DOG TRAINING TERMS AND CONDITIONS

DOG TRAINING SERVICES AGREEMENT

This is a contract by and between the Owner of the dog under the name _______________________________ identified herein as “Client”, and the trainer under Boks K9 – Dog School Philippines herein referred to as “Trainer” for a specific service and would be

enrolling his dog _________________ in a group dog training course.

For good and valuable consideration, the parties agree as follows:

TRAINING FEES. The Client agrees to pay Trainer a non-refundable fee in the amount of Php20,000.00 for a length of eight (8) weeks to be paid upon signing of this Agreement.

Sessions that may be completed within a span of eight (8) weeks from the date of commencement of contract shall depend on the ability of the dog.

Should the Client prefer to have his/her dog trained with Advanced Obedience Skills, as well as

skills related to Agility, Mondio Ring and Fly-Ball Sports or other dog sports, he has the choice to either avail of such program or continue further with the program, on top of the Basic Obedience Skills program, with an additional amount of Php12,000.00 per month plus Value-Added Tax (VAT), with the length of such training to be stipulated by the parties.

SERVICES. Trainer agrees to provide private lessons for Client and Dog on a lesson-by-lesson basis, the goal being to teach Client how to train and work with Dog. These lessons will take place at Trainer’s training facility every day, within the agreed 8-week scheduled timeframe. Trainer will make every reasonable effort to help Client achieve training and behaviour-

modification goals, but, however, makes no guarantee of Dog’s performance or behavior as a result of providing professional animal behavior consultation. The training includes the basic

skills expected of the dog, such as: (1) toilet training, (2) sitting, (3) staying down, (4) staying in one place, (5) coming to the owner when called off leash, (6) walking nicely on leash without pulling, (7) fetching, (8) socializing with people and other dogs, (9) avoiding

destructive chewing of objects, (10) avoiding food aggression and guarding, (11) stopping dog biting, (12) stopping unnecessary dog barking and (13) avoiding separation anxiety. As

mentioned above, the dog, under the choice of the Client, can also prefer to have his/her dog trained with Advanced Obedience Skills, as well as skills related to Agility, Mondio Ring and

Fly-Ball Sports or other dog sports with an additional fee. The program is also inclusive of (1) the training program proper, (2) the dog’s grooming and

hygiene, and (3) the dog’s daily exercise routine. On or before the day the care and custody are passed on by Client to the Trainer, the Client shall provide one (1) month’s supply of food

and vitamins as recommended by the Trainer. Such responsibility of the Client of providing food and vitamins shall be for the whole period until the end of the program. As such, the

Client, upon advice of the Trainer, shall see to it that provisions for food and vitamins shall never run out. However, as to the food of the dog, vitamins and other dog maintenance the Client shall shoulder the same until the end of the program.

Client understands that he/she and the members of the household must follow Trainer’s instructions without modification, work with dog daily as recommended, and constantly

reinforce training being given to Dog after the program.

CANCELLATION POLICY. If Client fails to give at least 24 hours cancellation notice, or is not present at time of scheduled appointment, session fees are still due. For a package deal, the

session will still be counted as one session. LIABILITY ON DAMAGES. If dog causes property damage, or bites or injures any dog,

animal or person (including but not limited to Trainer and Trainer’s agents), during or after the term of this Agreement, then client agrees to pay all resulting losses and damages suffered or

incurred, and to defend and indemnify the trainer and trainer’s agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees.

If dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any

resulting injuries, losses, damages, costs or expenses. At Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in Trainer's sole judgment dog is dangerous or vicious

to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) client breaches any term or condition of this Agreement.

Upon termination in accordance with the foregoing, trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

AGREEMENT ON RELEASE AND HOLD-HARMLESS. That for and in consideration of the

services rendered by the Trainer, the client does hereby waive and release the Trainer and Boks K9 – Dog School Philippines for any loss, damage or injury to any dog, persons, or property that may occur from any cause as a result of taking part in this behavioral training

activity. The Client recognizes that there may be an element of risk in dog behavioral training/handling. The Client understands that as the owner of the dog in training, that he is

responsible and legally liable for my dog's actions for the life of the dog, including the time period after the training.

WAIVER FOR SUCCESS OR NON-SUCCESS OF PROGRAM. The Client understands that the success of the training program is dependent upon numerous factors, including but not

limited to: the amount of time the Client spends working with his/her dog, how thorough the Client is in implementing the training protocol, the previous history and experience of his dog,

how the dog’s environment is managed, and the genetics and structure of his dog. The Client understand that the training his dog receives does not guarantee the dog’s behavior in the future, and that dog behavior is affected by the training that the client implements, the dog’s

previous training history, the dog’s temperament, and the dog’s developmental stages and the dog’s environment.

The parties confirm that, except for that which is specifically written in this Agreement and

those which are agreed upon by the parties, no promises, representations or oral understandings have been made with regard to the Dog or anything else. Without limiting the generality of the foregoing circumstances, the Client acknowledges that the Trainer has not

represented, promised, guaranteed or warranted that the trained dog will never bite, will never be vicious or dangerous in the future, will not exhibit other behavioural problems, or

that the results of the training will last for any particular amount of time.

REFUNDS. The Client understands that there are no refunds for training, due to the amount of time dedicated, the number of paid trainers, and very small and limited space of the program.

HEALTH. The Client authorizes the Trainer to take his dog to the veterinarian for any

emergency and that the Client will pay for all veterinary bills related to my dog or any bills of another dog that his/her dog harms. Dogs participating in such training must have all required

vaccinations or proof of protective titers required for dogs. A copy of proof of vaccinations or titers must be presented before training begins.

With all these given, the Client and Trainer agree to all of the terms and requirements of Training. This contract shall be deemed to have been made in, and shall be construed

pursuant to, the laws of the Philippines. This contract shall be binding on the heirs, administrators, personal representatives, and assigns of the Owner. Both parties understand

that the training does not include food, professional grooming bills, veterinary care, registration fees, or competition fees, and that they have thoroughly read and understand the above waiver.
