Abstract

Recently, the Unitary Patent and the Unitary Patent Court have thrilled the IP community. Expectations are high, however, one begins to fear possible downsides. Even a general trend back to national filings has 

been predicted. Apparently, at the turn of the tides, the German patent system is geared up for competition. The recent patent law amendment has been approved by the German Parliament and is coming into force 

at the 1st of April 2014. Several amendments are clearly directed towards European patent practice. Eventually, it will affect the filing policy of global players as well as medium sized companies in the 

upcoming years.

After the German Bundestag has passed the amendment for the Patent Law (BT publications 17/10308, 17/14221, 17/14222) on 27th of June 2013, the amendment has also passed the German Bundesrat on 5th of July. In this way the amendment has been finalized. The most important changes will become effective by

Additional patents are cancelled.

Additional patents cause no annual fees.  Claimed subject matter must be close to the claimed suject matter of the main patent.

Amendments

The period of time for filing a translation of an English or French application  is extended to 12 months after filing date, but shall not, however, exceed 15 months after priority date.

Exception: if request for search or examination is filed, the  Examination  Division  can ask  for  earlier translation.

In  other  European  Countries,  such  as  Sweden  or Finland,  the  entire  examination  procedure  can  be carried out in English. 

A search  request cannot be  filed by third parties any longer, only the request for examination!

Examination can be requested during the first seven years.

Amendments

The  contents  of  the  search  report  for  patent searches  is  extended  by  a  preliminary assessment of the patentability of  the subject to be  filed.  In  this way  the applicant shall get a better basis  for a decision whether  to  continue the  proceedings.  In  compensation  there  is  an increase  of  the  charges  for  the  search  in  the amount of 50 (total 300) EUR.

In combination with the translation amendment an extremely cost effective first filing is possible including a preliminary opinion without a translation during the priority year.

Request for examination is required during the first seven years only if the application not dropped.

Patent  application  is  deemed  to  be withdrawn,    when  the  translation  is  not filed  on  time.  Priority  can  be  claimed  –regardless  of  the  language  of  the  first filing.

So far:patent application was deemed not to be effected, if translation into German language was not filed within three months after filing date.

Continuing the German patent application is an option as well as any other subseqent filing (PCT, EP, etc…)

In the future the examination bodies always have to execute a hearing, if applied for an examination procedure.

In the future hearings are always public, when an opposition is filed.

The intention is to finish an examination procedure with a hearing and thereby obtain grants and rejection decisions faster.

So far  the examiner had a say justifying the need of a hearing.

Opposition deadline is extended from 3 to 9 months.

Non‐German entities have more time to file an  opposition.

Multiple opinions on transitional patents: 

1. Some patents, whose opposition time has ended, may still be challenged.

2. New time limit for filing an Opposition is yet applicable for all patents, whose decision to grant was published after January 1, 2014.

Amendments

An explicit legal basis is created for an online access to all electronically maintained case files. As a consequence, from autumn 2013 onwards the GPTO plans to offer online services in the area of patents and utility models.

Available for:‐ granted patents and registered utility models, with a publication of the decision of grant or registration after January 21, 2013‐ all patent and utility model applications upon request filed after January 21, 2013

Online file inspection has become possible due to the internal e‐file handling of the GPTO. Online file inspection effectively started on the 7th of January 2014.

Using DPMAregister  the application number needs to be supplied online and a new button “Akteneinsicht” (file inspection) appears.

Requested file not available:

For published patent applications, if the search or the examination has been requested, and for registered designs the file upload can be requested online (approx. timeline: 2 weeks). No notice is given when the upload is completed unless the file inspection was requested in a written form (not email).

Amendments

The amendment simplifies the electronic business between applicant and GPTO. Some property rights (e.g. trademarks) can be filed without the applicant having to sign electronically and having to provide for the necessary devices.

The draft of a “Law for modernization of the Design Patent Law as well as for changing the regulations for the publications for exhibition protection” (BT publications 17/13428, 17/14219, 17/14220) contains two important amendments concerning design law:

1. On the one hand the term “Geschmacksmuster” is changed into registered Design. Therefore in the future the “Geschmacksmustergesetz” will be called “Designgesetz”.

Official invalidity proceedings are introduced. Up to now it is only possible to assert the invalidity of a registered design before court. Soon the design department –which still has to be created ‐ of the GPTO will decide, when invalidity proceedings are filed or when invalidity has to be declared. 

Legal courts will only then be responsible, if the defendant is in an infringement lawsuit and requests a declaration of invalidity in respect of the registered design in question by way of counterclaim.

The new option seems to be more affordable for the client.

The option takes work away from the courts. So far, he registerd design has only been registered and not examined by the GPTO.

IP‐Law AmendmentObligation for Declaration of Inventor before Grant

Amendment

if the exceptional circumstances persist until grant of the patent the applicant was permitted to file the inventor declaration within a time period given by the GPTO. This possibility is cancelled now.

In general, 15 month after filing or priority date of an application the Inventor(s) has/have to be declared to the GPTO,

In exceptional cases it is possible to file the inventor declaration after the 15‐month period.
