SUMMARY
DPP APPEALS SENTENCE AGAINST CHINESE IVORY TRAFFICKER
A Chinese man, Mr. Zhang Chunsheng was arrested on the 28th January,
2014 at the JKIA after being found in possession without a permit with
products made of Ivory i.e. 3 necklaces, 2 bracelets, 10 pendants and 2
rectangular blocks weighing 0.30 kgs valued at Ksh. 58, 000/=.
He was first arraigned in court on the same day and charged with possession
of a wildlife trophy of an endangered species contrary to section 92 of the
new Wildlife Conservation and Management Act, 2013. He also faced 2
additional counts of dealing and manufacturing items from Ivory.
Due to lack of an interpreter, he did not answer to the charges and remained
in custody until 30th January, 2014. He pleaded guilty on all charges but was
convicted on only one of the three charges. He was sentenced to a fine of
Ksh. One Million in default to serve a term of five years.
On 3rd February, 2014 the Director of Public Prosecutions (DPP) moved to
appeal the sentence given by the lower court and seek an interim stay of the
orders given. The High Court granted interim orders as sought by the DPP
and thus barred the accused from leaving Kenya pending the hearing of the
appeal.
