An Administrative Design is considered the expansion of an existing development or new construction that results in a new building footprint that is less than 5,000 square feet. Façade changes and exterior alterations are also Administrative Design reviews. Administrative Design reviews may be approved by the Zoning Administrator. However, all Administrative Design reviews located within the Mixed Commercial (MC) District require Architectural Commission approval. Follow procedures 1- 4 for an Administrative Design review.

Step 1: Initial Contact with City Planning DepartmentPrior to the submittal of any Development Application, the applicant shall contact the Planning Department. This initial contact is intended for discussion of all elements of a development project so the applicant can obtain a full understanding of what is required, and for Planning Staff to be made aware of the proposed project. Multiple meetings may be necessary.

Step 2: Submittal for Staff MeetingAn official submittal for a City Staff Meeting can only occur after Planning Staff has determined Step 1 is complete. All required materials necessary for Staff to provide feedback and comments on the development must be submitted. Planning Staff can assist you in determining what items need to be submitted for your project. All items submitted shall be folded, collated and bound in some manner. If the submittal requires Staff time to copy, fold, clip or collate, the applicant will be billed for that time. All items must be submitted in the following order:

• Sixteen (16) completed “Staff Meeting Appearance Request” applications• Sixteen (16) copies of an explanation letter describing your proposed development/project• Sixteen (16) 11”x17” copies of the proposed development (e.g. site plans, floor plans, elevations, renderings, etc.)• A digital submittal (.pdf format) of the entire application • A digital submittal (.shp format) in NAD 83 (2011) Wisconsin State Plan South Zone, US Foot, coordinate system (if applicable)

• Proposed property lines/subdivision layout• Anticipated building/project footprint

A Major Design Review is required for the expansion of an existing development or new construction that results in a new building footprint that is greater than 5,000 square feet. Follow procedures 1-3, 5-6 for Major Design Review. All Major Design Reviews require both Architectural Commission and Plan Commission approval.

This section is a general overview for the development approval process. Since all projects are not the same, this section provides a general description for a typical project. Specific details for each proposed project should be verified with the Planning Department.

After the submitted Staff Meeting materials are determined to be complete, you will be scheduled on the next available Staff Meeting agenda. The City will e-mail a copy of the Staff Meeting agenda to all applicants and agents listed on the application prior to the meeting. It is required that at least one (1) representative from the development proposal be present at the Staff Meeting. The representative should be prepared to answer any questions City Staff may have.

Step 3: Technical ReviewWithin six (6) months following the Staff Meeting, the applicant shall submit six (6) large sets of plans (24” x 36”) in size and one (1) digital copy in AutoCAD format (in NAD 83 (2011) Wisconsin State Plan South Zone, US Foot) to the Planning Department. Planning Staff will distribute these plans to City Departments for feedback. After ten (10) working days, the applicant will receive a Staff Review Letter from the Planning Department containing the comments from all City Departments. The applicant shall make changes to the plans based on these comments and resubmit plans for additional reviews if deemed necessary by Staff.

The Applicant to provide the following for an estimate on development fees: • Number of Total Square Footage• Number of Units• Water Meter Size* • Electric Voltage• Electric Service Size

* Water use estimated if meter size is larger than 2”

Step 4: Submittal for Planning Department ReviewOnce ALL the technical items have been addressed in Step 3, the applicant shall submit two (2) paper sets of plans to the Planning Department along with one (1) digital copy in pdf format. Planning Staff will verify ALL technical items have been addressed and the project conforms to the Zoning requirements. If the plans conform, the plans will be stamped approved and one (1) set will be returned to the applicant. The applicant will be directed to work with the Building Inspector on obtaining the necessary building permits.

Step 5: Submittal for Architectural Commission ReviewOnce ALL the technical items have been addressed in Step 3, the applicant shall submit twelve (12) collated color sets (no larger than11”x 17”) of architectural plans to the Planning Department along with one (1) digital copy in pdf format. Planning Staff will verify the submittal is complete and if the submittal is complete, Planning Staff will place the development on the Architectural Commission agenda for review by the Architectural Commission. The Architectural Commission will approve, deny, or postpone the development proposal. Architectural Commission and Plan Commission meetings are held on the same night.

Step 6: Submittal for Plan Commission ReviewOnce ALL the technical items have been addressed in Step 3, the applicant shall submit sixteen (16) collated paper sets (no larger than 11”x 17”) of plans to the Planning Department along with one (1) digital copy in pdf format. Planning Staff will verify the submittal is complete and that all technical items have been addressed. If the submittal is complete, Planning Staff will place the development on the Plan Commission agenda for review by the Plan Commission. Planning Staff will create a Planning Staff Report for the Plan Commission summarizing the development. The Plan Commission will approve, deny, or postpone the development proposal.

If approved at this point, either a building permit may be applied for or the project may proceed to the City’s Common Council for final approvals.

This checklist is intended to guide developers with development submittals. In general, the items listed below are required for most projects as providing this information allows Staff to perform a complete a review of the project and reduce the need to ask for follow-up information. In addition to the items on this list, Staff may request additional drawings and data to review.

In addition to the Administrative fees for certain applications, City Staff time (City Engineer, City Planner, and City Attorney) will be charged back to the applicant. The City of Oconomowoc is attentive to financial costs and their resultant impact on the tax levy and taxpayers. In this era of development growth, the City incurs costs for the staff to review development proposals. As a result, the City has implemented the most equitable system of using chargeback fees. This is to ensure that costs to review development proposals are paid for by the developer responsible for the creation of those costs. A chargeback fee will be made under the following conditions:

• No chargeback fee will be assessed for general questions or inquires by local residents or businesses. There will be no chargeback fee for activities associated with building or improving a resident’s primary residence. Finally, chargeback fees for City employees’ time will not be applicable to Tax Incremental Financing (TIF) Districts as staff time is allocated to the districts through the payroll process. However, chargeback fees will be assessed for outside consultants’ time in the TIF districts.

• Regarding all other development activities, there will be no chargeback fee for the initial inquiry and the initial staff review meeting involving all City department heads and the associated time for preparing for that meeting. These initial steps are considered to be for information gathering purposes and are generally of limited time. However, to the extent that a developer request or inquiry involves substantial time, a chargeback may be assigned. Staff time spent after the developer’s initial inquiry and after the initial staff review meeting will be charged back.

• Time that the staff incurs beyond the initial inquiry and after the initial staff review meeting will be charged back at the rates established by the City. The time incurred for which a chargeback fee will be assessed includes but is not limited to, review of plans, creation of applicable planning documents, inquiries by telephone/mail/email, creation and review of development documents, legal documents, etc. In essence a chargeback will be made for any staff time directly or indirectly connected to activities performed by staff.

• The chargeback fees shall be based on the Finance Director’s determination of the costs associated with providing the service. The fees may be adjusted on an annual basis and are available on the City’s website or from staff.

• The City Planner/Zoning Administrator, and Planner/Community Development Specialist will record the billable time spent, in fifteen (15) minute increments, and submit it monthly to the Finance Department. The Finance Department will bill and collect the applicable fees.

• The City Engineer and City Attorney are contracted consulting services. The City is billed by the consultants for the time incurred in servicing a development proposal. The billing from the consultants will be charged back to the developer. Department heads will determine and submit appropriate chargebacks to the Finance Department. The Finance Department will bill and collect the applicable fee.

A City erosion control permit shall be obtained before any person commences a land disturbing or land development activity over 3,000 sq.ft.

Financial assurance is required for the Stormwater Management/Erosion Control to ensure project maintenance/completion. The type of form of financial assurance may include cash, a bond, an irrevocable letter of credit, or an escrow, the type thereof to be approved by the City Attorney and/or the Director of Public Works. The amount of assurance is based on current construction costs or applicable bid prices and shall not exceed 125% of the estimated cost of completing the approved storm water management plans, storm water maintenance agreement (construction verification, as-built survey), erosion control, grading and restoration.

All disturbed areas over an acre requires a DNR permit. Provide the City with a copy of the approved DNR permit.
