Failure to conduct an asbestos inspection by a certified asbestos inspection before renovation began. Used an unapproved method for removal of an asbestos containing material.

Concern Info Caller reports that there was recently a fire at the Summit Technology Campus at the Diodes FabTech location. Since the fire, work has been ongoing to repair the fire damaged areas. Floor tile, drywall, wiring, etc. has been removed before testing for asbestos. A pneumatic chipper was used to remove some of the floor tile. Also, holes are being drilled through the tile/mastic to run pipes into the basement.

An asbestos consultant was eventually hired, and the floor tile came back positive. Work has still been ongoing, and the caller is concerned that they will continue to remove building components improperly.

The building is managed by Cushman Wakefield. The local contact is Colleen Sliffe, whose office is located at the building. The building is owned by Cerner. Recently hired asbestos consultant is Nick's Inspection Services.

Air Odors Lee's Summit

Concern Info CP called in and said that the Lee's summit landfill is putting off a very strong odor in the newberry subdivision. They believe it is coming from the yard waste pile. They said on December 6, they came out from a school event about 7pm and the odor was very strong. Every since then, it has been lingering and today the smell is bad again. CP said that they are very concerned because it is December and think the odor should not be as strong this time of the year. CP said there is not a particular time that the smell gets worse, it can happen any time during the day.

Concern Info CP called to inform that the City of Rock Port has been burning at the compost pile more than what the burn permit allows. In the burn pile is trash, deer carcasses along with brush limbs. They have been warned twice for not following their burn permit, they do not put the fire out at 5 pm, they will leave it burning unattended and smoldering. The CP said that the burn pile has been burning now for 10 days. CP also said that she had called the city on Friday to remind them about following the permit and they told her not to worry about it.

I went to the property on January 24, 2017, and was unable to make contact with anyone. I also placed a phone call and did not get a call back.

I arrived at the property on February 22, 2017, and was able to make contact with Mr. Mack. Mr. Mack stated he hadn't burned since he was issued an NOV the last time we were there. A tour of his property revealed no signs of open burning.

Concern Info The concerned person states that Mr. Chris Mack and Mr. Art Mack are operating a salvage business in the back yard of their residence at 208 N. Maple in Skidmore Missouri. It was stated that the concern person has observed multiple burning events over the past year with dark black smoke that lingers for over an hour. It was stated that DNR had been to the residence on a similar complaint a year ago, and "fines" will given to the owners. The concern person believes the salvage burns wires, metals, and furniture for scrapping purposes. The concerned person stated that the salvage recently put a fence up around the property, and that because of this the burn pit can not be seen from the public walkways/roads. The concerned person stated the burn pit is in the back of the property by a large brush pile.

I live in the back of the neighborhood on Dalton Drive, and the smell this morning just hits you in the face. It's really bad this morning, and I wanted to have someone be aware of it.

No fugitive emissions were noticed during the investigation. I did notice some debris (grain) that appeared to be from Livestock Nutrition and had accumulated in the parking lot of the CP. Livestock Nutrition was in the process of replacing a valve that appeared to be faulty. This may have been the source of the debris.

The grain that has left the property is too big to be regulated by air pollution regulations. I referred the matter to North Kansas City Codes Enforcement.

A DNR employee spoke with Jason Watkins, Vice President of Watkins Litho, a few months ago regarding debris from the feed plant across the street from our building. The problem seems to be getting worse as cars are covered when we leave work in the afternoon. We’ve spoken with Garvey Nutrition multiple times, but this has continued to be an issue for 2 years now.

Weather conditions = 65 degrees Fahrenheit, 34 percent humidity, wind south at 15mph, clear sky.

I drove around the facility on Stockyeards Expressway, Bluff View Drive, and SW Lower Lake Road with the windows down. I could not detect any smell. I contacted the facility to let them know there had been an odor complaint submitted, but I did not detect any odors. Triumph already has plans to modify existing control devices to further ensure compliance with odor regulations.

From the plume, the caller believes it was tires that were burning.

Concern Info Caller reports that on August 13, 2016 a building in Hannibal burned, which also caused damage to his building (knocked hole in wall). He cannot address the issues in his adjoining building until the asbestos in the burned building is addressed. (Note- visible on Google Street View- burned building is adjoining Banquet Rialto Center, decimal degrees 39.707495, -91.360520)

Caller is concerned about the asbestos in the building. Nothing is being done to remove or address it and no demolition has been scheduled. I informed him that we could address how it was removed, but did not have authority to say when it must be removed.

Caller is also concerned about material leaving the property. He reported that some material was leaving the property at times.Caller is concerned about people entering the building through the back entrance and pulling out copper and other salvage with asbestos present.

Caller stated that the owner does not have any money to address the issues at the site and he has heard that she may be collecting donations for that purpose. He stated he called the city manager and was told that there was nothing they could do.

Caller requested the inspector call him so he could meet the inspector at the site.

Concern Info Caller reports that Danny Sapp owns a woodworking business and frequently dumps and burns sawdust in a hollow. On Friday, February 10, 2017 around noon he lit the sawdust on fire and it got out of control and burned several neighbor's properties, the story was on KMIZ (http://www.abc17news.com/news/outside-fire-burns-50-acres-in-boone-county/325438507). The caller was unsure if any other items than sawdust were burned, or where the exact location of the sawdust pile was. The fire department responded to the fire.

Concern Info Caller reports that Wayne Gutting near Neeper (south of Kahoka) burned a field, then is currently burning brush piles on CRP land from a fence row using used oil to get the fire going. The site is located about a mile south of Neeper on Rt. D near a gravel road (possibly 180th Ave.). It should also be near the Rt. D/Rt. A intersection. Caller is concerned about health issues from smoke and is tired of smelling smoke. I informed him that agricultural burning was generally allowed as long as they didn't burn prohibited materials in the brush piles. Ms. Karen Gaddy stated that she was not aware of the requirement to conduct an asbestos building inspection; but would have one done. This is a violation of the Missouri Air Conservation Law at 10 Code of State Regulations 10-6.080 Emission Standards for Hazardous Air Pollutants adopting by reference Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos. Mr. Mark Bonney conducted the building inspection on January 10, 2017, as a state-certified building inspector. There was no asbestos found to have been disturbed 120 square feet of undisturbed flooring was found in two bathrooms. A Letter of Warning was issued for this violation.

Comments At the time of my investigation, the cement kiln id (induced draft) fan duct work had been temporarily fixed. The involved area of the duct work was partially blocked by a metal brace. Moreover, the repair was complicated because the duct work has been worn thin over time. The duct will be replaced during a major shutdown scheduled for mid-February of 2017. The new duct will be lined to help protect it against physical wear (abrasion) and chemical wear (corrosion). The mid-February outage is the facility's normal annual outage. Per facility personnel, the ductwork might be replaced sooner if there is an unscheduled shutdown prior to the planned mid-February outage. A similar problem occurred before (in May of 2016) per the maintenance records that are kept in an Oracle maintenance database system. Since this facility is a major source of hazardous air pollutants, it is regulated under two maximum achievable control technology regulations these are Title 40 code of Federal Regulations Part 63 Subpart LLL---National Emission Standards for Hazardous Air Pollutants from the Portland Cement Manufacturing Industry and Subpart EEE---National Emission Standards for Hazardous Air Pollutants from Hazardous Waste Combustors. These subparts require, in part, that the facility abide by state approved plan(s) for startup, shutdown, malfunction, and operations. This duct work repair will necessitate that the cement kiln be taken offline. The shut down of the kiln requires a cool down prior to the repair. This cool down is a 48 hour period of time. Additionally, the startup of the kiln requires a 24 hour preheat period before the kiln can restart. This makes any shutdown expensive, since the cement kiln is offline and not producing clinker. I returned to the facility on February 16, 2017, which was during the kiln shutdown. The ductwork had been removed by contractors as had several other areas of ductwork some new replacement ductwork was on site. Mr. Backfisch forwarded two photographs on February 16, 2017, one of which detailed additional repair work that had been done to patch the leaking duct area after my initial visit. The second photograph showed the removed section of duct.

Comments The environmental concern was investigated on January 19 during normal business hours. I observed the property to have significant amounts of open dumping of solid wastes and wastes left from burning. No one was at the property during the visit nor did anyone respond from within the house to my use of the vehicle’s horn. There were numerous piles and scattered areas of wastes on the property that appeared to be greater than 30 cubic yards in volume.

On January 20 I contacted Thomas and Nancy Grindstaff by telephone and left them a message to contact me to discuss the illegal solid wastes that were dumped on their property. After not receiving a return telephone call, on January 23 I tried again to contact them. In response to again being prompted to leave a message, I alerted them that I would soon be sending them an enforcement letter for the illegal dumping on their property.

On January 24 Thomas Grindstaff contacted me and verified that he had received my telephone messages. He was cooperative during our discussion and stated that he was going to see to it that the property is cleaned up and that further illegal dumping and burning of solid wastes will cease.

On January 24 a Letter of Warning was sent to Thomas and Nancy Grindstaff for violations of the Missouri Solid Waste Management Law and regulations. The Grindstaffs were given a 30 day deadline to complete the cleanup. Additionally, a copy of the report was sent to the Pulaski County Commission and Pulaski County Sheriff’s Office due to the apparent littering of wastes from this property onto the county roadway and neighboring property.

Mr. Zweerink stated that the RP has been burning for several days and it is blowing all over the place and is concerned about the RP burning down neighboring properties. Mr. Zwerink does not know who lives at this property or who owns the property.

He denied burning any tires off rims. He said he had been burning house hold trash and items to clean up his yard. He allowed photographs of the two burn sites in his yard. In one burn pile I did observe what appeared to be a small ATV/Lawn mower size tire residue. There were two rims in the front yard but they did not appear to have been burned.

Mr. Womble was provided the fact sheets for management of scrap tires and open burning. He stated that he would make sure that there were no regulated wastes in his burn pile.

Comments On February 1, 2017, I drove by the location given. The apparent house had been the subject of a siding removal. The apparent transite siding was in back of the house neatly stacked with some other building materials such as brick. The house is located in a residential area. The location is a house or single dwelling building. It is exempted from Title 40 Code of Federal Regulations Part 61 Subpart M---National Emission Standard for Asbestos because of the definition of facility in the rule. Specifically, the definition of facility excludes residential buildings having four or fewer dwelling units. Since a building having fewer than four dwelling units is exempted from the definition of facility, it is excluded from the inspection, notification, and other requirements of the rule. I spoke to the building co-owner and he stated that the apparent transite siding had been removed to reduce the price of homeowners insurance. Additionally, he stated that the apparent transite siding would eventually be taken to Rich Woods (i.e. Timber Ridge Landfill) for disposal. Additionally, he stated that the siding had not been sampled and analyzed for the presence of asbestos. I requested that he proceed as if the apparent transite material contained asbestos and send it to a landfill for disposal. I left him two copies of the fact sheet: Management of Nonfriable Asbestos-Containing Materials, Fact Sheet--PUB2156.

Comments On 2-1-2017 I visited with Mr. Chuck Holbrook from Manac Trailers. He said they had not been burning. I walked the perimeter of the work site and did not observe any signs of open burning. Trucks entering the job site were causing some dust, but no violations of particulate matter across the property line were observed. Mr. Holbrook said that Manac would water the entrance to help prevent any dust issues. I then drove to the area on Cowan Street and observed that the ditch along the street had been burned. Also, one yard on Geneve Street appeared to have been burned. I contacted the Oran City Hall and spoke to the City Clerk who stated that they were aware that there had been a fire but that it was not intentional. They were not sure what caused the fire. I informed the City that they could not burn. I also spoke with Mr. Gregg Ourth, Oran Chief of Police. Mr. Ourth stated that the fires were accidental. He said that he would inform the High School that the large pile of tree/vegetative waste could not be burned. Residential burning of yard waste conducted by homeowners is not regulated by the Dept. I spoke with the Cardwell City Clerk and eventually contacted Mrs. Anice Beasley who now owns the property with her husband, Mr. Harvey Beasley. Mrs. Anice Beasley stated that some moldy old clothing and some rotten wood waste from the demolition project had been open burned for disposal. I informed Mrs. Beasley that demolition wastes cannot be open burned for disposal. Mrs. Beasley stated that they would cease all open burning on site and would utilize another method of waste disposal when the demolition project recommences. Comments Received two concerns about the same quarry. The other concern stated the children attending the local school could not go outside to play.

I stopped at the Jackson School District North Elementary School and spoke with the Principal Dr. Lance McClard. Dr. McClard stated they have not had any dust at the school from the quarry nor have they had any issues with the quarry. He stated they have only had one incident where they were able to feel a blast and it only rattled the windows.

I proceeded to the facility and investigated the concern. Strack Stone has applied water to the haul roads. The haul roads are adequately wet. Strack Stone has applied a average of three (3) loads of water daily when operating. The water applied to the haul road is taken from the storm water retention basin and Hubble creek. Strack Stone has a permit to take water from Hubble creek from the Army Corps of Engineers as required.

Strack Stone purchased 105,901 gallons of water from the Cape Girardeau Public Water District last month. They only have one toilet and one hand sink attached to this water source. They use bottled water for drinking. The spray bars on the equipment and the Dust Boss® are attached to this water source.

Comments On Friday, February 10, 2017 I was informed by my supervisor Amy Baker, Supervisor Air Pollution and Hazardous Waste Unit that she received a concern that Pallet Connection and Farms LLC was open burning pallets at their residence on CR 524 in Scott County. Rick Pretz, Environmental Supervisor Solid Waste Unit, and I went to investigate.

Upon arrival we observe a pile of ash that was still open burning in the area where open burning was reported to be occurring. Photographs taken. We could not determine the contents of the ash pile. However it was noted by Mr. Pretz it was household waste pick up day and all the homes along CR 524 had the waste bins still setting on the street side. Photograph taken. We did not make contact with the residence of the property because we could not determine the contents of the fire.

Comments I investigated this concern on February 16, 2017. There was a very strong ammonia type odor outside the entrance gate to Buckman Labs at 9:55 a.m. on 2/16/17. I could not however detect the odor with use of the nasal ranger. I then drove down Hwy 47 from Buckman about 1/8 mile and could detect a slight odor at 10:08. There was a faint odor in the air at the post office about 1/4 mile from Buckman at 10:12. I then drove down County Road 421 and there was a faint odor in the air at 10:16. I then drove back by the entrance to Buckman and there was a strong odor detected with the van windows up from Highway 47 at 10:18. There however was no odor detected at the railroad crossing just NW of Buckman down in the valley. The odor was traveling east and southeast of the facility at the time of investigation. The weather conditions recorded were 52°, Sunny, Wind SW @7mph, & 37% Humidity.

I then visited with Mr. Scott Lamb, Safety, Health and Environmental Manager of Buckman Labs about this odor concern. We went to the control room and was informed that two blow downs of the cooling tower had been done that morning already. These cooling tower blow downs are done 2-3 times/day in which they refresh the water with cooler water. They normally treat with storm water or treated water, but will do a complete cool down instead of just a couple ft. deep with fresh water and see if this helps with the odor that was detected. No production abnormalties have been recently recorded to aid in any odors of concern either.

Mr. Lamb sent an email later in the day with the following information. "I did a bit more follow up regarding the odor issue after you left today. This morning between 7 and 9 we completed product loading for a new material called Bulab 5111. Our Maintenance Manager and one of our Material Handlers stated that there was a pungent odor during the tank truck loading procedure. It was not part of our original procedure to vent this activity to the thermal oxidizer because there are no hazardous components associated with the final product, however, we are looking to change this due to the potential of odor. I don’t necessarily believe that this contributed to the odor you detected this morning, but it is a remote possibility."

No further investigation on this concern at this time. The facility is making a few changes as stated above to correct or aid in minimizing detectable odors.

Concern Info (SP #11417) CP stated the chemical smell is really bad making it hard to breath. He stated he has called several times before complaining about the harsh smell. CP also stated EPA or someone brought out meters and checked the air and didn't find anything. He was told it could have been due to a main water vacuum pump. CP stated he wasn't buying it they were covering for Buckman. (Concern #17906, SharePoint #1638, 3/19/14, conclusions mentioned this issue.

Comments This is a compositing and shingle recycling site owned by Hansen's Tree Service. It has been at this location for 12 years and employs 5 people. Regular working hours are from 7 am to 4 pam Monday through Friday. The facility is located on Kemmar Court approximately quarter a mile west of the intersection of Hoof Road and Kemmar Court in the City of O'Fallon. Nearby business include Sherman towing and K and P Precast.

The nearest residence houses are about quarter a mile away east of the property. There was no odor outside of the property line at the time of the visit. I made a tour of the property with Mr. Jeff Schneider, Recycling Manager and observed composting and shingle processing sites. The shingle processing/(grinding) unit was not operational. There was bad smell (rotten egg like smell) coming from the old composite pile which was being aerated. Compost piles normally are kept on-site for 6 to 12 months to give time for decomposition of organic matter. Mr. Schneider stated that the facility stops operations like aeration on windy days especially in mornings hours of hot summer days to reduce odor.

Mr. Schneider that they contacted St. Peters Recycling Center to learn ways of composting with no or less odor. There is a common understanding in such operations that at times if the green material is isolated from the brown material, it will start to decompose incorrectly and will start to give off a bad smell. If this occurs, the compost pile will smell like sewage or ammonia. I indicated that fixing this is may be a matter of mixing the pile a bit better. Proper care of a compost pile, such as turning it regularly and keeping greens and browns in balance, may help keep compost pile from smelling.

Concern Info Terry Ball's Initial Interview:After arriving at the fire, it was apparent that the demolition debris came from an old home that has stood on this location for many years. The address of the location is or approximately is 26 Langston Lane, High Hill, MO 63350. I exited my car and took a couple of photos of the fire and debris piles from the north side vantage point. The daylight was fading fast at this time. I then walked around the east side of the debris piles and met up with Mr. Joey Lansche. I identified myself and gave Mr. Lansche one of my business cards. Mr. Lansche asked if a report had been called in and said that he had contacted the fire department earlier today to alert them that he would be burning. I advised him that the fire had caught some attention and I was here to check on what was happening. Mr. Lansche again repeated that he had called the dispatcher to advise that he was going to burn the old house down. I asked him what their response was and he said that they didn’t tell him not to. I asked who he specifically had talked with that may have given him permission, he said that he just talked with a female dispatcher who answered the phone. Mr. Lansche said that he thought it was OK to burn the old house and that he would not have torn it down if he knew he couldn’t burn it. I advised him that it was NOT ok to burn the home and that MDNR would not allow the activity if they had known about it beforehand. I also advised that local fire departments really do not have the authority to permit the burning either. I told him that the reality is that it does happen on occasion, but it is not a lawful or permitted practice. Mr. Lansche countered that he believed there were certain counties around where burning was ok. I advised him that brush burning is allowed but burning demolition waste is not permitted anywhere.

He stated that usually in the evening time, large plumes of dust comes out of the top of their grain bins and a lot of times, covers his car and yard with grain dust. He thinks that either they need to replace a baghouse filter or they have mechanical problems with their baghouse that they are not repairing. Mr. Wilson says that he has left the dust sit on his porch table so that we can take samples if we want. Comments I conducted a site visit on January 24, 2017 at 1:57 P.M. Mr. Chupp took me to a dumpster where he stated burning took place in the past. I noticed unburned particle board in the dumpster, and then explained the open burning regulations for wood waste to facilities. I stated that treated wood such as particle board and chip board are illegal to be burned because of the hazardous materials they are treated with. Mr. Chupp stated the past burn sited above was only to reduce the amount sent to the landfill, and that he had plenty of space in his dumpsters to get rid of the scrap wood, even the wood that is untreated. Any material from the previous burn has already been disposed of in the dumpsters located on site. I provided the facts on open burning, and an application to open burn with the facility if they decide to open burning in the future.

Comments A site visit was conducted on January 30, 2017 at the location of County Road 2212, Cassville, Missouri. Upon arrival I met with Mr. Tracy Lannum. Mr. Lannum was standing in his driveway near his Chevy S-10 pickup when I drove up. I spoke to him about the concern and advised him of the Missouri Solid Waste Law and how it would pertain to his situation. As Mr. Lannum and I looked around the property and I did not see any violations at the time. The concerned party states that several mattresses were being placed on a burn pile. I was unable to locate the mattresses or a burn pile.

Twelve pallets and a pile of hardwood flooring was observed near Mr. Lannum's RV. The hardwood flooring had an old tarp across it. Mr. Lannum stated the pallets were going to be used to make his grand-daughter a tree house. A garbage bag of household trash was seen in the bed of his s10 pickup. I advised Mr. Lannum not to burn any furniture, mattresses, or anything else that is not considered household trash. No further action is requires at this time. No violations found so no photos were taken.

Comments Upon arriving at the site I spoke with staff and informed them of my investigation. The owner was called by phone and I was given permission to access the site. Mr. Pat Applegate accompanied me on the site tour. Mr. Applegate was not aware of any issues with the lagoon. He believed the lagoon was built in the 1970s. The lagoon was surrounded by thick woody vegetation. The lagoon is roughly 100 ft by 80 ft. The lagoon had plenty of freeboard and there were no signs of overflows. On the west side of the lagoon I noted a small pool of water in a low spot. The water was clear unlike the water in the lagoon which was black. I detected an odor while standing next to the lagoon, however off the site the odor was not detected. In 2003-2004 the unpermitted lagoon was brought to the attention of the department. A schedule of compliance was sent to the then owner in regard to permitting the lagoon and or closing the lagoon and connecting it to the City of Ozark's sewer system. The SOC was not signed and no follow up was conducted. I spoke with the City of Ozark who confirmed that a sewer line is adjacent to the property, roughly 480 ft. A Letter of Warning will be sent to the owner along with a schedule of compliance to either connect to the City of Ozark or permit the lagoon.

Comments Site visit of the property at 11:52 A.M. on February 16, 2017. The address was 808 North Washam Clean fill is all that remains of the home at this location which is under the ownership of Mr. Cotton Hall, who I met while photographing the area. The second and most recent location was at 608 North Washam where the lot is completely vacant and no evidence of burning was left. I was unable to find any charred earth or ashes at this location. I spoke with Mr. Bruce who is the Chief of Police at Miller MO. He stated that a fire training occurred at the property of 808 months ago and that the home was stripped of everything before the training occurred. He also stated that the second property had a mobile home that was broken down and scrapped. I informed him of the asbestos regulations and requirements as well as handed out guidance documents on open burning, demolition waste, and asbestos. I also noted a small burn pile that the new owner of 808 Washam had on the property. I informed Mr. Bruce that some items in that pile were regulated and that it should be cleaned up by the new owner. Mr. Bruce told me he would have him clean the burn pile up as soon as possible. Mr. Bruce seemed to know who called in the concern even when it was anonymous and stated that he is currently in a lawsuit against this person for testifying against him to have him removed from the city council.

Comments Rock crusher has only been on site for a month, and the machinery is located approximately 100 to 200 feet from the property line of the neighboring business. Rock crusher was not in operation at the time of investigation, and no definitive proof that dust came from the crusher itself. Walked the perimeter of the property to look for evidence of dust leaving the property. Talked with the co owners of the company Mr. Doug and Derik Stokes. They told of plans to buy more land from the neighboring property to move the machines further away from the property line to ease any problems that may arise. However this is sometime down the line as the purchase of that property is expensive. Mr. Stokes explained that they only run the machine when the winds permit it and it would not be blowing towards the neighboring property to keep it on site. He also said that the machine is equipped with water jets to suppress the dust coming off the machine. No violations at the time of investigation.

Concern Info Caller reports illegal burning of hauled in materials; fumes are noxious and may be contributing/causing health issues. Party is burning a good deal of the time, most active on weekends when the park owner is away but was burning last night (2/14/2017).

Caller notes the following: alleged source is a volatile person, actively carrying a weapon and is very paranoid. Other parties involved in the burning include someone that is either an active member or previously employed by the Forsyth police department. Caller believes the burning may be to cover up odors from possible meth manufacturing. Also suspicious material burned may have been marijuana waste from a grow site.
