RE: REGIONAL GROWTH STRATEGY BYLAW NO. 1615.01,2016FORMAL REFERRAL

Enclosed for your local government's consideration of acceptance is "Regional Districtof Nanaimo Regional Growth Strategy Bylaw No. 1615.01, 2016". The LocalGoveniment Act (Section 436) requires proposed regional growth strategy bylaws to bereferred to affected local governments (member municipalities and adjacent regionaldistricts) for acceptance after holding a public hearing and before the RDN can consideradoption of the bylaw.

The RDN Board gave first and second reading of Regional Growth Strategy Bylaw No.1615.01 on March 22, 2016. A public hearing for the Bylaw was subsequently held onApril 13, 2016. On April 26, 2016, the RDN Board accepted a report summarizing theproceedings of the public hearing and directed staff to refer the Bylaw to yourjurisdiction for consideration of acceptance.

Each affected local government is requested to respond to the regional growth strategybylaw by resolution. Upon receipt of this referral, each affected local government must:

1. Review the proposed RGS Bylaw No. 1615.01 in the context of any officialcommunity plan for its jurisdiction, both those that are current and those that arein preparation, and in the context of any other matters that affect its jurisdiction;and

2. Within 60 days of receipt of the referral either:a. Accept Regional Growth Strategy Bylaw No. 1615.01 as presented; orb. Respond by resolution, to the RDN Board indicating specifically the

reasons your local government refuses to accept.

Failure to accept the proposed RGS Bylaw No. 1615.01 or respond with specificobjections within 60 days of receipt of the referral will deem your local government tohave accepted the proposed RGS Bylaw No. 1615.01.

Should your local government choose not to accept the proposed RGS Bylaw No.1615.01 as presented, you must identify, by resolution, the reason for your objection. Ifa local government objects to RGS Bylaw No. 1615.01, the process is then taken overby the Minister of Community, Sport and Cultural Development who will determine theform and nature of efforts to resolve the matter. The disputing parties (the localgovernment that objects and the regional district and other impacted local governments)must share equally all costs associated with the process imposed by the Minister.

An affected local government does not have to accept any delegation or submissionbefore passing a resolution in relation to the bylaw, but it may choose to if it considers

that appropriate. If an affected local government accepts submissions or a delegation,the delegation or submission must be limited and relevant to the context within whichthe local government is permitted to comment.

Re: Regional Parks and Trails Service Area Amendment Bylaw No. 1231.05,2016

The Board, at its regular meeting held April 26, 2016 amended Bylaw No. 1231.05 whichrequires participating area approval (copy attached). This bylaw proposes to amend theannual requisition collected by parcel tax for 2016 and no longer sets a parcel tax ratefor years 2017 and onward. The Board has referred Bylaw No. 1231 to staff foralternatives for the 2017- 2022 parcel tax increases.

As part of the approval process for the amended bylaw, the Regional District requiresthe consent of at least 2/3 of the local service participants. As the District of Lantzville Isa participant in the local service. It would be appreciated If your Council would considerendorsing the following resolution as its next meeting:

A BYLAW TO AMEND REGIONAL DISTRICT OF NANAIMOREGIONAL PARKS AND TRAILS SERVICE AREA

CONVERSION BYLAW NO. 1231

WHEREAS the Board of the Regional District of Nanaimo wishes to amend "Regional District of NanaimoRegional Parks and Trails Service Area Conversion Bylaw No. 1231,2001";

AND WHEREAS at least 2/3 of the service participants have consented to the adoption of this bylaw inaccordance with section 349 of the Local Government Act;

NOW THEREFORE, the Board of the Regional District of Nanaimo, in open meeting assembled, enacts asfollows:

1. Citation

This bylaw may be cited as the "Regional Parks and Trails Service Area Amendment BylawNo. 1231.05, 2016". ^

2. Amendment

"Regional District of Nanaimo Regional Parks and Trails Service Area Conversion Bylaw No. 1231,2001" is amended as follows:

(1) By deleting Section 7 and substituting it with the following:

PURPOSE

To provide Coimcil with copies of Public Reports for the Climate Action Revenue Incentive Program(CARIP) regarding the District's climate actions and carbon neutral progress during 2015.

BACKGROUND

As a signatory to B.C. Climate Action Charter, the District is eligible to receive a grant approximatingthe amoimt of carbon tax paid on fuel purchases in the year. The 2016 grant, based on 2015piuchases, is estimated to be $900. A requirement of the grant is to report publicly on the District'sactions to reduce greenhouse gases (GHG's) and energy use and also its progress on achievingcarbon neutrality.

DISCUSSION

Attached is a copy of the report prepared by staff from a survey template provided by the Province.This is made public by posting it to the District's website as well as having paper copies available atthe District office for viewing.

The District achieved carbon neutrality for 2015 because of om participation in the organic wastecollection program. The Regional District of Nanaimo assigns to the District our share of GHGemission reductions from this program. These are used to offset the Districf s GHG emissionsgenerated from District operations. Emissions and energy usage are accumulated using SmartTool, adatabase program developed by the Province for use by municipalities in tracking their GHG's.

Local governments can achieve carbon neutrality by measuring and reducing emissions, bypurchîng carbon offsets to compensate for their greenhouse gcis emissions or by developingprojects to offset emissions.

There are no direct financial implications to this reporting, except to note that the reporting isrequired to remain eligible for the CARIP grant eacli }'ear. Purser, because the District is carbonneutral as a result of its operations in 2015, there is no requirement to purchase offsets.

I am touching base to let you know that we have completed a concept design as well as budgeting for the Bike Park area.

We tried to provide as many different ride options and feature diversity as possible with available budget.

At this point I have created a design that is about $10k-$12k above $32k to reflect potential contributions from themaintenance department, base prep, organic removal, bridge materials and bridge construction. The remaining $32k isdistributed between materials (dirt), logs, labour, specific machines travel and housing. There is flexibility within the budgetand design to adjust for In kind donation or for simply coming to the table and building a certain feature for dollar valuewithout any support.

I have included the 'LOI' (letter of intent) that has part of the design embedded in it as well as included several 'key' shots ofwhat the park is going to look like. The costs and prices section in the LOI is highlighted so that we can confirm the value ofthe park (in case you got more funding) and I can explain the methodology of your design and budget. If you are still keen tomove forward, lets touch base yla voice and go thru the LOI and once we have signed I can send you the budget breakdownsand more design specific information.

We are current with WCB and carry $5 million general liability and $1 million in Errors and Omissions.

The Council of the District of Lantzville in open meeting assembled, enacts as follows:

A. "District of Lantzville Regional Parks and Trails Parcel Tax and Assessment RollPreparation Bylaw No. 56, 2007", is hereby amended by adding the parcel taxamount as follows:

7. The Parcel Tax imposed under section 2 of this Bylaw shall be at thefollowing rate:
