Equity in IDEA: Changes in WI Criteria for Racial Disproportionality in Special Education

• USDE postponed the compliance date for implementing the significant

disproportionality regulations by two years

• Based on extensive stakeholder input, Wisconsin will use methodology, consistent for

the most part with final regulations, beginning in April 2019:

Methodology: weighted risk ratioRisk ratio threshold: 2.0 Cell size: 10/30 Reasonable progress: Yes (>0.25/yr for two prior consecutive years)Multi-year analysis: Yes (3)

• Wisconsin will see an increase in the total number of local education agencies

identified (~40 to ~50) significant increase in the total number of local education

agencies required to reserve 15% of Part B funds under IDEA for CCEIS (~10 to ~50)

DPI has made a commitment to improving our internal systems, statewide partnerships, and other supports for your local efforts to address equity issues…

… including “joint federal notification” for the Every Student Succeeds Act (ESSA) and Individual with Disabilities in Education Act (IDEA):

1) LEA determinations under IDEA (December 2018 in SAFE)2) school-level identifications, if any, under ESSA (December 2018 in SAFE)3) Racial disproportionality, if any, under IDEA (Spring 2019 in SAFE)

Next Steps for Identified Schools and Districts*

1. After the joint federal notification packet is released in December, consider setting up a 30-minute technical assistance phone consultation with DPI.

2. The joint notification initiates a planning period for your district or school --Use your current (i.e., Educator Effectiveness), or start a new, continuous improvement process, and be sure your process includes the required needs assessment that identifies root causes, a plan that specifically addresses them, stakeholder engagement (ESSA), and a review your resources for any inequities (ESSA).

3. Evidence of planning is due October 2019 in WISEgrants

Leading for Learning Series

DPI, Professional Organizations, and CESAs are aligning efforts to organize a professional learning series, beginning in the ‘19-’20 school year:

• Kick off summit June, 26-28, 2019, at the Concourse Hotel in Madison. Combination of THREE former conferences (Innovations in Equity, Summit for Data-Informed Leadership, and Quality Educator).

• Four additional Leading for Learning events (formerly WOW), simultaneously hosted at each CESA.
