3Details of anti-dumping investigations

The Directorate General of Anti-Dumping andAl l ied Dut ies (DGAD) rece ived 27applications during the year 2004-05 fromthe domestic producers alleging dumping ofvarious products causing injury to thedomestic industry. After scrutiny of theseappl ica t ions, the DGAD accepted 12applications for initiation of investigation.Out of the remaining applications, 4 have notbeen accepted due to lack of sufficientev idence and documentat ion. 11applications were under scrutiny at the endof the reporting period.

The first anti-dumping investigation in Indiawas initiated in 1992. During the period from1992-93 to 2004-05, the DGAD receivedlarge number of applications for initiatingant i -dumping invest igat ions. Af terexamination of these applications, anti-dumping investigations were initiated in 179cases. Between 1997-2005, 47 applicationswere not accepted by the DGAD for variousreasons. Major product categories for whichanti-dumping applications have been filed bythe domestic industry pertain to chemicals& pet rochemica ls fo l lowed bypharmaceuticals, steel & other metals andf ibers/ yarns. The countr ies/ customsterritories involved are mainly China PR, theEU (including member countries), Korea RP

and Chinese Taipei. While the total numberof cases investigated is 179, countriesinvolved in these investigations are 36(considering EU as single territory).

3.1 DETAILS OF INVESTIGATIONS INITI-ATED BY THE DGAD SINCE 1992-93:

a. Fresh Cases :

During the period from 1992-93 to 2004-05,the DGAD initiated 179 investigations. Statusof these investigations as on 31.3.2005 isgiven in the table below :-

b. Review Cases:

From 1992 till 31.3.2005 the DGAD initiatedreviews in 78 cases. The break-up of thesereview cases is as follows:

3.2 DETAILS OF THE INVESTIGATIONSINITIATED BY THE DGAD DURINGTHE YEAR 2004-05:

a. Fresh Cases :

During 2004-05, the DGAD initiated 12investigations. Status of these investigations ason 31.3.2005 is given in the table below: -

* The WTO counts each country involved in an anti-dumping investigation as one case, whereas the DGADas a matter of practice counts each investigation asone case, irrespective of the number of countriesinvolved.

The Anti-dumping Rules provide for completionof investigation normally within 12 months fromthe date of initiation extendable upto 18 monthsunder special circumstances. This period wasnot over as on 31.3.2005 in the cases initiatedduring the year 2004-05. The findings in respectof these cases will be issued during the year2005-06.

b. Review Cases:

During the year 2004-05 the DGAD initiatedreviews in 17 cases. The break-up of thesereview cases is as follows:

3.3 CESTAT / COURT CASES :

Since 1992-93, appeals were filed in 68 casesby various interested parties in the CustomsExcise and Service Tax Appellate Tribunal(CESTAT) out of which decision has been takenby CESTAT in 49 cases. 31 cases have beendecided in favour of the Designated Authority,findings of the Designated Authority have beenmodified in 13 cases and findings have beenquashed in 5 cases.

During the same period, 44 writ petitions havebeen filed in various High Courts. Decision ofthe High Courts has been in favour of theDesignated Authority in 27 cases, matters havebeen transferred to Supreme Court in 2 cases.One case has been decided against DGAD.15 cases are pending for orders.

The number of appeals filed in the Supreme Courtsince 1992-93 is 19. The orders of Supreme Courthave been in favour of the Designated Authority in7 cases, in one case findings of DesignatedAuthority have been set aside and two cases havebeen remitted back to CESTAT for decision onmerit. 9 matters are pending for orders.
