Today’s challeng-ing economy and market liberalisa-tion are transform-ing UK legal ser-vices. For example, because Alterna-

tive Business Structures now al-low non-lawyers to deliver legal services, the pressure is on law firms to compete with dynam-ic market entrants, both on price and service. To do that, they re-quire IT systems and tools to en-hance their efficiency and busi-ness agility. Fortunately, there’s a range of IT options available from off-the-shelf to bespoke software and systems that allow users to create workflows for particular processes (useful for firms that handle complex work which does not always lend itself to tight process management).

Accessible and flexibleThen there’s cloud comput-ing. Cloud — or managed ser-

vices delivered online — is level-ling the legal IT playing fi eld as its subscription model allows small

and mid-sized fi rms to access IT that previously required upfront investment. It’s why we are seeing increasing numbers of mid-mar-ket fi rms outsourcing their entire infrastructure to the cloud.

As long as there is a reliable in-ternet connection, the benefits of cloud are clear. Services are acces-sible, flexible and need little or no on-site infrastructure or mainte-nance. Yet there are well-docu-mented challenges with this plat-form too, including data security and privacy concerns which have hindered take-up in the past. And, of course, a subscription model does not necessarily reduce costs. A service that produced major savings over three years might be more expensive in the long run than a point solution. The right choice depends on a firm’s size, profile and IT needs.

There is plenty more to come. Around 50 ABSs have so far been licensed, with around three times that number working their way through the system. They range from small law fi rms that sim-ply want to bring a non-lawyer staff member into partnership, to some of the country’s best-known brands that see an opportunity in adding legal services to their of-fering (the AA and Saga have their applications in; Direct Line will do so soon).

Adapting to changeAlongside these has been a plethora of other innovative businesses that do not require the new ownership rules — such as QualitySolicitors

and Stobart Barristers — but have been encouraged by the ‘mood mu-sic’ of ABSs to think that now is the time to try something diff erent.

Most of these new businesses fo-cus on consumer legal services, but by no means all. What they have in common is, to put it broadly, a con-viction that clients are currently on the wrong end of a costly, ineffi -cient and poorly delivered service, while at the same time demand-ing ‘more for less’. So many seek to off er fi xed fees backed by stream-lined systems and technology.

Future trendsWeb-based services are rapidly on the rise, to be fuelled shortly by the entry into the UK of LegalZoom — the best-known legal brand in the US — and Google-backed Rocket Lawyer, both of which al-low users to build their own legal

documents and, if they want, have them checked over by a lawyer.

Stripping out the process refl ects one of the big themes of these re-forms. You don’t need to pay a law-yer to put together boilerplate in an agreement, but you do need to pay for advice, based on their specialist training and experience, on the gen-uine legal points that arise from it.

Some lawyers are adapting, some remain confi dent in their current business model, some are panick-ing. Many still question what the entry of nakedly commercial enter-prises into the law will do for ethical standards, and it will be for the reg-ulators to ensure that ABSs main-tain proper professional standards. ABSs are wrongly termed ‘deregula-tion’, when in fact they will be regu-lated as much as any law fi rm.

The rate of activity in last couple of years has been amazing. If Bill Gates is right, that less happens in two years and more happens in ten years than you might think, then the legal world of 2020 will be a very, very diff erent place.

More and more legal work is being done on fixed fees at the clients’ in-sistence or to budgets which will ul-timately be monitored by the courts. This provides an incentive for the law firm to deliver efficiently. Addressing efficiency involves looking in detail at the way work is done and challeng-ing long-established approaches.

In a naturally conservative profes-sion — and one whose existing ways of working have been remarkably profitable for many decades — this can be difficult and it often requires a third party, untainted by internal politics, to ask the difficult questions and suggest new approaches.

These approaches may include delegating some of the work to people at lower levels of qualifica-tion (or with no legal qualification at all), whilst providing those peo-ple with the necessary know how, so that they can work effectively and identify any issues that should be raised at a higher level.

Those people may be within the firm, they may be in a different, low-er cost, location or even in a separate organisation such as a legal process outsourcing company. There may also be opportunities to use tech-nology to streamline or even auto-mate some aspects of the work.

Delivering valueAlongside this analysis, a broad-er dialogue is opening up between law firms and their clients about how the service is delivered. Whereas in the past clients got the

service they were given — large-ly because there was little choice of alternative offerings — clients are now more interested in wheth-er their lawyers have a systematic approach to their work, often com-menting on lawyers’ poor project management. They want to see that their lawyers recognise the need to deliver value for money.

Sometimes lawyers are sur-prised by what their clients val-ue (and what they don’t). The out-come is not always a reduction in fees — the elimination of wast-ed time in one area may be coun-terbalanced by a greater focus on something else (such as planning and thinking ahead) or a particu-lar approach to considering like-ly risks. Working with the client to identify what matters to them can result in a much improved client relationship.

How can law firms address the challenges of the current marketplace?In the last three years, law firms have faced a downturn in the overall volume of work, coupled with rising demands from clients, competition from potential new entrants to the market and a squeeze on margins. One response has been to cut back-office costs, but there are limits to this. You can’t save your way to riches. Other firms are successfully re-thinking the way they deliver their services.

■ Andrew Powell, Director of IT at law firm Nabarro, is keen to define the word ‘cloud’ because it’s a term that means different things to different people. To some it’s a third party data centre that’s open to all and could well be — perhaps worryingly — storing company infor-mation on servers in, say, Asia (public cloud); to others it’s a company’s own easily upscaled data bank securely lo-cated on-site (private cloud).

“I’d extend public cloud to mean an environ-ment that sells its services to anyone,” says Powell, “so, therefore, anyone can have ac-cess to the same infrastructure that holds my data. By that defi nition, with the exception

of email fi ltering, we don’t use public cloud at Nabarro for core data sets.”

In fact, the vast majority of the fi rm’s da-ta is currently kept on premises. “We creat-ed the environment — into which we put our core services — to be scalable. We now have all the benefi ts of agility, fl exibility, expan-sion and provisioning that goes with cloud.” Nabarro’s cloud took six months to build and migrate into and went live four years ago. The fi rm has complete control of it.

From an IT perspective, one of its main advantages is easier capacity planning. “It’s useful from a budgetary point of view,” says Powell, “because it’s relatively easy to predict growth requirements and means I can provision servers quickly.” In

the future, there is “every chance” that Na-barro’s own infrastructure will move to a third party data centre.

But what has private cloud meant for the fi rm’s own productivity? Powell says this is hard to gauge. “What I would say is that our uptime has improved, and I think our ability to bring services online faster has improved as a result of a cloud-based o� ering. Sta� and clients probably get a better turnaround from us… although they don’t want to know the detail. Cloud or not is irrelevant — they only want to know it works.”

■ The problem with big data, says Paul Caris, CIO of international law firm Eversheds, is that it’s very dif-ficult to explain what it can actually do for a client. Essentially, though, ‘big data’ is the analysis of very large data sets to produce intelligence — without knowing what it is you’re looking for.

“It’s about finding trends or interesting things happening within data that moves you away from the surrounding ‘noise’,” says Caris.

“With big data you have to go in believ-ing you are going to find a trend that would never even have been thought of. You come out the other end with visual data that al-lows you to drill down to the detail.”

■ Last year, law firm Maclay Murray & Spens (MMS) began giving company iPads to their partners in order to help them become more flexible and mobile. This isn’t part of the increasingly popu-lar Bring Your Own Device (BYOD) cul-ture, says Crawford Hawley-Groat, IT Director at MMS. Instead, this is a Mo-bile Device Management strategy.

“The devices are owned by the fi rm and we have full right to see everything on them,” he says. “We have far more control. It’s an impor-tant distinction. With an employee-owned device, we’d give them access to their email — but we have no plans to ever go past that.”

There was some pressure from the fi rm’s em-ployees to have mobile devices — but, really, says Hawley-Groat, it was more about provid-ing better technology to enable working on-the-go. From a corporate IT-support and con-fi guration perspective, a wide range of brands wasn’t feasible, so Apple products were exclu-sively chosen. “I’ve never been a big fan of lap-tops,” says Hawley-Groat. “I think there are too many data management issues with them. When we found out what the security model of the iPad was, it took o� .” All devices lock within fi ve minutes of not being used and have com-plex passwords. Lost devices can be located via its GPS capabilities and/or wiped remotely.

Recently, MMS have been giving employees iPhones too. “From an IT point of view we have in-creased costs,” admits Hawley-Groat. “And it does pose a number of challenges: for example, there’s an expectation that everything that works in-ternally will work on an iPad — and that’s not al-ways the case. “But the users are very happy with them. The iPads have larger screens, so for law-yers who are reviewing documents that’s a sig-nifi cant benefi t; plus our partners using iPads in meetings are pleased by the reactions they get. They are seen as being a step ahead, able to access more information and work more e� ciently.”

Eversheds can find out what people are saying about a brand, company or organ-isation on a social media platform such as Twitter. “A series of algorithms takes all tweets related to a subject or hashtag,

works out whether they are positive or negative and then aggregates the data to come up with a trend,” says Caris. “This can be broken down by continent, country and even district to reveal that, for exam-ple, there are lots of positive tweets about a brand in the south of England — but ma-ny negative ones in the north. We can then find out who is tweeting and what they are saying… and that the problem might relate to an incident in one location that has gone viral.”

Big data has the capability to analyse data from all websites (not just social me-dia) and Eversheds is currently investigat-ing whether it can be used to evaluate, for example, intellectual property infringe-ments relating to a client, or a company’s international risk.

Big data can be expensive to imple-ment. Eversheds — the first UK law firm to use it — has bought Minority Report-style hi-tech ‘touch tables’ to help it map patterns. But, says Caris, “big data under-lines the effort we make to really under-stand our clients.”

Addressing internal security concerns

Are law firms increasingly com-ing under attack by cyber-crimi-nals? Seth Berman believes they are. Berman is a former lawyer who is now Executive Managing Director at Stroz Friedberg. He points out that, in November 2011, the FBI convened a meeting with the top 200 law firms in New York to urge them to rethink their cy-ber-security policies.

“In general, law firm part-ners are not always super adept at technology,” says Berman. “One problem is that these are not usually top-down organisa-tions, so it’s hard to unify and enforce policy that might im-prove security.”

The challenges that big and small law fi rms face are very dif-ferent, says Berman, because of a diff erence in budgets. “Smaller law fi rms suff er from the problem that all small companies have to some extent: i.e. it’s hard to invest in enough IT to make things very secure. This is particularly true for

law fi rms where lawyers and their clients expect 24/7 access (to all kinds of material).”

Security reviewTo strengthen cyber-securi-ty, Berman advises law firms to bring in an outsider to per-form a review of all their poli-cies. “I think the reality is that a lot of law firms don’t know where they stand (security-wise),” he says. “When you are too close to

things, you might not see issues that others from outside may be surprised by.

“Another problem is that an IT department’s job is to keep the main systems running well — and it can be hard to step back from that, shift focus and ask: ‘Do we have the RIGHT systems?’ Plus, it can sometimes be hard for inter-nal IT people to raise the alarm about bad practices because part-ners don’t want to listen to it.

They fi gure their IT folks are al-ways saying ‘be careful, be careful, be careful’.”

Cloud computing The Bring Your Own Device (BYOD) culture is a signifi cant problem for law fi rms. “It’s very hard for a fi rm to control security on a device (that isn’t their’s),” he says. “Also, it’s hard to manage data that resides on devices that aren’t, technically, owned by the fi rm. But, apparent-ly, phone-makers are working on technology which allows users to run two things on one device.”

Berman sees companies over-coming their security fears around cloud computing “although law fi rms are particularly worried about cloud because they’re focused on data ownership and data control is-sues.” Still, there are ways for law fi rms to become comfortable with third party servers sitting off their system, he says — and this partly depends on knowing who the data is owned by and where it is.

“In terms of where the market is going,” says Berman, “I think se-curity is something law fi rms will begin to pay more attention to. As in every industry, people take more notice when something bad happens to them — or it happens to a fi rm like them.”

Clients are increasingly insisting that firms have stricter data security measures

■ When fi rms receive pre-quali-fi cation questionnaires request-ing tenders, etc, a lot more detail is required. For example, does the fi rm have an ISO9001 standard for quality and an ISO27001 standard for information security manage-ment? Most clients want to know that a fi rm has Security Informa-tion Risk Offi cers (SIROs) in post, and they may want to carry out an audit to prove that a fi rm is sound.

When it comes to safeguarding client data, a firm needs to think about its ‘three Ps’

■ Firstly, Personnel: staff training and awareness. Then there’s Phys-ical: having the right doors, win-dows, locks, CCTV, etc. And, thirdly, Processes: having the right poli-cies, procedures, contracts, en-cryption — and IT — in place.

■ But there is always room for im-provement if changes need to be made because this is a fast-chang-ing environment. I think the days of ‘trust me, I’m a lawyer’ are long since past.

Digital documents, electronic case management systems, virtual law firms. Just like the society and the people it serves, the law is going dig-ital and is adopting tech-based solu-tions at an increasing pace. But will it do so in line with the best inter-ests of clients and the highest pro-fessional standards?

Accessibility and productivityTechnology is already helping to bridge the gap between lawyers and their clients by making the law more accessible. Consumers can use online tools such as the Law Socie-ty’s Find a Solicitor service to find a lawyer; legal websites, forums and social media are demystifying com-mon legal issues; and cloud services provide solicitors and their clients instant access to data. The demand for online legal services will only in-crease, as the generation who can-not remember a time before the in-ternet seek legal advice and support at key stages in their lives.

Thanks to technology, law firms are seeing an increase in produc-tivity, often leading to reduced cost to clients. Firms can coordinate work between international offices

via email, secure intranets and even virtual conferences, bringing down the costs of supporting inter-national clients. Savings brought by new tech-based solutions will also aid high street law firms, which are looking for ways to of-fer more value to their clients in an increasingly competitive market-place, as well as law centres facing budget cuts.

New ways of workingTechnology is also enabling the le-gal profession to change traditional

work processes. Routine business processes, such as transcription from digital dictation, can be car-ried out overnight in the UK or abroad. Document assembly sys-tems and teleconferencing help clients do part of the work them-selves (‘DIY law’) so that legal ex-pertise is deployed only when it is needed. Case management sys-tems ensure that tasks are han-dled systematically, and auto-mated updates help keep clients informed. In a world of huge digi-tal data sets, electronic discovery

has become an essential weapon in the litigator’s armoury.

Adapting to changeThe face of the profession is chang-ing too. An increasing number of firms are encouraging their staff to adopt new working patterns that can make the law more inclusive. So-licitors can work from home or on the move. The opportunities to think imaginatively about the production and delivery of legal services will only increase, as lawyers and their clients make use of smartphones, tablets and laptops to access cloud-based software. The flexible use of new technology will be particularly attractive to younger lawyers, who already see it as part of everyday life.

However, adopting tech-based and digital solutions won’t come without challenges. For justice to become a speedier process, from in-struction to resolution, the courts, and public sector in general, need to be as technologically enabled as the modern law firms handling the cases. The legal sector will also have to come to terms with the securi-ty risks posed by electronic assets, warding off challenges in the fields of cyber security, online privacy and data protection.

Ultimately, technology will bol-ster the traditional values, standards and services of the profession, by al-lowing solicitors to find new ways to serve their clients, from FTSE 100 cor-porations to first-time home buyers.

■ Technology has aided flexible working. During the Olympics, flexible working helped law firms avoid disruptions and brought benefits to companies, adding to the Olympics legacy, says The Law Society.

■ For instance, law firm employees who otherwise might have struggled with their commute were able to ‘plug in’ from home.

Society warned solicitors about the need for caution when adding a client on social media sites such as Facebook. The risk of merging professional and personal lives could result in a breach of client confidentiality.

■ What are the benefits for law firms using social media?

!There are many, but visi-bility, brand building and

customer engagement would sum it up for me… The types of law firms that are really going for it on social platforms at present are those that are posi-tioning themselves for the challenges of a post-Legal Ser-vices Act market place. In this environment, new entrants to the legal sector, especially in areas like PI, conveyancing, wills and probate, etc, will probably have a ready made supply of customers to offer their legal services to — so so-cial media helps to level the playing field.

■ What should firms bear in mind when using social media?

!It goes without saying that lawyers need to en-

gage wisely. Everything posted will be up for public scrutiny. Common wisdom, but more likely your firm’s policy, dic-tates that lawyers should be particularly careful not to pro-vide legal advice on social plat-forms, although one brave chap does just that on Twitter.

■ What should firms be using social networks for?

!It boils down to sharing engaging and well-pre-

sented content that is of inter-est to your target audience. That could mean a YouTube channel or a niche tax law blog. I’d love to see a law firm do something like Aviva’s “You Are The Big Picture” Facebook campaign last year. If it can work for insurance then it can work for law.

■ And what should they avoid using social networks for?

!Cheap video marketing (there are so many bad law

firm videos), spam and SEO (few social networks offer tan-gible SEO benefits). Some would argue humour, but I think that definitely has a place on social networks, even if you’re a lawyer!

The important and often sensi-tive documents produced by the legal profession can be famous-ly long — and famously dense. To complicate matters, modifi-cations or amendments to these documents may come from myr-iad sources, making it difficult to keep track of changes.

Barrie Hadfi eld is CTO of Work-share, a provider of document col-laboration software to 18,000-plus customers across legal fi rms and enterprise legal departments in more than 70 countries with more than 1.8 million users. Taking an insider’s view of these challeng-es, Workshare has developed soft-ware — with built-in security fea-tures — which simplifi es the col-laborative process and pinpoints exactly how one version of a docu-ment diff ers from another.

Simplifying processesEssentially, these are tools de-signed to make a legal profes-sional’s life easier — but without changing the way he or she cur-rently works.

“It’s our job to simplify custom-er experiences around informa-tion,” says Hadfi eld, “and fi nd bet-ter ways of multi-party collabora-tion and communication across departments, between offi ces, cli-ents and among partners.”

The legal industry has spe-cial requirements in this regard, however, because of the sheer number of documents it produc-es. “The legal profession always aims to produce its content as ef-ficiently and as securely as possi-ble,” says Hadfield. “But because of today’s technology, there’s recently been a change in con-sumer expectations. The clients of law firms now expect to have secure, easy access to their legal documents across mobile, desk-top, tablet and other devices.”

Comparison capabilitiesWorkshare’s software includes Workshare Compare, which fea-tures document comparison ca-

pabilities to streamline and se-cure the collaboration and review process. It also allows communi-cation with other members of a team within the document itself.

Workshare’s Protect software, meanwhile, is a fail-safe way to ensure that sensitive or confi-dential information is automat-ically removed or redacted from documents before they are sent outside the company.

Cloud securityThis software is available as cloud-enabled file-sharing, syn-chronisation and collaboration platform, which means the le-gal profession can now have ac-cess to a robust, secure and prov-en cloud platform. “For me, cloud is another kind of delivery mech-anism,” says Hadfield, “and a very effective one. We now have 10,000 cloud users including government and private organ-isations, plus top management consultants and professional services firms.”

The Workshare platform now includes the same level of da-ta protection and collaboration features that its users have been benefiting from in their inter-nally hosted or deployed desk-top application. This means that

Cloud take up in the legal pro-fession certainly appears to be growing. A 2012 survey from the ILTA (International Legal Tech-nology Association) noted that “70 per cent of all respondents have either added cloud comput-ing to their IT roadmap or are currently using or implementing a cloud solution (5 per cent in-crease from 2011).” Some compa-nies have voiced concerns about

data security in the cloud, yet Hadfield says that stor-ing documents in the cloud is vastly more se-cure and manageable than sending the same information by email.

Greater control“Actually, I would argue that 100 per cent of all legal companies have been utilising cloud,” says Hadfield, “because they’ve been sending emails for the last two decades. Email is the world’s big-gest cloud-deployed infrastruc-ture, but one that companies have no control over.

“What our cloud service does, however, is provide an infra-structure with built-in data pol-icy enforcement and protection — something that email can’t do.

“Cloud also gives users much greater control. For example, if sensitive legal information needs to be recalled and deleted, a firm can do that easily in the cloud. With email, you can’t. Once in-formation has been emailed and it’s ‘out there’; there’s no getting it back.

“So cloud offers a very secure way of working, yet allows users to access information and con-tent anywhere and from any de-vice.” This flexibility of being able to work on the move and be-ing able to access information or documents at any time has also proved to be a major plus for ma-ny legal firms.

Complete solutionEven so, admits Hadfield, com-panies used to having informa-tion ‘on site’ can still be nervous

about surrendering c o n t r o l to a cloud provider. Workshare has therefore created the perfect solution. “A firm’s concern usu-ally pertains to the geographic location of the information,” he says. “They want to know where and in which country it will be kept. So we allow them to re-tain that geographic control and choose where the data is located, and as you would expect, we al-so include encryption to ensure that their firm — and only their firm — can access their data.”

The integrated mobile, desktop and tablet solutions reduce the commercial risk posed by inad-vertently sharing confi dential or sensitive documents. Today more than 98 per cent of AmLaw 200 and 62 per cent of fortune 1,000 legal departments rely on Work-share to protect and collaborate on documents.
