COMES NOW TRAIAN BUJDUVEAN, Plaintiff, Pro-se, and Moves this Honorable
Court for a Renewed Second Motion For Summary Judgment as instructed by this
Court in the Court's Order Denying Motions For Summary Judgment and Motions To
Strike Plaintiffs Sur-Replies. (DE# 119)
Plaintiff was not able to comply with the Court's Order regarding deadline filing due
to his absence from this country for medical treatment with Fetal Stem Cells at Kiev
Municipal Clinic Em ergency Hospital, located in Kiev, Ukraine, which saved his life.
Treatment was approved by this Court (Exhibit 1)
Plaintiff, Traian Bujduveanu (Pro Se Litigant), hereby sles this Renewed Second
Motion For Summary Judgment against Dismas Charities, lnc., a corporation

authorized to transact business in the State of Florida, and Co-Defendants Ana
Gispert, Derek Thomas, and Lashanda Adam s, and states as follows:
INTRODUCTION
Plaintiff wms a federal prisoner who was released from prison by the Blzreau of Prisons
on July 28, 2010, due to medical problems, to complete the service of his federal prison
sentence in a halfway house. He was assigned to Dismas Charities, , located in Dania,
Florida. (Exhibit 2)
ThereaRer, given the severity of his health condition, with the approval of CCM
Director . Carlos Rodriguez, the Plaintiffwas placed on home confinement, allowing
him to serve the rest of his sentence at home so long as he reported to Dismas every
W ednesday. (Exhibit 3)
Federal Guidelines stipulates that CCM Director is the ONLY person designated by
the Director of the Federal Prisons, to have the power to send a prisoner from
Halfway House to Home Confinement, or from Home Confinement back to the
Federal Prison.
Said facility was, at the time, was Managed by Co-Defendant Ana Gispert. Co-
Defendants Derek Thomas and Lashanda Adam s were responsible for supeM sing
the Plaintiff during his rehabilitation and re-entry into society as part of his federal
prison sentence.

The Plaintiff provided the appropriate soffmembers with copies of his driver
license, driving history from the Division of Motor Vehicles in Tallahassee,
vehicle registration, and valid insurance, in compliance with the terms and
conditions necessary to obtain permission to operate a motor vehicle during
supervision.
As it can be seen from the original Complaint all documents from Florida
Departm et of M otor Vehicles w ere in order and all copies of docum ents including
Driver License, Vehicle Registration and Insurance were kept in Lashanda Adam's
office. Plaintiff holds a US Driving License since 1974, and he never had any
accidents. He is also the holder of a US Department of Transportation, Federal
Aviation Administration, Single and Multi Engines Airplane Pilot License.

Following a series of vicious and illegal acts and abuses, committed by Defendants,
Plaintiff was sent back to Federal Prison, FDC Miami facility, for 81 (eightpone)
days, without permission of the proper authorities, and without due process, in a time
when Plaintiff was very sick, and without any consideration for his medical
conditions. Defendants conspired to, and caused the Plaintiff false imprisonment by
using the cellphone incident as a mean to cause the Plaintiffs incarceration, when
they knew in fact it was not legal.
Defendants have engaged in Depravation of property, in violation of the Fourth
Amendments, M alicious Prosecution in violation of the Fourteenth Amendment,

Fabricating of evidence, and Failure to keep 9om harm, which represent acts both
within and beyond the limits of their lawful authority or oftkial status.
Defendants have committed abuses of power in violation of 42 U.S.C. 1983, which
included unlawful acts, in an official capacity, under the ttcolor of law'' and conspired
to, and willfully deprived the Plaintiff of his rights protected by the Constitution or
U.S. law, in a time when the M ovant was institutionalized, in violation of Fourth,
FiRh, Eight and Fourteenth Amendment to the Constimtion of United States.
Defendants knowingly and willfully used a false writing or docum ent, knowing the
sam e to contain a m aterially false, fictitious or fraudulent statement or entry, in
violation of 18 U .S.C. 1001.
Defendrmts conspired to commit the above offense against the United States in order
to defraud the United States, and acting to effect the object of the conspiracy, in
violation of 18 U.S.C. 371. (DE# 1 15, Exhibit A,B)

Defendants willfully misrepresented the United States of America without power of
attorney, in violation 28 U.S.C. 371
Violations of the federal criminal sàtutes at 18 U.S.C. 371 and 18 U.S.C.1001 are
felonies.
Dismas Charities,lnc. is a private not for protit corporation, operating 28 halfway
houses in 13 states. Dism as Charities house has limited independent disciplinary
discretion, and could impose sanctions on residents only for the most minor of

prohibited acts. Any serious sanctions required approval of CCM , USPO and
Com mlmity Sanctions representatives. Under its arrangement with the governm ent,
the Dismas Charities facility, as a halfway house, could not detain a resident.
Residents are free to leave, provided they signed a sign-out sheet. The facility could
not be ''locked down'' in order to prevent residents from leaving, ln sum, residents
could leave the facility at any time, subject only to the consequences that could be
imposed by the courts or by the Bureau of Prisons. lf M ovant would have leR the
facility, Dismas Charities could only report the incident to the CCM and USPO.
II. STATEM ENT OF M ATERIAL FACTS
In 2008, while imprisoned at FDC M iami, Movant was diagnosed with Hepatitis C
Infections, Liver Cirrhosis, Diabetes, Throm bocytopenia, Ascites, Hypertension,
Hyperlipidemia, Clzronic Fatigue, and other complications associates with Hepatitis C
lnfection. M ovant's condition lim ited his ability to engage in physical activity, and
due to that fact, while in prison, M ovant was never required to perform any working
duties. At present time there are 300 pages of medical documents issued by the
Federal Bureau Of prisons M edical Staff, and more than 100 pages of medical records
issued by M emorial Hospital, Broward General Hospital, Nova University M edical
Center and physicians. Defendants are fully aware of these records and have access to
a1l medical records.
To hum iliate the Plaintiff and inflict pain, Defendant Thomas forced the Plaintiff
to vacuum rooms for him while at Dismas, clean the windows, take large garbadge

bags to the dump conoiners located in the backyard of the property, and this was
called later by the Defendants ''DUSTING'' despite the Plaintiff's aggravated m edical
condition. This when Dismas Charities had access to more than 300 pages of
Movant's medical records from the Federal Bureau Of Prisons, and new exactly the
W orking Restrictions of the PlaintiffA copy of Movant's medical records was located
in the Movant's Personal Records File, at Dismas Charities. (Exhibit 4)
W hile at Dismas House, and later on Home Continement, Defendants Denied the
movant to attend religious services at the Orthodox Church, located within 16 minutes
from Dismas House, invoking the reason of Federal Guidelines. Such Guidelines do not
exist. Federal Govemment remains neutral in regards to a11 aspects of religion practices
or distances to or from a halfway house. (Exhibit 5)
W hile at Dismas house and after, when in Home Confinment, which was outside of
the jtuisdiction of the halfway house, Defendants tortured, htlmiliate, single out,
discriminate against race, ethnic origin, color and race, abuse, and harassed the
M ovant without any consideration for his medical conditions.
After the M ovant was sent illegally to FDC M iami , a g'roup of four Dismms Charities
employees visited the M ovant in Prison and presented him with a one page, home
m ade form , bearing the nam e of US Federal Prison charge of Greatest Violation Code
108, signed by Derek Thomas, to justify the illegal imprisonment. This was for the
same violation applied twice in the past, on different forms, without due process,

which resulted in sanctions applied personally by Derek Thomas, at Dismms Charities,
lnc.
W hile incarcerated at FDC M iami, M ovant did not have any charges levied against
him by any DHO, BOP, or any other legal authority, and his custody remained as
Community Custody, until his release on 01/03/201 1. Movant was not in the federal
prison for any crimes that he committed. He was in the federal prison due to illegal
acts against him committed by the defendants.
A11 employees of FDC M iami, that cam e in contact with this case, including
Counselor Price, W arden and a11 DHO Officers, stayed away from Dismas Charities
as they felt the incarceration was highly illegal. Counselor Price attempted to contact,
on several occasions, by telephone, em ail and telefax, CCM Director Carlos
Rodriguez, who would be responsible for returning a prisoner to federal prison, to no
avail. USPO stated that they found out about the M ovant incarceration in January
201 1 when they have received a copy of The M otion For the Retum Of property, sent
to them by the M ovant. Even today, BOP does not recognize any charges levied
against Traian Bujduveanu, by anyone while at Dismas Charities, lnc., or after he was
removed from Dismas Charities, and incarcerated at M iami FDC without any regards
for his medical conditions, and until the end of his sentence.
At the time the incident took place, referring to the telephone found in the glove
com partment of the vehicle, the Plaintiff was in Homeconinem ent, outside of the

jurisdiction of the halfway house,and he was present at Dismas Charities or his weekly
report. Conditions And Terms Of Home Confinement do not contain or
specify telephones in the glove compartment of the driven vehicle. ln fact the terms
and conditions do not mention anything about cellular telephones, or any kind of
phone, being used as a weapon or existence of a phone in the glove compartment of a
vehicle parked outside.
The decision to send the Plaintiff back to the federal prison was not m ade by USPO,
CCM and/or Community Sanction Center.ln fact USPO has stated that Defendants failed
to advise USPO within 48 hours, of the Movant incarceration, asrequired by Federal
Bttreau of Prisons regulation. USPO found out about the incarceration in January 201 1,
when they received a copy of the Motion For The Retllrn Of Property, from the M ovant.
Today there are no existing reports, investigations or charges by the US Federal
Bureau Of prisons, US M arshall, USPO, Com munity Sanctions Center or any other
legal entity, and none of these agencies/bureaus what to get involved or hear anything
about Dismas Charities or the Defendants, a11 documents pointing to the fact hat
Defendants acted alone. Those acts and omissions represent very grave illegal acts
which are against the Constittltion Of 'The United States of America. W hat the
Defendants have on hand, are only their words but not any support of BOP, USPO,
US Marshall, or any legal authorities and this is revealed in the Sentry Report. (Exhibit )

111. CLM M S UPON W HICH JUDGM ENT IS SOUGHT
A. Plaintiff is entitled to Summary Judgment on Claim 1: Right to be free from
unlawful seizure of property or person.
1. Burden of proof and elem ents:
The Plaintiffs claim of Violation of his Fourth Amendment rights to the Constimtion
of United States, and his Fifth Amendment to the Constitution of United States.
An illegal search was conducted of the vehicle that M ovant drove and property was
removed from the vehicle without the knowledge of the M ovant and without the
M ovant being present at the search. Data and evidence from the surveillance cameras
was deliberately destroyed by the Defendants.
The Fourth Amendment to the U.S. Constitution protects people from - lmreasonable
searches and seimzres by requiring that the govem ment flrst secure a warrant based on
probable cause.
Having a cellular telephone in the car, does not represent a violation for prisoners on
home continement as Halfway House Rules and Regulations are not the same as
Home Confinement Rules and Regulations. 'I'he incident was a motive for the
defendants to create a hostile environment, mental anguish, pain, suffering, and
harassment. A search would not be valid without a search wazrant for example, if a
cell phone was found in the car, and the owner of the car was not present. However
none of the above applies here due to the fact that the M ovant was on hom e
confinem ent at the tim e and not a resident of Dismas halfway house.
lt is well established that a person whose property is being forfeited is entitled to

notice, reasonably calculated under a11 the circumstances, to apprise interested parties
on the pendency of a legal action and an opportunity to present their objection.
Gonzales-Gonzales, 257F. 3d. at 35 (citing Mulane v. Cent. Hanover Bank & Trust
Co., 339 U.S. 306, 314, 70S. Ct.652, 94L. Ed.865 (1950). See also Mathews v.
Eldrige, 424 U.S. 319, 348, 965. Ct. 893, 471,. Ed. 2d. 18 (1976) (The essence of due
process is the requirement that a person injeopardy of serious loss be given notice of
the case against him and opportunity to meet it.'')
''A search is legally defmed as an invasion of an individual's legitimate expectation of
privacy. See Katz v. United States, 389 U.S. 347,19L Ed. 2d 576, 88 S, Ct. 507
(1967). This requires that an individual have a subjective expectation of privacy and
that the expectation be objectively reasonable one, meaning one that society is
repared to accept as reasonable.''P
''Seizure of property occtlrs when a govemment official meaningfully, intedkres with
a person's possessory interest in that property. See United States v. Jacobsen, 466 U.S.
109, 8L. Ed. 2d 85, 104 S. Ct. 1652 (1984). ln plain English, it is a seizure of property
when the police take the bag, impound the car, or voucher the ptlrse.''
Fabricating evidence against or falsely arresting an individual also violates the colorof 1aw statute, taking away the person's rights of due process and unreasonable
seizure. ln the case of deprivation of property, the color of 1aw stam te would be
violated by tmlawfully obtaining or maintaining a person's property, which oversteps
or m isapplies the ofticial's authority.

The Fourteenth Amendm ent secures the right to due process; the Eighth Am endment
prohibits the use of cruel and tmusual punishment. Dming an arrest or detention, these
rights can be violated by the use of force amounting to punishment. The person
accused of a crime must be allowed the opportunity to have a trial and should not be
subjected to punishment without having been afforded the opportunity of the legal
PCOCCSS.
The Plaintiff's claim of Violation of his FiRh, Sixth, Eight and Fourteenth
Amendment to the Constitution of United States.
Defendants have conspired to caused the arrest of the M ovant, by US M arshall, for a
illegalconfiscation of property- that a violation of a person's civil rights m ay occlm
B. Plaintiff is entitled to summary judgment on Claim 3: Rights to due process.
1. Btlrden of proof and elem ents
The Plaintiffs claim of Violation of his Fifth, Eight and Fourteen Amendment rights
to he Constitution of United States.
Plaintiffwas given there violations, on different dates, for the same incident that has
occurred in the sam e day, tim e and place, without due process of 1aw and he was sent
to federal prison by Defendants, without Due Process of Law.
EThe CCC Contractor, the provider of home Confinement, shall develop a system for
handling violations of program rules, which meets the ttdue process'' criteria of W olf
v. M cDonald, and includes provisions for dealing with minor infractions of program
nzles for prisoners in Home Confinement.'' (Dept. of Justice), (Federal Bureau Of

Prior to the United States Supreme Court's decision in Goldberg v. Kelly, 397 U.S. 254,
90 S. Ct. 101 1 (1970), there were no constitutional safeguards protecting prisoners from
arbitrary and capricious punishment.
In Kelly, the Supreme Court extended the Due Process clause of the United States
Constitution, holding that before a welfare recipient could be deprived of a grant, certain
procedural safeguards were due him or her. They include: notice of the chargets),
confrontation or cross-exnmination of adverse wimesses and the right to representation
by counsel before an impartial hearing ofticer.
These procedural safeguards were then expressly extended to include prisoners facing
disciplinary proceedings by the U.S. Supreme Court's decision in W olff v.
McDonnell, 428 U.S. 539, 94 S. Ct. 2963 (1974). Prisoners in New Jersey were also
accorded extensive rights by the N ew Jersey Suprem e Court's ruling in Avant v.
Clifford, 67 N.J. 496 (1975). The standards and procedures that are outlined here
stem directly from these two decisions.
The rights and procedural protections of prisoners facing disciplinary proceedings were
recently ''reaffirmed and reinforced'' by the N.J. Supreme Court in two decisions,
McDonald v. Pinchak, (A-2-94), - N.J. - (1995) and Jacobs v. Stephens, (A-1-94), -
N.J. - - (1995).
ln McDonald, the Court clarified and moditied some of the DOC's disciplinary hearing
practices ''to further ensure that DOC properly im plem ents both the standards announced
inAvant and the DOC's own regulations.''

C. Plaintiff is entitled to Summary judgment on claim 4: Malicious prosecution.
1. Burden of proof and elements
On October 20, 2010, at 6:30 A .M ., after the Plaintiff was released from the
hospital emergency room and after the Plaintiff was declared a fugitive by the
Defendants, while sleeping in his bed at Dismas House, the Plaintiffwas arrested
by U .S. Marshall agents and transported to F.D.C. Miami, without any charges
levied against him and without Due Process of Law . The incarceration was done
without the knowledge of USPO, Community Service Manager and CCM Director,
Carlos Rodriguez, as he did not sign the papers for the incarceration, thus
making it clear that the Defendants engaged in a campaign of erasing evidence
and fabricating docum ents in order to cover up any suspicion of the events.
Plaintiff could not possible be a fugitive since he has been taken to the hospital
by ambulance, from Dismas, with the approval of Dismas staffmembers, and
even more, when he was picked up in the morninp form the emergency room by
Dismas personnel. Declaring Plaintiff a fugitive was the ONLY way to get rid of a
problem.
The Plaintiff's claim of Violation of his Fourth, Fifh, Sixth, Eight and Fourteenth
Amendment to the Constitution of tmited States.
Defendants have engaged in Color of Law Abuses, M isconduct and Deprivation of
Rights Under the Color of Law Statute, W illfully Failed to Keep an lndividual from
Harm, which include acts carried out by Defendants operating both within and beyond
the limits of their lawful authority, tlms being in violation of the color of 1aw statute.

lt's a federal crime for anyone acting under ç<color of law'' willfully to deprive or
conspire to deprive a person of a right protected by the Constitution or U.S. law.
çicolor of law'' simply means that the person is using authority given to him or her by
a local, state, or federal government agency.
ln the United States law, a state actor is a person who is acting on behalf of a
governmental body, and therefore subject to regulation under the United States Bill of
ltights, lncluding the First, Fifth and Fourteenth Am endments, which prohibit the
federal and state govemments from violating certain rights and geedoms.
D. Plaintlff is entitled to Summary Judgment on claim 5: Right to be free fromcruel and unusual punishm ent.
1. Burden of proof and elements
The Plaintiffs claim of repeated violation by the Defendants of his Violation of his
Sixth and Eight Am endm ent, to the Constitution of United States, crtzel and unusual
punishment.
W hile at Dism as House, and later on home confmem ent, M ovant was constantly
terrorized, intimidated and humiliated without any regards for his medical conditions.
He was forced to do cleaning jobs when in fact he was not allowed by his doctors. ln
the end, as a tinal punishment, the M ovant was sent back to federal prison for a m inor
incident, without due process, for charges, that even if trtze, do not require arrest and
incarceration.
M ovant's m edical conditions affected almost a1l life activities having to do with
motion, including the major life activities of walking, sitting, and standing. His

doctors recommended restrictions on frequent twisting and bending, lifting objects, or
pedbrming any work activities. Thus, Dismas Charities accomm odations were
tmreasonable.
W hile at Dism as house, Defendants have deliberately interfered with the M ovant's
medical treatm ent in order to harass him , hum iliate him , create pain and suffering.
ççerhere is no iron curtain drawn between the Constimtion and the prisons of this
cotmtry.'' Wolffv. McDonne11,418 U.S. 539, 555-56 (1974).
E. Plaintiff is entitled to Sum m ary Judgm ent on Claim : 6: UnlawfulDiscrim ination based on Race, National O rigin, Ethnic G roups and Ancestry,
Reverse Discrim ination under the color of state law, Discriminatory Harassm ent.
1. Btlrden of proof and elements
Plaintiff claim discrim ination under Title VIl of the Civil Rights Act, 42
U.S.C. j 2000e et seq., against national origin, etbnic background, color, and religion.
M ovant was discriminated and harassed constantly, by the Defendants, because he
was a foreigner, spoke English with an accent, practiced Greek-orthodox Religion
and he was white. Other residents at Dismas house were not t'reated in the same way.
Title Vl1 prohibits race discrimination against al1 persons, including Caucasians.
Defendants have a background in discrimination and a clear pattern. However they
have categorically refused to reveal any background information when requested in
the discovery, invoking harassm ent and other inexistent motives and issues.
Prisoners are protected tmder the Equal Protection Clause of the Fourteenth
Amendment from invidious discri discrimination based on race. Lee v. W ashington, 390
U.S. 333 (1968).

F. Plaintiff is entitled to Sum m ary Judgm ent on Claim 7: rights to freedom of
Expression
1. Btlrden of proof and elements
The M ovant's claim repeated violations by the Defendants of his constitutional
rights, religious discrimination and retaliation under 42 U.S.C, 1983, First
Amendment rights, to the constitution of United States, the right to freedom of
religion and geedom of expression.
Defendats have caused the M ovant harm and humiliation by not allowing him to
attend Church Services on Stmday, at a Orthodox chlzrch on Sundays, located 16
m inutes from the Dismas Charities halfway house, thus violating the M ovant's First
Am endment Rights.
The Bill of Rights guarantees that the governm ent can never deprive people in the
U .S. of certain fundam ental rights including the right to freedom of religion and to
free speech and the due process of law .
G. Plaintiff is entitled to Summary judgment on claim 8: Intentional Inmction ofM ental Distress and Abuse of Process.
1. Burden of proof and elements
The Plaintiffs claim of Violation of his FiAh, Sixth, Eight and Fourteenth
Amendment to the constitution of United States.
Defendants have abused their power acting in the name of the State and Federal
Governm ent by torfllring the plaintiff.

H. Plaintiff is tntitled to Summary judgment on daim 9: Negligence.
1. Burden of proof and elements
Defendants were intentionally intedkring with the Plaintitrs medical keatment.
Defendants committed these illegal acts against the M ovant, when they were fully
aware of the medical condition of the M ovant.
1. Plaintiffis entitled to Summary judgment on claim 10: Gross Negligence byfailing to ascertain the m edical condgtion of the M ovant com plaints of feeling iII.
Despite the 300 or m ore m edical records, issued by the Doctors of US Federal Prison, the
Defendants continues to obligate the Plaintiff to vacullm the facility, clean the windows,
take large bags of garbage to the garbage container located in the backyard of the facility
and do other cleaning jobs and a11 this was called by the Defendants EKDUSTING''.
