International Convention against the Recruitment, Use, Financing and Training of Mercenaries

The States Parties to the present Convention,

Reaffirming the purposes and principles enshrined in the Charter of the United Nations and in the Declaration on the Principles of International Law concerning Friendly Relations and Co-operation among States in accordance with the Charter of the United Nations,

Being aware of the recrultment, use, financing and training of mercenaries for activities WhlCh violate principles of international law such as those of sovereign equality, political independence, territorial integrlty of States ana self-determination of peoples,

Affirming that the recrultment, use, financing and training of mercenaries should be considered as offences of grave concern to all States and that any person committing any of these offences should either be prosecuted or extradited,

Convinced of the necessity to develop and enhance internatlonal co-operation among States for the prevention, prosecution and punishment of such offences,

Expressing concern at new unlawful international activities linking drug traffickers and mercenaries in the perpetration of violent actions which undermine the constitutional order of States,

Also convinced that the adoption of a convention against the recruitment, use, financlng and training of mercenaries would contribute to the eradication of these nefarious activities and thereby to the observance of the purposes and princip1es enshrined in the Charter of the

United Nations,

Cognizant that matters not regulated by such a convention continue to be governed by the rules and principles of international law,

Have agreed as follows:

Article 1

For the purposes of the present Convention,

1. A mercenary is any person who:

(~) Is specially recruited locally or abroad in order to fight in an armed conflict;

(~) Is motivated to take part in the hostilities essentially by the desire for private gain and, in fact, is promised, by or on benalf of a party to the conflict, material compensation substantially in excess of that promised or pa1d to combatants of similar rank and functions in the armed forces of that party;

(£) Is neither a national of a party to the conflict nor a resident of territory controlled by a party to the conflict;

(~) Is not a member of the armed forces of a party to the conflict; and

(~) Has not been sent by a State which is not a party to the conflict on official duty as a member of its armed forces. ~

2. A mercenary is also any person who, in any other situation:

(~) Is specially recruited locally or abroad for the purpose of participating in a concerted act of violence aimed at:

(i) Overthrowing a Government or otherwise undermining the const1tutional order of a State; or

(ii) Undermining the territorial integrity of a Statel

(~) Is motivated to take part therein essentially by the desire tor significant private qa1n and is prompted by the promise or payment of material compensation;

(£) Is neither a natlonal nor a resident of the State against which such an act is directed;

(~) Has not been sent by a State on official duty; and

(~) Is not a member ot the armed forces of the State on whose territory the act is undertaken.

Article 2

Any person who recruits, uses, finances or trains mercenaries, as defined in article 1 of the present Convention, commits an offence for the purposes of the Convention.

Article 3

1. A mercenary, as defined in article 1 of the present Convention, who participates directly in hostilities or in a concerted act of violence, as the case may be, commits an offence for the purposes of tne Convention.

2. Nothing in this article limits the scope of application ot article 4' of the present Conventlon.

Article 4

An offence is committed by any person who:

(~) Attempts to commit one of the offences set forth in the present ConventionJ

(E) Is the accomplice ot a person who commits or attempts to commit any of the offences set forth in the present Convention.

Article 5

1. States Parties shall not recruit, use, finance or train mercenaries and shall prOhibit such activities in accordance with the provisions of the present Convention.

2. States Partles shall not recruit, use, finance or train mercenaries for the purpose of opposlng the legitimate exercise of the inalienable right of peoples to self-determlnation, as recognized by internatlonal law, and shall take, in conformity with international law, the appropriate measures to prevent the recruitment, use, financing or training of mercenaries for that purpose.

3. They shall make the offences set forth in the present Convention punishable by appropriate penalties which take into account the grave nature of those offences.

Article 6

States Parties shall co-operate in the prevention of the offences set forth in the present Convention, particularly by:

(~) Taking all practicable measures to prevent preparations in their respective territories for the commission of those offences within or outside their territories, including the prohibition of illegal activities of persons, groups and organizations that encourage, instigate, organize or engage in the perpetration of such offences;

(E) Co-ordinatlng the taklng of administrative and other measures as appropriate to prevent the commission of those offences.

Article 7

States Parties shall co-operate in taking the necessary measures for the implementation of the present Convention.

Article 8

Any State Party havinq reason to believe that one of the offences set forth in the present Convention has been, is being or will be committed shall, in accordance with its national law, communicate the relevant information, as soon as it comes to its knowledge, directly or through the Secretary-General of the United Nations, to the States Partles affected.

Article 9

1. Each State Party shall take such measures as may be necessary to establish its jurisdiction over any of the offences set forth in the present Convention which are committed:

(~) In its territory or on board a ship or aircraft registered in that State~

(~) By any of its natlonals or, if that State considers it appropriate, by those stateless persons who have their habitual residence in that territory.

2. Each State Party shall likewise take such measures as may be necessary to establish its jurisdiction over the offences set forth in articles 2, 3 and 4 of the present Convention in cases where the alleged offender is present 1n its territory and it does not extradite him to any of the States mentioned in paragraph 1 of this article.

3. The present Convention does not exclude any criminal jurisdiction exerclsed in accordance with national law.

Article 10

1. upon being satisfied that the circumstances so warrant, any State Party in whose territory the alleged offender is present shall, in accordance with its laws, take him into custody or take such other measures to ensure his presence for such time as is necessary to enable any criminal or extradition proceedings to be instituted. The State Party shall immediately make a preliminary inquiry into the facts.

2. When a State Party, pursuant to this article, has taken a person into custody or has taken such other measures referred to in paragraph 1 of this article, it shall notify without delay either directly or through the Secretary-General of the United Nations:

(~) The State Party where the offence was committed;

(~) The State Party against which the offence has been directed or attempted;

(E) The State Party of Wh1Ch the natural or juridical person against whom the offence has been directed or attempted is a national;

(~) The State Party of Wh1Ch the alleged offender is a national or, if he is a stateless person, in whose territory he has his habitual res1dence;

(~) Any other interested State Party which it considers it appropriate to notify.

3. Any person regard1ng whom the measures referred to in paragraph 1 of this article are being taken shall be entitled:

(~) To commun1cate w1thout delay with the nearest appropriate representative of the State of which he is a national or which is otherwise entitled to protect hlS rights or, if he is a stateless person, the State in whose territory he has his habitual residence;

(~) To be visited by a representative of that State.

4. The provisions of paragraph 3 of this article shall be without preJudice to the right of any State Party having a claim to jurisdiction in accordance with art~cle 9, paragraph ~ (~), to invite the International Comm1ttee of the Red Cross to communicate with and visit the alleged offender.

5. The State which makes the preliminary inquiry contemplated in paragraph 1 of this article shall promptly report its findings to the States referred to in paragraph 2 of thlS article and indicate whether it intends to exercise jurisdiction.

Article 11

Any person regarding whom proceedings are being carried out in connection with any of the offences set forth in the present Convention shall be guaranteed at all stages of the proceedings fair treatment and all the rights and guarantees provided for in the law of the State 1n question. Applicable norms of international law should be taken into account.

Article 12

The State Party in whose territory the alleged offender is found shall, if it does not extradite him, be obliged, without exception whatsoever and whether or not the offence was committed in its territory, to submit the case to its competent authorities for the purpose of prosecution, through proceedings in accordance with the laws of that State. Those authorities shall take their decision in the same manner as in the case of any other offence of a grave nature under the law of that state.

Article 13

~

1. States Parties shall afford one another the greatest measure of assistance in connection with crlminal proceedings brought in respect of the offences set forth in the present Convention, including the supply of all evidence at their disposal necessary for the proceedings. The law of the State whose assistance is requested shall apply in all cases.

2. The provisions of paragraph 1 of this article shall not affect obligations concernlng mutual judicial assistance embodied in any other treaty.

Article 14'

The State Party where the alleged offender is prosecuted shall in accordance with its laws communicate the final outcome of the proceedings to the Secretary-General of the United Nations, who shall transmit the information to the other States concerned.

Article 15

1. The offences set forth in articles 2, 3 and 4 of the present Convention shall be deemed to be included as extraditable offences in any extradition treaty eXlsting between States Parties. States Parties undertake to include such offences as extraditable offences in every extradition treaty to be concluded between them.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request for extradition from another State Party with which it has no extradition treaty, it may at its option consider the present Convention as the legal basis for extradition in respect of those offences. Extradition shall be subject to the other conditions provided by the law of the requested State.

3. States Parties which do not make extradition conditional on the existence of a treaty shall recogn1ze those offences as extraditable offences between themselves, subject to the conditions provided by the law of the requested State.

4. The offences shall be treated, for the purpose of extradition between States Parties, as if they had been committed not only in the place in which they occurred but also in the territories of the States required to establish their jurisdiction in accordance with article 9 of the present Convention.

Article 16

The present Convention shall be applied without prejudice to:

(~) The rules relatlng to the international responsibility of States;

(~) The law of armed conflict and international humanitarian law, including the provisions relating to the status of combatant or of prisoner of war.

Article 17

1. Any dispute between two or more States Parties concerning the interpretation or application of the present Convention which is not settled by negotiation shall, at the request of one of them, be submltted to arbitration. If, within six months from the date of the request for arbitration, the parties are unable to agree on the organization of the arbitration, anyone of those parties may refer the dispute to the International Court o~ JustLce by a cequest in conformity Wltn tne Statute of the Court.

2. Each State may, at the tlme of signature or ratification of the present Convention or accession thereto, declare that it does not consider itself bound by paragraph 1 of this article. The other States Parties shall not be bound by paragraph 1 of this article with respect to any State Party which has made such a reservation.

3. Any State Party which has made a reservation in accordance with paragraph 2 of this article may at any time withdraw that reservation by notification to the Secretary-General of the United Nations.

Artlcle 18

1. The present Conventlon shall be open for signature by all States until 31 December 1990 at United Nations Headquarters in New York.

2. The present Convention shall be subject to ratification. The instruments of ratification shall be deposited with the Secretary-General of the United Nations.

3. The present Conventlon shall remain open for accession by any State. The instruments of accession shall be deposited with the Secretary-General of the United Nations.

Article 19

1. The present Conventlon shall enter into force on the thirtieth day followlng the date of deposlt of the twenty-second instrument ot ratification or accession with the Secretary-Genera~ of the United Nations.

2. For eaCh State ratifying or acceding to the Convention after the deposit of the twenty-second instrument of ratification or accession, the Convention shall enter into force on the thirtieth day after deposit by such State of its instrument of ratification or accession.

Article 20

1. Any State Party may denounce the present Convention by written notification to the Secretary-General of the United Nations.

2. Denunciation shall take effect one year after the date on which the notification is received by the Secretary-General of the United Nations.

Article 21

The original of the present Convention, of which the Arabic, Chinese, English, French, Russian and Spanish tex~s are equally authentic, shall be deposited wlth the Secretary-General of the United Nations, whO shall send certified copies thereof to al~ States.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto by their respective Governments, have signed the present Convention.

Convention internationale contre le recrutement, l'utilisation, le financement et l'instruction de mercenaires

Les Etats parties a la presente Convention,

Reaffirmant les buts et principes consacres par la Charte des Nations Unies et par la Declaration relative aux principes du droit international touchant les relations amicales et la cooperation entre les Etats conformement a la Charte des Nations Unies,

Sachant que des mercenaires sont recrutes, utilises, finances et instruits pour des activites qui violent des principes du droit international tels que ceux de l'egalite souveraine, de l'independance politique et de l'inteqrite territoriale des Etats ainsi que de l'autodetermination des peuples,

Affirmant que le recrutement, l'utilisation, le financement et l'instruction de mercenaires doivent etre consideres comme des infractions qui preoccupent vivement tous les Etats et que toute per sonne ayant commis l'une quelconque de ces infractions doit etre traduite en justice ou extradee,

Convaincus de la necessite de developper et de renforcer la cooperation internationale entre les Etats en vue de prevenir, de poursuivre et de reprimer de telles infractions,

Preoccupes par les nouvelles activites internationales illicites liant les trafiquants de drogues et les mercenaires dans la perpetration d'actes de violence qui sapent l'ordre constitutionnel des Etats,

Convaincus egalement que l'adoption d'une convention c~ntre le recrutement, l'utilisation, le financement et l'instruction de mercenaires contribuerait a l'elimination de ces activites reprehensibles et, par consequent, au respect des buts et principes consacres par la Charte des Nations Unies,

Conscients que les questions qui ne sont pas reglees par une telle

convention continuent d'etre regies par les regles et les principes du droit international,

Article premier

Aux fins de la presente Convention,

1. Le terme "mercenaire" s'entend de toute per sonne :

~) Qui est specia1ement recrutee dans Ie pays ou a l'etranger pour combattre dans un conflit armei

b) Qui prend part aux hostilites essentiellement en vue d'obtenir un avantaqe personnel et a laquelle est effectivement promise, par une partie au conflit ou en son nom, une remuneration materielle nettement superieure a celle qui est promise ou payee a des combattants avant un rang et une fonction analoques dans les forces armees de cette partie;

£) Qui n'est ni ressortissante d'une partie au conflit, ni residente du territoire contrale par une partie au confliti

~) Qui n'est pas membre des forces armees d'une partie au conflit; et

~) Qui n'a pas ete envoyee par un Etat autre qU'une partie au conflit en mission officielle en tant que membre des forces armees dudit Etat.

2. Le terme "mercenaire" s'entend egalement, dans toute autre situation, de toute personne :

~l Qui est specialement recrutee dans Ie pays ou a l'etranger pour prendre part a un acte concerte de violence visant a

il Renverser un qouvernement ou, de quelque autre maniere, porter atteinte a l'ordre constitutionnel d'un Etat; ou

ii) Porter atteinte a l'integrite territoriale d'un Etati

£) Qui prend part a un tel acte essentiellement en vue d'obtenir un avantage personnel significatif et est poussee a agir par la promesse ou par Ie paiement d'une remuneration materielle;

£) Qui n'est ni ressortissante ni residente de l'Etat contre lequel un tel acte est diriqe;

~) Qui n'a pas ete envoyee par un Etat en mission officiellei et

e) Qui n'est pas membre des forces armees de l'Etat sur Ie territoire duquel l'acte a eu lieu.

Article 2

Quiconque recrute, utilise, finance ou instruit des mercenaires, au sens de l'article premier de la presente Convention, commet une infraction au sens de la Convention.

Article 3

1. Un mercenaire, au sens de l'article premier de la presente Convention, qui prend une part directe a des hostilites ou a un acte concerte de violence, selon Ie cas, commet une infraction au sens de la Convention.

2. Aucune disposition du present article ne limite le champ d'application de l'article 4 de la presente Convention.

Article 4

Commet une infraction quiconque :

a) Tente de commettre l'une des infractions definies dans la presente Convention;

~) Se rend complice d'une personne qui commet ou tente de commettre l'une des infractions definies dans la presente Convention.

Article 5

1. Les Etats parties s'enqagent a ne pas recruter, utiliser, financer ou instruire de mercenaires et a interdire les activites de cette nature conformement aux dispositions de la presente Convention.

2. Les Etats parties s'engagent a ne pas recruter, utiliser, financer ou instruire de mercenaires en vue de s'opposer a l'exercice legitime du droit inalienable des peuples a l'autodetermination tel qu'il est reconnu par le droit international et a prendre, conformement au droit international, les mesures appropriees pour prevenir Ie recrutement, l'utilisation, Ie financement ou l'instruction de mercenaires a cette fin.

3. Iis repriment les infractions definies dans la presente Convention par des peines appropriees qui prennent en consideration la nature grave de ces infractions.

Article 6

Les Etats parties collaborent a la prevention des infractions definies dans la presente Convention, notamment :

a) En prenant toutes les mesures possibles afin de prevenir la preparation sur leurs territoires respectifs de ces infractions destinees a etre commises a l'interieur ou en dehors de leur territoire, y compris des mesures tendant a interdire les activites iliegaies des individus, groupes ou organisations qui encouragent, fomentent, organisent ou perpetrent de telles infractions;

b) En coordonnant les mesures administratives et autres a prendre pour prevenir la perpetration de ces infractions.

Article 7

Les Etats parties collaborent en prenant les mesures necessaires pour appliquer la presente Convention.

Article 8

Tout Etat partie qui a lieu de croire que l'une des infractions definies dans la presente Convention a ete, est ou sera commise fournit aux Etats parties interesses, directement ou par l'intermediaire du Secreta ire general de l'Organisation des Nations Unies, conformement aux dispositions de sa legislation nationale. tous renseignements pertinents des qu'il en a connaissance.

Article 9

1. Chaque Etat partie prend les mesures necessaires pour etablir sa competence aux fins de connaitre des infractions definies dans la presente Convention qui sont commises :

a) Sur son territoire ou a bord d'un navire ou d'un aeronef immatricule dans ledit Etat;

Q) Par l'un quelconque de ses ressortissants ou, si cet Etat Ie juge approprie, par les apatrides qui ont leur residence habituelle sur son territoire.

2. De meme, chaque Etat partie prend les mesures necessaires pour etablir sa competence aux fins de connaitre des infractions definies aux articles 2, 3 et 4 de la presente Convention dans Ie cas ou leur auteur presume se trouve sur son territoire et ou ledit Etat ne l'extrade pas vers l'un quelconque des Etats mentionnes au paragraphe 1 du present article.

3. La presente Convention n'exclut pas une competence penale exercee en vertu de la legislation nationale.

Article 10

1. S'il estime que les circonstances le justifient, tout Etat partie sur le territoire duquel se trouve l'auteur presume de i'infraction assure, conformement a sa legislation, la detention de cette personne ou prend toutes autres mesures appropriees pour s'assurer de sa personne pendant 1e de1ai necessaire a l'engagement de poursuites penales ou d'une procedure d'extradition. Cet Etat partie procede immediatement a une enquete preliminaire en vue d'etablir les faits.

2. Lorsqu'un Etat partie a, conformement aux dispositions du present article, mis une per sonne en detention ou pris toutes autres mesures prevues au paragraphe 1 du present article, il en avise sans retard directement ou par l'entremise du Secretaire general de l'Organisation des Nations Unies :

~) L'Etat partie ou l'infraction a ete commise;

~) L'Etat partie qui a fait l'objet de l'infraction ou de la tentative d'infraction;

£) L'Etat partie dont la per sonne physique ou morale qui a fait l'objet de l'infraction ou de la tentative d'infraction a la nationalite;

i) L'Etat partie dont l'auteur presume de l'infraction a la nationalite ou, si celui-ci est apatride, l'Etat partie sur le territoire duquel il a sa residence habituelie;

~) Tout autre Etat partie interesse qu'il juge approprie d'aviser.

3. Toute per sonne a l'eqard de iaquelle sont prises les mesures visees au paragraphe 1 du present article est en droit :

~) De communiquer sans retard avec le plus proche representant qualifie de l'Etat dont el1e a 1a nationalite ou qui est autrement habilite a proteger ses droits ou, s'il s'agit d'une personne apatride, de l'Etat sur le territoire duquel elle a sa residence habituelle;

£) De recevoir la visite d'un representant de cet Etat.

4. Les dispositions du paragraphe 3 du present article sont sans prejudice du droit de tout Etat partie ayant etabli sa competence conformement a l'alinea b du paragraphe 1 de l'article 9 d'inviter le Comite international de 1a Croix-Rouge a communiquer avec l'auteur presume de l'infraction et a lui rendre visite.

5. L'Etat qui procede a l'enquete preliminaire Vlsee au paragraphe 1 du present article en communique rapidement les conclusions aux Etats mentionnes au paragraphe 2 du present article et leur indique s'il en tend exercer sa competence.

Article 11

Toute per sonne contre laque1le une action est intentee pour l'une quelconque des infractions definies dans la presente Convention beneficie, a tous les stades de 1a procedure, de la garantie d'un traitement equitable et de tous les droits et garanties prevus par le droit de l'Etat interesse. Les normes applicables du droit international devraient etre prises en compte.

Article 12

L'Etat partie sur le territoire duquel l'auteur presume de l'infraction est decouvert, s'il n'extrade pas ce dernier, est tenu, sans aucune exception, et que l'infraction dont il s'agit ait ete ou non commise sur son territoire, de soumettre l'affaire a ses autorites competentes pour l'exercice de l'action penale, selon une procedure conforme a la legislation de cet Etat. Ces autorites prennen~ leur decision dans les memes conditions que pour toute autre infraction de nature grave conformement a la legislation de cet Etat.

Article 13

1. Les Etats parties s'accordent l'entraide judiciaire la plus large possible dans toute procedure penale relative aux infractions definies dans la presente Convention, y compris en ce qui concerne 1a communication de tous les elements de preuve dont ils disposent et qui sont necessaires aux fins de la procedure. Dans tous les cas, la loi applicable pour l'execution d'une demande d'entraide est celle de l'Etat requis.

2. Les dispositions du paragraphe 1 du present article n'affectent pas les obligations relatives a l'entraide judiciaire stipulees dans tout autre traite.

Article 14

L'Etat partie dans lequel une action penale a ete engagee contre l'auteur presume de l'infraction en communique, conformement a sa legislation, le resultat definitif au Secretaire general de l'Organisation des Nations Unies, qui en informe les autres Etats interesses.

Article 15

1. Les infractions definies aux articles 2, 3 et 4 de la presente Convention sont de plein droit comprises comme cas d'extradition dans tout traite d'extradition conclu entre Etats parties. Les Etats parties s'engagent a comprendre ces infractions comme cas d'extradition dans tout traite d'extradition a conclure entre eux.

2. 5i un Etat partie qui subordonne l'extradition a l'existence d'un traite est saisi d'une demande d'extradition par un autre Etat partie avec lequel il n'est pas lie par un traite d'extradition, il a la latitude de considerer la presente Convention comme constituant la base juridique de l'extradition en ce qui concerne ces infractions. L'extradition est subordonnee aux autres conditions prevues par la legislation de l'Etat requis.

3. Les Etats parties qui ne subordonnent pas l'extradition a l'existence d'un traite reconnaissent ces infractions comme cas d'extradition entre eux dans les conditions prevues par la legislation de l'Etat requis.

4. Entre Etats parties, les infractions sont considerees aux fins d'extradition comme avant ete commises tant au lieu de leur perpetration que sur le territoire des Etats tenus d'etablir leur competence en vertu de l'article 9 de la presente Convention.

Article 16

La presente Convention n'affecte pas:

~) Les regles relatives a la responsabilite internationale des Etats~

~) Le droit des conflits armes et le droit international humanitaire, y compris les dispositions relatives au statut de combattant ou de prisonnier de querre.

Article 17

1. Tout differend entre deux ou plusieurs Etats parties concernant l'interpretation au l'application de la presente Convention qui n'est pas regle par voie de negociation est soumis a l'arbitrage, a la demande de l'un d'entre eux. Si, dans les six mois qui suivent la date de la demande d'arbitrage, les parties ne parviennent pas a se mettre d'accord sur l'organisation de l'arbitraqe, l'une quelconque d'entre elles peut soumettre le differend a la Cour internationale de Justice, en deposant une requete conformement au Statut de la Cour.

2. Tout Etat peut, au moment OU il signe la presente Convention, la ratifie ou y adhere, declarer qu'il ne se considere pas lie par les dispositions du paragraphe 1 du present article. Les autres Etats parties ne sont pas lies par lesdites dispositions envers un Etat partie qui a formule une telle reserve.

3. Tout Etat partie qui a formule une reserve conformement aux dispositions du paragraphe 2 du present article peut a tout moment lever cette reserve par une notification adressee au secretaire general de l'Organisation des Nations Unies.

Article 18

1. La presente Convention sera ouverte a la signature de taus les Etats. jusqu'au 31 decembre 1990, au Siege de l'Organisation des Nations Unies, a New York.

2. La presente Convention sera soumise a ratification. Les instruments de ratification seront deposes aupres du Secretaire general de l'Organisation des Nations Unies.

3. La presente Convention sera ouverte a l'adhesion de tout Etat. Les instruments d'adhesion seront deposes aupres du Secretaire general de l'Organisation des Nations Unies.

Article 19

1. La presente Convention entrera en vigueur Ie trentieme jour qui suivra 1a date de depOt aupres du Secretaire general de l'Organisation des Nations Unies du vingt-deuxieme instrument de ratification ou d'adhesion.

2. Pour chacun des Etats qui ratifieront la Convention ou y adhereront apres Ie depOt du vingt-deuxieme instrument de ratification ou d'adhesion, 1a Convention entrera en vigueur Ie trentieme jour apres Ie depOt par cet Etat de son instrument de ratification ou d'adhesion~

Article 20

1. Tout Etat partie pourra denoncer la presente Convention par voie de notification ecrite adressee au secretaire general de l'Organisation des Nations Unies.

2. La denonciation prendra effet un an apres la date a laquelle la notification aura ete re9ue par 1e Secretaire general de l'Organisation des Nations Unies.

Article 21

L'original de la presente Convention, dont les textes aoglais, arabe, chinois, espagnol, fran9ais et russe font egalement foi, sera depose aupres du Secretaire general de l'Organisation des Nations Uoies, qui en fera tenir copie certifiee conforme a tous les Etats.

EN FOI DE QUOI les soussignes, dGment autorises a cet effet par leurs gouvernements respectifs, ont signe la presente Convention.

Convencion Internacional contra el reclutamiento, la utilizaci6n, la financiacion y el entrenamiento de

mercenarios

Los Estados Partes en la presente Convencion,

Reafirmando los propositos y principios consagrados en la Carta de las Naciones Unidas y en la Declaracion sobre los principios de derecho internacional referentes a las relaciones de amistad y a la cooperaclon entre los Estados de conformidad con la Carta de las Naciones Unidas,

Conscientes de que se utilizan, reclutan, financian y entrenan mercenarios para actividades que quebrantan principios de derecho internacional tales como los de la igualdad soberana, la independencia politica, la integridad territorial de los Estados y la libre determinaci6n de los pueblos,

Afirmando que debe considerarse que el reclutamiento, la~tilizacion, la financiaci6n y el entrenamiento de mercenarios constituyen delitos que preocupan profundamente a todos los Estados y que las personas que cometan cualquiera de esos delitos han de ser sometidas a juicio 0 ser objeto de extradici6n,

Convencidos de la necesidad de aumentar y desarrollar la cooperacion internacional entre los Estados para la prevencion, el enjuiciamiento y el castigo de esos delitos,

Expresando su preocupaci6n por las nuevas a~tividades internacionales ilicitas que vinculan a traficantes de drogas y a mercenarios en la perpetracion de actos de violencia que socavan el orden constitucional de los Estados,

Convencidos tambien de que la aprobacion de una convenClon contra el reclutamiento, la utilizacion, la financiacion y el entrenamiento de mercenarios contribuiria a la erradicacion de estas actividades reprensibles y, con ello, a la observancia de los propositos y principios consagrados en la Carta de las Naciones Unidas,

Conscientes de que las cuestiones no reguladas por una convenci6n de esa indole se seguiran rigiendo por las normas y los principios del derecho internacional,

Han convenido en 10 siguiente:

Articulo 1

A los efectos de la presente Convencion:

1. Se entendera por "mercenario" toda persona:

~) Que haya sido especialmente reclutada, localmente 0 en el extranjero, para combatir en un conflicto armado,

£) Que tome parte en las hostilidades animada esencialmente por el deseo de obtener un provecho personal y a la que se haga efectivamente la promesa, por una Parte en conflicto 0 en nombre de ella, de una retribucion material considerablemente superior a la prometida 0 abonada a los combatientes de grado y funciones simi lares en las fuerzas armadas de esa Parte;

~) Que no sea nacional de una Parte en conflicto ni residente en un territorio controlado por una Parte en conflicto;

£) Que no sea miembro de las fuerzas armadas de una Parte en conflicto~ y

~) Que no haya sido enviada en mision oficial como miembro de sus fuerzas armadas por un Estado que no sea Parte en conflicto.

2. Se entendera tambien por "mercenario" toda persona en cualquier otra situacion:

~) Que haya sido especialmente reclutada, localmente 0 en el extranjero, para participar en un acto concertado de violencia con el proposito de:

i) Derrocar a un gobierno 0 socavar de alguna otra manera el orden constitucional de un Estado, 0 de,

ii) Socavar la integridad territoria~ de un Estado~

£) Que tome parte en ese acto animada esencialmente por el deseo de obtener un provecho personal significativo y la incite a ello la promesa 0 el pago de una retribucion materialJ

~) Que no sea nacional 0 residente del Estado contra el que se perpetre ese actoJ

i) Que no haya sido enviada por un Estado en mision oficial; y

~) Que no sea miembro de las fuerzas armadas del Estado en cuyo territorio se perpetre el acto.

Articulo 2

A los efectos de la presente Convencion, cometera un delito toda persona que reclute, utilice, financie 0 entrene mercenarios, segun la definicion del articulo 1 ce la Convencion.

Articulo 3

1. A los efectos de la presente Convencion, cometera un delito todo mercenario, segun la definicion del articulo 1 de la Convencion, que participe directamente en hostilidades 0 en un acto concertado de violencia, segun sea el caso.

2. Ninguna de las disposiciones del presente articulo limitara el ambito de aplicacion del articulo 4 de la presente Convencion.

Articulo 4

Cometera un delito toda persona que:

a) Intente cometer uno de los delitos previstos en la presente Convencion~

~) Sea complice de la persona que cometa 0 intente cometer los delitos previstos en la presente Convenci6n.

Articulo 5

1. Los Estados Partes no reclutaran, utilizaran, financiaran ni entrenaran mercenarios y prohibiran ese tipo de actividades de conformidad con las disposiciones de la presente Convencion.

2. Los Estados Partes no reclutaran, utilizaran, financiaran ni entrenaran mercenarios con el objeto de oponerse al legitimo ejercicio del derecho inalienable de los pueblos a La libre determinacion reconocido p~r el derecho internacional y tomaran, de conformidad con el derecho internacional, las medidas apropiadas para prevenir el reclutamiento, la utilizacion, la· financiacion 0 el entrenamiento de mercenarios para tal objeto.

3. Los Estados Partes estableceran penas adecuadas para los delitos previstos en la presente Convencion en las que se tenga en cuenta su caracter grave.

Articulo 6

Los Estados Partes cooperaran en la prevencion de los delitos previstos en la presente Convencion, en particular:

a) Adoptando todas las medidas factibles a fin de impedir que se prepare en sus respectivos territorios la comision de tales delitos, tanto dentro como fuera de ellos, incluida 1a prohibicion de las actividades ilegales de personas, grupos u orqanizaciones que alienten, instiquen u organicen la comision de esos delitos 0 participen en ella;

b) Coordinando La adopcion de las medidas administrativas y de otra indol; necesarias para impedir que se cometan esos delitos.

Articulo 7

Los Estados Partes cooperaran en la adopcion de las medidas necesarias para la aplicacion de La presente Convene ion.

Articulo 8

Todo Estado Parte que tenga razones para creer que se ha cometido, se esta cometiendo 0 se vaya a cometer uno de los delitos previstos en la presente Convencion transmitira, de conformidad con su 1egislacion nacional, toda 1a informacion pertinente a los Estados Partes afectados tan pronto como 11egue a su conocimiento, directamente 0 por conducto del Secretario General de las Naciones Unidas.

Articulo 9

1. Cada Estado Parte adoptara las medidas que sean necesarias para establecer su jurisdiccion respecto de cualquiera de los delitos previstos en la presente Convencion que se cometan:

~) En su territorio 0 a bordo de una aeronave 0 un buque matriculado en ese Estado~

~) Por uno de sus naciona1es, 0 por personas apatridas que residan habitualmente en su territorio si, en ese ultimo caso, ese Estado 10 considera apropiado.

2. Cada Estado Parte adoptara asirnismo las medidas que sean necesarias para establecer su jurisdiccion respecto de los de1itos previstos en los articulos 2, 3 y 4 de 1a presente Convene ion en los casos en que el presunto delincuente se encuentre en su territorio y no se proceda a su extradicion a ninguno de los Estados mencionados en el parrafo 1 del presente articulo.

3. La presente Convene ion no exc1uye ninguna jurisdiccion penal ejercida de conformidad con el derecho interno.

Articulo 10

1. Si considera que las circunstancias 10 justifican, cualquier Estado Parte en cuyo territorio se encuentre e1 presunto de1incuente procedera, de c~nformidad con su leaislacion, a detener10 y a tomar otras medidas a fin de asegurar que este presente durante el tiempo que se requiera para iniciar un procedimiento penal 0 de extradicion. EI Estado Parte procedera inmediatamente a una investigacion preliminar de los hechos.

2. Cuando un Estado Parte, en virtud del presente articulo, haya detenido a una persona 0 haya adoptado las demas medidas mencionadas en e1 parrafo 1 del presente articulo, 10 notificara sin,demora, directamente 0 por conducto del Secretario General de las Naciones Unidas:

~) Al Estado Parte en cuyo territorio se haya cometido el delitoJ

~) A1 Estado Parte contra el cual haya sido dirigido 0 intentado el delito;

£) Al Estado Parte del que sea naciona1 1a persona natural 0 juridica contra la cua1 se haya perpetrado 0 intentado perpetrar e1 delito;

~) Al Estado Parte del cual sea nacional el presunto delincuente 0, si este es apatrida, a1 Estado en cuyo territorio tenga su residencia habitual,

~) A todos los demas Estados Partes interesados a los cua1es considere apropiado notificarlo.

3. Toda persona respecto de 1a cual se adopten las medidas mencionadas en el parrafo 1 del presente articulo tendra derecho:

~) A ponerse sin demora en comunicacion con el mas proximo representante competente del Estado del que sea nacional 0 de aquel al que, por otras razones, competa la proteccion de sus detechos, 0, si se trata de una persona apatrida, del Estado en cuyo territorio tenqa su residencia habitual,

£) A ser visitada por un representante de ese Estado.

4. Lo dispuesto en el parrafo 3 del presente articulo se entendera sin perjuicio del derecho de todo Estado Parte que pueda hacer valer su jurisdiccion, con arreqlo al inciso~) del parrafo 1 del articulo 9 a invitar a1 Comite Internacional de la Cruz Roja a ponerse en comunicacion con el presunto delincuente y visitarlo.

5. E1 Estado que proceda a 1a investigacion pre1iminar prevista en el parrafo 1 del presente articulo comunicara sin dilacion sus resultados a los Estados mencionados en el parrafo 2 del presente articulo e indicara si se propone ejercer su jurisdiccion.

Articulo 11

Toda persona que este siendo objeto de un procedimiento en relacion con cualquiera de los delitos previstos en la presente Convencion gozara, durante todas las fases del procedimiento, de la garantia de un trata justa y de todos los derechos y garantias previstos en la legislacion del Estada de que se trate. Deben tenerse en cuenta las normas aplicables del derecho internacional.

Articulo 12

El Estado Parte en cuyo territorio se encuentre a1 presunto delincuente, si no concede la extradicion de este, estara ob1igado, sin excepci6n alquna y con independencia de que el delito haya sido 0 no cometido en su territorio, a someter el caso a las autoridades competentes a efectos del procesamiento segun el procedimiento previsto en la legislaci6n de ese Estado. Esas autoridades tomaran su decision en las mismas condiciones que las aplicables a cualquier otro delito de caracter grave, con arreglo a la legis1acion de ese Estado.

Articulo 13

1. Los Estados Partes se prestaran la mayor ayuda posible en relacion can los procedimientos penales que se entablen respecto de los delitos previstos en la presente Convene ion, incluido el suministro de todas las pruebas necesarias para el procedimiento que obren en su poder. En todos los casos se aplicara la legislacion del Estado al que se solicite ayuda.

2. Las disposiciones del parrafo 1 del presente articulo no afectaran las obligaciones de ayuda judicial mutua estipuladas en cualquier otro tratado.

Articulo 14

E1 Estado Parte en que se haya enjuiciado a1 presunto de1incuente comunicara, de conformidad con su 1egislacion, e1 resu1tado final de ese procedimiento al Secretario General de las Naciones Unidas, quien transmitira 1a informacion a los demas Estados interesados.

Articulo 15

1. Los delitos previstos en los articulos 2, 3 Y 4 de la presente Convencion se consideraran incluidos entre los que dan lugar a extradicion en cualquier tratado de extradicion celebrado entre Estados Partes. Los Estados Partes se comprometen a incluir tales delitos como casos de extradicion en cualquier tratado de extradicion que celebren entre si en el futuro.

2. 5i un Estado Parte que subordine la extradicion a la existencia de un tratado recibe una solicitud de extradicion de otro Estado Parte con el que no ha celebrado un tratado de extradicion, podra discreciona1mente considerar 1a presente Convencion como 1a base juridica para 1a extradicion con respecto a dichos delitos. La extradicion estara sujeta a las demas condiciones previstas en la legis1acion del Estado a1 que se haya hecho la solicitud.

3. Los Estados Partes que no subordinen la extradicion a la existencia de un tratado reconoceran esos delitos como casos de extradicion entre ellos, con sujecion a las condiciones previstas en la legislacion del Estado al que se haya hecho 1a solicitud.

4. A los efectos de la extradicion entre Estados Partes, se considerara que los delitos han sido cometidos nO solamente en el lugar donde ocurrieron sino tambien en los territorios de los Estados obligados a establecer su jurisdiccion con arreglo al articulo 9 de la presente Convencion.

Articulo 16

Se aplicara la presente Convencion sin perjuicio de:

£) El derecho de los conflictos armados y el derecho humanitario internacional, incluidas las disposiciones relativas al estatuto de combatiente o de prisionero de guerra.

Articulo 17

1. Las controversias que surjan entre dos 0 mas Estados Partes con respecto a la interpretacion 0 aplicacion de la presente Convencion, y que no sean solucionadas mediante neqociaciones, seran sometidas a arbitraje a peticion de uno de ellos. 8i en el plazo de seis meses contados a partir de la fecha de presentacion de la solicitud de arbitraje las partes no consiguen ponerse de acuerdo sobre la organizacion del arbitraje, cualquiera de elIas podra someter la controversia a la Corte Internacional de Justicia mediante una solicitud presentada de conformidad con el Estatuto de la Corte.

2. Cualquier Estado podra, en el momenta de la firma 0 ratificacion de la presente Convencion 0 de su adhesion a ella, declarar que no se considera obligado por el parrafo 1 del presente articulo. Los demas Estados Partes no estaran obligados por 10 dispuesto en el parrafo 1 de este articulo respecto de ningun Estado Parte que haya formulado esa reserva.

3. El Estado Parte que haya formulado la reserva prevista en el parrafo 2 del presente articulo podra retirarla en cualquier momento mediante una notificacion al Secretario General de las Naciones Unidas.

Articulo 18

1. La presente Convene ion esta abierta a la firma de todos los Estados hasta el 31 de dieiembre de 1990 en la Sede de las Naciones Unidas en Nueva York.

2. La presente Convencion esta sujeta a ratificacion. Los instrumentos de ratificaeion seran depositados en poder del Secretario General de las Naciones Unidas.

3. La presente Convene ion esta abierta a la adhesion de cualquier Estado. Los instrumentos ne adhesion seran deposi~ados en poder del Secre~ario General de las Naciones Unidas.

Articulo 19

1. La presente Convencion entrara en vigor el trigesimo dia a partir de la fecha de deposito del vigesimo segundo instrumento de ratificacion 0 adhesion en poder del Secretario General de las Naciones Unidas.

2. Para cad a uno de los Estados que ratifiquen la Convencion 0 se adhieran a ella despues del deposito del vigesimo segundo instrumento de ratificacion 0

adhesion, 1a Convencion entrara en vigor el trigesimo dia a partir de la fecha en que dicho Estado haya depositado su instrumento de ratificacion a adhesion.

Articulo 20

1. Todo Estado Parte podra denunciar la presente Convencion mediante notificacion por escrito diriqida al Secretario General de las Naciones Unidas.

2. La denuncia surtira efecto un afto despues de la fecha en que el Secretario General de las Naciones Unidas reciba la notificacion.

Articulo 21

El original de la presente Convencion, cuyos textos en arabe, chino, espaftol, frances, ingles y ruso son igualmente autenticos, sera depositado en poder del Secretario General de las Naciones Unidas, quien enviara copias certificadas de el a todos los Estados.

EN TESTIMONIO DE LO CUAL, los infrascritos, debidamente autorizados por sus respectivos gobiernos, han firmado la presente Convencion.
