Dear Dr. Handrahan:
On October 13,2009, this Office received your third request to investigate ElizabethStout, Esq., the Guardian ad litem appointed to represent the interests of the child Mila Malenkoin PORDC-FM-2008-51 O.
In my letters to you dated February 27,2009 and June 17,2009, I informed you that "thisOffice does not have authority to review or act in any pending case." (Emphasis added.)
Upon inquiry, the Portland District Court has informed this Office that active litigationremains in your case. As in my prior correspondence, I must unfortunately remind you of RuleII(4)(a) ofthe Maine Rules for Guardians ad litem that reads, in part, as follows:
"The Chief Judge will not take any action with respect to, or initiate areview with respect to, a complaint arising from a pending case."(Emphasis added.)
Therefore, I must again inform you that since the matter remains a pending case, thisOffice is without jurisdiction to act, and therefore no further action will be taken.
