MINISTERIAL REGULATION ON A DETERMINATION OF FIELD IN PROFESSIONAL ENGINEERING AND

CONTROLLED PROFESSIONAL ENGINEERING, B.E. 2550 (2007)1

By virtue of the definition of the “Professional Engineering” and “Controlled

Professional Engineering” under section 4 and section 5 of the Engineer Act B.E. 2542, which contains certain provisions in relation to the restriction of right and liberty of person, in respect of which section 29 in conjunction with section 43 and section 45 of the Constitution of the Kingdom of Thailand so permit by virtue of law, the Minister of Interior hereby issues the Ministerial Regulation as follows:

Clause 1. The following fields of engineering shall be supplemented to the

professional engineering: (1) environmental engineering; (2) chemical engineering. Clause 2. The following fields of professional engineering shall be the

controlled professional engineering: (1) civil engineering; (2) mining engineering; (3) mechanical engineering; (4) electrical engineering; (5) industrial engineering; (6) environmental engineering;

(7) chemical engineering. However, only for a work by type and scale prescribed in each field of

professional engineering under this Ministerial Regulation. Clause 3. A work in each field of the controlled professional engineering shall

be as follows: (1) consulting work means giving advice, conducting diagnosis or conformity

assessment; (2) project planning work means studying, analyzing for an appropriate

alternative, or strategic planning of the project; (3) designing and computation work means applying a theory and an

expertise in order to obtain details of construction, building, production, or plant and machinery layout with a calculation sheet displaying in figure, drawing, specification or estimation;

(4) construction or production control work means controlling supervision or controlling in connection with a construction, building, production, installation, reparation, modification, demolition, or relocation of work in order to comply with the figure, drawing, and requirement of the professional engineering;

(5) consideration and inspection work means researching, analysing, testing, searching for data and statistic to exert as a criteria or support the inspection and examination of work or verification;

(6) operating supervision work means administrative operations supervision, maintenance including part or system in order to comply with the figure, drawing, and requirement of the professional engineering.

Clause 4. Types and scales of the controlled professional engineering work in

the field of civil engineering shall be as follows: (1) a building from three stories high or above, or building structure with a

storey height of 4 metres or above, or building with a beam span of 5 metres or above; (2) all scales of public buildings; (3) a warehouse, silo, cold storage, or barn with a capacity of 100 cubic

metres or above;

(4) a structure in a form of tower, chimney, or religious object such as a statue of Buddha or pagoda with a height of 6 metres or above;

(5) a bridge structure with a distance between the center of foundation posts ranging from 10 metres in length or above;

(6) a wharf or dock for vessels with a displacement tonnage of 50 metric tons or above;

(7) all types of structural components of precast concrete or pre-stressed concrete with a length of 5 metres or above;

(8) a concrete pile with a length of 6 metres or above, or which can carry a safe load of 3 metric tons or above;

(9) all scales of foundation strengthening work; (10) a scaffolding or temporary shoring with a height of 4 metres or above; (11) a concrete mould for post with a height of 4 metres or above, or beams

with a span of 5 metres or above; (12) an underground structure, temporary building, retaining wall, levee, or

canal with a height or depth of 1.50 metres or above; (13) a structure of public transportation system, bus lane, or airport runway of

all scales; (14) a railway, tramway, highway, public way, or airport runway of all scales; (15) a dam, weir, tunnel, drainage pipe, or irrigation system with a height of

1.50 metres or above ,or with a capacity of 50 cubic metres or above, or with a water flow rate of 1 cubic metre per second or above;

(16) a fluid confined structure such as water tank, oil tank, water tunnel, or swimming pool with a capacity of 50 cubic metres or above;

(17) a water supply pipe, drainage pipe, or drainage channel with a diameter of 0.80 metres or above, or with a cross-sectional area of 0.50 square metres or above and is equipped with a supporting structure, or with a length of 100 metres or above;

(18) an irrigation system with an irrigation area of 500 rais2 or above per project;

(19) a sign or construction built for attaching or installing the sign with an area of 50 square metres or above and has a height of 15 metres or above measuring from a

ground, or the sign or construction built for attaching or installing the sign with an area of 25 square metres or above setting up on a roof, deck, or awning, or attaching to any part of the building;

(20) a grandstand with an area of 1,000 square metres or above; (21) a structure for receiving and transmitting, or for installation of radio or

television receiver and transmitter with a height of 25 metres or above measuring from a structure base level, or with a weight of 200 kilogrammes or above;

Clause 5. Types and scales of the controlled professional engineering work in

the field of mining engineering shall be as follows: (1) mining works shall include:

(A) a mining operated at a total maximum power of 600 kilowatts or above;

(B) an underground mining of all scales; (C) an excavating of mine tunneling, or a drilling of chimneys or holes in

all sizes of rock; (D) an engineering work which utilize explosive of all scales; (E) a milling, grinding, or crushing of ore and rock operated at a total

maximum power of 600 kilowatts or above; (F) a separation of material from a used product by utilizing ore dressing

process of all scales; (G) an ore dressing operated at a total maximum power of 100 kilowatts

or above; (H) an evaluation and analysis of the value of ore deposit of all scales;

(2) metallurgical works shall include: (A) a separation of material from a used product by utilizing ore dressing

process of all scales; (B) an ore dressing operated at a total maximum power of 100 kilowatts

or above; (C) an iron ore smelting or steelmaking with a maximum production yield

of 7,000 metric tons or above per year; (D) other ores smelting or extraction of metals, alloys, or metal

compounds from ores, slags, scraps, materials, or other chemicals including refining of

metals operated at a maximum production yield of 1,000 metric tons or above per year, or a work with an investment of ten million baht or above excluding the value of land;

(E) a melting, casting, deforming, heat treating, surface finishing, or metal coating for work which requires thirty workers or above, or a work with an investment of ten million baht or above excluding the value of land.

Clause 6. Types and scales of the controlled professional engineering work in

the field of mechanical engineering shall be as follows: (1) a consulting work, and a consideration and inspection work under (2) (3)

(4) or (5) of all types and scales; (2) a project planning work:

(A) a machine worth ten million baht or above per unit, or worth twenty million baht or above per project, or with a total system capacity of 100 kilowatts or above, or operated in a building with a utility space of 2,000 square metres or above, or operated in a building with occupants of two hundred persons or above;

(B) a steam generator or vapour generator, pressure vessel, or industrial furnace worth ten million baht or above per unit, or worth twenty million baht or above per project, or the steam generator or vapour generator, or industrial furnace operated with a heat consumption of 20 million megajoules or above per year, or the steam generator or vapour operator, pressure vessel, or industrial furnace operated in a building with a utility space of 2,000 square metres or above, or operated in a building with occupants of two hundred persons or above;

(C) an air conditioner or refrigerator worth ten million baht or above per unit, or worth twenty million baht or above per project, or with a system capacity of 100 kilowatts or above, or operated in a building with a utility space of 2,000 square metres or above, or operated in a building with occupants of two hundred persons or above;

(D) a fluid system in pressure pipe or vacuum pipe worth ten million baht or above per unit, or worth twenty million baht or above per project, or with a system capacity of 100 kilowatts or above, or operated in a building with a utility space of 2,000 square metres or above, or operated in a building with occupants of two hundred persons or above;

(E) an energy management unit with a power of 1,000 kilowatts or above, or operated with a heat consumption of 20 million megajoules per year or above;

(F) a fire extinguishing system and fire protection system worth a total of three million baht or above per system, or with a fire protection area of 2,000 square metres or above;

(3) a designing and computation work: (A) a machine with a total power of 7.5 kilowatts or above per unit; (B) a steam generator, vapour generator, pressure vessel, or industrial

furnace of all scales; (C) an air conditioner or refrigerator with a power of 7.5 kilowatts or above

per unit, or with an area of air conditioning or refrigerating of 400 square metres or above; (D) a fluid system in pressure pipe or vacuum pipe with an atmospheric

pressure within pipe of 500 kilopascals or above, or with a vacuum of minus 50 kilopascals or below;

(E) an energy management unit of all scales; (F) a fire extinguishing system and fire protection system with a fire

protection area of 2,000 square metres or above; (4) a construction and production control work:

(A) a machine with a total power of 20 kilowatts or above per unit; (B) a steam generator or vapour generator, pressure vessel, or industrial

furnace with a pressure of 500 kilopascal or above, or with a capacity of 1 cubic metre or above, or with a rate of steam or vapour generation of 500 kilogrammes or above per hour;

(C) an air conditioner or refrigerator with a power of 20 kilowatts or above; (D) a fluid system in pressure pipe or vacuum pipe with an atmospheric

pressure within pipe of 500 kilopascals or above, or with a vacuum of minus 50 kilopascals or below;

(E) a fire extinguishing system and fire protection system with a fire protection area of 5,000 square metres or above;

(5) an operating supervision work; (A) a machine with a total power of 500 kilowatts or above per system; (B) a steam generator or vapour generator, pressure vessel, or industrial

furnace with a rate of steam or vapour generation of 20,000 kilogrammes or above per hour per unit;

(C) a compressed air vessel or compressed gas vessel with a pressure of 1,300 kilopascals or above and with a capacity of 10 cubic metres or above;

(D) an air conditioner or refrigerator with a power of 500 kilowatts or above per system;

(E) a fluid system in pressure pipe or vacuum pipe with an atmospheric pressure within pipe of 500 kilopascals or above per system;

(F) a fire extinguishing system and fire protection system with a fire protection area of 5,000 square metres or above.

Clause 7. Types and scales of the controlled professional engineering work in

the field of electrical engineering shall be as follows: (1) an electrical power work shall include:

(A) a consulting work under (B) (C) (D) (E) or (F) of all types and scales; (B) a project planning work:

1) an electricity generating system with a total power capacity of 1,000 kilovolt-amperes or above, or with a maximum line-to-line voltage within system of 3,300 volts or above;

2) an electric transmission system, electric distribution system, and electric loads system with a total power capacity of 1,000 kilovolt-amperes or above, or with a line-to-line voltage within system of 12 kilovolts or above;

(C) a designing and computation work: 1) an electrical system or device with a power capacity of 300 kilovolt-

amperes or above, or with a line-to-line voltage within system of 3,300 volts or above; 2) an electrical system for public buildings operating with a total

electricity consumption of 200 kilovolt-amperes or above; 3) a fire alarm system and lightning protection system for high rise

buildings, mega-scale buildings, or condominiums; (D) a construction and production control work:

1) an electrical system or device with a power capacity of 1,000 kilovolt-amperes or above, or with a line-to-line voltage within system of 12 kilovolts or above;

2) an electrical system for public buildings operating with a total electricity consumption of 200 kilovolt-amperes or above;

3) a fire alarm system and lightning protection system for high rise buildings, mega-scale buildings, or condominiums;

(E) a consideration and inspection work: 1) an electrical system with a total power capacity of 1,000 kilovolt-

amperes or above, or with a maximum line-to-line voltage within system of 12 kilovolts or above;

2) a fire alarm system and lightning protection system for high rise buildings, mega-scale buildings, or condominiums;

(F) an operating supervision work in electrical system or device with a power capacity of 1,000 kilovolt-amperes or above, or with a maximum line-to-line voltage within system of 12 kilovolts or above;

(2) an electrical communication work shall include: (A) a consulting work under (B) (C) or (D) of all types and scales; (B) a project planning in a network system with receiving, transmitting, and

broadcasting stations for electromagnetic wave propagation at a frequency of 300 kilohertz or above, and with a transmitting power for each station of 1 kilowatt or above;

(C) a designing and computation work, construction and production control work, and consideration and inspection work:

1) an electromagnetic wave propagation system at a frequency of 300 kilohertz or above, and with a transmitting power for each station of 1 kilowatt or above;

2) a system of signal receiving, signal transmitting, signal splitting, or signal combining operated with electromagnetic wave at a frequency of 300 megahertz or above, and with communication channels of 60 channels or above or equivalent;

(D) an operating supervision work in electromagnetic wave propagation system at a frequency of 300 kilohertz or above, and with a transmitting power for each station of 1 kilowatt or above.

Clause 8. Types and scales of the controlled professional engineering work in

the field of industrial engineering shall be as follows: (1) a consulting work, project planning work, designing and computation work,

construction and production control work, and consideration and inspection work: (A) a factory which requires fifty workers or above, or factory with an

investment of twenty million baht or above excluding the value of land; (B) a manufacturing, making, or assembly process of any object, a

production process of finished or semi-finished material, melting, casting, rolling, or metal

coating, and heat treating, plating, or processing of metal, wood, or other materials which requires fifty workers or above, or with an investment of twenty million baht or above excluding the value of land;

(C) an ore smelting, and metal refining which have a production yield as follows. In case of tin, the production yield shall be two tons or above per day. In case of lead, zinc, copper, or antimony, the production yield shall be 5 tons or above per day. In case of iron or steel, the production yield shall be 10 tons or above per day;

(D) a fire extinguishing system worth a total of three million baht or above, or with a fire protection area of 2,000 square metres or above;

(2) an operating supervision work: (A) a construction and machine utilized for a pollution control, waste

treatment, disposal of toxic, disposal of hazardous materials, or disposal of other substances from the factory which requires fifty workers or above, or with an investment of twenty million baht or above excluding the value of land;

(B) a ventilation system, lighting system, and other systems in connection with a pollution control, waste treatment, disposal of toxic, disposal of hazardous materials, or other substances from the factory which requires fifty workers or above, or with an investment of twenty million baht or above excluding the value of land;

(C) a manufacturing process with chemical reaction, utilizing flammable substance, hazardous substance, fractional distillation, or processing within equipment which has pressures above atmospheric pressure, within a factory which requires fifty workers or above, or with an investment of ten million baht or above excluding the value of land;

(D) a fire extinguishing system worth a total of three million baht or above, or with a fire protection area of 2,000 square metres or above;

Clause 9. Types and scales of the controlled professional engineering work in

the field of environmental engineering shall be as follows: (1) a water supply system with a maximum production rate of 1,000 cubic

metres or above per day; (2) a clean water system for factory, public building, or large building with a

maximum production rate of 50 cubic metres or above per day;

(3) a wastewater system for community, factory, public building, or large building which can support wastewater at a maximum production rate of 30 cubic metres or above per day;

(4) a wastewater recovery system for community, factory, public building, or large building with a maximum production rate of 30 cubic metres or above per day;

(5) a land or water resource development system which has an impact on environment in connection with:

(A) rainwater or rainwater swamp with a total maximum quantity of 10,000 cubic metres or above per day;

(B) wastewater or groundwater with a total maximum quantity of 1,000 cubic metres or above per day;

(6) an air pollution control system of the place where the polluted source has an exhaust ventilation airflow of 10,000 cubic metres or above per hour;

(7) a noise pollution control system for factory or public building which has a sound level beyond a prescribed legal standard;

(8) a soil treatment system which occupies an area of 3,000 square metres or above, or water treatment system with a maximum production rate of 30 cubic metres or above per day;

(9) a waste system in the following locations: (A) a community which has a waste quantity of 10,000 kilogrammes or

above per day; (B) a factory, public building, or large building which has a waste quantity

of 2,000 kilogrammes or above per day; (C) a source which has been rendered an infection and has a waste

quantity of 15 kilogrammes or above per day; (D) a source which has radioactive contamination of all scales;

(10) an industrial waste management of all scales; (11) a fire extinguishing system and fire protection system worth a total of

three million baht or above per system or with a fire protection area of 2,000 square metres or above.

Clause 10. Types and scales of the controlled professional engineering work

in the field of chemical engineering shall be as follows:

(1) a manufacturing process in factory or enterprise which relies on chemical reaction, chemical physics reaction, biochemical reaction, or electrochemical reaction so as to make product as determined, with an investment of one hundred million baht or above excluding the value of land, or requires a power of 500 kilowatts or above or equivalent;

(2) a manufacturing process in factory or enterprise which renders the modification of physical properties or phase transition in raw materials so as to make product as determined, with an investment of one hundred million baht or above excluding the value of land, or requires a power of 500 kilowatts or above, or equivalent. However, only for that consisting of a manufacturing process of the manufacturing unit under (9).

(3) a manufacturing process in factory or enterprise which its raw materials or products are in a form of powders or pellets that might bring about an explosion or electrostatic charge, with an investment of one hundred million baht or above excluding the value of land, or requires a power of 500 kilowatts or above, or equivalent;

(4) a manufacturing process in factory or enterprise which utilizes a hazardous chemical substance as a mixture or agent during the production;

(5) a manufacturing process in factory or enterprise which relies on a chemical reaction within a pressure of 3 atmosphere or above, or below a pressure of 1 atmosphere;

(6) a management or treatment process of waste from the manufacturing process of factory or enterprise which requires chemical substances, catalysts in chemical reaction, biochemical reaction, and biological reaction, or manufacturing unit which assist waste treatment, with an investment of one million baht or above excluding the value of land, or which requires a power in waste treatment process of 20 kilowatts or above, or equivalent;

(7) a storage or transfer system which is used in the factory or used for exportation out of the factory of hazardous materials, chemicals, toxic substances, or powder materials, or pellet materials which may bring about an explosion or electrostatic charge in a scale of 20 metric tons or above;

(8) all scales of manufacturing process which require or produce hazardous material, chemical, toxic substance, or flammable substance;

(9) a manufacturing process which relies on chemical reaction, chemical physic reaction, biochemical reaction, or electrochemical reaction of the following manufacturing units:

(A) a distillation column, adsorption column, absorption column, extractor, settling tank, or crystallizer which requires a power of 7.5 kilowatts or above, or equivalent;

(B) other types of separation apparatus such as membrane separator, ion exchange column, or packed bed filter which require a power of 7.5 kilowatts or above, or equivalent;

(C) other types of filtering apparatus such as filter bag, cyclone, or electrostatic precipitator which require a power in manufacturing process of 7.5 kilowatts or above, or equivalent;

(D) an evaporator or furnace used in the manufacturing process which requires a power of 10 kilowatts or above, or equivalent;

(E) a reactor of all scales (10) a fire extinguishing system of all scales in the chemical industry factory. Clause 11. This Ministerial Regulation shall not apply to the professional in

science and technology exclusively for the part in connection with the controlled professional engineering in the field of environmental engineering and controlled professional engineering in the field of chemical engineering.
