• Requires remediation plans in basins where septic tanks contribute at least 20 percent of nutrient pollution

• Creates wastewater grant program, requiring 50 percent local match, to finance septic to sewer, septic upgrades and sewage treatment plant upgrades• Requires remediation plans in basins where wastewater plants contribute at least 20

percent of nutrient pollution• Increases fines for spills

• Requires DEP, Water Management Districts to update stormwater rules by 2021

• Requires Department of Agriculture to collect, provide fertilization, nutrient records from each producer enrolled in best management practices• Requires DACS to perform onsite inspections of each agricultural producer that enrolls in

a best management practice every two years

• Requires DEP to adopt rules for biosolids management

SB 712 ShortcomingsAccording to analysis from Florida Springs Council, Florida Waterkeepers, Sierra Club:

• Bill doesn’t fix flaws with Basin Management Action Plans for polluted waterways that lack necessary programs and funding to reduce nutrient pollution within total maximum daily loads

• Required remediation plans for septic tanks, wastewater treatment facilities tied to targets that have not been set

• No remediation plan required for agriculture, the biggest polluter in many watersheds

• Agriculture relies on Best Management Practices not proven to be effective in meeting pollution reduction goals

• Bill falls short of other Blue-Green Algae Task Force recommendations, such as one calling for septic tank inspections

• Because it has Governor’s backing, it’s water quality bill most likely to become law

• Opportunities remain to strengthen before passage• Better bill might not pass in current political environment• Bill’s failure could repeat 2019 experience – another year

lost to address water quality• Bill’s policies, programs could provide foundation for

additional, critical improvements in later years• Choice between some progress or none• We respect decision of allies who have chosen to oppose bill

– a tactical, not philosophical difference

•Addresses another environmental priority for Governor

• Increases required or maximum penalties for wide range of environmental offenses, including

• Sewage spills• Fuel spills• Illegal dumping• Illegal dredge and fill• Surface or drinking water contamination• Damage to a coral reef

•Most changes increase penalty by 50 percent

•Changes duration that penalties may run, so each day that violation occurs or is not remediated constitutes a separate offense, leading to possibly higher fines

•1000 Friends supports bills, though we’d like more funding for communities to upgrade wastewater infrastructure

•Wastewater problems complex; call for carrots, not just sticks

•Raises same home rule issue as 2019 bill pre-empting local bans on plastic straws – passed but vetoed by Governor

HB 1199 Environmental Protection Act• Florida authorizes citizens to assert standing to stop activity that affects

use, enjoyment of air, water, or natural resources

• Legislation, court rulings elsewhere in U.S. create possibility that specific legal rights of nature may exist, allowing a person to assert standing in legal challenge on behalf of natural resources

• Citizens have been pursuing this “Rights of Nature” strategy in several communities throughout Florida

• HB 1199 amends Florida Environmental Protection Act to bar a local government “from recognizing or granting any legal right to a plant, animal, body of water, or any other part of the natural environment”

• 1000 Friends opposes HB 1199 as pre-emption of local decision making on best approach to environmental protection

• Ideally, legislators would repair damage done to citizen standing in legislation, court cases

• Similar pre-emption in Senate part of much broader bill, SB 1382

The bill provides a right of first refusal allowing heirs property cotenants to purchase the property interests of a cotenant seeking partition before the property is divided or sold.

Tenants in common lack a right of survivorship, property passes to the heirs of the deceased, not cotenants. As the number of heirs increase with time, the risk of a fractionalized portion of the property being compromised by a judgment lien or back taxes increases.

This vulnerability makes heirs property acquisition attractive to developers.

• This bill formalizes the way the state and local governments in Monroe County handle taking claims by establishing the Florida Keys Property Rights Protection Act.

• As a result of ROGO, new development permits are capped at 197 per year and all available permits will be exhausted in 2023 when the Keys hits its carrying capacity.

• Additional property rights litigation is anticipated. This bill splits the expense between the state and the local government on a 50-50 basis.

• An amendment to increase evacuation time from 24 hours to 30 hours (thereby increasing the new development permits by 8,000) failed yesterday in the House Judiciary Committee.
