DRAFT ENVIRONMENTAL IMPACT REPORT

The Draft Environmental Impact Report (Draft EIR) was published today. A number of scheduling and other procedural matters are now ripe for ruling.

Availability of DEIRThe Draft EIR is available on the Commission’s web page:

http://cpuc-pgehydro.support.net/. A paper copy of the Draft EIR is also available at 30 repositories that include libraries and local planning departments. These repositories are identified in Attachment 2. Although neither CEQA nor the Commission’s rules require that the Draft EIR be served on individuals, the Energy Division has served the Draft EIR on all appearances and people on the state-service portion of the service list. It has provided a notice to people on the information-only portion of the list.

To assist readers of the Draft EIR, a detailed Table of Contents is provided. It gives the reader the complete layout of the Draft EIR and should help the reader focus their review on, for example, topical

interests, like fisheries, or geographic areas of interest, like the DeSabla Bundle or the Hat Creek 2 facility. For parties’ convenience, a copy of the Draft EIR Table of Contents is included as Attachment 3 to this ruling.Draft EIR Volumes as Reference Items

The Draft EIR is voluminous and will likely be referenced in future pleadings. For clarity, I am marking the Draft EIR volumes as reference items, tables and figures inclusive. When referring to the Draft EIR in future pleadings, parties are directed to use the reference letters noted below.

Written Comment on the Draft EIR

Given the interest in the potential environmental consequences of Pacific Gas and Electric Company’s proposed auction demonstrated in the scoping phase of the environmental review, I expect considerable attention will be given to the Draft EIR. The Commission will benefit from this public review and comment. Written comments are due on February 5, 2000. I call parties’ attention to the Draft EIR discussion of the market power implications of the proposed auction and alternative ownership scenarios. Pursuant to the October 16, 2000 ruling I issued with President Lynch, parties are presently reviewing and perhaps revising their testimony on market power.

ScheduleA number of future events in this proceeding are scheduled to

occur relative to the date of the publication of the Draft EIR. I have attached a revised schedule for the proceeding that sets dates for the events and activities that should occur before the prehearing conference I previously noticed for January 25, 2001. At or after that

prehearing conference, events and activities that should follow it will be announced.

In summary, the revisions extend the due dates for various filings to avoid conflicts with weekends and state holidays. The briefing schedule will be reset in light of the fact that additional testimony is scheduled to be served. I will announce the new deadlines for the filing of briefs at or after the January 25 prehearing conference. The dates for Public Participation Hearings are also now set, as detailed below, and summarized in the revised schedule.

Public Participation HearingsWith the publication of the Draft EIR, it is time to conduct public

participation hearings. Pacific Gas and Electric Company shall notify its customers of the opportunity to comment at public meetings by including the attached notice of hearings in customers’ bills over the next billing cycle. Pacific Gas and Electric Company shall ensure that all customers have received the notice not later than January 22, 2001.Motions to Intervene

I have two outstanding Motions to Intervene that drew no protests. The California Retailers Association (Retailers) is a trade organization whose membership is made up of California department and specialty stores, mass merchandisers, grocery, and chain drug and convenience stores. Retailers claim that its members have more than 9,000 stores, employ more than 2 million Californians and account for more than $100 billion in annual sales.

Retailers states that it seeks to intervene in the proceeding so that it can participate in settlement negotiations and formally

comment on any settlement proposal, and will thereby not broaden the proceeding.

Upper Mokelumne River Watershed Authority (Authority) also moved to intervene. The Authority states that it consists of six voting members: Alpine County Water Agency, Amador Water Agency, Calaveras County Water District, Calaveras Public Utility District, East Bay Municipal Utility District, and Jackson Valley Irrigation District. It has three non-voting associate members: Alpine County, Amador County, and Calaveras County. The Authority’s purpose is to acquire, operate, and maintain the Pacific Gas and Electric Company hydroelectric generating facility, FERC license 0137. The Authority asserts that its interest is unique and distinct from that of its individual members, some of whom have been active participants in this proceeding since its inception. It states that it will not unduly broaden the scope of the proceeding.

NOTICE OF PUBLIC HEARINGS/MEETINGSThe California Public Utilities Commission (CPUC) wants to hear

from you.

The CPUC will be holding a series of Public Participation Hearings and information meetings on the Draft Environmental Impact Report (DEIR) on the proposal by Pacific Gas and Electric Company (PG&E Co) to sell its hydroelectric generating plants and associated real estate.

The Commission values your opinions and wants to hear your opinions on:

What are your views on the proposal of PG&E Co to sell its hydroelectric system?

Do you have any alternative proposals for the valuation of PG&E Co’s hydroelectric system?

Which of the options proposed in the DEIR do you prefer?

Is the DEIR complete and accurate, or does it need to be modified?

On September 30, 1999, PG&E Co filed an application with the CPUC for approval of a plan to sell off its hydroelectric generation and related assets through an auction (Application 99-09-053). California’s electric industry restructuring law, Assembly Bill 1890, requires the CPUC to determine the market value of all of PG&E Co’s non-nuclear generating assets by the end of 2001. A sale, appraisal,

or other divestiture are authorized means of determining market value. PG&E Co proposes to use an auction process to value and transfer ownership of its hydroelectric generating facilities and related assets. Under its proposal, hydroelectric facilities will be sold in bundles, groups of five to 20 powerhouses and related facilities.

PG&E Co’s hydroelectric assets include 110 electricity generating units located at 68 power houses, 99 reservoirs, 174 dams, 76 diversions, 184 miles of canals, 135 miles of tunnels, 44 miles of flumes or aqueducts, 19 miles of pipes, five miles of natural waterways, and its interest in approximately 140,000 acres of land. Altogether, these facilities can store approximately 2.3 million acre-feet of water and generate almost 3,900 megawatts of electricity.

The CPUC is the agency that ensures investor-owned utilities operate in compliance with state regulations. In compliance with the California Environmental Quality Act (CEQA), the CPUC prepared a draft environmental evaluation of PG&E Co’s auction proposal. The environmental review identifies potential environmental impacts of the proposed auction and alternatives and identifies ways to reduce or eliminate potential environmental impacts. The review also evaluates potential environmental impacts of each of the alternatives chosen for study. The CPUC's initial analyses and conclusions are contained in the DEIR.
