Type of work/occupations Every operation, process, duty and function carried on or performed in or in connection with or incidental to any of the following industries:

. . . employees engaged in the manufacture of engine packing in the State, excluding the County of Yancowinna, within the jurisdiction of the Engine Packing Manufacturers (State) Industrial Committee.

. . . employees of the classes herein mentioned engaged in or in connection with the manufacture of brake linings, disc pads, clutch facings or other friction materials for automotive or other industrial applications in the State, excluding the County of Yancowinna, within the jurisdiction of the Friction Materials, &c.(State) Industrial Committee.

This award shall apply to the Industries and Callings under the jurisdiction of the Metal and Engineering Industry (New South Wales) Industrial Committee.

Employees engaged in the industries and occupations of engineering, metal working, electrical/electronic, fabricating and vehicle building and to all their branches and all allied industries who were previously covered by one of the following Awards:

1.3.2 This Award applies to all employees designated in subclause 1.3.3, who are employed in a business in which at least 50 per centum of the employees are engaged in mechanical and/or electrical engineering, metal working and/or metal fabricating.

Every operation, process, duty and function carried on or performed in or in connection with or incidental to any of the foregoing industries.

Agricultural implement making and repairing.

Section 1: All persons employed in the industries and callings of aircraft engineers, aircraft mechanics (wood and metal), assemblers (agricultural and coachmakers, rail), assemblers of motor chassis (not including engines or gearing, mudguards or valance), angle-iron smiths, blacksmiths, brass finishers, polishers of any metal working in conjunction with brass finishers, borers, blacksmiths, machinists, bulldozers, bradley hammersmiths, coppersmiths, coppersmiths' machinists, chainsmiths, cycle mechanics (including liners, writers and enamellers, wheel builders, filers and/or cleaners), drillers, die sinkers, drop hammersmiths, engineers, electric welders, fitters, forgers and/or faggoters, forge furnacemen, forging machinists, gauge makers, grinders, hydraulic press machinists, key-way cutters, locksmiths, lift maintainers, lappers, millers (general or universal), markers-off, machinists making nuts, bolts and/or dog spikes, metal badge workers, metal sawyers, motor mechanics, motor cycle mechanics, motorsmiths, oliversmiths, oxy-acetylene operators, patternmakers, punching machinists, planers, power-press machinists, pipefitters, rolling stocksmiths, springmakers, springsmiths, spring fitters, slotters, shapers, shift engineers, scientific instrument makers, shearing machinists, springmakers' machinists, screwing machinists, shipwright-boatbuilders, shipsmiths, safe makers, scale makers and/or adjusters, turret lathe turners,

1.3.3 Except as provided in subclauses 1.3.4 and 1.3.5, this Award is binding on all persons engaged in the industry of the occupations of clerks, typists, stenographer typists, calculating machine operators (including adding machine operators), ledger machine operators, flexowriters or similar type operators, punch card operators, verifiers, telex operators and switchboard attendants, whether as employers or employees and whether members of an association or not.

Section 3: Tinsmiths, canister makers, sheet iron workers, sheet metal workers, tinbox makers and in connection with such industries, oxy-acetylene welders and galvanisers and tinners, and persons employed in association with such galvanisers and tinners; and electroplaters (excepting electroplaters, other than those in outside jobbing shops, engaged in the making or repairing of articles customarily made or repaired by stove, oven and grate makers), bronzers, oxidisers, metal polishers (other than polishers of any metal working in conjunction with brass finishers), spinners and makers and stampers of electroplated ware, and their assistants.

Boilermaking and erection and repairing.

Bridge and girder construction and erection and repairing.

Section 4: All persons employed in or in connection with painting, colouring, varnishing, japanning, lacquering or enamelling in the manufacture of articles of sheet metal (10-gauge and under) or cast metal including those made for use as household utensils, office and travelling requisites, builders' ironmongery, and toys.

Bridge and girder construction and erection, and repairing.

Exemptions 1.0 BHP Steel (AIS) Pty Ltd, as to its employees at Port Kembla is exempt from this award.

2.0 Broken Hill Proprietary Company Limited as to its employees at Newcastle is exempt from this award.

3.0 The Broken Hill Proprietary Company Limited shall apply to its employees covered by the BHP Steel Long Products Division-Welded Products Plant Employee Relations Agreement registered under the New South Wales Industrial Relations Act the terms of that agreement in lieu of the terms of this award.

4.0 BHP Steel (AWI) Pty Ltd: This award shall not apply in respect of employees covered by the BHP Steel (AWI) Pty Ltd Geelong Wiremill Award 1994 (Print L5737 (B0402)) (or any award replacing or succeeding that award).

5.0 BHP Steel (AWI) Pty Ltd as to its employees at Newcastle is exempt from this award.

6.0 BHP Steel (AWI) Pty Ltd: This award shall not apply in respect of employees otherwise covered by the Australian Wire Industries Pty Ltd Sydney Wiremill Award of the Industrial Commission of New South Wales.

7.0 Electrical Trades: Employers in the State of New South Wales as to the employment of persons in connection with wiring contracting and the installation of electric light and power plants are exempt from this award. This exemption shall not apply to employers who are manufacturers or vendors of plant or equipment who install or maintain the said plant and equipment in high and low tension power stations and/or substations for the generation and/or transmission of electric power.

8.0 BHP Steel (JLA) Pty Ltd.

With the exception of matters provided for by clause 3 Area and Incidence, of the BHP Steel Sheet and Coil Products Division, Westernport Tradespersons Award 1994.

9.0 Master Plumbers, South Australia: This award shall not apply to master plumbers in South Australia except insofar as they may employ engineering or electrical tradespersons as such.

10.0 Metal Manufactures Limited: This award shall not apply to employees of Metal Manufactures Limited, New South Wales.

11.0 Oil Companies: This award shall not apply to employers bound by the Engineering (Oil Companies) Award 1980.

12.0 Plumbers: This award as to plumbers shall only apply to respondent employers whose establishments are predominantly metal trades establishments, but excluding plumbers whose normal duties in the classification require them to perform work away from the employer's establishment and plumbers employed by any respondent employer whose plant is principally concerned with the erection, repair, or demolition of buildings.

Excludes the County of Yancowinna; and

1.5.2 This Award shall not apply to any employee or employer who is covered by: (a) Any other award in force; (b) Any industrial agreement which specifically excludes the operation of this Award; and (c) Any other industrial agreement in force in relation only to the matters covered in that industrial agreement. 1.5.3 Other exemptions

Employees classified at levels C5 and higher may agree in writing with the employer not to be bound by the conditions of this Award excepting: Annual leave; Long service leave; Sick leave; Public holidays; Family leave; Superannuation; Grievance & dispute settling procedure; Union encouragement; & Termination change & redundancy.

Provided that the overall terms and conditions of employment agreed to under such arrangements shall not be less favourable than the provisions of this Award as a whole. A true copy of any such agreement shall be supplied to the employee forthwith after signing by all parties.

1.3.4 This Award is not binding on persons who, for the time being, are covered by a registered Enterprise Agreement within the meaning of the Act to the extent of the terms of the Agreement which are inconsistent with the Award.

1.3.5 This Award is not binding on:

1.3.5.1 employers or employees engaged in the automotive industry

1.3.5.2 employers or employees engaged in the maintenance and servicing of motor vehicles

1.3.5.3 employers or employees engaged in generating and distributing electrical energy

1.3.5.4 employers or employees engaged in generating and distributing industrial gases

1.3.5.5 persons who are employed in the South Australian Public Sector (within the meaning of the Government Management and Employment Act 1995)

1.3.5.6 the Broken Hill Associated Smelters Pty. Ltd., Port Pirie or its employees.

(b) This award shall not be binding upon:

(i) Those employers or employees who are for the time being subject to an industrial agreement within the meaning of Schedule 1 Transitional Provisions of the Industrial and Employee Relations Act 1994 or an Enterprise Agreement under the said Act; and/or

(ii) Those employers and employees who are currently bound by the Metal Trades Award (1952) or the Metal Industry Award (1971);

(iii) The Public Service Board in respect of any Public Service employees.

(iv) The Flinders University of South Australia or any employee thereof.

(v) Santos and Delhi International Oil Corporation Incorporated, in respect of the Hours, Overtime and Shift Work clauses

of this award.

(vi) The Broken Hill Associated Smelters Pty Ltd in respect of any of its employees to whom the B.H.A.S. Employees

Award applies.

(vii) The Broken Hill Proprietary Company Limited in respect of any of its employees.

(viii) OneSteel Manufacturing Pty Ltd in respect of any of its employees.

(c) This award shall not be binding upon the District Councils of Cleve, Elliston, Kimba, Le Hunte, Murat Bay and Streaky

Bay in respect of Employees to whom the Eyre Peninsula Local Government Electricity Undertakings (S.A.) Award applies.

Exemptions 13.0 Queensland Sugar Industry: This award shall not apply to any employees in the sugar industry in Queensland, but this exemption shall not include employees of contractors, members of the Metal Trades Industry Association performing work in sugar mills, bulk sugar and molasses terminals, sugar refineries and sugar industry research organisations.

14.0 Rubber Industry: Named respondents, and respondent members of the Australian Chamber of Manufactures (all of whose employees are members of the National Union of Workers ) to the Rubber, Plastic and Cable Making Industry General Award 1996, and who are observing the said award shall not be bound by this award in respect to employees covered by the Rubber, Plastic and Cablemaking Industry General Award 1996.

15.0 Sandvik Australia Pty Limited and Sandvik Hard Materials Pty Limited shall apply to their employees covered by the Sandvik General Agreement registered under the New South Wales Industrial Relations Act the terms of that agreement in lieu of the terms of this award.

16.0 Tubemakers of Australia Limited: This award shall not apply to employees of Tubemakers of Australia Limited at its Kilburn Works, South Australia, except:

those employed in the following trades including apprentices: Blacksmiths, electrical fitters, electrical mechanics, machinists-first and second class, patternmakers, toolmakers, tradesperson engineers, welders special class, first class and second class;

Ironworkers associated with any of the foregoing trades;

Employees in the following classifications: Electroplater-1st, 2nd and 3rd class, Maker-up, Polisher 1st class and Polisher-other.

Clause 4.4 Severance Pay of this award.

17.0 Vehicle Industry: This award shall not apply to employers who are parties to and bound by the award known as the Vehicle Industry Award 1982 or any award subsequently made to replace it insofar as such employers are bound to observe that award towards their employees.

18.0 This award shall not apply to Security Personnel, Cleaners (subject to the next clause hereof) and gardeners.

19.0 This award shall apply to cleaners engaged in cleaning work only where the work is incidental to the performance of other work covered by this award or where the employee is engaged for the greater part of their working time in cleaning in engineering, metal working, fabricating, manufacturing, repairing or any other operation referred to in Schedule A of this award. This award shall not apply to cleaners principally engaged in the cleaning of offices, administrative buildings and canteens, nor in the cleaning of toilets and amenities which are separate and distinct from the production areas of the establishment.
