Section 1: Information For Responders 1.1 About Dharma Realm Buddhist Association The Dharma Realm Buddhist Association (DRBA) is an international, non-profit Buddhist organization founded by the Venerable Master Hsuan Hua in 1959. During its five decades of operation, the educational activities of the Dharma Realm Buddhist Association have expanded to include the Dharma Realm Buddhist University, the Institute for World Religions, and the Buddhist Text Translation Society. Also, at the City of Ten Thousand Buddhas, in Talmage, California, some 200 K-12 students attend the Instilling Goodness Elementary School and the Developing Virtue Secondary School, the latter with a fully accredited high school curriculum. Further, some 30 branches of the Dharma Realm Buddhist Association have been founded in the Western United States, Canada, and the Pacific Rim, in order to help transmit the traditions of Buddhism in the twenty-first century. 1.2 About Dharma Realm Buddhist University Dharma Realm Buddhist University is a community dedicated to liberal arts education in the broad Buddhist tradition—a tradition characterized by knowledge in the arts and sciences, self–cultivation, and the pursuit of wisdom. DRBU has campuses at the City of Ten Thousand Buddhas in Ukiah, California, and at the Institute for World Religions in Berkeley, California. The Dharma Realm Buddhist Association (DRBA) is in the process of purchasing the former Trinity School on 225 Hope Street, Ukiah, California. This Trinity School site will serve the new programs developed by DRBU in near future.

1.3 Project Description The former Trinity School campus consists of 4.89 acres of land and eight (8) existing buildings that provide 85,489 sqft of educational facilities. Until mid-2009, the Trinity Youth Services operated a residential school at this location. DRBA plans to convert several existing paved concrete playground areas to provide sufficient parking spaces for the proposed school population, in accordance with the City of Ukiah zoning regulations. In addition to the conversion of existing paved concrete playgrounds, DRBA also plans to construct a new driveway at the W. Clay Street between S. Hope Street and the S. Barnes Street. The new driveway will comply with the codes specified in the City's and in the Americans with Disabilities Act (ADA). The approved user permit is included in Attachment A. Attachment B includes the planning level's site plans and the site plans specify the required parking spaces on the sites. The parking lot conversion would include but not limited to some removal of children playing facility, filling of sand pits, re-paving lots, re-striping parking spaces, two tree wells at the parking lot #2 along the S. Spring Street, etc.

An optional task would be a covered bicycle parking lot. Based on the approved user permit, DRBA is required to provide 7 bicycle parking spaces on the campus. However, it is still under discussion whether DRBA would provide a covered bicycle parking lot. Therefore, the proposal should include the cost estimate of building a simple covered bicycle parking lot with roughly 20 bicycle parking spaces as an optional task. A possible location of the covered bicycle parking lot would be at the southeast gated corner of the intersection at the W. Church Street and the S. Barnes Street. Address: Dharma Realm Buddhist Association 4951 Bodhi Way Ukiah, California 95482 1.5 Limits of Liability DRBA assumes no liability for any cost incurred by Responders in responding to this RFP or in responding to any further request for interviews, additional information, etc. prior to the issuance of the contract. 1.6 Type of Contract, Fees and Compensation All facilities, labor, material, equipment, and design services that are typically required for the completion of the Work are included in this design/build proposal. All Work shall comply with the applicable federal, state and local requirements. DRBA will execute a contract for professional services required to complete the work specified within the RFP. The contractor will be paid based on the contracted amount.

1.7 Proposed Target Dates RPF Release: May 29, 2015 One Site Visit: June 2, 2015 Questions Due June 8, 2015 Proposals Due June 10, 2015 Award Contract July 17, 2015 1.8 Proposal Format There is no restriction to length of proposals; however, Responders are encouraged to be as concise as possible. All proposals should include: 1. Letter of transmittal and three (3) copies of proposal. 2. Project work schedules. 3. Permits and Approvals list. A list of all necessary permits, such as an encroachment

permit application of the new driveway construction. 4. Qualifications:

a) Personnel b) Experience and facilities of the Firm(s) c) Recent work history of similar projects. d) Identification and qualifications of subcontractors. e) Three references of recent similar work

5. Total fee.

1.10 Evaluation Criteria

DRBA will evaluate proposals based upon best value for DRBA/DRBU and other economic factors, detailed technical approach to the project, experience and qualifications of the Responder and subcontractors as well as references of the Responders and their Subcontractors.

1.11 Rights Reserved to DRBA DRBA reserves the right to:

Reject any or all PROPOSALS

Verify all information submitted in the PROPOSALS;

Withdraw this solicitation at any time with no obligation to negotiate or enter into any form or type of Agreement, with any Respondent;

Supplement, amend, modify, or cancel the RFP;

Extend the times and dates set forth in the RFP;

Issue additional and subsequent RFPs and to conduct further investigations with respect to the qualifications of a Respondent; and,

Amend any type of Agreement(s) resulting from this RFP to incorporate necessary attachments and exhibits or to reflect negotiations between DRBA and the successful Respondent(s).

1.12 Validity

PROPOSALS must be valid for a period of at least three (3) months from the closing date and time of this RFP. 1.13 Pre-Contractual Expenses

DRBA shall not, in any event, be liable for any pre-contractual expenses incurred by Respondents in the preparation of their PROPOSALS. Respondents shall not include any such expenses as part of their PROPOSAL. Pre-contractual expenses are defined as expenses incurred by the Respondent in preparing its PROPOSAL in response to this RFP; submitting that PROPOSAL to DRBA negotiating with DRBA any matter related to the PROPOSAL; and, any other expenses incurred by the Respondent prior to the date of award and execution of any Agreement associated with this RFP. 1.14 Confidentiality

1. Respondent may provide supplemental information exempt from public disclosure under California Gov. Code(s), including “trade secrets” under Evidence Code(s) as applicable. Such supplemental information shall not be material to the required submittal information and DRBA shall be under no obligation to consider such supplemental information in its evaluation.

2. If submitting confidential, supplemental information, such information shall be printed and submitted separately from the rest of the submittal. It shall be clearly marked "Confidential." Upon completion of its evaluation, DRBA will destroy any confidential, supplemental information submitted, or return such information to Respondent if so requested.

1.15 Execution of Agreement(s)

After a Respondent is selected, the execution of any agreement(s) is contingent upon the successful negotiation of terms, negotiation of final power costs (either lump sum turnkey, time and material base or other type of agreement is formed), acceptability of fees, and formal approval by DRBA. 1.16 Insurance

Respondent shall state its willingness and ability to provide DRBA with required insurance coverage prior to execution of any associated Agreement(s). The insurance coverage required for this RFP is as follows:

a. General Liability = $2,000,000 b. Automobile Liability = $1,000,000 c. Workers’ Compensation insurance covering all of Respondent’s employees

shall be furnished in accordance with the Statutory Requirements of the State of California and shall include Employers’ Liability insurance with a limit of $1,000,000 for each accident for bodily injury or disease.

d. Professional liability insurance policy, with a company authorized to do business in California, affording professional liability coverage for the professional services to be rendered in the amount of $2,000,000 per claim.

The insurance policies described in (a) and (b) shall name DRBA as additional insured. The insurance policies described in (a), (b), and (d) shall include a waiver of subrogation and the certificate shall reference the “Trinity School Site.” Within fifteen (15) days of execution of a contract, respondent shall furnish DRBA with appropriate certificates and endorsements or at DRBA’s request, copies of its policies. Respondent shall provide 30 days notice of cancellation to DRBA. 1.17 Assumption of Risk and Indemnity

In addition to other provisions regarding assignment of risk between the parties, language regarding assumption of risk and indemnity, substantially in the form set forth below, shall be required to be included as part of any Agreement(s) negotiated with Respondent

“Respondent shall assume all risk of loss to itself, which in any manner may arise out of the use of DRBA/DRBU property or infrastructure under an Agreement to engineer, procure, install, and/or operate any facility. Further, Respondent hereby agrees to indemnify and defend DRBA/DRBU and its directors, officers, and employees against any and all liability and expense, including the reasonable expense of legal representation whether by special counsel or by DRBA/DRBU’s staff attorneys, resulting from injury to or death of any person, or damage to any property, including property of DRBA/DRBU or damage to any other interest of DRBA/DRBU, including, but not limited to, suit alleging noncompliance with any statute or regulation which in any manner may arise out of the issuing of any

agreement(s) entered into between the proponent and DRBA/DRBU, or use by Respondent, or any adjoining land used with Premises. Respondent assumption of risk and indemnity obligations under this Paragraph shall include, but not be limited to, any action brought against DRBA/DRBU that includes an allegation of the dangerous condition of property as a specific cause of action.”
