1. Mission Statement

A grand majority of graphic designers do not understand or

implement contracts within their work. Contracts are the basic level of

protection for graphic designers. The current f ight against this dilemma

is Online templates ; great for those who already understand contracts,

but leaving many readers scratching their heads.

Design Agreement is a multi-day traveling conference all about

teaching freelance graphic designers how to understand contracts, and,

through understanding, develop the ability to read contracts presented

to them and write outgoing contracts for freelance client work. This new

skill will provide more comfort, security, and control to designers.

2. Why

While many publications, most noticeably the AIGA STANDARD

FORM OF AGREEMENT FOR DESIGN SERVICES, are great resources,

they are not teachers (Graphic Artists...). 83% of designers surveyed by

Terry Stone, in 2006, do not use the AIGA standard form. There is a fear

and discomfort from the design community, from the recent college grad

to the long term freelancer. Designers want to learn more about contracts

for the simple fact that; designers get screwed by contracts.

3. Strategy

Design Agreement is presented through a 2 day design

conference. The f irst day is planned around teaching the basics of a

contract, common contract clauses, and being able to defuse ‘ legalese.’

The focus of the second day is workshops based upon where designers

have a lack of understanding. Workshops wil l also be focused on writing

contracts for certain projects, the differences between a web contract

and a logo contract. Partnering with local design communities is

essential in the holding of events.

4. Why

The template is the current overarching solution. While this is

a usable item, it ignores hands-on learning. Design Agreement is focused

on understanding contracts, and that requires hands-on learning. Without

building the basic understanding of a contract, a template is void and

potentially dangerous. Through a convention of workshops and lectures,

designers will work from a basic understanding to contract autonomy.

The f inal step is comfort. When a designer is able to competently

represent themselves legally, the contract changes from a form to be

feared to a protector of their work.

1. Exploration of Logo Possibilities

The main challenge for Design Agreement was choosing an

appropiate name without too much length. As contracts have been heavily

covered by a multitude of sources, many names are already out and

about. Contracts for Creatives, Design Contracts, Contracts for Graphic

Designers, etc. were already within use.

I orginally exporled the name X or x . After just a few

repugnant logos combined with questioning looks as to what the logo

actually was, I realized my own humorous style was a barrier to a

serious logo for the project. Playing to my own strengths, as well as the

aesthetics of designers, I decided to shoot for a type only solution, which

would keep the brand simple and easily approachable. After a long search

Design Agreement was settled on. At right you can see a few sketches for

defunct early logo solutions.

Simplicity is the name of the game. I used typographyforlawyers.

com to choose a font family with both a design history and a law history

(see page 10 for more details). With simplicity in mind Design Agreement

uses just a wordmark with an optional box surrounding it. Left airy and

open, the brand felt as though it was too crowded with a logo, and the

logo often left viewers more confused in the case of a brand such as this,

which mixes law and creativity. Oil and water. The optional box around

the wordmark is based upon old contracts, which would have a box

drawn around them, and current invoicing procedures, in which the box

is the general symbol of separation between categories and inputs.

2. Wordmark

The beef and potatoes of the brand. Combining the design

history of Caslon, with the modern and creative approach of Benguiat,

it is a type that can be pushed around like Helvetica, but with a classic

older look. Pushing the leading to a huge 250, and setting all caps helps

to complete the look of a contract title.

3. Lack of Icon

A combination of the need for simplicity with my own

inadequacies. Anything beyond a simple wordmark caused a busy look

with an already lengthy feeling name. My own mark making trends toward

cartoony and humorous, thus my logos were not an appropriate f it.

1. Choice

Design Agreement uses ITC Caslon 224 as its only typeface.

With a basis of making contracts simple, it was found that a simple single

typeface solution would prove suitable. A reworking of William Caslon’s

type work (“William...”) by Edward Banguiat (“Edward...”), Caslon 224

has deep roots within design history. The discovery of this font was due

to font recommendations on typographyforlawyers.com, in which Matthew

Butterick demonstrates Williams Caslon. Caslon has a higher contrast

between its thick and thin lines within its serif than Williams Caslon.

2. Usage

The wordmark for Design Agreement uses Caslon in all caps,

medium, and with a massive 250 tracking. Title usage is also in all caps,

however in bold and with 200 tracking. In body Caslon is generally

limited to 75 tracking, and used in either black, medium, or medium

italic, and never in all caps. This usage is based upon the general layout

and formatting of type within legal documents.

Simple black and white with few hits of color when appropriate.

Design Agreement is based upon the simplicity of what contracts can be.

Based on the aesthetic of a contract, the color palette is plain. The goal is

to show contracts as simple and easy to use words. Graphic designers are

familiar with the visual laden side of words as well as working with their

context. Design Agreement has based its color usage on that simplicity.

1. Why

There are two based tones which needed to be presented.

The f irst tone is that which makes designers feel happy inside,

and invited them to come and partake. Simplicity and type, two concepts

which are familiar and comforting to the greater designer community.

Taking the layouts from a profusion of contracts already in exsistence

and fusing it with Swiss typographic posters allows for a law feel in

combination with an airy and simplistic composition.

The second tone is the dystopia to the f irst tone’s utopia. Busy

type, overlayed or placed together in such a way where readibility is

still exsistant, however is lowered and diff icult. Sometimes this type

style is used within punk or dada aethetics. It’s main goal is to show

the stereotypical designer view of what a contract looks like. Put in

combination with the f irst tone, it will appear even more overwhelming

and busy.

1. Audience

Graphic Designers ; in particular those who freelance or don’t

have much experience with contracts. Even those who already use

contracts would f ind it beneficial to attend to get a second look at their

contracts in use, but also to refresh their memory. Design Agreement

looks to affect those who are not confident with contracts, fear them, are

ignorant to the words presented, and overall hurt by not having a working

understanding of them.

The essential target market are those getting screwed by

contracts. The people in need of immediate help. Those who have already

been screwed by contracts are equally important, an older group, they

also need help in reworking their existing contracts. The f inal group is

a preventative one, the youthful designer who has yet to use or need a

contract. By implementing a usage of contracts with them early on in

their careers, Design Agreement builds a stronger business person out of

that designer.

1. Audience

Graphic design is one of the lowest paying jobs to be expected

directly out of college (StudentsReview). The median salary for a graphic

designer nationwide in the U.S. is $49,315 (salary.com). This places the

average graphic designer income just below the median household income

nationwide of $51,017 (Denavas-Walt). With such a low level of pay for a

career that averages a college education; money is tight. Alongside this,

lawyer fees are notoriously high, even a contract review lawyer in NYC

can cost between $50 and $75 an hour (Neil). And all that lawyer does is

double check your already written document.

When asking graphic design students, teachers, and working

professionals whether a design was a good or service within a contract,

I was met with mainly odd stares and excessive questions. It seems that

most designers have a lax understanding as to what they are even selling

in business or law terms (Stone). A f inancial f law. Such an error can cost

a designer hundreds of dollars, or even the rights to their own work, or

in a worst case scenario: a lawsuit for displaying the work they created

in their own portfolio. Even the Graphic Arts Guild recommends using a

clause for such a case (Shaftel).

2. Why

Designers don’t understand contracts and have to pay for it. Want

proof that designers don’t understand contracts, just look at the many

books based on the subject, or the thousands of websites. 43 million hits

on graphic design contract on Google alone. And the f inancial costs for

not understanding or not using a contract can range from getting paid

$50 total instead of $50/hour to having to pay a multi-thousand dollar

penalty for a design due to a week late delivery date.

3. Reflection

I expected to see ignorance and fear of contracts from my

classmates, generally based on a lack of history within the design

industry, but the surprise came mainly from teachers and professionals.

Many teachers understood contracts in general, but were not acquainted

with specif ic clauses or felt comfortable editing a contract they were

given. More so, it was shown that most professionals told me that they

were able to f ind their way in the world of contract through getting

screwed by them, knowing only what to look for based on what they had

been historically f inancially screwed by.

Most harrowing was looking at how little designers on average

make, and how much lawyer fees are, making it cost prohibitive to use a

lawyer unless that lawyer is a fr iend giving you a good discount rate.

Most working designers have a history with contracts. And from

survey: it is mainly a negative based history. There is a long standing

history of designers who do not like, or, even more often, fear or resent

contracts. Two basic needs must be met. First is convincing those with

a short history of contracts that contracts are actually an item they can

use to protect themselves, through a show of the benefits of contracts.

The second of which is overthrowing the lax procedures by those with

longer histories with contracts and the design f ield (Picciafuoco). It is not

uncommon for designers with a long client relationship to drop the use

of a contract in order to ease the speed of work within the relationship

(Stone).

2. Why

“A good contract prevents confusion and protects everyone’s

interests. You realize how important this is after you’ve been burned a

few times.” - Shel Perkins (Stone).

There is a long history of the confusing contract. Out of fear of

misunderstanding the contract itself designers tend to shy away, however

the contract is meant for clarif ication. Thus by pushing forward a style of

contract writing based on understanding basic law vocabulary mixed with

writing a contract with your own personal voice, we show designers that a

contract can be used simply and clearly.

3. Reflection

The history of design and its lament of contracts was a

history I shared at a personal level. Through discussions with working

professionals I was dismayed at how my previous fear matched the

current for working designers. What changed my history? Business Law

1 at Champlain College, in which I was given the depth of how contracts

were written. I took this class as a double major, but my personal identity

was still fully aligned as a graphic designer. Thus I took the class as one,

and was elated at how much it pertained to me as a designer. For me

personally, this section became evident then, almost 3 years ago.

The biggest nightmare that any graphic designer can have is their

work being stolen, taken, being corrupted, or in any way disappearing.

While ownership is a relatively small part of a contract in terms of the

written word (Faris), it is the most contested (Shaftel). The designer

wants as much access to their work as possible and the client wants as

much access to the designs as they can get.

Design Agreement has a large focus on ownership for that reason.

Teach designers all of the crazy ways in which their work can be taken

from them through the legal system and, more importantly, how to

protect from it is the essence of importance.

2. Why

Ever had a computer crash while you were writing a paper?

Making a design? Finishing off a f inancial calculation? It sucks. And you

get angry because you know that there is nothing you could do, its just

bad luck. Having your design taken and being able to do nothing because

you did not protect it is a similar feeling, but you know you could have

done something.

The idea of Design Agreement is being able to teach you how to

protect against against that feeling before that feeling happens, or at least

stopping you from havin g to go through that again. Ownership can be

f inancial, but for the creative, the emotional can hurt the worst.

3. Reflection

Ownership did not come to my mind immediately, as it is many

times not supremely recognized. Many designers use stock art without

consent, or have their art used in such a similar way and feel as though

they have no control over its theft. The common example I was given was

what is an average communication between desigenrs and clients:

“Here are the preliminary mock-ups of your logo, please review

them and respond with changes for the next round of mock-ups.”

And no response, no payment, no communication at al l. Then

the designer sees the prelimary design in use. From online examples to

personal accounts, this is a standard within the design industry. This

happens far too often. New just came the designer recognition that they

could have done something about the problem before it happened in

order to protect against it. Nothing feels worse than losing something

and knowing it was because you didnt f ight to protect it in the f irst

place.

1. Foreseen: Positive

The most important consequence is that graphid designers start

to use contracts to protect themselves and that it becomes the norm.

Graphic designers get to keep more of the money that they have made, as

well as are overall stronger and more comfortable f inancially.

2. Foreseen: Negative

A slight loss of some work for designers based soley on an

industry standard fear of a contract with a graphic designer, esspecially

for smaller projects. A forseen negative consequence is harsher rules

around design contracts. Personal vernacular can be taken advantage

of with design contracts due to the close nature of the client-designer

relationship, and the law could change in accordance against the trust of

that relationship.

3. Unforeseen: Positive

This actually had to be told to me by another student, but,

better laws for designers, and more protection for design work in the

legal sphere. This project could possibly inspire young graphic designers

to persue a career in legal work, and possibly push his all the way into

copyright law or intellectual property law.

4. Unforeseen: Negative

One unforeseen negative consequence would be that contract

lawyers would have slightly less work, however it is still recommended

that a designer visit a contract lawyer with dependance on the monetary

scale of the project.

1. Ideation

When it came to the posters for Design Agreement, the main

concept was eye-catching dystopia of contracts. Through the use of copy

as pattern rather than simply words I was able to shift the contract into

a visual understanding rather than a legal one. In order to keep the

contract aesthetic, from a designer perspective, I added contract layout,

heavy overly wide columns, justif ied type, and overall busy and heavy

layouts.

For sketches I stayed within the digital realm as it was were I

am comfortable with type. I treated the words as though they were lines

rather than actual type in order to focus aesthetically rather than on the

actual copy. This was combined with ad concepts, showing a semblance of

a lesson to learn in order to help promote the idea of the poster being for

a class.

2. Why

The idea of the visual dystopis of a contract was based soley on

the designer opinion of a contract, and creating a visual interpretation.

Taking such design ideas of heirarchy, white space, and f low of the page

and including them within the page, rules followed, but broken was

the f irst step. Familiarity and confusion. Thus designers were given an

aesthetic that was familiar, and yet unsettling in some way.

1. Why

This was the main fun of the project. The dystopia. For basic

sketches I began to push around type on a page in order to obtain all of

the principals above. With a good few posters shifted from a quick sketch

to a actuallized graphic, I saw an opportunity for a slight change.

Having been to each city that a poster was made for, I knew that

a slight difference of design aesthetic exsisted, but in no way was able to

express that myself. Thus research. Each poster is based on the design

aesthetic of the city it is representing to further push the poster towards

the veiwers eye.

Most important to these posters is ; why posters? It is slightly

diff icult to create a advertisement for a city-to-city show without

something ground level and presented within the city itself. With

exception of Boston, each town presented is known for modes of

transportation that are slow and ground level. Thus a poster made the

most sense for them. Then how would Boston or other cities such as New

York City actually f it in?

In any city ground level advertising, spread well accross the

appropriate neighborhoods, shows an effect return of attendance.

Within Bosotn and New York City posters are prevalent and a norm of

communication.

1. Ideation

Simplicity was the name of the game. I purposely chose so little

to illustrate within the book to allow for an easy openness. The openness

was essential. Graphic designers often feel overburdened by lengthy

contracts, and thus this publication needed to feel fr iendly. The cover

and back were given the most freedom for creative direction, and, as the

show was happening in Burlington, I looked into how to incorporate that

aesthetic and make the book pop on the cover.

Second was the interior pages. All following the same basic

layout, with the variation coming from different description lengths. I

choose to set the type large to copy layouts from children’s publications.

2. Why

The outside of the publication is built on two divided aspects.

The f irst is the showing of the logo outside of pockets. The publication is

just large enough to peek out of pockets and such gives an opportunity to

show our logo. The second is a creative yet bold composition on the front

and back to interest the designer to open the publication. I gave myself

some artistic license with this, and re-purposed one of the poster designs

to carry through the brand.

The interior is based on a children’s book layout, which also has

some decent freedom. This realization came from researching layouts

to f ind the fr iendliest professional appearing design possible. I copied

a children’s book as a joke and loved it. With the type it allowed for

fr iendly yet professional. I then moved that typeset around until the

aesthetics were clear and concise.

1. Why

One of the most diff icult part of reading through a contract and

editing it, possibly one of the most diff icult actions a person could ask

for a designer to do, is the vocabulary. Beyond the use of confusing and

intentially obscure writing is the writing of definitions of this vocabulary.

Equally confusing descriptions are given to already crpytic words and

phrases.

Thus, this book tackles some of those SAT vocabulary words and

gives them the average man definition. Even down to a base of what that

means within a contract. These books were made small, 4in wide by 5in

tall, and slightly thin in order to be easily mobile. The small size also

allows for the book to be left on a designer desk and stay majoritively out

of the way until needed.

Built on the utopia of design contracts, rather than the dystopias

seen within the posters, the design is open and airy. Plenty of space

and thin columns that would be used within children books takes the

serious tone of the Design Agreement type and makes it approachable

and friendly. Not an end all be all solution by any means, this book is

supposed to be just another fr iendly guide for a designer.

1. Ideation

The website started with a page listing and what should be on

each page. I then began working out what the basic design principals for

it should be. Websites have a distinctively different aesthetic based upon

the activity which it can have, as well as no standard media size and have

to be reactive.

The general aethetic from other deliverables had a horizontal

f low, thus the site fell in line with a horizontal layout. I then worked to

create the assests for the site, the bars, the call outs, the importance of

information. I worked particularly hard on separation of navigation and

page without any markings, and the cohesiveness of the websites body.

2. Why

The utopian viewpoint of the brand called for a very open design

witgh plenty of airyness around it. Thus the wide sides. For the sake

of simplicity I worked to compress each page to be as minimalistic as

possible.

1. Why

In this day and age, its necessary to have a web presence, even

more important in Design Agreement for managing ticket sales for

attendance. By making a site that is purely made for the sales of the

Design Agreement tickets, the site allows for an incredible clean view and

open comfort.

As the site works furth from left to right the functionality of the

pages increases. This is built in such a way to ease the user into more

complex imagery such as an embedded google map.
