President’s Message"A successful person is one who can lay a firm foundation with the bricks thatothers throw at him." -David Brinkley

Some may view the new state law with as much welcome as a brick, but Ibelieve we need to use it as an opportunity to enhance our ties with our cus-tomers and grow. I hope that you have had a chance to see our presentation onthe new state law at your local association meeting, but if you missed it youhave another chance at our annual meeting (see page 13 for details).

As an industry we have a responsibility to make the implementation of these newrequirements as smooth as possible. By reducing the burden on public safety wecan make it less likely that unreasonable changes to police response are proposedor enacted.

As we approach the annual convention I would be remiss if I did not thank everyone on the board andour committees for all their help in making the TBFAA the success that it is. J D Benfer, Nathan Bryant,Rex E. Adams, Mark Matlock, Brian McKinney, JP Shull, Ruben Fechner, Walter Tutor, Debi Ulmer, ChrisRussell, Malcolm Reed, Gary Dawkins, Kathleen Schraufnagel, Rodney Hooker, Dennis Bryant and DaveSimon have all served us well as board or committee members. I would like to welcome Roy Soto asour new Region I Director and thank Pam Elliott for her past service in that capacity

A few leaders are taking well deserved breaks and deserve special acknowledgment. When JanWisdom moved out of the industry and out of her role as Secretary, Roger Byrd stepped up to fill thevacancy and has done an exceptional job. Those of you who have been around a while know Rogerhas already paid his dues with service as TBFAA President and a longtime leader in the STAA. BillParsley has served as STAA president for 5 years and is turning over the reigns this year because inhis words “its time to give someone else a chance”. Bill not only has one of the best attendancerecords on the board but he also has been consistent with support and constructive ideas. Last andcertainly not least is Henry Homrighaus who has served as associate director for several years and hasconsistently helped our legislative effort, helped to organize our conventions and always been readywith a great idea. Knowing each of these leaders as I do, I not only hope, but expect, that we will seethem all again in some capacity

I also need to make sure that I acknowledge the effort of our instructors who keep our valuable training pro-gram going strong. Brian McKinney, Whitney Crahen, Gary Dawkins, Joe Francis, Malcolm Reed, Roy Hornand Brant Pierce consistently giveus extra effort to make sure ourstudents get maximum value.

I have witnessed all of these lead-ers grow and learn and get a lotdone. They are all great examplesof what Mahatma Gandhi said“The best way to find yourself is tolose yourself in the service of oth-ers.”

In July the South Texas Alarm Association(STAA) made a donation of $2500 to the

Legislative Support Fund. In May theHouston Gulf Coast Alarm Assn, (HGCAA)donated $5,000 to the TBFAA legislativefund. At the North Texas Alarm Assn.

(NTAA) May Board meeting, a motion todonate $5,000 to the TBFAA general fund

was passed unanimously.

TBFAA Annual Membership Meeting

Plan now to attend the TBFAA annual membership meeting and lunch on Saturday October 29 fromNoon-2pm in Galveston (see Page 12 for a full schedule).

The meeting is your chance to vote on important bylaw changes and on officers who will serve you forthe coming year. The candidates listed in this newsletter have submitted themselves to you for election.Additional qualified members can be nominated from the floor at the annual meeting. Visitwww.tbfaa.org or contact TBFAA for a copy of the bylaws to see the qualifications and responsibilities foreach office.

At each regular or annual general membership meeting, each Regular and Associate Member in goodstanding will be allowed to carry a maximum of one (1) vote by proxy of another Regular or AssociateMember in good standing. Each proxy must be declared to the Secretary at the beginning of the meet-ing in which the proxy is intended to be used. The Secretary of the Corporation must on the prescribedform and style maintain each proxy. Each proxy shall be dated and shall apply only to the specific regu-lar, special, or annual general membership meeting.

TBFAA Board Seeks Membership InputAt the first meeting of the newly elected board, immediately following the membership meeting onSaturday October 29th, the Board will begin its plans for the 2006 membership year.

In 2004 the TBFAA Board made the decision to help form and join a new national alliance- the NationalElectronic Security Alliance (NESA). NESA has multiple benefits to TBFAA and its members including;

* Networking and information sharing. Each state association has to face and tackle the same chal-lenges that TBFAA faces. No one is a better source of help than our peers in other state associations. *Leadership training will be provided at NESA meet-ings to help your state leaders run the associationbetter.* The ability to monitor and influence federal legis-lation and regulation. We need collaboration andcoordinated efforts with other state associations torepresent our industry at a national level.* NESA will help TBFAA keep you updated with thelatest codes and standards and will allow industryleaders to mobilize to influence the codes and stan-dards process.* Individual state members can gain credibility andexposure as a member of a National Association.

TBFAA’s participation in NESA costs $50 per regularand associate member per year. The TBFAA boarddecided that the association could absorb the costfor the first year without increasing dues to coverthe increased cost. We will face that decision againat the October meeting.

Goals: It is my goal to build on the momentum started in2005 and continue to raise awareness of the TBFAAthrough the post card campaign and through the existingmarketing campaign. I want to see membership exceed200 members for the first time in the Association’s history.I also want to work more closely with the new AssociateDirector to boost associate membership as well as regularmembership. The primary objective of the Texas Burglar and Fire Alarm Associationis to represent the alarm industry before the Texas Legislature andother governmental agencies. The objectives of the association canonly be accomplished by the combined efforts of the Board ofDirectors and our lobbyist Ron Kessler of the law firm of Ron KesslerGroup, LLC. The Board of Directors, headed up by President Chip Bird,coordinates the activities of the association. Ron Kessler heads up ourlobbying effort. It would be fair to say “he opens a lot of doors”.

The Texas Burglar and Fire Alarm Association incurs a cost of morethan $90,000 per Biannual Legislative Session for our legislativeeffort. The membership dues are not enough to cover this expense.Special help is needed.

We, the Board of Directors, are asking the professional alarm dealersof the state of Texas to participate either monthly or yearly in thisongoing legislative effort. With the team concept we can get the jobdone.

Qualifications: Currently TBFAADirector Emeritus, Past TBFAATraining Director for several years,TBFAA and former NBFAA instruc-tor, Instructor of the Year NBFAA2001, Training Director of the Year NBFAA 2002, formerInstructor Pilot United States Air Force in the T-38 super-sonic jet, former high school math teacher, Texas StateTeaching Certificate to teach high school math andphysics and science, Bachelor’s Degree in Mathematicswith a minor in Physics, Master’s Degree in ComputerScience.

Goals: In my new position at Response Center USA, Ishould again have time to devote to the position ofTraining Director. The TBFAA now has its own Level 1course, which is a good income producer for TBFAA.However, this course needs updating and changing tomake it more effective. I would like to get this done. Ihave learned from the many students whom I have taughtover the years that there is a great deal of misunder-standing about how fire alarms are to be installed, andwhat licenses are required to do so. I would like to see aone or two day fire alarm course developed by theTBFAA, or perhaps contracted out with income coming tothe TBFAA, to better prepare those who are installing firedevices. This would also be of great help to those whoare studying for the fire license exam.

The recent changes in our state law will have a noticeable impact on our industry and many of our busi-ness practices. There is a challenge, duty, and opportunity before us all to review our current businessmodel and implement changes that are responsible, effective, and beneficial. These changes shouldcause us all to closely examine how we do business.

Texas law allows city ordinance adoption of escalating fines to alarm users after 3 dispatched alarms ina 12 month period. It may be of worthy consideration for your alarm company to provide a third-partyprivate response service option. Using private response for those customers could result be fewer policedispatches and could save your customer money. Careful thought and planning may give you the oppor-tunity to develop another service solution for your business.

Effective in 2007, all installed and replaced alarm systems must comply with the CP-01 standard. As analarm installing company you may consider early implementation and boast of the advantages. It wasintroduced into law because it will reduce alarms and false dispatches. Non-compliant CP-01 panelsrequire customer acclimation and higher replacement cost if the alarm control is replaced after 2006.

Enhanced Call Verification is the law and no longer a choice or preferred method. If you are an alarmmonitoring company this should be an integral part of your monitoring procedures, legal instruments,sales process, and new customer orientation. Presented correctly, your customer should feel apprecia-tion for your company’s dedication to reducing unnecessary dispatches for safety reasons, prevention ofunnecessary expenses, and efficient utilization of resources.

Expect and plan that your new customer will know very little about false alarms or your procedures.Educate and prepare them with the facts of how your business addresses them and their role.Demonstrate that you have an effective plan. The new or potential customer should easily recognizeyour higher degree of professionalism and knowledge. In the coming months and years to come, yourcustomers should have the confidence in your business and will be better prepared for your solution.

Texas Puts Landmark Alarm Legislation into LawGov. Perry signs SB 568, managing how municipalities will manage alarm ordinances

Austin, Texas – Texas Governor Rick Perry recently signed landmark legislation that establishes a frame-work for managing security alarms within the state, the Texas Burglar and Fire Alarm Association(TBFAA) announced. The bill, SB 568, outlines provisions for municipalities to follow when they developalarm ordinances or policies.

The bill contains significant provisions designed to drive down the number of calls to police to dispatch avehicle when an alarm proves to be inadvertent. Cutting down the number of these calls saves policeresources.

Three key features are included in the bill to help reduce the number of these calls to dispatch police:An industry equipment standard, called CP-01; an escalating fine structure when an alarm proves to beinadvertent; and Enhanced Call Verification (ECV), where the monitoring center places two calls to acustomer to determine whether an alarm is valid before contacting law enforcement to dispatch an offi-cer.

"We worked cooperatively with law enforcement and legislators to ensure these standards were put inplace to reduce unnecessary dispatches. This a landmark piece of legislation for the industry because itcreates statewide standards in Texas," said Malcolm Reed, Chairman of TBFAA's Legislative Committee.

"We appreciate the hard work and involvement of the law enforcement community, and the efforts ofseveral key legislators who believe in the benefits the legislation provides Texans. Everyone committedto the common goal of improving alarm management," said Rodney Hooker, former President of TBFAAand a member of the Legislative Committee.

The CP-01 equipment standard gives alarm users additional time to set the alarm and leave their homeor business, and additional time to enter the residence when entering. ECV -- placing two calls to cus-tomer to confirm a break-in -- has been demonstrated in several communities across the United Statesto reduce false dispatches.

Combined with an alarm permit system, which is also included in the legislation, escalating fines alsohelp serve to reduce false dispatches by creating a monetary incentive for the alarm owner to detectand fix errors. "We're pleased to see all these components included in the legislation. They are part of acoordinated, successful plan to address the core problems associated with false dispatches," said StanMartin, Executive Director or the Security Industry Alarm Coalition (SIAC), an industry group focusingon alarm management issues.

A statement clarifying legislative intent was also included in the conference committee report dealingwith a requirement mandating public input. It stated that the intent of the language in SB 568 is "toprohibit cities and municipal police departments from eliminating first response to consumer alarm sys-tems without first holding public hearings where citizen alarm users will have the opportunity to voiceconcerns or support with such a municipal ordinance or policy."

"We feel it is imperative as part of our country's dem-ocratic principles to include this public comment provi-sion, and are grateful to Senator Bob Deuell forinserting the statement of legislative intent," Reedsaid.

“Amnesty” for Late Individual RegistrationsNow is the time to ensure that all of your employees performing private security duties are properly reg-istered! Effective August 1, 2005 through October 31, 2005, late individual registration and commissionapplications received by the Private Security Bureau will not result in an administrative fine. You will stillbe required to pay the normal application and fingerprint fee on originals and the normal application feeplus the late fee on renewals.

You must submit the late original or renewal individual registration or commission application, includingthe Request for Amnesty form, by October 31, 2005 in order to avoid the administrative fine. AfterOctober 31, 2005, any late individual registration or commission registration received by the PrivateSecurity Bureau will result in an administrative fine.

You must use the most current version of the application forms. These forms are available on our web-page at www.txdps.state.tx.us. (Forms PSB-3a or PSB-38a or PSB-17) If you have any questions con-cerning forms or fees, please contact the Private Security Bureau License Section at 512-424-7710.

Please be advised that this does not affect late company license applications; nor does it affect criminalviolations committed by companies or individual employees. When calculating fees, please rememberthat effective September 1, 2005, registration fees will increase as set out in House Bill 2303 and sub-scription fees will be required on original applicationsas well as renewals.

How do you say you have had lots of fun, a few heart tremors, aclose call or two, but still enjoyed the ride? This will be the lastSouth Texas Alarm Association update from yours truly. At ourmeeting in September, we the STAA will elect a new set of officersto replace the current crew. I, as President, have enjoyed theexperience and wish the new set of STAA officers our best and willdo all I can to work with them to take the STAA to new heights inall areas. I’m sure I speak for all our officers.

The August 9 meeting found Rodney Hooker doing a power pointpresentation about the various changes in the our state law thatthe covers the security industry. As usual, Rodney did a great job.There are several very important changes that everyone needs tobe aware of starting on Sept. 1, 2005. Thanks Rodney. We alsohad as a presenter at the August 9 meeting, Mr. Stan Martin,Executive Director of SIAC, who gave an excellent presentation ofthe upcoming CP-01 control panel standards that go into effect Jan1, 2007 here in Texas. If you are an installing dealer, you need to make yourself aware of this changein the law. We thank Stan for his unbeatable stamina in working for the alarm industry and helping thevarious alarm associations deal with some very hard problems. Thanks Stan.

I wish to take a moment and thank Sandra Barton, our Secretary / Treasure for the past several years.She has done an outstanding job at a very thankless task of keeping the minutes, bank account, andmembership role up to date, and straight. When you see her, give her a big “Thank You”. She hasearned it and more. Thanks Sandra.

I want to thank Danny Little for being Vice President for us this year. Even through Danny was notasked to conduct a meeting, he was ready and willing to help in any way he was asked. I really appre-ciate his willingness to serve the STAA. Thanks Danny.

And last but not least, I want to thank you the security dealers of South Texas. I don’t think we willever find a better group of people to work with. These past few years as your President have been aneye-opener as to how well people can work and get along when they may hold different views on a sub-ject. I encourage you to continue to support the STAA, and take an active role in what is happening tothe alarm industry in South Texas. NFPA Gives Final Approval to 731, RejectsNBFAA Appeal

Aug 12, 2005, QUINCY, Mass. -- The NFPAStandards Committee has given its final approvalto NFPA 731 — Standard for Electronic PremisesSecurity Systems — and rejected an appeal bythe NBFAA to return the standard to committee.The ruling clears the issuing of NFPA 731 butalso opens up the process for last revisions tothe standard that will roll back standby powerstandards and remove entirely a requirement forshort-to-ground supervision.

NFPA 731 sets standards for the application,location, installation and performance of non-residential electronic security systems. Amongother items, 731 contains cabling specifications,mandates training and urges verification ofalarms.

In its Aug. 11 statement containing the ruling,the Standards Council was critical of NBFAA,saying it raised grievances late in the process.

Also in its ruling, the Standards Committee putthe revision cycle for 731 on a fast track.Instead of the usual five-year cycle before arevision, a new edition of NFPA 731 will beissued in early 2008.
