1. That the complainant named above is a citizen of India

and Muslim by religion.

2. That the family of the complainant consists of his wife

named Nida Alam, his two minor daughters named

Muskan, 9 year, Emu/Iman 1 years old and an

infant 6 months old son namelyMd.Hassan.

3. That the complainant ordinarily resides at Madarsa

Kangal Shah,Dhaula Kuan, New Delhi along with his

wife and children presently residing at a distinct place

due to the fear of the accused persons.

4. That the accused persons are namely Hamid Khizar

(father), Mehmood Alam (brother), Harooni (wife of

Mehmood), Waheeda (sister), Sahfi Khan (brother in

law), Nawab @ Meenu Kasi (butcher) and Mohd.

Arshad Ahmad Raja (both students of Madarsa).

5. That prior to 2006 complainant was living in a joint

family in the Madarsa situated at Dhaula Kuan

without much interaction with each other.

6. That the father of the complainant Hamid Khizar, was

the General Secretary of the Managing Committee of

the Madarsa Kangal Shah, at Dhaula Kuan, New

Delhi.

7. That in the year 2006 the complainant was appointed

as Mohatmim (Incharge) of the Madarsa by Wakf

Board, Delhi by dissolving the earlier Managing

Committee, wherein the father of the complainant was

General Secretary.

8. That the accused persons had been involved in

antisocial activities which includes the slaughtering

the cows in the premises of Madarsa, keeping illegal

arms, getting and selling fake gold bricks, fake, Indian

currency notes /coins, being received from a person of

Pakistan Embassy, providing shelter to antisocial

elements and antinational elements and they having

nexus with local police wherein each and every

accused was involved in illegal activities one way or

the other and smashing huge amount of money.

9. That after the appointment of the complainant as

Mohtamim/Incharge of the Madarsa, the complainant

raised objections against the illegal and anti-national

activities carried out by the accused persons and also

informed the Police Station, Delhi Cantt., (at present at

Dhaula Kuna) and requested them to take legal action

against the accused persons who are the enemies of

country. Copy of complaints dated 24.9.2009,

25.9.2009 and 26.09.2009 are enclosed herewith for

kind perusal of this Honble Court.

10. That inspite of several verbal complainants to the

SHO, Police Station Delhi Cantt. they did not take any

action against the accused persons presumably the

police was also a party to the above said illegal

activities and receiving monthly good bribe/amount of

money from the accused persons.

11. That when the complainant made a complaint to SHO,

P.S. Delhi Cantt., the accused persons became the

sworn enemy of the complainant and started giving

threats to eliminate him and his family members in

case if there is any complaint against them in future.

12. That the complainant without having any support from

the police, he became helpless living under great fear

from these anti-social and anti-national people, who

were bent upon to eliminate him and his family

members i.e. his wife and three children.

13. That in consequence of the above mentioned

complaints made on 24,25,26.09.2009, at around 6.00

p.m. the father of the complainant Shri Hamid Khizar,

his brother Mehmood along with Wahida, Hamida,

Shafi Khan, Hanif, Nawab Urf Meenu Kasai, Ahmed

Raja, and Arshad, with a common intention to kill the

complainant and his family members attacked the

complainant and his family members with dreaded

weapons such as knife, chapad, Lathis, rods, bats etc.

17. That during the attack the wife of the complainant

named Nida Alam called up PCR No. 132 and

informed the PCR to send the police as the accused

persons are beating them mercilessly.

18. That when the police did not reach there, she again

made a call on PCR No. 126 and again on PCR No. 123

PCR No. 125 and PCR No. 1212 but all in vain.

19. That from the recording made by all the 5 PCRs is

evidently clear that there was a attack by the accused

persons on the complainant and his family members.

Recordings by 5 PCR are enclosed.

20. That the complainant contacted his friend who was

residing nearby who immediately reached to the place

of incident, he took photographs of the incident. The

photographs are attached with the complaint.

21. That the friend of complaint personally went to P.S.

Dhaula Kuan and informed the police about the

incident and requested them to rush to the place of

incident and save the life of the complainant and his

family members, who are under attack and their death

is imminent if delayed.

22. That after some time the police of Dhaula Kuan

reached to the place of incident and took all the

injured persons to the Safdarjung Hospital, New

Delhi.

23. That the injured persons were examined by the doctors

on duty of Safdarjung Hospital, the MLCs were

prepared, the details are given below:

24. That the MLCs clearly shows all the family members

have injuries in head, hands, knees etc. as stated

above. The copy of medical reports are annexed with

the complaint.

25. That inspite of head injuries, and factures shown in

medical reports the Police Station, Dhaula Kuan did

not register the FIR against the accused persons.

26. That the house of the complainant where he was

residing with his family was smashed, windows and

door was completely damaged, including Room Cooler,

by the accused persons.

27. That on 28.9.2009 at 12.03 p.m. the complainant

made a complaint to the Commissioner of Police

through a fax message on telephone no. 23722052

made from JNU New Delhi about the incident/attack

with the request to take legal action against the

accused persons and save the life and property of the

complainant and his family members.

28. That a copy of the complaint dated 28.9.2009 was also

given to DCP Dwarka, which was received by H.C.

Shyam Singh.Copy of the complaint dated 28.9.2009

is annexed herewith.

33. That inspite of best efforts made by the complainant

that the Delhi Police has not taken any action against

the accused persons and as a result the complainant

with his family members has been hiding at a

unknown place due to fear from the accused persons

as they can go to any extent to eliminate the

complainant and his family members.

34. That the complainant has lost all hopes from the Delhi

Police as they will not take any action against the

accused persons as they themselves are involved

because of their own connivance with all accused

persons involved in anti-social, anti-national activities

earning lakhs of rupees from the illegal activities like

slaughtering the cows in the premises of Masjid,

selling fake gold bricks, fake currency notes/coins and

sheltering terrorists, armed people including from the

Pakistan Embassy for which they are facing charges in

Delhi High Court and Patiala House Courts, New Delhi

for anti-national activities and theft/slaughtering of

cows.

35. That the accused persons have committed an offence

u/s307/506/120-B/Sd in English (strikeout) 153(A),/153(B)

/149/238/ 239/240/ 445/459/489 (B)/ 511 read

with section 34 of Indian Penal Code and hence they

are liable to be punished for the same.

With due respect I want to state that I am Masood Alam S/o Hamid Khizer,

inchage/Mohatmim, Madarsa Tarteel Ul-Quran, Mochi Bagh, Dhaula Kuan,

New Delhi 10. I am registered by Delhi Wakf Board. I have wife, Nida

Alam and 3 small kids elder one is daughter 9 yrs old, 1 , Yrs old daughter

and youngest 6 mnths old son. My father, sister, brother, namely Hamid

Khizar (father), Mehmood Alam (Brother), Wahida (Sister), are torturing us

to leave the Madarsa. Few days back they hitted a lathi on my temple, due

to which I had internal bleeding through intestine. But I thought they ill not

do so again. Last night again at 2 P.M, they called some person from

MEWAT VILLAGE (Mahun) and threatned us to leave the Madarsa

immediately, we refused. So they tried to hit again on my head with Laathi

to kill me. I merely escaped with my family by locking us inside our rooms.

Again in the morning at 9 a.m. They shouted on me, abused my wife, cursed

my kids and tried to hit me and kill me. But I immediately said I will call the

Police and no more will care for family prestige, I was not saying anything

because they are my family members. But as I came to know about their

intentions that they wants to kill me, for the safety of our lives.

I want Police protection, not only our lives my house security in also in

danger. As they can ransack my house in my absence.

I am registered owner of Madarsa Tarteel Ul Qura, by Delhi Wakf Board in

year 2006. But as I do service also in Kotak Mahindra Bank as DRA, I told

my family members to look after the Madarsa. I frequently visits at Madarsa

time to time. But from last few months whenever I reached Madarsa and

asked about its administration etc, they refused to give me any details. By

seeing their attitude I shifted permantently to Madarsa to look after it. As

many complainants I heard about them. My father is doing Babas business,

illegal practices and collecting donations in the name of Allah & Madarsa &

misusing it. I am the responsible person of Madarsa & if anyone by his acts

deteriorates the reputation of the body (Madarsa) that will undoubtly effect

the incharges reputation. I asked them to stop doing fake Babas business &

stop exploiting people & use the donation money in right work, i.e., forimprovement in Madarsas education. As its may right through authority to

interfere and manage Madarsas affairs. But my father, brother & Sister

threatned me to not to interfere in Madarsas matters & leave the place

immediately otherwise they will kill & destroy my kids & wife. These

people are torturing me, did many attempts to hit me to kill. Using abusive

language, threatened to rape my 9 yrs old daughter & my wife. We are very

much disturbed. Kindly look into the matter seriously and interfere in the

matter to save my familys life. I am attaching my voter I.D. wifes voter

I.D., Power of attorney & then certificate of Incharge issued by Delhi Wakf

Board. Please help me and give us protection.

1. I am Masood Alam, bonafide Incharge of Madarsa Tarteel Ul Quran, DDAIndira Park, Jheel, Dhaula Kuan, New Delhi 110010, appointed by Delhi Wakf

Board to run this Madarsa. A group of known people including some of my family

members and others, made an attempt to murder me with my wife and three

children, in a well planned manner on 26/09/2009, around 06:00 p.m, because of

my persistent opposition and fear of exposure of their criminal and anti-national

activities. As I have evidence against them which can expose, their all secrets and

seen everything from my own eyes, slaughtering cows, anti-national activities etc.They are very influential and good contacts with high level people. Since 2002, when

my father was caught and spend some time in the Tihar Jail, developed good contactswith hard core criminals, apart from cow slaughtering and other anti social activities,

he start dealing in fake notes, harbouring armed criminals and terrorists from Pakistan.My father, brother, and my brother in law along with Nawab Kasai and others

developed good contacts with criminal/anti-national people and also developed good

relations with Police. That is why inspite of incharge of Madarsa, they have forced meto stay outside the Madarsa after their attempt to murder, on 26/09/2009 to till date.

Me, my wife and all three children are still under a trauma.

2. It was my opposition and fear of exposure of their (Hamid Khizar, Mehmood, ShafiKhan, Uncle Hanif, Waheeda, Waheed, Arshad, Ahmed Rajja and Nawab Kasai) anti-

national and criminal activities, resulted a joint and pre-planned attack to murder mealong with my whole family, on the eve of 26/09/2009. In which me, my wife and allthree children merely escaped death. Hamid Khizar (father), Mehmood, Wahida,

Harooni, Shafi Khan, Nawab Kasai, Uncle Hanif, Ahmed Rajja, and Arshad gathered

downstairs in the closed varandha, around 6:00 P.M. That time I was in my room onfirst floor, upstairs, discussing the Police behaviour with my wife, I heard a strong

voice of my father Masood neeche aa I immediately went downstairs, my wife and

children got panicky, I told my wife and children to stay inside the room, let me see, Iwill come back soon, when I went down stairs, I found all accused persons were

looking at me angrily, My father said you have left us with no option except to kill

you. You did not stop complaining about us in the Police. I already paid Rs. Two

Lakhs to SHO, Dhaula Kuan, to keep his mouth shut, I cannot throw money anymorebecause of you, and if you will not stop we all will be behind the bars. On this when I

asked them why cant you stop and keep yourself away from all criminal and anti-

national activities? And it is not you people, I will be caught without any involvementbecause I am the incharge of Madarsa, Dhaula Kuan. On this they become furious,

and jumped towards me to catch near the stairs, Uncle Hanif was yelling, Khatm kar

do saale ke yahin par, they were prepared to kill me as all of them suddenly tooklathis in their hand within a fraction of second, and I saw into their eyes which was

full of hate and their faces were different, which clearly reflected their intention to

kill, I got terrified.

3. Thereafter, immediately my father attacked on my head with a lathi from which Iescaped after that he and Mehmood tried to pull me down as the stairs were narrow allof them could not come upstairs, sensing their intentions I ran back and locked myself
