Other vendors are also offering farm machinery/miscellaneous items for sale, some of which may be subject to reserved prices. ORDER OF SALE The sale will commence at 10.30 am prompt with the main seller’s items, followed by the outside entries. CLEARANCE By no later than 5.00pm on Wednesday, 17 th October 2018. Should any items be left on the sale field, then this will be the responsibility of the buyer. Help with loading will be available on the day and in the subsequent week, wherever possible. PAYMENT AT CLOSE OF SALE Buyers are required to pay for items purchased on the sale day, prior to removing them from the sale field. Any buyers not known to the Auctioneers are required to make themselves known prior to bidding. VAT The seller is registered for VAT purposes and therefore VAT will be charged at the prevailing rate in addition to the purchase price. Some or all of the outside sellers may also be registered for VAT and therefore their items will attract VAT also. BUYER’S PREMIUM In addition to the purchase price, buyers will be required to pay 10% premium, charged on all the lots, to a maximum of £200 plus VAT per lot. Persons not known to the Auctioneer must bring proof of identification and address. REFRESHMENTS A mobile canteen will be in attendance on the day of the sale and all those attending are requested to put their litter in the bins provided or take home with them to dispose of, rather than leaving on the sale field. DIRECTIONS On entering the village of Malborough, turn right (with the Petrol Station on your left hand side) following the signs to Bolberry. Continue along this road for about 2 miles and bear off to the right, following the Luscombe Maye ‘TO THE SALE’ signs. FALL OF THE HAMMER At the fall of the hammer any items purchased will be the buyer’s responsibility and in no way can the seller be responsible for the items thereafter. CONDITIONS of Sale by Auction of MACHINERY AND MISCELLANEOUS ITEMS by Luscombe Maye, Auctioneers, as set out in the attached particulars.

1. The highest bidder shall be the purchaser, and if any dispute arises on the bidding, the disputed lot shall, at the Auctioneer’s discretion, be put up again and resold. The Auctioneers shall be sole arbitrators as to any disputed matter. No bidding shall be retracted.

2. The Auctioneers reserve the rights to refuse any bidding, to withdraw any lot, to sell together or divide any

lots, to bid a reserve price for any lot, and to withdraw any lot, without giving a reason, within the period ending 7 days after the sale, until the end of which time (unless with the Vendor’s consent) and until these conditions are signed and/or complied with.

3. Each lot is at the purchaser’s risk at the fall of the hammer, and shall be taken with all faults, defects or any

misdescriptions. The attached particulars neither constitute nor constitute part of an offer or contract. Intending purchasers must satisfy themselves by inspection or otherwise as to the accuracy of statements made in the particulars or at the sale about weight, condition, quality or anything else, and which are made for guidance only, without responsibility on the Auctioneers’ or the Vendors’ parts, and one of which is to be relied upon as a statement or presentation of fact. Neither the Vendors, or the Auctioneers nor their employees has any authority to give any representation or warranty in relation to these particulars.

4. Each purchaser shall pay to the Auctioneers at the close of sale the full amount of the purchase price of the

items purchased. 5. In addition to the purchase price, buyers will be required to pay 10% premium, charged on all the lots, to a

maximum of £200 plus vat per lot. Persons not known to the Auctioneer must bring proof of identification and address

6. Failure to pay in the way stated and at the times stated shall incur interest on the outstanding amount of 2%

per month above National Westminster Bank base rate which shall be added to the purchase price and recovered as such.

7. If any Purchaser fails to comply with these conditions, any lot the subject of default shall be resold. Any

deficiency occurring together with all expenses incurred by such second sale shall be made up by the defaulting purchaser, and shall be recoverable by distress and sale, or by payment of liquidated damages or in a Court of Law.

8. In the event of sale of any lot before auction, or within two months of the auction, the Vendor will pay to the

Auctioneers commission calculated at the rate charged to Purchasers on sale by auction.
