TEACHER & COURSE SUPPORT

TESTING – DynEd’s Placement & Mastery Tests

DynEd provides a comprehensive set of testing materials, including both Placement Tests and Mastery (Achievement) Tests.

Placement and Speaking tests are randomized, computer-adaptive, variable-length tests - If a student is doing well, the tests will automatically move quickly to test items at a higher level. On the other hand, for a student at a lower language level, the test will move more slowly and will end once the appropriate level is ascertained

Placement Test for Kids, appropriate for children between the ages of 5 to 10 or so, places children at the appropriate starting point for DynEd’s Kids courses.

General Placement Test is for older teenage and adult students – from beginning to advanced levels. It provides a quick evaluation of language skills, with an emphasis on listening comprehension and grammar to determine which DynEd courses the students should study.

General Placement Test is now also available on-line, for quick, flexible, convenient testing of students with Internet access wherever they may be in the world. Contact your DynEd distributor or sales representative for additional details.

Speaking Test is an optional extension of the General Placement Test, using Speech Recognition to provide an additional gauge of the oral fluency of intermediate level students who achieve at least 1.0 on DynEd’s General Placement Test. (To ensure adequate hardware, such as microphones, and familiarity with Speech Recognition, students must pass a Practice Test before they can take the test itself.) Each test is automatically recorded in the Records Managers so that the sentences can later be re-evaluated by human raters, if desired, to provide a confirmation of the test results.

* All test correlations should be used with great caution. Different tests examine different skills, and have

different strengths and intended purposes, so test scores are not truly equivalent and should never be considered more than an approximate guide to a person’s overall language level.

DynEd Mastery Tests DynEd has developed a series of Mastery Tests for most DynEd courses which serve as achievement tests. A successful score on the test indicates that the student is prepared to move on successfully to the next lesson or Level of the program. Mastery Test scores, in conjunction with the student’s day-to-day records from the Records Manager, provide the teacher or program administrator with a comprehensive basis on which to provide intelligent grading, should such be desired.

GUIDES – DynEd’s Extension Activities and Teacher & Study Guides Includes suggested lesson-by-lesson Extension Activities built into the Records Manager, comprehensive Teacher's Guides, and student-oriented Study Guides. Extensive Help files are also provided within the courses themselves, with Study Tips for every lesson available in a wide variety of languages.

Extension Activities All core DynEd courses now have specific, lesson-by-lesson Extension Activities, conveniently built into the Records Manager to simplify the planning and teaching of classroom follow-up sessions.

These provide general study tips, detailed suggestions on how best to use the materials, and a variety of photocopiable worksheets (in addition to those provided in the Teacher’s Guides) for written reinforcement of the grammar and vocabulary the students are learning. They can be found under Help/Documentation in all DynEd courses, as well as in the Records Manager.

TEACHER TRAINING

DynEd considers Teacher Training to be of the most important determinants of our customers’ ability to effectively use our Solutions and successfully implement DynEd’s blended learning system. DynEd will train your trainers and assist them in disseminating DynEd training to your customers’ teachers and teacher trainers through DynEd Teacher Training Seminars and the DynEd Teacher Training Course. At the very least, you must designate one Academic Coordinator or Teacher Trainer on staff who has attended and successfully completed a DynEd Teacher Training Seminar. With DynEd’s support, this person will be responsible for training and monitoring effectiveness for all of your customers’ trainers and teachers to ensure the on-going quality and success of the programs.

As it is essential that all teachers and tutors using DynEd receive training, should your Academic Coordinator or Teacher Trainer leave for any reason, you are responsible for making sure his/her replacement immediately attends a DynEd Teacher Training Seminar, or is otherwise certified or approved by DynEd.

QUALITY ASSURANCE VISITS

In order to maintain the highest standards of instruction for those using DynEd’s courseware, as well as to protect the reputation of the DynEd brand, DynEd reserves the right to review your Student’s Records and to visit customer classrooms from time to time to observe instructional techniques and, where appropriate, make recommendations for improved student coaching and blending of classroom and self-study time. DynEd also offers periodic follow-up Teacher Training review sessions whose aim is to ensure that all staff are aware of the most recent developments in DynEd’s courseware, technology, and pedagogy, so that both students and staff may continue to benefit from all such developments.

DYNED RECORDS MANAGER

Its principal role is to give teachers a clear picture of what students are doing when they are using DynEd’s multimedia courses for self-study by tabulating and storing all student study records, including:

dates and times of study

details of all lessons being worked on by date or product

quick indications of how much of each lesson students have completed

scores on all exercises, Placement and Mastery Tests

insight into student study habits through the Intelligent Tutor

DynEd’s Intelligent Tutor is a feature of the Records Manager that analyzes all student records to help teachers identify student-coaching opportunities on how to improve their results

In addition, the Intelligent Tutor helps teachers blend the Records Manager study data into their class and lesson plans to create dynamic personalization and extension activities, leading to a virtuous circle of learning success and satisfaction. The combination results in more effective practice by students both outside and inside class, leading to much faster progress and a quicker return on learning investments.

The Records Manager allows teachers to:

automatically set study paths with DynEd’s Placement and Study Path Managers

lock and unlock access to individual Lessons so as to create customized learning paths for students – even for students studying at home

Distance Learning System DynEd's Internet-based Records Server provides a simple, flexible system for delivering and managing a blended distance learning program, freeing students, teachers, and administrators to work anywhere, anytime without compromising quality.

Students can study on any computer, or on multiple computers, anywhere in the world: at home, in a language lab, and in their offices — even on their laptops on the road.

USB drive, can be taken anywhere and requires no installation.

Students can study on or off line — even in places with no Internet connection — for up to two weeks at a time.

Broadband Internet connections are not necessary,.

No matter where students study, their records are centralized in a single on-line database (the i-RM), which teachers can access from anywhere there’s an Internet connection.

Quality Assurance Perhaps the most important role of the i-RM and DynEd’s Intelligent Tutor from an administrative perspective is to provide a measure of student progress and study techniques at both the individual student level and for classes as a whole. This is principally done through a detailed evaluation of student study habits as evidenced in their extensive records and summarized in a Study Habit score for both students and classes. This in-depth analysis provides administrators early indications of how well teachers are coaching their students and whether further training for either teachers or students is advisable to improve program results.

MARKETING SUPPORT

For partners wishing to use DynEd’s logos, trademarks, or product images in their sales or marketing materials, DynEd can provide copies of our own promotional materials, graphics, etc., on CD/DVD or for download over the Internet. Before producing any such materials, all DynEd Partners should review DynEd’s Guidelines for Using DynEd Trademarks and Copyrights, at the end of this Handbook, which summarizes the proper form and usage of DynEd’s various logos and trademarks.

Any DynEd partner is free to develop their own sales and marketing materials in any form they wish as long as these Guidelines are followed and prior approval of at least the basic templates being used is requested and confirmed by DynEd. This prior approval is essential. Partners may use approved templates in a variety of promotional materials and circumstances consistent with their originally anticipated use without specific additional authorization from DynEd.

All of the above guides may also be downloaded from the DynEd Download Center. Check DynEd’s Technical FAQ online database for answers to technical issues.

Getting Technical Help & DynEd’s Analyzer DynEd’s iRM servers around the world are monitored around the clock by our engineering staff. Should anyone experience trouble with server access, existing students may continue to study offline until the connection can be re-established. You can check the DynEd Support Website for Server status.

For other technical problems, the first thing to do is to update the installation using DynEd’s UptoDate application (always good to do on at least a monthly basis).

Should problems persist after updating, the next thing is to check DynEd’s Technical FAQ, an online database of solutions to common problems and frequently asked technical questions.

If a solution cannot be found in the FAQ, DynEd’s Analyzer application should be run. Items in red will usually indicate an error with the installation, which may suggest a possible solution. For additional help, in the Analyzer’s "File" menu there is an option to “E-mail Technical Log File to DynEd International…” This will send the file, named “DynEd_log.txt” to the DP’s DynEd representative, or DynEd’s engineers at [email protected]. The file includes crucial technical details, system information, error messages, etc., so only a brief description of the technical issue needs to be added.

Updates & Upgrades DynEd’s applications and materials are under constant development. Updates and upgrades are periodically provided, free of charge, to all subscription customers via an automatic on-line system. DynEd’s UptoDate application may also be used at any time to do a manual update to the latest versions of all of our programs. (Updating using UptoDate also helps resolve many technical issues. Updating at least monthly is recommended.)

SUPPORT RESPONSIBILITIES You must provide both academic and technical support to all your clients as an integral part of the customer service DynEd requires of its Partners. Failure to provide adequate academic and technical support as defined below may be considered cause for early termination of the Agreement. (Please see DynEd Distribution Agreement or DynEd Language School License Agreement)

ACADEMIC SUPPORT RESPONSIBILITIES

Each Partner is responsible for maintaining a DynEd-trained and certified staff member or consultant capable of responding to client inquiries regarding DynEd-related implementation or academic questions via telephone, e-mail or VOIP communication, normally within 24 hours, as well as provide the following crucial academic support services for it customers:

Initial teacher training seminars on “How and Why to Use DynEd,” including:

How DynEd’s approach is different from traditional ELL programs,

DynEd’s interface, content, and exercise types,

DynEd’s Placement and Mastery Tests,

DynEd’s Placement and Study Path Manager,

DynEd’s Records Manager and Intelligent Tutor,

Hands-on training in using DynEd courseware and Records Manager, including how to:

set up and edit Classes, including all class defaults

change passwords

add/delete and edit Students

view records in various ways

generate reports

interpret and explain Intelligent Tutor and Study Score data

understand the Study Path Manager and its components

understand how to interpret study data

locate and use documentation in the Records Manager

understand Session Scripts for planning extension activities

Consultation on effective implementation of DynEd’s “blended teaching model,” including:

the role of the classroom

optimizing lab study time

integrating classroom follow-up with the self-study course content

coaching techniques

evaluating RM-generated study data, etc.

Client teachers must be trained on or before DynEd implementation takes place.

TECHNICAL SUPPORT RESPONSIBILITIES

Each Partner is responsible for providing the following technical support services for its customers:

Advise clients on minimum hardware specifications, platforms and configuration options;

Provide installation support for Network or Stand-alone, Diskless or Disc-based, Internet or Local Records installation configurations;

Be available for telephone, e-mail or VOIP response to client tech support inquiries, normally within 24 hours.

Assist clients with DynEd trouble-shooting, including how to update, use the “DynEd Analyzer,” and how to generate and send a “DynEd_ log.txt” file.

Be available to assist DynEd’s back-up technical support team in solving client problems.

Provide clients with its tech support person’s contact information as the first point of contact when support is needed. DynEd is to be contacted by the tech support person, not the customer, in cases where he/she needs assistance, or to arrange a conference call with the customer when a problem cannot be figured out at a site.

GENERAL BUSINESS TERMS AND CONDITIONS This Section summarizes basic terms and conditions for doing business with DynEd not covered in other sections. It contains the specifics involved in the business deal under which this distribution right is granted. Markets Segments The Market Segment is defined as follows:

Children Language Training Center – Language academy offering language training and/or supplemental language tutoring services at English language learning facility operated under the LS’s Easy Learn English brand for trainees sixteen years or less.

Adult Training Center – Language academy offering language training and/or supplemental language tutoring services at English language learning facility operated under the LS’s Easy Learn English brand for trainees seventeen years or older. (Note: The Adult Training Center Market Segment does not include formal language training programs such as a secondary school, post-secondary institution or university might offer to students studying for a certificate or degree).

Post-Secondary - defined as follows: government-accredited certificate-granting or diploma-granting full curriculum two-year or three-year colleges, professional institutes or vocational institutes for students who have completed their secondary education, in which English language is taught and studied as one of several courses in the individual student’s curriculum.

University - defined as follows: government-accredited certificate-granting or diploma-granting full curriculum four-year-or-more learning institutions for students who have completed their secondary education offering certificates or diplomas, in which English is taught and studied as one of several courses in the individual student’s curriculum.

Corporate Training – Language training offered to adults as employees of a company; training may be contracted with or mediated through the trainee’s employer or an organization offering human resource services.

Kindergarten – Schools offering Ministry of Education approved formal education for kindergarten students.

Primary School – Schools offering Ministry of Education approved formal education from grades one through six.

Middle School –Schools offering Ministry of Education approved formal education from grades seven through nine.

High School – Schools offering Ministry of Education approved formal education from grades ten through twelve.

Teacher Training – is defined as language and pedagogical skills training offered to government teacher training centers, kindergarten schools teachers and tutors, primary schools teachers and tutors, middle school teachers and tutors, high school teachers and tutors, or similar persons by pedagogical experts versed in DynEd solutions where DynEd solutions are used to improve those persons’ abilities to teach English to their students.

Language school Size and Configuration, Responsibilities and Opening Procedures Each language school will conform in size and format to the following model:

A = LS Language School Minimum Size = 1000 square meters (gross space); Minimum Number of Computers = 90; B = LS Language School Minimum Size = 800 square meters (gross space); Minimum Number of Computers = 70; C = LS Language School

Minimum Size = 500 square meters(gross space); Minimum Number of Computers = 50;

For each language school LS will be responsible for the language school site and facilities, government permissions and approvals, computers and technology infrastructure, teachers, an academic coordinator or teacher supervisor(s), school management, marketing and recruitment of students, financing, and such additional operating materials and systems as may be required for a successful operation. LS agrees to provide DynEd with the name, contact name, address and basic information on the size and license configuration for each new LS language school no later than three months prior to the scheduled school opening so that DynEd may review the proposed license, ask questions about hardware, staff and facilities, prepare invoices, and subject to prompt payment of all fees in accordance with schedules set out in the Section on Financial Terms, issue the license, installation discs and other necessary materials, and establish an account for the school within DynEd’s management systems.

Student Use License

For purposes of this agreement, a “student” is defined as a person enrolled at an LS school. Each student enrolled shall automatically be granted a “student use license,” defined as a right to study at the LS school where he or she is enrolled using DynEd’s courseware, methodologies and strategies. LS shall owe DynEd a Student Use Royalty for each month of licensed student use ("student-month.") A student’s student use license shall automatically terminate when the student’s course of study at the LS school ends and LS duly removes the student from DynEd's records management system. A student whose course of study at the LS school whom LS as not so removed shall be considered to be a student still studying under a student use license for whom LS shall owe DynEd a Student Use Royalty for each student-month until LS has duly removed the student from DynEd's record management system -- that is, once registered in DynEd’s record management system, a student shall be considered registered until (1) duly deleted from the system (de-registered) or (2) duly de-activated within the system, all in accordance with normal system procedures. Student use licenses shall not be transferable between students or between schools. LS and students shall not otherwise share access to DynEd courseware, methodology or strategies. For the purpose of commercial transactions between DynEd and LS, any calendar month or part thereof in which a student has been enrolled at the school shall count as one calendar month -- e.g. students enrolled on January 1, January 15 or January 31 shall all be deemed to have been licensed for one calendar month and be subject to a Student Use Royalty of one student month.

Glossary of DynEd Terms

PEDAGOGICAL TERMS

Automaticity – An operational ability that is fast, confident, and generally without conscious thought, such as a well-developed skill. Automaticity requires extensive practice to develop procedural memory. It is particularly important for effective listening and speaking in a foreign language.

Auto-Unlock – An option used to set the program to automatically unlock Placement Tests, or a relevant Mastery Test once the student has achieved a predetermined Completion Percentage score in the lessons related to that test.

Blended Learning – A training approach that combines multimedia study with teacher-led classroom follow-up to maximize the best aspects of each. By emphasizing the kinds of practice that are most appropriate and effective in each context, blended learning can substantially reduce costs and learning time, particularly in language training.

Bootstrap – This comes from syntactic/semantic bootstrapping. Involves how learners guess in predictable ways and use what they know to discover underlying structures. Proper sequencing is essential for this to work; this is a particular strength of DynEd’s design.

Completion Percentage – A metric defined by DynEd to help determine student mastery of lesson content. The Completion Percentage, shown in the student records, tracks the number of learning steps a student takes in a lesson, disregarding time. If the target number of steps to reach mastery is 1000 and a student has taken 500, then the DP is 50%. If the student has taken 2000, then the DP is 200%. We generally recommend that students get a minimum DP of 80% for each lesson (except review lessons). A DP of 80% or more means that the student has completed the recommended amount of study for a lesson or group of lessons and should be prepared to pass a Mastery Test for the lessons (achieving a passing score of 85 or more). Teachers may adjust the Completion Percentage calculation by changing the Recommended Study Time.

Comprehensible Input – Refers to optimal input (audio or text) that students can at least partially understand because of visual cues, context, or prior knowledge. Comprehensible Input helps students ‘bootstrap’ the language. We believe that students should understand 50 ~ 80 percent of the language they are listening to for most efficient learning to occur.

Conceptual Syllabus – Building blocks of information, such as frequency, duration, cause-effect, change, shape, size, etc… these concepts are rooted in the organic structures of the brain and shape all languages. The language presented and practiced in DynEd’s courses is organized and sequenced in terms of such concepts, starting with language focused on basic, concrete information, such as frequency, point in time, and negation, then progressing to increasingly more complex, abstract information related to such concepts as causality, the passive, and degrees of certainty.

Declarative Memory – The type of memory related to the recall of events, words, or individual things… doesn’t include skills which are handled by procedural memory.

Extension Activities – Classroom activities in which students practice using newly and previously-acquired language in typical, real-life situations, and contexts beyond those in the courseware. Suggested activities are provided in the Teacher’s Guides for each course, and are now also in a new built-in section of the Records Manager, which includes, for all core DynEd courses, a variety of unit-by-unit classroom lesson plans and telephone scripts, convenient links to photocopiable worksheets, and quick links to unit-specific sections of relevant TGs.

Four Skills Path – The learning sequence that begins with listening, then speaking, then reading, then writing… recognizes that listening and reading involve separate pathways in the brain.

Iconic – An icon is not just a picture or video… it includes things like numbers or shapes or anything that represents an item or set of information. DynEd uses an iconic approach to provide visual support to language input. Whereas a picture often lacks informational focus, an icon can be clearer and more effective.

Intelligent Tutor – A feature of the Records Manager that continuously analyzes the study data of students and evaluates the study patterns based on DynEd’s on-going research in effective practice. Highlights positive elements as well as areas of concern, and makes recommendations to teachers and students about how to study more efficiently.

Learning Path – The order in which we introduce, practice and review the key structures of English; at DynEd this involves a conceptual sequence which goes from basic & concrete to advanced & abstract. A good learning path includes Preview, Comprehension, Focused Practice, Review, and Intermittent Review, helping learners progress toward language mastery and automaticity.

Learning Step – An action taken by a learner that activates or stimulates memory development in the brain; includes new synaptic paths and electrochemical changes over time. Asking/answering questions, pointing to something, putting together a sentence, recording and monitoring one’s voice… are examples of learning steps. A significant advantage of multimedia in the blended learning approach is that students can complete far more learning steps in a typical week compared to a classroom-only approach.

Lock/ Unlock – A feature within the Records Manager that allows a teacher or administrator to manually control student access to any lessons or tests within the program.

Mastery Tests – Achievement tests available in most DynEd courses.

Multi-Modal Approach – A multi-sensory approach involving a rich media mix of visual, conceptual, and auditory activation not possible with a textbook… a major advantage of multimedia for language learning that is strongly supported by research.

Path Manager – Built-in to the Records Manager (2.2+), the Path Manager consists of 2 parts: 1. Placement Manager: Requires students to take the Placement Test and then sets an initial Study

Path for each student. Students must take additional tests to confirm placement. The initial Study Path will include both review lessons and tests.

2. Study Path Manager: Once the students are placed, this monitors student progress and automatically opens up new lessons and courses as students complete lessons and pass appropriate tests.

Path Manager Features:

Uses Placement Test results to set a Study Path for each student.

Uses selected Mastery Tests to adjust the Placement Level.

Teachers may choose which courses to allow for each class.

Teachers may choose to have tests open automatically.

Saves teachers and administrators time, while improving program quality.

Personalization – The process of making dead, generic language live and relevant to the learner. One of the key tasks for teachers is to provide personalization activities in the classroom in which students can “personalize” the language they are learning in the courseware by using it to talk about their own lives, feelings, opinions, etc. Such personalization plays a huge role in student motivation.

Placement Manager – See Path Manager

Procedural Memory – Skill memory (as opposed to declarative memory), particularly involving a sequence, such as the decoding of language strings. Must be done unconsciously. Repetition is generally the key to building this kind of memory.

Recommended Study Time – Found in the class Edit screens in the Records Manager, this feature is a slider that allows the teacher to adjust the calculation of the student’s Completion Percentage value. Moving the slider towards Less makes it easier for the student to reach a high Completion Percentage value. Moving the slider towards More slows the percentage calculation, requiring students to practice more and study longer before reaching their target Completion Percentage, which controls when they can take the Mastery Test for that lesson

Recursive Hierarchical Recognition (RHR) – This term describes a key set of concepts in the theory of language learning that underlies DynEd’s blended approach and the structure of all of DynEd’s core multimedia materials. Developed by DynEd’s founder Lance Knowles, RHR reflects a number of crucial insights from research in neuroscience as to how the brain is designed to learn languages. One central tenet is that the human brain has evolved to search for, recognize and employ language patterns. Moreover, language is a skill and learning is a recursive, cumulative process, not a linear one. DynEd’s materials, then, provide carefully sequenced input with key concepts and patterns repeated at appropriate intervals and at increasing levels of difficulty. Alongside this is a regimen of regular, frequent practice that takes advantage of the brain’s hierarchical memory structure. (For more see RHR).

Repetition – Neuroscience and experience both support the notion that skill learning involves repetition. However, there are different kinds of repetition, such as “shallow” repetition and “deep” repetition. Summarizing, for instance, is a kind of “deep” repetition and is far more valuable than repeating something word for word with no need to consider meaning.

Scope and Sequence – A curriculum outline or syllabus, usually in the form of a chart, listing the learning objectives, structures, skills, key vocabulary, etc., found in each lesson of a course. The Scope & Sequence for all DynEd courses is available on our web site and in our Teacher Guides.

Shuffler – A patented mechanism within DynEd courseware that automatically adjusts the depth and variety of the content according to student performance. As a student answers questions and completes activities, the Shuffler Level, which ranges from 0 to 3, rises or falls depending on the accuracy of the student’s responses. As the level increases, the Shuffler provides the student with new (generally more difficult) variations of the sentences, questions, and story lines in the lesson. Students must study lessons repeatedly and reach a Shuffler Level of 3.0 before they will have seen the full content of the lesson.

Spiral Syllabus – This describes the underlying structure of DynEd’s courseware in which core language, structures, and concepts appear repeatedly in varying contexts and levels throughout each course, helping students build mastery and automaticity.

Study Path Manager – See Path Manager

Study Score – A quantitative indication of the quality of a student’s practice provided by the Intelligent Tutor. Teachers may view it in the Records Manager, and students may view it in their personal Study Records.

Verb Markers – These indicate how a verb is being used, and is a unique feature of DynEd’s approach to language sequencing. A summary of the verb markers is in the Appendices of all DynEd Teacher Guides.

Voice Record – This feature allows learners to record their voice, and then play it back to compare what

they said with the native speaker models.

OTHER TERMINOLOGY

Acrobat®, Acrobat Reader®, Adobe Acrobat® – Software developed by Adobe Systems, Inc., that allows users to access PDF versions of DynEd documents, such as User, Study, Installation, and Teacher Guides. The guides are stored in the DynEd\Doc directory. This is installed automatically when using the DynEd DVD.

CD-Based Installation – An installation during which only core applications, such as the DynEd Engine, QuickTime, and the Speech Recognition engine are installed. No course content is included. Students have to insert the DynEd DVD each time they want to study. Not available for local, non- iRM licenses.

Disadvantages: DVDs can get lost, scratched, or broken.

Client – A computer that is connected to a file server on a network, as opposed to a standalone computer. See also Thin Client.

Diskless Installation – An installation during which all course content is copied from the DynEd DVD onto a local hard drive or a network file server. After a diskless installation the DynEd DVD is no longer needed when students study. The number of simultaneous users is regulated by the Installation Code.

Advantages: No CD or DVD is required to run the course.

Disadvantages: If this is a networked installation, network traffic can be slowed down while the file server attempts to send high bandwidth items (such as audio, video, and graphics) to client computers. This is particularly true for older networks, or where large numbers of students are studying at the same time. Course content, however, may also be installed on each local computer on the network to reduce demand on the network server and to minimize the load on the network bandwidth.

DynEd DVD – This includes installation and DynEd course content files. It is used for the installation of the DynEd Engine and other technologies, such as Speech Recognition, Adobe Acrobat, and QuickTime. It also contains/installs all relevant DynEd documents, such as the DynEd User Guide, Study Guides, and Teacher Guides, and does automatic updates of older installations. The DynEd DVD is updated several times a year and installations should always be done with the most recent version, when possible. If an installation must be done with an older DynEd DVD and access to the Internet is available, the UptoDate application should be run immediately afterward to update the installation to the latest versions.

DynEd Engine – The proprietary software that runs DynEd courseware.

DynEd USB or DynEd Flash/Pen/Stick Drive – A specialized USB drive, pre-configured with all relevant DynEd courses, allowing DynEd to be studied instantaneously on any computer, anywhere, at any time, on- or off-line, without requiring any installation, or an Internet connection. (A first time user must be on-line to confirm their registration in the Records Manager; also the local computer must have QuickTime and Acrobat Reader already installed, which most do – if not, they can be installed from the DynEd USB drive.)

File Server – A computer that holds files centrally on a network. Other computers that connect to it are called clients or workstations. Installing DynEd courses to a file server on a network is generally the most convenient for teachers and students.

i-RM or Internet-based Records Manager – The Internet version of DynEd’s Records Manager as used by all subscription customers. Required for Internet Records.

Internet Records – The system used by DynEd’s i-RM (Internet-based Records Manager) in which all study records and licenses reside on DynEd’s main Records Server, accessed over the Internet (as opposed to Local Records). Internet Records are generally only available as an installation option to subscription customers.

Advantages: Records can be seen from anywhere at any time and are backed up regularly by DynEd.

Disadvantages: Requires an Internet connection.

LAN – A network, or Local Area Network.

Launcher – Also known as launchw.exe or launcher.app (Mac), this is the application starts or runs all DynEd courses. The DynEd Courseware shortcut which is installed automatically on most desktops during standalone installations links to this application which resides in the DynEd directory wherever it has been installed. Clicking on this shortcut launches or starts the DynEd program.

Network Server – A file server on a LAN or network

Networked Installation – An installation to a central file server on a network (as opposed to a Standalone Installation). This is also referred to as a LAN (local area network) installation.

Advantages: Installation is done only once. Study records are stored centrally on the file server so that any student can sit and study at any client computer on the network and have access to their most recent study records. Updating has to be done only once.

PSPM or Per Student Per Month – Used when discussing subscription fees. Other commonly-used pricing terms and their abbreviations include:

QuickTime® – Software developed by Apple Computer, Inc. that allows DynEd courses to include full-motion video and high-quality sound.

Records Manager (RM) – This application manages study records for all DynEd courses and tracks student progress. The Intelligent Tutor within the RM provides detailed information on how effectively the learner studies and uses his/her practice time in each course. The RM is required for unlocking Placement & Mastery Tests, locking and unlocking lessons, and for monitoring detailed study activities for classes and individual students.

Records Server – Refers to the main server located at DynEd headquarters in Burlingame, California, as well as at other Regions around the world set up and managed by DynEd. This server hosts DynEd’s i-RM and all student records for subscription customers. It is backed up several times a day.

Simultaneous Users – This refers to the number of students who may study the courseware on a network at the same time. (It is not relevant to subscription customers who do not have any limits to the number of registered students who may study simultaneously.) The number of simultaneous users allowed is specified in all network licenses, depending on what is purchased. It does not limit the total number of students who may study at different times, just the number who may study simultaneously at any one time. A 25-user network license, for example, would allow 25 students to study at the same time. Additional students could study once one or more of the first 25 had logged off.

Speech Recognition (SR) – Technology within some DynEd courses that can analyze selected sentences that students record, evaluating things such as grammatical accuracy, word order, and fluency. Students speak into a microphone and if what they say is correct and comprehensible, the program confirms and provides positive feedback. If the learner’s input is not comprehensible or includes targeted mistakes, the program prompts the learner to try again. DynEd’s SR engine is installed automatically from the DynEd DVD for all DynEd courses that use SR.

Stand-alone Installation – An installation done onto a single computer. This is usually for computers that are not connected to a network or where the IT (Information Technology) Department does not authorize installations onto their network file server.

Disadvantages: Installation must be done to EACH computer separately. Unless this is an Internet Records installation, students must always sit at the same computer to have access to their study records. Updating has to be done on EACH AND EVERY computer.

Subscription – DynEd’s subscription pricing is an alternative to purchasing DynEd courses. Users pay a fee covering the period they wish to be allowed access to study the courses. Usually this is a monthly fee, but they may also be by quarter, semester, year, or level. In most cases, a single subscription fee provides access to ALL of DynEd’s extensive range of courses, though the fee may vary in some cases for intensive programs or for options such as Home Study. As updates and upgrades become available, all subscribers using DynEd’s on-line system are automatically provided these free of charge.

UpToDate – Also known as UptoDate.exe, this is a small program in the DynEd directory that can be run to update all DynEd applications and courses automatically over the Internet. It is highly recommended that all DynEd users run UptoDate at least once a month.

WAN – A large network, or Wide Area Network, usually comprised of a number of linked LANs.

TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE

2. Ownership and License. This is a license agreement and NOT an agreement for sale. DynEd continues to

own the copy of this Software contained in this package and all other copies that you are authorized by this

Agreement to make (the "Software"). Your Rights to use the Software are specified in this Agreement, and

DynEd retains all rights not expressly granted to you in this Agreement. Nothing in this Agreement

constitutes a waiver of DynEd's rights under U.S. Copyright law or any other federal or state laws or the

Copyright laws or any other applicable laws of other nations.

3. Permitted Uses. You are granted the following rights to the Software:

(a) Right to Install and Use. If you have a license for the standalone computer version, you may install and use

the Software on one and only one compatible computer at a time. If you have a license for a network version,

you may install and use the Software on a single file server for use on a single (local or wide area) network

with the Software working simultaneously on up to the number of workstations indicated on the Software

License Agreement Addendum. You may not, under any circumstance, install and use the Software in any

way that exceeds your license. If you wish to use this Software on more than one standalone computer, one

network, or on a network with the Software working simultaneously on more than the number of workstations

specified in the Software License Agreement Addendum, you must license additional copies of the Software.

(b) Right to Transfer. You may not lend, rent, or lease this Software without the express written consent of

DynEd. However, you may transfer this license to use the Software to another party on a permanent basis by

transferring this copy of the Licensing Agreement, the original Software, and all documentation. Such

transfer of possession terminates your license from DynEd. Such other party shall be licensed under the terms

of this Agreement upon its acceptance of this Agreement by its initial use of the Software. If you transfer the

Software, you must remove from your computer any copy of the Software you may have made and you may

not retain any such copies of the Software for your own use.

4. Prohibited Uses. You may not, without written permission from DynEd:

(a) Use, copy, modify, merge, or transfer copies of the Software and any accompanying documents except as

provided in this Agreement;

(b) Disassemble, decompile or "unlock,” reverse translate or engineer, or in any manner decode the Software for

any reason; or

(c) Sublicense the Software.

5. Privacy Policy. To improve study habits, this Software will monitor student's study behavior and will collect

data on the study records and habits. The Software will not collect any personal and identifiable information.

The data collected will be used solely for the purpose of academic supervision and improving the usage of the

Software and will not be used for direct marketing purposes.

6. Limited Warranty. DynEd makes the following limited warranties, for a period of ninety (90) days from the

date you acquired the Software from DynEd or its authorized dealer:

(a) Media. The optical media or removable devices ("Media") and documentation supplied by DynEd will be free

from defects in materials and workmanship under normal use. If the Media or documentation fail to conform

to this warranty, you may, as your sole and exclusive remedy, obtain a replacement free of charge if you

return the defective Media or documentation to DynEd or its authorized dealer with a dated proof of purchase.

If the Software fails to operate in accordance with this warranty, you may, as your sole and exclusive remedy,

return all of the Software and documentation to the authorized dealer from whom you acquired it, along with a

dated proof of purchase, specifying the problem, and DynEd, at its option, will provide you with either a new

version of the Software or a full refund.

(c) Warranty Disclaimer. DynEd does not warrant that this Software will meet your requirements or that its

operation will be uninterrupted or error-free. DynEd excludes and expressly disclaims all expressed and

implied warranties not stated herein, including the implied warranties of merchantability and fitness for a

particular purpose. (These warranties give you specific legal rights, and you may also have other rights,

which vary from jurisdiction to jurisdiction. Some jurisdictions do not allow the exclusion or limitation of

implied warranties, so the above exclusion or limitation may not apply to you. In that event such warranties

are limited in duration to the warranty period. No warranties apply after that period.)

7. Charges and Taxes. DynEd does not give refunds or credits for any charges or taxes paid.

8. Limitation of Liability. DynEd's liability to you for any losses shall be limited to direct damages and shall not

exceed the amount you originally paid for this Software. In no event will DynEd be liable for any special,

incidental, or indirect damages or for any economic consequential damages (including lost profits or savings),

even if DynEd, or its reseller, has been advised of the possibility of such damages. Some jurisdictions do not

allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion

may not apply to you.

9. Disclaimer of Liability for Hosting in DynEd Servers. DynEd disclaims all liability for any and all damages,

including direct, consequential and incidental damages, arising out of the failure or inability of DynEd to

maintain access to the DynEd servers in accordance with this agreement, including, but not limited, losses or

damages resulting from the loss of your business, loss of data or service as the result of delays or service

interruptions.

10. United States Government Restricted Rights. The enclosed Software and documentation are provided with

Restricted Rights. Use, duplication or disclosures by the U.S. Government or any agency or instrumentality

thereof is subject to restrictions as set forth in subdivision (c)(1)(ii) of the Rights in Technical Data and

Computer Software clause at 48 C.F.R. 252.227-7013, or in subdivision (c)(1) and (2) of the Commercial

Computer Software - Restricted Rights Clause at 48 C.F.R. 52-227-19, as applicable. Contractor

Manufacturer is DynEd International, Inc., 1350 Bayshore Hwy., Suite 850, Burlingame, CA 94010.

11. Export Controls. You agree that you will not directly or indirectly transfer the Software or documentation to

any country where such transfer would be prohibited by the U.S. Export Administration Act and the

regulations issued thereunder.

12. Termination. This license and your right to use this Software automatically terminates if you fail to comply

with any provisions of this Agreement, destroy the copies of the Software in your possession, or voluntarily

return the Software to DynEd. Upon termination you will destroy all copies of the Software and

documentation.

13. Miscellaneous Provisions. This Agreement will be governed by and construed in accordance with the

substantive laws of the state of California. This is the entire agreement between you and DynEd relating to

the contents of this package, and supersedes any prior purchase order, communications, advertising, or

representation concerning the contents of this package. No change or modification of this Agreement will be

valid unless it is in writing and is signed by DynEd. The governing language of this agreement shall be

English.

Marketing Guidelines For Using DynEd Trademarks & Copyrights

These guidelines are for DynEd Authorized Parties (DAP), licensees, authorized training organizations, developers, resellers, agents, language schools, and any others wishing to use DynEd’s trademarks, service marks or images in promotional, instructional, reference, or advertising materials, or on their web sites, products, labels, or packaging. DynEd’s trademarks, service marks, trade name, etc., are valuable assets. By following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities.

By using a DynEd trademark, in whole or in part, you are acknowledging that DynEd is the sole owner of the trademark and promising that 1) you will not interfere with DynEd’s rights in the trademark, including challenging DynEd use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world; and that 2) you will not harm, misuse, or bring into disrepute any DynEd trademark.

The goodwill derived from using any part of a DynEd trademark shall inure exclusively to the benefit of, and belong to, DynEd. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. Misuses and exploitative uses of DynEd’s trademarks, service marks, trade name or images are unlawful and subject to legal actions.

Authorized Use of DynEd Trademarks

1. Advertising, Promotional, and Sales Materials: Only DynEd and its authorized licensees may use the DynEd Trademarks and Logos in advertising, promotional, and sales materials.

2. Compatibility: DynEd authorized parties may use DynEd®, (but not the DynEd Corporate Logo or

other reserved DynEd-owned graphic symbol/logo) in a referential phrase on product/service materials, promotional/advertising materials to describe that the third party product/service has been certified by DynEd for use, provided they comply with the following requirements.

a. The DynEd word mark is not part of the product name.

b. The DynEd word mark is used in a referential phrase such as "powered by," "certified by," "for," or "developed under guidance from."

c. The DynEd word mark appears less prominent than the product name.

d. The product/service is in fact certified by DynEd.

e. The reference to DynEd does not create a sense of endorsement, sponsorship, or false association with DynEd or DynEd products or services.

f. The use does not show DynEd or its products in a false or derogatory light.

3. Publications, Seminars, and Conferences: You may use a DynEd word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:

a. The use is referential and less prominent than the rest of the title. Acceptable: XYZ CONFERENCE features DynEd speakers.

b. The use reflects favorably on both DynEd and DynEd products, services, or technology.

c. Your name and logo appear more prominent than the DynEd word mark on all printed materials related to the publication, seminar, or conference.

d. The DynEd logo or any other DynEd-reserved graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from DynEd.

e. A disclaimer of sponsorship, affiliation, or endorsement by DynEd, similar to the following, is included on the publication and on all related printed materials: "(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by DynEd International, Inc."

f. A trademark attribution notice is included in the credit section giving notice of DynEd’s ownership of its trademark(s) and Copyright(s). Please refer to the section below titled "Proper Trademark Notice and Attribution."

4. Web Sites: DynEd approved web sites that serve only as noncommercial electronic informational forums concerning a DynEd product, service, or technology may use the appropriate DynEd word mark, provided such use complies with the guidelines set forth in Section 3 above.

5. Web Pages: Approved web sites may use the DynEd Web Badge if the site links to the DynEd site for informational use only.

Unauthorized Use of DynEd Trademarks

1. Company, Product, or Service Name: You may not use or register, in whole or in part, DynEd, or any other DynEd trademark, including DynEd-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

2. DynEd Logo and DynEd-owned Graphic Symbols: You may not use the DynEd Logo or any other DynEd-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from DynEd.

3. Variations, Takeoffs or Abbreviations: You may not use other variations of the DynEd logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of a DynEd trademark for any purpose. Example:

Not acceptable: DynEdo DynEdschool

4. Disparaging Manner: You may not use a DynEd trademark or any other DynEd-owned graphic symbol, logo, or icon in a disparaging manner.

5. Endorsement or Sponsorship: You may not use DynEd, or any other DynEd trademark, including DynEd-owned graphic symbols/logos, or icons, in a manner that would imply DynEd's endorsement, sponsorship, or support of a third party product or service except under the guidelines for the Approved Training Organization Program.

6. Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing DynEd, or any other DynEd trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from DynEd.

7. DynEd's Trade Dress: You may not imitate DynEd packaging, web site design, or logos.

8. Slogans and Taglines: You may not use or imitate a DynEd slogan or tagline without written permission.

9. Domain Names: You may not use an identical or virtually identical DynEd trademark as a second level domain name. Example:

Rules for Proper Use of DynEd Trademarks

1. Trademarks are adjectives used to modify nouns, such as the generic name of a product or service.

2. As adjectives, trademarks may not be used in the plural or possessive form. Example:

Correct: I bought two DynEd courses. Incorrect: I bought two DynEds.

3. An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that. Suggested generic terms are provided below.

4. Always spell and capitalize DynEd's trademarks exactly as they are shown below. Do not shorten or abbreviate DynEd product names. Do not make up names that contain DynEd trademarks.

Proper Trademark Notice and Attribution

1. Within the United States Only

a. On product, product documentation, or other product communications, use the appropriate trademark symbol (TM, ®) the first time the DynEd trademark appears in the text of the advertisement, brochure, or other material.

b. See below for the correct trademark symbol, spelling of the trademark, and generic term to use with the trademark. Generally, the symbol appears at the right shoulder of the trademark.

c. Include an attribution of DynEd's ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.

Depictions of DynEd Products

1. Endorsement or Sponsorship: DynEd does not support the use of its logos, company names, product names, or images of DynEd products by other parties in marketing, promotional or advertising materials as their use may create the perception that DynEd endorses or sponsors the product, service or promotion.

2. Compatibility: If you are a Certified Training Organization, you may show an image of a DynEd product in your promotional/advertising materials to indicate that your service is certified by DynEd, provided you comply with the following requirements:

a. Your product or service is in fact certified by DynEd.

b. The image is an actual photograph of the genuine DynEd product and not an artist’s rendering (Note: You must obtain express written permission from DynEd before using any photograph owned or licensed by DynEd).

c. The DynEd product is shown only in the best light, in a manner or context that reflects favorably on the DynEd products/service and on DynEd International, Inc.

Authorized Usage Guidelines for DynEd Logos

If you are a DynEd Authorized Party, you may use the DynEd logos, marks, and images under the following usage guidelines.

1. General Guidelines:

a. The logo must be large enough to allow for easy viewing from a normal viewing distance.

b. The logo must not be larger than the logo of the DAP (if they have one).

c. The logo must not be smaller than 80% of the DAP's logo.

d. Clear space surrounding the logo must be 0.5 multiplied by the height of the logo.

e. The logo must be placed on a solid color background and may not be placed on a patterned background.

f. The logo may not be placed on any background that obscures the logo or does not allow clear viewing of the logo.

g. The logo may not be altered or adjusted in any way that alters the appearance of the logo.

h. The logo may not be incorporated into any design such as starbursts.

i. Any variance to these guidelines must receive prior written approval from DynEd.

2. Marketing Materials, Business Cards, Other Usage

a. The logo may NOT be localized.

b. All relevant logos must be used in advertising and promotional materials.

c. All logos may be used on business cards.

d. Each first instance of a marketing piece must identify the type of DynEd organization.
