FEDERAL REAL ID ACT

What is the Real ID Act?

• Enacted by the U.S. Congress in 2005

• Sets minimum standards for the issuance of driver licenses and identification cards

How does it affect us?

• A Real ID compliant license or ID card will be required to fly within the U.S. or to enter federal buildings.

• We will begin issuing Real ID compliant licenses or ID cards on January 1, 2010.

• Your current Florida driver license or ID can be used until December 1, 2014 if you were born on or after December 1, 1964 or until December 1, 2017 for all others.

Required Documentation

• Proof of identity – birth certificate, U.S. passport, certificate of naturalization

• Proof of social security number• Proof of residential address• Proof of legal presence• Proof of name change

Card Changes

• Full legal name – two lines for name• Residential address instead of

mailing address• 8 year term - unless older than 80, 6

year term; or CDL HazMat, 4 year term

• Real ID designation

Additional Requirements

• Cancel out-of-state license prior to issuance of Florida license

• Cannot hold two credentials at once• Elimination of Valid-in-Florida-Only

licenses• Florida already meets the

requirements for card and data security

EMERGENCY CONTACT INFORMATION SYSTEM

What is ECI?

• Enter up to two names with accompanying addresses and phone numbers at www.flhsmv.gov

• Accessible to law enforcement through DAVID and NCIC/FCIC

• Prohibited from release to anyone other than law enforcement

DRIVER PRIVACY PROTECTION ACT

What is DPPA?

• Federal law and Section 119.0712(2), F.S.

• Prohibits the release of personal information associated with a driver or vehicle record, unless the requestor meets one of 15 exemptions

• Personal information includes driver license number, name, address, phone number, social security number

How does DPPA affect us?

• Agreements for use/access of driver license data

• Re-release of data obtained from the driver or vehicle record

• Record sales• Penalties• Collier Settlement

CITATION REPORTING

Citation Reporting Timelines

• Dispositions must be submitted to the Department via TCATS within 10 days– 95% or higher compliance – 15 of 67

counties– 70% or lower compliance – 10 of 67

counties• Dispositions returned to the county

for correction must be resubmitted to the Department within 10 days of the notification of the error

Citation Reporting Errors

• 14 of 67 counties have a monthly error rate of 2% to 31.74%

• 6 of 67 counties have an error rate of 0.02% or less

• Over 278,000 cumulative unresolved errors

Improvements in Citation Reporting

• Working with 5 clerks (Lee, Duval, Palm Beach, Suwannee, and Taylor) as part of DOT grant to identify causes of errors.

• FACC currently supports 3 versions of the ICD.

• ICD is likely to change again this year due to findings from grant project and to implement legislative changes.

E-Citations

• Expanding the use of e-citations will likely reduce errors

• Accepting e-citation data• 16 vendors are approved to provide

e-citations• 100% of FHP troopers use e-citations• 179 law enforcement agencies use e-

citations in some way

• D6 clearances through FACC’s web site– Piloted by Hernando and Orange

Counties

• DL and MV inquiries• Driver histories

Other News

• Fees may increase this year, including D6 reinstatement fees (proposed to increase to $60) and driver record fees (proposed to increase to $5, $7 or $10)

• Customers may now visit www.flhsmv.gov, Driver License Check to find out if they are eligible to elect driver improvement school in lieu of points
