Project Specific Activities

Preliminary Bridge Engineering TASK 0012 Bridge Estimate for Study Report

Those tasks necessary to estimate the costs to do bridge repairs as contained in the preliminary repair recommendations.

TASK 0014 Preliminary Repair Recommendations

All tasks required to publish preliminary repair recommendations, as necessary for Study Report documentation, stating the work necessary to rehabilitate a bridge. Tasks are complete when the District approves the repair recommendation document.

TASK 0017 Estimate For Study Report Without Preliminary Repair Recommendations

Those tasks necessary to estimate the costs to do bridge repairs as contained in the final repair recommendations (Task 0018).

TASK 0018 Final Repair Recommendations

All tasks required to publish detailed recommendations, stating the bridge repair work necessary to rehabilitate a bridge. These recommendations include work found necessary from the condition survey. Tasks are complete when the District approves the repair recommendation document.

TASK 0022 Hydraulics

Those tasks necessary to make recommendations for the bridge design parameters related to waterway conditions. Required waterway opening, structure type, flood elevations, flow member elevation, flow velocities and scour potential, at bridge site are normally included.

TASK 0030 Bridge Construction Foundation Review

Those tasks necessary to make recommendations for the type and depth of foundation to be used in the design of the bridge.

Those tasks necessary to determine or make recommendations for the type and extent of bridge aesthetic treatments. Mn/DOT has three levels of aesthetic investments: landmark, corridor, and routine. Work could include participating in and/or conducting meetings with various consultant, Mn/DOT, and city groups.

TASK 0035 Preliminary Bridge Plan

All tasks necessary to prepare a type, size, and location drawing for a bridge project. The drawing shows span arrangement, roadway cross section, and any other information necessary for guiding the detail design of the bridge. Work could include any of the following:

• Receive bridge survey • Submit depth of structure • Receive grades • Begin drawing • Complete drawing • Check drawing • Conduct construction review • Prepare for plan signing

TASK 0040 District Letter And Preliminary Estimate

Those tasks required to prepare and distribute the Preliminary Bridge Plan and the estimated cost for construction of the proposed bridge to those who need to coordinate other work with the bridge work.

TASK 0045 FHWA Approval

Those tasks necessary to obtain Federal Highway Administration approval of the Preliminary Bridge Plan as may be necessary for major bridge projects, interstate projects, and urban projects.

TASK 0050 Bridge Design

All design tasks necessary to complete bridge construction plans or design criteria or construction criteria for the project.

TASK 0062 Partial Plan Delivery

Those tasks necessary to accomplish the first submittal of work by the GEC showing the corner details of the bridge and direction proposed by the GEC for bridge design and plan preparation.

TASK 0068 Final Bridge Plan Review

All tasks necessary to review submittals of the final construction bridge plan.

TASK 0070 Consultant Final Tracings

All tasks required to prepare the submittal of the reproducible tracings and all design computations for the bridge plan with all revisions as discussed in the final review meeting.

TASK 0075 Tracing Backcheck

All tasks required to review the tracings to ascertain that all revisions discussed at the plan review meetings are incorporated into the final bridge plan.

TASK 0076 Bridge Specifications and Design Criteria

Those tasks required to prepare the written special provisions and design criteria required for the bridge construction that supercede or supplement the Mn/DOT standard specifications and the information shown on the plan.

TASK 0080 Bridge Construction Plan Review

All tasks required for the review of the design-builder’s bridge plan and special provisions, including all release for construction, final, and as-built versions.

TASK 0090 Construction Estimate

Those tasks required to prepare the engineer’s estimate for the bridge plan, including necessary funding separations for cost sharing with other agencies.

TASK 0095 Design-Build Bridge Concepts

Those activities required to develop and/or verify bridge concepts that will be included in the design-build RFP. Work could include any of the following:

§ Verify bridge locations, widths and span lengths § Determine preliminary beam type and superstructure depth § Verify lateral and vertical clearances § Verify retaining wall locations § Determine retaining wall types (cut or fill) and approximate heights

(1000) Design-Build Project Development TASK 1003 Project Scoping

All tasks and work necessary to determine the project's scope. This activity is intended to get all functional groups to review the project location, either in person or through other means, to trigger a review so that the project's scope is more clearly defined from this point forward. This activity could involve developing several alternatives (including a "do nothing” alternative) for the project that take into consideration existing roadway layouts, project goals, and public input. Work could include any of the following:

• Gather and compile data related to the project • Develop draft scoping sheet • Visit project site(s) • Conduct internal scope of work meeting • Finalize project scoping sheet and distribute to project team • Prepare preliminary analysis of data and hydraulic estimate

TASK 1010 Project Management

Those tasks necessary to manage or monitor the progress of a project during the Preconstruction Phase. This activity is performed over the entire preconstruction project schedule.

TASK 1011 Consultant Selection The process involved in obtaining consultant services for a specific project, activity, or task within a project. Work could include any of the following:

• Assess need for Consultant • Determine scope of services • Prepare and submit requisition for contracted services • Develop Request for Proposals • Review proposals and select Consultant

TASK 1012 Aerial Photography

All field and office tasks needed to plan for and produce aerial photography suitable for the Photogrammetric Base Map. District meetings requesting aerial photos are normally held in February. Because vegetation and snow prevent a clear view of the targets, flights for aerial photography suitable for producing the Photogrammetric Base Map can only be flown in the spring and fall. and contact prints from flights are normally available within two to three months after the flights. Work could include any of the following:

TASK 1013 Consultant Management

The process involved in managing the work done by a Consultant for a specific project, activity, or task. Work could include any of the following:

• Meet with Consultant • Review Consultant work progress • Maintain communication with Consultant

TASK 1015 Traffic Forecasts

The forecasting of traffic necessary for Preliminary Design. Traffic forecasts on complex projects can be very lengthy and need to be scheduled early to prevent delaying other preliminary engineering activities.

Work could include any of the following:

• Review Mn/DOT’s historically based traffic forecast for the project area • Evaluate land use and demographic data for potential adjustments to

previous forecasts • Develop long range, generally 20 year, traffic forecast using existing

traffic data • Develop a project need and objectives statement that is based on

public involvement, traffic studies, and analysis • Evaluate crash studies and alternative levels of service • Estimate service life of the project components.

TASK 1016 ESAL Calculations

The forecasting and calculating of traffic necessary for pavement design criteria and/or type selection.

TASK 1018 Photogrammetric Base Map

All tasks needed to provide photo control, base maps, and requested digital terrain model.

Photo control planning involves the analysis of specific control requirements for the project and ordering of photographic materials used in control and compilation. Photo control surveys involve surveying and computing the position of targeted control points and any supplemental control points needed. The survey crews also run field test profiles that will be used to figure the accuracy of compiled mapping. Work could include any of the following:

• Complete photo control planning • Conduct photo control surveying • Establish survey control points • Prepare field test profiles • Prepare analytical triangulation • Compile stereoscopic images • Prepare base map including digital terrain models (as needed)

TASK 1020 Preliminary Design Mapping

All office and field tasks necessary to provide mapping to District Preliminary Design. Work could include any of the following:

• Draw existing alignment on base map • Add annotation (street names, basic utility features, etc.) to base map • Place property lines on base map

TASK 1021 Preliminary Design Surveys

All field and office tasks necessary to obtain the survey information needed to prepare the Geometric Layout, consisting of land surveys, photogrammetric cross sections, exhibits, and map annotation.

Work could include any of the following:

• Existing alignment and existing right-of-way • Planimetric map files • DTM files in GEOPAK binary format - Triangular Irregular Network

(TIN) • Graphic file of obscured areas

TASK 1030 Control Surveys

All tasks necessary to furnish horizontal and vertical control for the project except photo control. Work could include any of the following:

TASK 1040 Final Design Surveys

All office and field survey tasks necessary to complete design activities (topography, cross-sections, drainage, utilities, etc.). Work could include any of the following:

• Conduct survey including topography, cross-sections, drainage, and utilities

• Process field data • Place property lines on Base Map • Produce field input file

TASK 1041 Bridge Surveys

All survey tasks necessary to document bridge geometrics. Work could include any of the following:

• Conduct survey • Prepare bridge survey report

TASK 1050 Scoping Document

All tasks necessary to prepare the document that provides information about the project including need, alternatives, and environmental impacts. In terms of the highway project development process, the Scoping Document is typically the first report prepared for projects thought to require an EIS, and it is distributed before the Public Scoping Meeting(s) so that comments on the project can be received and used to make a Scoping Decision. The Scoping Document serves the same purpose as a scoping EAW under the state process. The Scoping Document is required under MEQB rules for EIS projects. This

document identifies potentially significant issues relevant to the proposed project; defines the form, level of detail, content, alternatives, timetable for preparation, and preparers of the EIS; and is used to determine the permits for which information will be developed concurrently with the EIS. Work could include any of the following:

• Visit project site • Formulate alternatives • Prepare scoping document • Conduct review process among Mn/DOT, FHWA, and other external

agencies • Incorporate comments • Obtain approval of document • Publish the Scoping Document's Notice Of Availability in the MEQB

Monitor. • Distribute document

TASK 1051 Public Scoping Meeting

A meeting to share information about the proposed project at an early stage and to receive input from agencies and the general public to identify purpose and need, discuss the mode and project concept, narrow the number of alternatives that will be studied in greater depth in the environmental and project documents that follow, and discuss the consequences of the no-build alternative. The Public Scoping Meeting is required by the MEQB rules for EIS projects. The purpose of the Public Scoping Meeting is to present to the public and affected agencies the findings of the Scoping Document and to incorporate comments from the meeting into the Scoping Decision Document. The Public Scoping Meeting must be held during the 30-day comment period for the Scoping Document, but not less than 15 days after the Scoping Document is made available. Work could include any of the following:

• Prepare for meeting • Begin public review and Scoping Document comment period • Conduct meeting • Prepare and distribute Scoping Meeting minutes • End public review and Scoping Document comment period

TASK 1052 Scoping Decision Document

The tasks required to produce the Scoping Decision Document, which indicates the issues, and alternatives that will be examined in the EIS. The Highway Project Development Process Handbook 1, Part II, Section C, provides additional guidance for preparation of the Scoping Decision Document. Work could include any of the following:

TASK 1060 Draft Project Memorandum

Those tasks necessary to produce the draft project memorandum, which is a Mn/DOT document used for certain Class II Actions (Categorical Exclusions) in order to obtain Mn/DOT and FHWA environmental clearances. It may also be used as a vehicle for coordination with outside agencies (and the public) that may have an interest in the project. Normally, it is prepared early in the process while still addressing the content requirements. Work could include any of the following:

• Prepare document • Conduct review process • Incorporate comments

TASK 1070 Project Memorandum

Those tasks necessary to complete the Project Memorandum (PM). The Project Memorandum is a Mn/DOT document used for Class II Actions (Categorical Exclusions) in order to obtain Mn/DOT and FHWA environmental and design clearances. The appropriate project design standard is documented and when critical design elements of the project’s design standards are not met, design exceptions are noted and justified. It may also be used for coordination with other agencies and the public and guidance for final design. It is prepared as early as possible in the project development process, while still addressing the environmental requirements necessary for approval. Work could include any of the following:

• Revise Draft Project Memorandum • Conduct internal Mn/DOT review process • Conduct external agency review process • Incorporate comments • Obtain State Environmental “Exception” Determination and (when

appropriate) Federal Categorical Exclusion Determination approval TASK 1080 Preliminary Geometric Layout

All tasks necessary to complete Preliminary Geometric Layouts, which are conceptual plans showing the horizontal and vertical location of the proposed roadway(s) in relation to the existing topography.

Work could include any of the following:

• Concept alignment and profile • Approximate construction limits • Anticipated typical sections

TASK 1082 Wetlands

All tasks involved with identifying and describing project related wetland impacts, preparing impact assessment sections for project documents, designing wetland impact avoidance, minimization, and replacement measures, and deciding whether to develop project-specific replacement or use the wetland bank. This activity also covers all tasks associated with identifying, delineating, and mitigating wetland impacts. Work could include any of the following:

• Review files (i.e., NWI, USGS, SCS, County Soil Survey, DNR Protected Waters Maps, Mn/DOT and/or other aerial photos, existing boring logs, hydrologic studies, information on any county ditches) and project area

• Identify type of wetland impacts along project corridor (i.e., section, township, range, major watershed, wetland type Circular 39, wetland type Cowardin, dominant vegetation, total wetland size, impact area, topographic setting, if within the shoreland wetland protection zone the distance to the waterbody/watercourse)

• Delineate existing wetlands according to the United States Army Corps of Engineers Wetland Delineation Manual (January 1987. and determine impacts

• Prepare wetland impact sequencing section for project document • Describe the impacts on the functions and values of wetlands for

each alternative, including: *Vegetative diversity * Maintenance of hydrologic regime * Flood / Storm water attenuation * Water quality protection * Shoreline protection * Ground-water interaction * Wildlife habitat * Fishery habitat * Aesthetics/Recreation/Education/Cultural

• Commercial uses • Hold interagency coordination meeting/field review

• Mitigate impacts; design wetland impact avoidance, minimization and replacement measures

• Decide to develop project-specific replacement or use the state wetland bank

Inplace field data collection (surveys, inspections, etc.) cannot be accurately gathered during the winter season (December to April). This activity does not cover the construction or maintenance monitoring work for the wetlands.

TASK 1086 Economic Analysis

All tasks needed to identify the positive economic gains from a project and compare them to the investment made in order to ensure that infrastructure investments strengthen the economy. Work could include any of the following:

• Define alternatives, including base case • Perform traffic modeling • Estimate total costs • Monetize travel time, vehicle operating costs, traffic crashes

TASK 1090 Special Project Documents

All tasks necessary to complete Special Project Documents, which are separate documents (other than DEIS, FEIS, Environmental Assessment, Project Path Report, Scoping Document, SDD, FONSI, Project Memorandum, or Study Report), which are prepared based on the specific needs of an individual project. Examples of types of special documents necessary would include Section 4(f) statements, noise reports (preliminary & final), air quality reports, hydraulic reports, aesthetic reports, wetlands findings, Interstate Access Reports, Environmental Assessment Worksheets, Value Engineering Reports, etc.

Work could include any of the following:

• Determine type of Special Project Document(s) required • Noise Analysis (i.e., existing, no-build, and build conditions; new and

old alignment; daytime and nighttime; with and without noise barriers) • Air Analysis (i.e., no-build and build air quality analysis for one and ten

years after construction using Mobile 5A emissions and CAL3QHC dispersion modeling (or current Air Quality air quality model approved by EPA)

• Value Engineering (projects with an anticipated construction cost in excess of $25 million will need a value engineering study in accordance with Federal-Aid Policy Guide dated September 8, 1998, Transmittal 24, Chapter 6, “Value Engineering”.)

• Prepare document(s) • Conduct review process • Incorporate comments

TASK 1100 Draft Environmental Impact Statement (DEIS)

Those tasks necessary for the preparation of a DEIS, with all associated submittals and coordination required to comply with NEPA. The DEIS is a document that discusses the environmental impacts of a proposed Class I Action. It discusses all reasonable alternatives to the proposed action and summarizes the studies, reviews, consultations, and coordination required by law. The DEIS is a document required under MEQB rules for projects exceeding thresholds listed under FHWA regulations. The purpose of a DEIS is to provide information for governmental units, the proposer of the project, and other persons to evaluate proposed projects which have the potential for significant environmental effects, to consider alternatives to the proposed projects, and to explore methods for reducing adverse environmental effects. The documents shall be prepared in accordance with FHWA Regulations (as specified in 23CFR771 and FHWA Technical Advisory T6640.8A) and the Mn/DOT Highway Project Development Process, which can be found at www.dot.state.mn.us/tecsup/xyz/plu Impact items that must be addressed in preparation of the DEIS are listed in Table 2, Part II, Section D of the Mn/DOT Highway Project Development Process (Handbook 2A). Work could include any of the following:

• Prepare document • Conduct review process • Incorporate comments • Obtain approval to prepare FEIS • Distribute document after Public Hearing has been completed

TASK 1110 Public Hearing on a DEIS

All tasks necessary to prepare for, conduct, and document a public hearing; the purpose of which is to present to the public an explanation of a project, including alternatives under consideration, and receive public comments. A Public Hearing on a DEIS is required for an EIS project. It includes notices in the MEQB Monitor, Federal Register, and local newspapers; distribution of the DEIS; comment period; the public hearing; and preparation of a transcript.

The public involvement process could involve elected officials, affected Mn/DOT and other state, federal, and permitting agency staff, and the general public. There are different degrees of understanding of transportation and environmental concerns among these groups. Few, if any, participants will have any familiarity with the EIS process. Therefore, the public involvement task is primarily one of education. Work could include any of the following:

• Prepare for hearing • Conduct hearing • Incorporate comments into Public Hearing Document • Prepare Public Hearing transcripts and affidavits of publication • Distribute Public Hearing documents

TASK 1111 Public Hearing on an EA

All tasks necessary to prepare for, conduct, and document a public hearing on an Environmental Assessment (EA); the purpose of which is to present to the public an explanation of a project, including alternatives under consideration, and receive public comments.

A Public Hearing on Environmental Assessment projects is sometimes required. When a public hearing is not held, a Notice for an EA will be prepared (see Opportunity for Public Hearing (1130).) Since the EA also serves as a State EAW, MEQB rules must also be followed. Public Hearings on EA include notices in the MEQB Monitor and local newspapers, distribution of the EA, comment period, the public hearing, and preparation of a transcript.

Work could include any of the following:

All tasks necessary to prepare for, conduct, and document an information meeting, the purpose of which is to present to the public and other governmental agencies an explanation of a project, including alternatives under consideration, and to receive comments.

Public Information Meetings are used to inform and gather information from the public on project alternatives, impacts, schedule, cost, and other activities. There are no specific time requirements. Multiple Public Information Meetings may be used on a project.

Work could include any of the following:

• Arrange for meeting location • Announce meeting • Prepare for meeting • Conduct meeting • Incorporate comments into Public Meeting Document

TASK 1120 Final Environmental Impact Statement (FEIS)

All tasks necessary for the preparation and processing of the Final Environmental Impact Statement (FEIS) document as established by federal and state laws.

The FEIS is a document required under MEQB rules for projects exceeding thresholds listed under FHWA regulations. The purpose of the FEIS is to respond to the substantive comments received on the DEIS consistent with the scoping decision. The FEIS discusses responsible opposing views related to scoped issues which were not adequately discussed in the DEIS, and Mn/DOT’s response to those views.

Changes from the DEIS are generally, but not necessarily always, minor and consist of factual corrections and/or an explanation of why comments received on the DEIS do not warrant further response (this assumes that all issues were adequately presented and evaluated in the DEIS). In this case, the EIS would consist of the DEIS and an attachment containing the following:

• Errata sheets making any necessary corrections to the DEIS • An explanation of how mitigation will be developed • Summaries of all substantive comments of the DEIS and responses

thereto.

The FEIS is generally reviewed by Mn/DOT District, Central Office, and FHWA staff, and could involve meetings with any one or all groups to review comments. Work could include any of the following:

TASK 1121 Adequacy Determination

Those tasks needed to write the brief report known as the Mn/DOT Adequacy Determination, which is required by the MEQB rules and provides reasons explaining why the EIS is adequate. The Adequacy Determination can be made no earlier than 10 working days after FEIS Availability Notice appears in the MEQB Monitor. The Adequacy Determination is required under MEQB rules for EIS projects. The purpose of this document is to determine if the EIS adequately addresses potentially significant issues and alternatives raised in scoping, was prepared in compliance with State procedures, and provides responses to the substantive comments received during the DEIS review. The format and content is not extensive. A letter is prepared according to the requirements in the “Mn/DOT/State Alternate Environmental Review Guidelines” and MEQB rules (Ch. 4410.2800). Work could include any of the following:

TASK 1122 Record of Decision Those tasks performed by the District to prepare a draft of the Record of Decision (ROD). The ROD is a federal document that states what decision was made, identifies all alternatives considered by the agency, and states whether all practical measures to minimize environmental harm will be adopted.

Approval cannot occur until at least 30 days after the FEIS Notice of Availability appears in the Federal Register. The Record of Decision presents the basis for the FHWA (or other federal agency) environmental decision, summarizes any mitigation measures that will be incorporated in the project, and documents any required Section 4(f) approval. The ROD is required for EIS projects.

TASK 1129 Environmental Assessment

The process of writing the Environmental Assessment (EA), a federally required document, for those federally aided actions that are not Categorical Exclusions and where the potential significance of the environmental effects is not clearly established. The EA is also used as a State Environmental Assessment Worksheet (EAW) for those federally aided projects that are not exempt and which are not clearly mandated State EIS projects.

When a public hearing for an EA project is not held, a notice of availability of the EA will be placed in the local newspapers. Since the EA also serves as a State EAW, MEQB rules must also be followed. A notice of availability for an EA includes notices in the MEQB Monitor and local newspapers, distribution of the EA, and comment period. An Environmental Assessment Worksheet is a State document required for projects where certain thresholds are crossed.

TASK 1131 EIS Need Decision

Those tasks necessary for Mn/DOT to make an EIS Need Decision, which is a State requirement, and can be thought of as a Finding of Facts and Conclusions (FOF&C) and decision on the need for an EIS. The FOF&C summarizes the State environmental review process and includes summaries of the steps taken in reviewing a proposed project in accordance with environmental review procedures, public and agency written comments on the Environmental Assessment (EA) or Environmental Assessment Worksheet (EAW) and Mn/DOT’s response, and the issues raised through public involvement, including public hearings, and Mn/DOT’s response. It also includes the conclusions, based on findings, that the project has no potential for significant environmental impacts; that feasible mitigation will be provided; that all environmental review requirements have been met; and a decision on the need for an EIS. Typically, a negative declaration is made. It is required under MEQB rules. The EIS Need Decision includes preparation of a Findings of Fact and Conclusions and distribution of the decisions.

TASK 1132 Finding of No Significant Impact

The development of the Finding Of No Significant Impact (FONSI), which is a separate document written for the FHWA. The Environmental Assessment and Finding of Facts and Conclusions are attached to the FONSI and incorporate by reference any other appropriate information. The FONSI documents the finding that no EIS is needed, and the request for it is a product that includes the hearing transcript (if held), letters, responses, etc. The FHWA approves the FONSI package.

• Alignment and profile • Construction limits suitable for purchase of any additional R/W, if

necessary, to construct the project. Such R/W may include, but is not limited to, drainage; NPDES permit requirements, and wetland mitigation.

TASK 1141 Preliminary Hydraulics Design

The tasks needed to develop preliminary hydraulic recommendations from the District Hydraulics/Metro Water Resources Engineer. Inplace field data collection (surveys, inspection, etc.) cannot be accurately gathered during the winter season (December through April). Work could include any of the following:

• Research files • Identify permits • Identify and review inplace drainage patterns and structures • Identify new drainage patterns and design criteria • Recommend preliminary construction limits • Prepare cost estimates, cost splits (by agency if applicable), and

recommendations TASK 1142 Municipal Approval of Final Layout

All tasks needed to receive a Resolution from the municipality(s) approving the Final Geometric Layout. Minnesota Statute 161.172 notes that highway improvements involving the following require municipal consent:

This task includes the development and ongoing design enhancement and maintenance of a design-build project website that the public could view from either Netscape or Microsoft Explorer web browsers. This task could also include work necessary for identifying and building links to other appropriate websites and information, including the Department’s program website, www.dot.state.mn.us/designbuild. This task could also include the creation of a secured access website that would be used by the project team for sharing project design files, text documents, or other project-related information that is not ready for public viewing.

TASK 2050 Procurement Debriefing

All tasks necessary to prepare, coordinate, conduct, and document debriefing meetings with the teams that were interested or involved in the project procurement. This could include teams that were not short-listed, short-listed but unsuccessful teams that were not chosen for the design-build contract, and the selected design-builder. The purpose of the meetings would be to solicit feedback from each team regarding the process, procurement documents, methodology, level of effort, and ideas for improving future projects.

(3000) Design-Build Contract Administration 1 General Requirements

This section outlines a general list of the responsibilities and requirements for the GEC. This is broken into two subsections. Section 2.6 identifies the types of services that could be needed to administer the design and construction aspects of a design-build project, including design and construction quality management, inspection, materials testing and design-build contract administration. When examining the plans from the Design Builder, the GEC would use the following – or similar – criteria to check and review the plans:

• Review – A comparative analysis for agreement with standard practice,

agreement with similar structures, all with application of professional judgment. Mathematical analysis is not specifically required, but may be necessary where a discrepancy appears likely. Could include an analysis of the Design Builder’s methods, assumptions, and calculations.

• Check – Make a complete mathematical computation and resolve all

differences that appear in the plans. All record keeping and documentation will be in accordance with standard Department procedures, formats, and content.

2 Personnel Training and Experience Requirements

For the 5000 series tasks listed below, the GEC would be expected to provide a satisfactory number of qualified personnel as necessary to effectively carry out its responsibilities under each work order that included contract administration. Depending on the project, there may be work during nighttime hours, on weekends, and/or generally under tight time constraints. The number of personnel needed during any particular project may change as the project progresses (i.e., intense roadway and bridge/structure design in the early stages that tapers off to plan submittal review near the end of a project.

The GEC may only use competent personnel who are qualified by experience and/or education as indicated. Minimum qualifications for some example positions are defined in this section. For any specific project work order, the Department may require that these minimum qualifications be altered in specific instances when the unique nature of the work requires specific or more specialized skills that are not shown below.

2.1 General Staffing Requirements The GEC will adequately staff each project sufficiently in advance of the beginning of work on that project to be properly prepared to satisfy its responsibilities; however, the GEC must not assign any personnel to any project until submitting, in writing for the Department’s review and approval, the qualifications of each person proposed to be assigned to that project. The GEC must submit its request for approval to the Project Manager at least two weeks before the date an individual is to report to work. Responsible personnel, thoroughly familiar with all aspects of design and construction may need to be available until the design-build contract is complete, to resolve any final pay quantities disputes.

An individual, who is previously approved by the Project Manager, but whose performance is later determined by the Project Manager to be unsatisfactory, will be replaced by the GEC in accordance with Section xxxxx of this Scope of Services.

The Department considers that any personnel identified in the GEC’s proposal will be assigned to design-build project(s) and committed to performing program support services. Any changes in personnel from the people identified in the GEC’s proposal will require written approval from the Project Manager.

When the design-builder’s operations on a Contract diminish, the GEC will reduce the number of its personnel assigned to that Project as appropriate. Any adjustment of GEC forces as recommended by the Project Manager will be accomplished within one week after notification.

2.2 Roadway Design Personnel Training and Experience

Specific personnel, experience, licensure, and registration requirements may vary from project to project, but will be specifically defined in each project work order. The personnel, experience, licensure, and registration requirements shown below are a representative sample of what the Department would require on specific design-build projects or program support activities:

Before starting a project for which the GEC will provide construction and/or materials testing administration, all GEC staff must have a working knowledge of the current Contract Administration Manual and Mn/DOT’s Standard Specifications, and must possess the necessary certifications for performing the duties of the position they hold. The GEC will ensure that the Department’s current practices, policies, and procedures are met throughout the course of the project. The following training and experience standards are expected, as a minimum, for all GEC personnel under each category.

2.6 Potential Tasks for Design-Build Contract Administration TASK 3010 Roadway Design Review

All tasks necessary for the GEC to review the design-builder’s plans for conformance to the design concept upon which the preliminary plans and the design-build RFP were prepared. Depending on the work order agreement, the GEC could be responsible for making sure that the plans coming from the design-builder are complete and correct. The roadway design review will be performed as shown in Table 5010.1.

Work could include any of the following:

• Review and check the design-builder’s roadway plans, which could include the following preliminary road plans, release for construction plans, 100% plans, and as-built plans.

• Verify that the final plans will be prepared in accordance with current Mn/DOT standards and practices and follow the format of the Mn/DOT sample plans. These practices include, but are not limited to, the most current version of the Mn/DOT Road Design Manual, the CADD Design Standards, and following the Mn/DOT Architectural And Aesthetic Design Guidelines.

• Other design review services required to adequately oversee the design-builder’s roadway design activities and products.

TASK 3030 Contract Administration – Design The GEC will perform all design-build contract administration services necessary to assure the proper coordination of all parties involved in accomplishing completion of the projects is achieved; to maintain complete, accurate records of all activities and events relating to the projects; to properly document all significant changes to the projects; to provide interpretations of the design-build RFP, plans, specifications, and contract provisions; to make recommendations to the Department to resolve disputes which arise in relation to the construction contracts; and to maintain an adequate level of surveillance of the Design Builder’s activities.

The GEC will also perform any other contract administration services that are required to fulfill its responsibilities under this Agreement. All record keeping and documentation will be in accordance with standard Department procedures, formats, and content.

Work could include any of the following:

1. Attend any conferences or meeting necessary for close coordination during day-to-day progress of the work or as required to carry out the design-build contract. Meetings could include a pre-construction and close out meeting.

2. Become familiar with the standard design practices of the Department, the design-build plans, design-build RFP, and design-build contract, and the design builder’s proposed schedule of operations before beginning design review services.

3. Assign a sufficient number of technically qualified and experienced personnel to the project to perform the services required under the contract, in a timely manner to avoid delay to the design-builder.

4. Notify the Project Manager immediately of any unanticipated project conditions.

5. Withdraw any personnel or halt any services no longer required, at the request of the Department, or within a reasonable time after the lack of need becomes apparent to the GEC.

6. Provide for GEC personnel transportation, supplies, materials and incidentals as are needed to accomplish the Services required under the contract.

7. Provide design review services on a full time basis during all pertinent construction activities. The GEC staff will be required to co-house with the department staff and the design builder’s staff.

8. Maintain a record of design submittals, approvals, changes, and modifications.

9. Prepare and submit such periodic, intermediate, and final data and records as may be required by the Department and as are applicable to the project.

10. Collect, properly label or identify, and deliver to the Department all original calculations, drawing and sketches, electronic design files, records, reports, and other documents prepared by the GEC in the performance of the work order, upon completion or termination of the work order.

11. Review and monitor the design-builder’s schedule for design.

12. Document changes in plans and specifications for as-built plan preparation.

13. Review the design-builder’s as-built plans.

14. Provide to the design-builder, interpretations of the plans, specifications, and contract provisions. The GEC will consult with the Project Manager when an interpretation involves complex issues or may have an impact on the cost of performing the work. When warranted, the Project Manager may request an interpretation from the GEC.

15. Evaluate value engineering proposals, in cooperation with the Project Manager, and provide conclusions as to whether or not proposed changes are structurally equal to the planned construction as well as the validity of estimated savings to the Department and the design-builder.

16. Analyze changes to the design-build RFP, plans, specifications or design-build contract provisions and extra work, which appear to be necessary to carry out the intent of the contract. When it is determined that a change or extra work is necessary, the GEC will make recommendations to the Project Manager for approval.

17. Assist appropriate Department offices in preparing for arbitration hearings or litigation that may occur during the contract.

18. To prevent delays in design-builder’s operations, promptly check and review plans, calculations, and specifications, produce reports, and/or write communications.

TASK 3040 Contract Administration – Construction

The GEC will provide services as necessary to administer the construction portion of the design-build contract to assure that the project is constructed in substantial conformity with the design-build RFP, plans, specifications, and contract provisions.

The GEC will advise the Project Manager in writing of any omissions, substitutions, defects, and deficiencies noted in the work of the design-builder and the corrective action taken.

The GEC will perform technical duties in inspecting work to assure compliance with the Department’s Contract Administration Manual, Standard Specifications, the design-build request for proposal, special provisions, construction plan, policies and procedures, standards, OSHA Regulations, and FHWA guidelines, as well as any other applicable laws. The GEC will provide on-site construction inspection on a full time basis during all critical construction activities. The design-builder will provide quality inspection service by ensuring that all construction is in accordance with approved plans, specifications, special provisions, and that compliance with Mn/DOT construction standards and policies is maintained.

The GEC will perform services necessary to assure proper coordination of the activities of all parties involved in the projects; to maintain complete, accurate records of all activities and events relating to the project; to properly document all significant changes to the project; to provide interpretations of the design-build RFP, plans, specifications, and contract provisions; to make recommendations to the Department to resolve disputes which arise in relation to the construction contract; and to maintain an adequate level of surveillance of the design-builder’s activities.

10. Prepare and submit such periodic, intermediate, and final data and

records as may be required by the Department and as are applicable to the project.

11. Collect, properly label or identify, and deliver to the Department all

original diaries, logs, notebooks, accounts, records, reports, and other documents prepared by the GEC in the performance of the work order, upon completion or termination of the contract. Keep daily diaries, logs, and records consistent with Department practices as are needed for a record of the design-builder’s construction progress.

12. Review and monitor design-builder’s schedule for construction.

13. Prepare all appropriate contract time documents (Weekly

Construction Diaries & Status Reports) in accordance with the design-build RFP, specifications, and special provisions, and the Contract Administration Manual. Submit to the Department for review.

14. Perform daily reviews of detour signing and maintenance. Take

any corrective action necessary.

completed. Measure and compute quantities of all materials incorporated in the work and items of work completed, and record date into a database.

16. Document changes in plans and specifications for as-built plan

preparation.

17. Prepare partial estimate pay vouchers using a database and provide to the Department for approval. Partial pay vouchers will be generated at regular intervals not to exceed once a month.

18. Prepare final documentation of construction pay items, quantities,

materials, and other requirements as per the design-build RFP, plans, specifications, special provisions, and the Contract Administration Manual.

19. Review the design-builder’s submittals of records and reports

including: weekly payroll; statement of wage compliance; requests for payment of materials on hand; or other reports and records as required for the project by the Department.

20. Conduct final inspection and recommend project acceptance.

21. Prepare final documentation of construction pay item quantities in

accordance with the design-build RFP, plans, specifications, special provisions, and the Contract Administration Manual.

22. Generate a draft final voucher using CAARS and submit to the

Department for review and approval. The Department will produce the Final Payment Voucher and Certificate of Final Acceptance. Prepare final project documentation in accordance with Mn/DOT Construction Manual.

23. Review the design-builder’s as-built plans.

24. Sample and test all component materials used on the project and obtain samples for submittal to Mn/DOT’s District Laboratory. Field-testing may include, but is not limited to, concrete (slump tests, cylinders, etc.), bituminous (asphalt cement samples, temperatures, quantity weigh tickets, gradations, etc.), grading and base materials (gradations, moisture, density, etc.), pile driving (driving depth, etc.) in accordance with the design-build (Modified) Schedule of Materials Control. The GEC will sample and test, as appropriate, materials to be incorporated in the work and will reject the design-builder’s work and materials that do not meet the designated criteria.

25. Test materials in accordance with Mn/DOT’s design-build

(Modified) Schedule of Materials Control and the Department Standard Specifications or as modified by the design-build RFP. Where the Schedule of Materials Control specifies laboratory/Agency testing, those tests will be performed at the District Materials Laboratory. The GEC will be responsible for delivering the samples to the District Materials Laboratory.

26. The GEC will keep daily diaries, logs, and records consistent with

Department policy as are needed for a record of the construction design-builder’s progress. Necessary concrete, bituminous and grading and base reports will be prepared by the GEC and submitted to responsible parties as required during the same week that the construction work is done or as otherwise directed by the Project Manager.

27. All testing equipment used by the GEC will be calibrated at least

once per year, or at the specified intervals, in accordance with Mn/DOT’s Laboratory, Bituminous, Concrete and Grading and Base Manuals.

28. No provisional certifications will be allowed for these testing procedures.

29. The GEC will contact the District Independent Assurance Inspector

and request an Independent Assurance review for the project. This review may be necessary for all testers and observers; at least one documented check of each tester and observer is required each year. The individual tester or observer may be required to perform the test(s) in either the field or the District Materials Laboratory.

§ The tester is defined as the individual who actually runs the

test. § The observer is defined as the inspector who watches the

design-builder run the test. 30. Schedule and conduct a utility preconstruction conference and a

project preconstruction conference. Record significant information revealed and decisions made at these conferences and distribute copies of these minutes to the appropriate parties.

31. Maintain on a daily basis a complete and accurate record of all

activities and events relating to the project and a record of all work completed by the design-builder, including quantities of pay items in conformity with final estimates preparation procedures, and

specifications. The GEC will immediately report apparent significant changes in quantity, time, or cost as they are noted to the Project Manager.

32. Maintain Contract Time and Project Diary for the entire project. 33. Maintain a log of all materials entering into the work with proper

indication of the basis of acceptance of each shipment of material. 34. Maintain records of all sampling and testing accomplished and

analyze such records required to ascertain acceptability of materials and completed work items. The field reports for records of work and testing results will be submitted within one week.

35. At least once each month, prepare a comprehensive tabulation of

the quantity of each pay item satisfactorily completed to date. Quantities will be based on daily records or calculations. Calculations will be retained. The tabulation will be used for preparation of the Monthly Pay Voucher. The Monthly Pay Voucher will be generated by the GEC.

36. Provide the design-builder with interpretations of the design-build

RFP, plans, specifications, and contract provisions. The GEC will consult with the Project Manager when an interpretation involves complex issues or may have an impact on the cost of performing the work. When warranted, the Project Manager may request an interpretation from the GEC.

37. Evaluate value engineering proposals, in cooperation with the

Project Manager, and provide conclusions as to whether or not proposed changes are structurally equal to the planned construction as well as the validity of estimated savings to the Department and the design-builder.

38. Analyze changes to the design-build RFP, plans, specifications, or

contract provisions and extra work, which appear to be necessary to carry out the intent of the contract. When it is determined that a change or extra work is necessary, the GEC will make recommendations to the Project Manager for approval.

39. When it is determined that a modification to the original contract for

a project is required due to a necessary change in the character of the work, negotiate prices with the design-builder and prepare and submit for approval by the Project Manager all design-build contract changes in accordance with applicable Department policies.

40. In the event that the design-builder gives notice, either written or

verbal, that it deems certain work to be performed is beyond the

scope of the design-build contract, and it intends to claim additional compensation, the GEC will maintain accurate records of the costs involved in such work. These records will include labor and equipment times and materials installed (temporary or permanent) in the portion of the work in dispute.

41. In the event that the design-builder for a project submits a claim for

additional compensation, analyze the submittal and prepare a recommendation to the Project Manager covering validity and reasonableness of charges and conduct negotiations leading to recommendations for settlement of the claim. Maintain complete documentation of schedule, work, and planning data conclusive for counsel’s use and defense procedures. If necessary, the GEC/Subconsultant will act as an expert witness in defense of claims for the Department.

42. In the event that the design-builder for a project submits a request

for extension of the allowable design-build contract time, analyze the request and prepare a recommendation to the Project Manager covering accuracy of statements and the actual effect of delaying factors on completion of controlling work items.

43. Prepare and submit to the Project Manager a Final Voucher and

Final Documentation and as-built plans.

44. Assist appropriate Department offices in preparing for arbitration hearings or litigation that may occur during the GEC’s contract time.

45. Monitor the design-builder’s compliance with design-build contract

provisions concerning payment of predetermined wage rates in accordance with Department procedures. This includes design-builder compliance.

46. Serve as the Compliance Officer for surveillance of the design-

builder’s compliance with contract requirements. The Compliance Officer is responsible for reviewing, monitoring, evaluating, and acting upon documentation required for design-build contract compliance and maintaining the appropriate files thereof. Typical areas of compliance responsibility include EEO Affirmative Action, DBE, OJT positions and number of hours, payroll and subcontracts.

47. Monitor the construction project to the extent necessary to

determine whether construction activities violate the requirements of any permits. Notify the design-builder of any violations or potential violations and require its immediate resolution of the problem. Violations must be reported to the Project Manager immediately.

48. Maintain a complete log of all submittals of shop drawings, noting

the dates of first submittal and subsequent reviews and resubmittals, approvals, etc. The GEC will take note of and ensure that any changes are properly carried through to construction and will further record, report, make recommendations and adjudicate upon any circumstances which affect the progress or cost of the work: The GEC will actively encourage all reviewers to accomplish reviews promptly. Shop drawings will also include any manuals or similar documents outlining proposed construction procedures submitted by the design-builder.

49. Provide coordination between the design-builder and utility

companies to assure that conflicting utilities are removed, adjusted or protected in-place in a timely manner to minimize delays to construction operations. Documentation will be maintained in accordance with the Department’s policies.

50. As required by the Project Manager, provide inspection of utility

work including reimbursable utilities that are shown in the contract. This will also include all required documentation.

51. Conduct a weekly meeting with the design-builder and/or utility

companies to review plans, schedules, problems, or other areas of concern. The results of these meetings will be recorded with minutes distributed to all affected parties including the Project Manager.

52. Conduct and document field reviews of the maintenance of traffic

operations including after normal working hours, weekends, and holidays.

53. To prevent delays in design-builder’s operations, promptly produce reports, verify quantity calculations, field measure for payment purposes, and/or write communications.

54. Upon identification of a proposed changed condition or construction

contract change, analyze the extent of change, and estimate an order of magnitude change in cost and time change, if any.

55. Negotiate all contract changes, in accordance with Mn/DOT

Standard Specifications, utilizing the design-builder’s prepared fair cost estimate, along with approval from the Mn/DOT Estimating Section. Submit the results to the Project Manager and report if agreement is not reached. The Project Manager will review and approve recommended changes in cost and time. The GEC will prepare contract change documents and track the status of each document.

56. Videotape the pre-construction conditions throughout the project limits. Provide a digital photo log of the project area, with heavy emphasis on areas with potential claim items/issues and on areas of real/potential public controversy.

manage inquiries from the public, public officials, and the news media, including but not limited to, acting as liaison for the Department in matters dealing with public meetings (notifications, arrangements, recording), construction meetings, the Internet (updating website, maintaining address, compiling address book of site users), and media (preparing press releases, newsletters, newspaper articles, public advisories) and responding to and recording contacts from the general public. TASK 4030 Design-Build Evaluation

Develop a methodology for evaluating the performance of Mn/DOT’s design-build projects compared to design-bid-build projects, addressing such things as

• Delivery schedule • Initial cost vs. final cost • Change order and claims history • Life-cycle costs of proposed and constructed items • Congestion management and reduction • Designer and contractor concerns • Perceived advantages and quality of the design and construction • Other factors that would provide a complete evaluation of Mn/DOT’s

design-build experiences.

This task could include an annual report with regard to the status of the program and individual projects.

TASK 4040 Design-Build Training

All tasks necessary to develop and deliver design-build training to the Department’s project delivery staff and other stakeholders. Work could include coordinating with other groups such as the University of Minnesota’s Center for Transportation Studies (CTS) or the Design-Build Institute of America. Training could be delivered to project specific work teams or provided as a general seminar or part of the Department’s design-build “users group” meetings.
