estate plan should include a will, selection of a guardian forminor children, assignment of financial power of attorney, andadvance health directives. But, for families of a child with specialneeds there are many other things to consider when planning for thefuture, like where the individual will live, what their daily life will belike and who will care for them. Answering these questions requires acomprehensive planning process called special needs planning andwill often include establishing a special needs trust.

What is a Special Needs Trust?Special needs trusts, also known as supplemental needs trusts, can beset up as part of a will, but are more often set up as a living trust forthe benefit of the individual with special needs. They are designed topreserve eligibility for public benefits while enhancing the quality ofthe individual’s life.

The trust may be created separately from a family’s estate for taxpurposes, and is managed by a trustee. Because the trust is usuallyestablished during the parent or primary caregiver’s lifetime, theparents, who most intimately understand the child’s particular needs, are typically the initial trustee. Establishing a special needs trust earlyon can be useful because they:

• Allow the opportunity for other family members, like grandparents,to make contributions to the trust (if it is a living trust).

• Many families do not know that an inheritance of as little as $2,000can disqualify an individual from public benefits unless theinheritance is paid into a trust.

• Establish a pattern of behavior to be used by future trustees, showingthe expenditures that will be most useful to the special needs child.

• Provide your loved one with an advocate and protector of their legalrights.

Why is a Special Needs Trust Important?A special needs trust provides a lifetime of money management for achild with special needs, and ensures access to the services and carethat child may need as he or she moves through various stages of life.Once a child turns 18, his or her income will be used to determineeligibility for public benefits such as Medicaid and SupplementalSecurity Income (SSI), food stamps, and housing assistance.

Receipt of too much income or having too much in resources will leadto the reduction or loss of these important benefits. But, funds paidinto a special needs trust will not be counted as income, allowing theretention of public benefits.

Rules guiding the things for which a special needs trust may be useddo exist. Special needs trusts are meant to supplement the publicbenefits for which the individual with special needs is eligible, that is,to pay for things beyond the basic needs covered by the government. Therefore, if funds from the trust are used regularly to purchase orpay for necessities, such as groceries, housing or utilities, those fundsmay count as income and, as a result, reduce or eliminate benefitsaltogether.

However, funds from the trust can be used to pay for things likeschooling, vacations, summer camp, home companions, electronics, such as computers and televisions, services like massage therapy, andsocial events.

Establishing a Care PlanMany families will also want to establish a care plan. A care plan is setup by a family to make a future guardian or trustee aware of a child’sneeds. A good care plan will explain the educational, social, financialand other needs of the individual with a disability as well as thatindividual’s capacity to attend to those needs on his or her own. Noone knows a child better than his or her own parents and a care planprovides the opportunity to impart that knowledge to a futurecaregiver. A care plan should be updated periodically, and it should bekept with other trust and planning documents. A care plan may comein the form of a Letter of Intent.

Consulting a Qualified ProfessionalWhen deciding whether or not a special needs trust is right for yourchild, it is important to consult an attorney who is well-versed in thecomplex and ever-changing rules that govern this specialized area ofestate planning. It is advisable to select an attorney who dedicates asignificant portion of his or her practice to staying abreast of the stateand federal laws relevant to special needs trusts.

Once you select an attorney and schedule an initial consultation, theattorney will generally ask you to provide some basic information, likefinancial data, details about the family member’s disability, publicbenefits currently being received, or estate plans already in place. Foryour first appointment, you should bring copies of all relevantinformation that will help the attorney advise you as to whether ornot a special needs trust is appropriate.

If you do set up a trust, the attorney will also help you select a trusteeor guardian who understands the details of the administration andtaxation of a special needs trust, which can be complex. The cost of aspecial needs trust varies depending on where you live, the experiencelevel of the attorney, the type of trust and the complexity of the trustdesign.

Estate planning can be overwhelming, but seeking out an expert toadvise you is the first step in a process that will provide for andprotect your child’s future, ensure he or she is taken care of accordingto your wishes, and give you the long-term peace of mind that everyparent seeks.
