The Transport and Logistics Industry Skills Council (TLISC) covers a broad range of industry sectors including: Aviation

This submission puts forward the Case for Endorsement for the AVI Aviation Training Package Release 3.0, relating to: seventeen (17) qualifications

o grounds operations: ten (10)

o flight operations: seven (7)

one hundred and forty (140) units of competency and associated assessment requirements

o aviation safety: twenty-seven (27)

o grounds operations: seventy-seven (77)

o flight operations: thirty-six (36)

forty-one (41) Skill Sets

o grounds operations: twenty (20)

o flight operations: twenty-one (21).

The AVI Aviation Training Package Release 3.0 submission is presented in three parts and covers three sectors.

Part A: Aviation Safety

Part A includes twenty-seven (21) units of competency related to aviation safety. Three (3) units of competency and two (2) Skill Sets were previously released in AVI Aviation Training Package Release 1.0.

Part B: Ground Operations

Part B includes seventy-seven (77) units of competency, ten (10) qualifications and twenty (20) Skill Sets related to aviation ground operations. Nine (9) units of competency and one (1) qualification were previously released in AVI Aviation Training Package Release 1.0.

Part C: Flight Operations

Part C includes thirty-six (42) units of competency, seven (7) qualifications and twenty-one (21) Skill Sets related to aviation flight operations. Sixty-four (64) units of competency, three (3) qualifications and one (1) Skill Set were previously released in AVI Aviation Training Package Release 2.0.

The AVI Aviation Training Package Release 3.0 draft components have been structured to align with the Standards for Training Packages, which were endorsed by the Standing Council for Tertiary Education, Skills and Employment on 16 November 2012.

‘The purpose of the Standards for Training Packages is to ensure Training Packages are of high quality and meet the workforce development needs of industry, enterprises and individuals. The Standards for Training Packages apply to the design and development of Training Packages for endorsement consideration by the new endorsing body.’ (National Skills Standards Council)

Stakeholder agreement has been obtained for all the draft components of the AVI Aviation Training Package Release 3.0 being submitted for endorsement. There are no outstanding issues related to any of these draft components.

The units of competency and associated assessment requirements, qualifications and Skill Sets meet the requirements of the Standards for Training Packages. This has been confirmed by the independent Quality Assurance Report (Appendix B).

The Companion Volume Implementation Guide (CVIG) Release 3.0 will be available on the TLISC website: http://tlisc.org.au/training-packages/. The CVIG has been quality assured through the TLISC quality assurance process.

Draft components to be considered for endorsement are in Appendix A.

Interdependence with the TLI Transport and Logistics Training Package

This Case for Endorsement includes TLI Transport and Logistics Training Package units of competency that are part of a concurrent Case for Endorsement submission, creating an interdependence between these two Training Packages. Both Training Packages are managed by TLISC.

Including 89 units of competency from the proposed TLI Transport and Logistics Training Package Release 2.0 in the AVI Aviation Training Package Release 3.0 ground and flight operations qualifications and Skill Sets ensures the currency of these imported units and minimises the impact of change on industry, learners and training providers as a result of the Training Package endorsement process.

Mapping information and competency equivalency statements are contained within the TLI Transport and Logistics Training Package Release 2.0 Companion Volume Implementation Guide.

With the interdependent nature of Training Packages1, the continuous improvement process of various industry sector Training Package products has led to many imported units of competency becoming superseded through various releases of the AVI08 Aviation Training Package. Training package products policy2 requires that ‘developers must ensure that the status of imported units in Training Packages is checked through continuous improvement processes, and that imported units are kept current through these processes’. While TLISC has endeavored to do this, it is anticipated that some of the units of competency imported from Training Packages not managed by TLISC, will be put up for endorsement at the same time as the AVI Aviation Training Package Release 3.0, presenting a currency issue outside of TLISC’s control.

SECTION 1 – RESPONSIVENESS & RECOGNITION QUALITY PRINCIPLES

Responding to government broad policy initiatives

Part A: Aviation Safety

In April 2014, the TLISC Aviation Advisory Committee identified the need for a stronger training focus on aviation safety, including risk management, across all Aviation Industry occupations. This identified need also reflected the viewpoint and policy intent (current and future) of all international and national aviation safety regulators. Additionally, the TLISC Aviation Advisory Committee directed that all AVI08

Aviation Training Package Release 5.0 units of competency, qualifications and Skill Sets be transitioned to the Standards for Training Packages, by the end of 2015 in accordance with government vocational education and training (VET) policy and direction.

In October 2014, TLISC undertook to review, research and develop aviation safety units of competency/Skill Sets for roles across the Aviation Industry, to align with existing job roles/tasks, and to align with international and domestic aviation safety regulatory requirements. This was articulated in the TLISC Aviation Continuous Improvement Plan (CIP) as item 1.17.

The Aviation Safety Project responded to this identified need through the development of an Aviation Safety Management Framework. The Framework resulted in units of competency and Skill Sets being developed for flight and ground operations. Implementation of the Framework commenced with three units of competency and two Skill Sets being included in the AVI Aviation Training Package Release 1.0.

AVI Aviation Training Package units of competency that are allocated to the Competency Field with the letter ‘F’ designator (Safety Management) are considered to be part of the Aviation Safety Management Framework. The units span aviation safety, risk management and human factors, which are considered ‘non-technical’ skills and consequently, are reliant on integrated training and assessment strategies to support the ‘technical’ skills of working in the Australian Aviation Industry.

The following units related to aviation safety are submitted for endorsement in the AVI Aviation Training Package Release 3.0.

Part B: Ground Operations

This was articulated in the TLISC AVI08 CIP as items 1.5 and 1.13.

The Ground Operations Project also sought to develop new and/or review existing units of competency, qualifications and Skill Sets to meet the needs of ground and aerodrome operations personnel within the following roles: Ground Passenger Service

Part C: Flight Operations

In April 2014, the TLISC Aviation Advisory Committee directed that all AVI08 Aviation Training Package Release 5.0 units of competency, qualifications and Skill Sets be transitioned to the Standards for Training Packages, by the end of 2015 in accordance with government VET policy and direction.

On 1 September 2014, the Civil Aviation Safety Authority (CASA) released Civil Aviation Safety Regulations1 (CASR) 1998 Part 61—Flight Crew Licensing, which sets out the licensing scheme for pilots and flight engineers of registered aircraft. Under regulation 61.035 of CASR 1998, and for Part 61 of CASR 1998, the supporting Manual of Standards (MOS) sets out matters relating to: flight crew licences, ratings and endorsements

the use of an airborne collision avoidance system (ACAS)

aeronautical radio operations

aeroplane taxiing

conditions on flight examiner ratings.

The MOS Part 61 also includes enterprise competency standards, and describes the required skills, knowledge and assessment requirements for the issuance of a flight crew licence, rating or endorsement for approved flight operations within Australia. Further detail on the imperative for change is outlined in the section about ‘Reflecting licensing and regulatory requirements’.

In October 2014, TLISC undertook to review, research and develop flight operations units of competency, qualifications and Skill Sets for roles across the Aviation Industry to align with existing job roles/tasks, and to align with international and domestic aviation regulatory requirements. This was articulated in the TLISC AVI08 CIP as items 1.6, 1.9, 1.10, 1.11 and 1.15.

The Cabin Crew, Rotary Wing, Commercial Pilot and Pilot in Command projects also sought to develop new and/or review existing units of competency, qualifications and Skill Sets to meet the needs of flight operations personnel within the following roles:

Recognising convergence and connectivity of skills

Safety underpins all work in the Aviation Industry and is specifically reflected in the AVI Aviation Training Package by use of the Aviation Safety Management Framework.

In AVI Aviation Training Package Release 3.0, convergence and connectivity of skills is recognised through the aviation safety units of competency, which are packaged in qualifications and Skill Sets for ground operations and flight operations. The aviation safety units of competency are aligned with international and national regulatory requirements addressed in Australia's Aviation State Safety Program (SSP)2.

The aviation safety units will also be available for other industries to import into qualifications and Skill Sets where workers are exposed to high-risk and safety critical aviation operating environments.

Convergence and connectivity of skills is also recognised by importing units of competency from other Training Packages, such as business services, health, property services, public sector, public safety, tourism, transport and logistics, and training and education.

Supporting movement of skills within and across organisations and sectors

Part A: Aviation Safety

The Aviation Safety Management Framework applies to all occupational roles and across all sectors of the Aviation Industry in domestic and international realms.

Units that support this Framework are embedded as core requirements across the majority of AVI Aviation Training Package Release 3.0 qualifications, and offered as elective choices in all qualifications. Safety skills transference to other industry sectors is greatly improved, with common language and terminology being used in knowledge and performance evidence requirements where appropriate, within AVI Aviation Training Package Release 3.0 unit of competency assessment requirements.

Part B: Ground Operations

Qualifications related to ground operations roles are packaged to allow the maximum level of flexibility for individuals working across a range of aviation sectors. Units included within qualification core and elective structures are packaged to allow easy skills transfer between complementary ground operations roles, or vertical pathways through operator, supervisor and management functions.

The Skill Sets related to ground operations roles have been created in response to industry need to acknowledge the diversity of roles in this highly specialised industry.

Part C: Flight Operations

Qualifications related to flight operations roles are packaged primarily to achieve regulatory outcomes for commercial aviation. Alignment of qualifications with national operating standards ensures that individuals possess the skills and knowledge to perform safely and effectively in domestic and international aviation operating contexts.

The Skill Sets related to flight operations roles have been created in response to industry need to acknowledge the diversity of roles in this highly specialised industry.

Part A: Aviation Safety

Continuous improvement in global aviation safety is fundamental to ensuring air transport continues to play a major role in driving sustainable economic and social development around the world. For an industry that directly and indirectly supports the employment of 56.6 million people, contributes over $2 trillion to global gross domestic product (GDP), and carries over 2.5 billion passengers and $5.3 trillion worth of cargo annually, safety is aviation’s first and overriding priority.

With air traffic projected to double in the next 15 years, current and emerging safety risks must be addressed proactively to ensure this significant capacity expansion is carefully managed and supported through strategic regulatory and infrastructure developments. It is therefore imperative that International Civil Aviation Organization (ICAO) Member States and regions remain focused on establishing, updating and addressing their safety priorities as they continue to encourage expansion of their air transport sectors.3

Annex 19 to the Convention on International Civil Aviation – Safety Management, describes a systematic approach to managing safety, including the necessary organisational structures, accountabilities, policies and procedures.4

In Australia CASA has adopted the requirements of Annex 19 for implementing safety management systems (SMSs) within the Australian Aviation Industry. The framework for an SMS includes four main components and twelve elements, representing the minimum requirements for an SMS. CASA’s SMS includes an additional three elements: the SMS implementation plan, third party interface (contractors and service providers) and internal safety investigation.5

Safety risk management consists of hazard identification, and risk assessment and mitigation. These elements are articulated through a combination of safety skills training and safety management processes.

Risks affecting organisations can have consequences in terms of economic performance and professional reputation, as well as environmental, safety and societal outcomes. Therefore, managing risk effectively helps organisations to perform well in an environment full of uncertainty.6 CASA endorsed the use of ISO 31000 Risk management as the international standard for the risk management process within an SMS.

Aviation safety language, literacy and numeracy (LLN) skill requirements were aligned with the international and nationally recommended requirements for Aviation English Language Proficiency (AELP).

Part B: Ground Operations

Qualifications developed for ground operations roles are designed to achieve regulatory outcomes based on national legislation and international aviation treaties and conventions. Qualifications related to aviation transport security are nationally recognised, and address mandated skill and knowledge requirements under Australian law, including the Aviation Transport Security Act 2004 and Aviation Transport Security Regulations 2005.

Individuals performing roles on and around Australian aerodromes including aerodrome reporting officers, works safety officers and aviation safety personnel must adhere to the requirements directed under CASR 1998 Part 139 – Aerodromes. Core and elective units related to aerodrome operations roles are aligned to these requirements, and allow individuals to transfer skills and knowledge across a wide range of certified and uncertified aerodrome environments.

Part C: Flight Operations

Qualifications developed for flight crew roles are packaged to achieve licensing, certification and regulatory outcomes based on national legislation and international aviation treaties and conventions. Qualifications related to air transport pilot and flight instructor requirements are nationally recognised, and address mandated skill and knowledge requirements under Australian law, including Civil Aviation Orders, CASRs and other national operating standards such as the Model Work Health and Safety Act.

Qualifications developed for non-pilot flight crew roles are aligned to the same body of legislative outcomes, and allow individuals to operate safely and effectively in domestic or international operating environments.

Reflecting licensing and regulatory requirements

ICAO is a United Nations (UN) specialised agency, created in 1944 on the signing of the Convention on International Civil Aviation (Chicago Convention). ICAO works with the Convention’s 191 Member States and global aviation organisations to develop international Standards and Recommended Practices (SARPs), which Member States reference when developing their legally-enforceable national civil aviation regulations.

Improving the safety of global air transport safety systems is ICAO’s guiding and most fundamental strategic objective. The organisation works constantly to enhance global aviation safety through a range of coordinated activities.

CASA's primary function is to conduct the safety regulation of civil air operations in Australia and the operation of Australian aircraft overseas. It is also required to provide comprehensive safety education and training programs, to cooperate with the Australian Transport Safety Bureau, and to administer certain features of Part IVA of the Civil Aviation (Carriers’ Liability) Act 1959.

The Civil Aviation Regulations (CARs) 1988 and the CASR 1998, made under authority of the Civil Aviation Act, provide for general regulatory controls for the safety of air navigation. The Civil Aviation Act and CARs 1988 empower CASA to issue Civil Aviation Orders on detailed matters of regulation. The CASR 1998 empowers CASA to issue a Manual of Standards (MOS), which supports CASRs by providing detailed technical material.

CASA is undertaking a regulatory reform program to modernise existing legislation and to harmonise it with SARPs published by ICAO. The new legislation for flight crew licensing is formally known as CASR Part 61. It became legally effective on 1 September 2014, at which time, a four-year transition period began. New legislation for training organisations also became effective on 1 September 2014 with the introduction of CASR Part 141 and CASR Part 142. All training for the grant of a Part 61 licence, rating or endorsement must be conducted by the holder of a Part 141 or Part 142 certificate.

To support the harmonisation of the regulations with international practices, competency-based standards have been introduced for all CASA flight crew qualifications. Detailed competencies for the granting of a licence, rating or endorsement have been published by

CASA in the MOS Part 61. These competency standards are consistent with Australian Government policy that requires VET to be7: structured and competency-based

delivered by qualified and competent instructors

assessed against clearly-defined competency standards.

TLISC has ensured that mandatory skills and knowledge articulated within the MOS Part 61 have been accurately and appropriately included within all relevant flight operations units of competency, qualifications and Skill Sets.

The Department of Infrastructure and Regional Development administers the Aviation Transport Security Act 2004 (the Act) and the Aviation Transport Security Regulations 2005 (the Regulations). The Act and Regulations came into force in Australia on 10 March 2005. The purpose of the legislation is to establish a regulatory framework to safeguard against unlawful interference to aviation. It establishes minimum security requirements for civil aviation in Australia by imposing obligations on persons engaged with civil aviation related activities. In particular it obliges certain Aviation Industry participants to develop, and comply with, aviation security programs.

The Act also gives effect to Australia's aviation security obligations under the Convention on International Aviation (also known as the Chicago Convention). Under these laws people and companies who operate in the Aviation Industry have responsibilities that help to maintain Australia’s excellent reputation as one of the most secure places in the world.8

TLISC has also ensured that mandatory skills and knowledge articulated in Australia’s aviation transport security legislation have been accurately and appropriately included in all relevant ground operations and flight operations units of competency, qualifications and Skill Sets.

People employed in aviation safety, ground or flight operations roles across the Aviation Industry need to fulfil competency and training requirements as detailed in the regulations relevant to their occupation. People assessed as complying with these requirements are usually provided with some form of certification by CASA, Airservices Australia, the Department of Infrastructure and Regional Development or other relevant bodies.

Detailed flight and ground operations licensing and regulatory information has been provided in the AVI Aviation Training Package CVIG Release 3.0.

SECTION 2 – FLEXIBILITY & FUNCTIONALITY QUALITY PRINCIPLES

Meeting the diversity of individual and enterprise needs

Stakeholders consulted in the transition, development and validation of the proposed units of competency, qualifications and Skill Sets were associated with a range of organisations – with varying numbers of members, operating budgets, business structures, and legislative and funding requirements.

The structure of the qualifications primarily includes core and general elective units, allowing the flexibility required to adapt the qualification to individual needs or the needs of a group of employees within an organisation.

Supporting equitable access and progression of learners

AVI Aviation Training Package units of competency and imported units of competency that require prerequisite units are clearly identified within qualification packaging rules, and are included in elective options where appropriate.

Qualifications that require entry requirements are aligned to piloting and flight instructor roles. Commercial or military pilot entrants to these qualifications should check requirements with CASA or Defence Aviation for certification and/or flight hour requirements, or be able to demonstrate equivalent competence.

While the qualifications support equitable access and progression of learners, it will be the industry employer and regulatory bodies who will determine the employment parameters of equitable access and employment progression.

Supporting learner transition between education sectors

There are no formal transition arrangements between the VET sector and the higher education sector for the AVI Aviation Training Package Release 3.0. The higher education sector has a narrow aviation focus on flight crew and facility management.

Supporting implementation across a range of settings

The AVI Aviation Training Package CVIG Release 3.0 provides advice on implementation.

The assessment requirements support implementation across a range of settings and may be modified for distance-based learners, and for the use of simulated and synthetic learning and assessment activities.

Supporting sound assessment practice

As a minimum, assessors and assessment practices must satisfy applicable regulatory requirements, which include requirements in the Standards for Registered Training Organisations current at the time of assessment.

Assessment must occur in workplace operational situations. Where this is not appropriate, assessment must occur in simulated workplace operational situations that reflect workplace conditions. Assessment processes and techniques must be appropriate to the language, literacy and numeracy requirements of the work being performed and the needs of the candidate.

Evidence required to demonstrate competence must be relevant to, and satisfy all of the requirements of the elements, performance criteria and range of conditions on at least one occasion. Where multiple iterations of an assessment event are required, this is clearly articulated by reference to the enabling regulatory requirements, or described in performance evidence and/or knowledge evidence.

The components of the qualifications are specific to industry requirements and units need to be suitably assessed with respect to the dimensions of competency. The assessment requirements provide detail about the performance evidence and knowledge evidence. Units also include cognitive skills and practical components, which must be adequately assessed.

Aviation Industry specific information and advice is provided to Registered Training Organisations (RTOs) in the AVI Aviation Training Package CVIG Release 3.0 to indicate industry’s expectations and requirements of training delivery and assessment. Defence Aviation and civil sector RTOs were involved in the units of competency, qualifications and Skill Sets review process to ensure they could be successfully implemented in a practical setting.

Supporting implementation through compliance with National Register requirements

The materials have been written to comply with the Standards for Training Packages.

Part C: Flight Operations

Vocational flight training within Australia is delivered through a wide range of training mechanisms, including progression from a recreational activity to commercial flight training within non-VET training organisations, within aviation RTOs, and through tertiary education programs aligned to university curriculum.

Changes to flight crew licensing requirements imposed by CASA (1 September 2014) have led to significant restructuring of pilot training programs for all flight training organisations. RTOs that plan to deliver AVI Aviation Training Package Release 3.0 products are required to also transition CASA approved curriculum and syllabus simultaneously. Duplication of regulatory compliance requirements imposed by CASA and the relevant VET regulator – the Australian Skills Quality Authority (ASQA), the Victorian Registration and Qualifications Authority (VRQA), the Western Australian Training Accreditation Council (TAC) – is required prior to implementing and delivering flight crew related qualifications.

Significant investment in training facilities, aircraft and simulation devices is required for implementation of the revised flight training regulatory requirements. Industry training providers will seek to maximise the time available to identify new domestic and international commercial pilot students, to ensure all regulatory and compliance requirements are achieved, and to adopt the revised training requirements as directed under VET and CASA transition requirements.

Part C: Flight Operations

Flight training enterprises and industry expect that:

flight crew licensing and qualification requirements will equip graduates to enter the Aviation Industry with the skills and knowledge required to be successful within commercial aviation contexts

industry flight training RTOs will focus on providing quality training and assessment that is consistent with and meets the outcomes identified in the units of competency, and is aligned to flight crew licensing standards.

Public/private training and assessment services

The proposed units of competency, qualifications and Skill Sets will replace the relevant products in the AVI08 Aviation Training Package Release 5.0.

RTOs intending to deliver and/or assess material in the AVI Aviation Training Package Release 3.0 will need to apply for an amendment to their scope of registration according to relevant VET regulator requirements. Consideration will also need to be given to the review, amendment or development of delivery and assessment resources, equipment and infrastructure required by aviation RTOs to support training and assessment.

Enterprises

There are no identified negative impacts of the AVI Aviation Training Package Release 3.0 on enterprises.

Licensing and regulatory environment

The introduction of the AVI Aviation Training Package Release 3.0 will provide a viable national framework for implementation of regulations as required by ICAO, CASA, the Department of Infrastructure and Regional Development, and other relevant national regulatory bodies.

Policy environment

Training and VET policies have been addressed during the development process through consultation with state/territory training authorities and state/territory Industry Skills Councils.

The national and state/territory training authorities will need to consider the public funding implications of delivering and assessing these units of competency and qualifications, and the workplace participation and productivity agenda as identified in the Australian Government’s National Aviation White Paper 20091. It is anticipated that a significant increase in public and private enterprise interest in the commercial pilot (aeroplane and helicopter) and air transport qualifications will result in increased demand for public funding for training and assessment of these products.

Systemic issues

Key issues that will ensure the effective implementation of the qualifications and units of competency include valid and reliable assessment by RTOs, especially in relation to skills recognition.
