Because of the unfortunate burning of the Monongalia courthouse in 1796, with its accumulated papers of twenty years, we are without the records which would have made this and the preceding chapter more complete. Among the early justices from the Preston end of the county was Thomas Butler, who resigned in 1797. Others were Thomas Chipps, John Fairfax, Jonathan Brandon, Hugh Evans, John T. Goff, Amos Roberts, who went out in 1809, and Frederick Harsh, who served from 1803 till 1811. Still others, with the dates of their mention, were Rawley Evans in 1810-13, Charles Byrne, Isaac Powell, and Hugh Evans in 1810, Nathan Ashby in 1811, William Sigler in 1814-16, and James Webster in 1816. Butler was sheriff in 1793, Chipps in 1794, Goff in 1800-2, and Fairfax in 1805-6. [B]y Act of the Virginia Assembly, dated January 19, 1818, Preston came into being as the twentieth of the counties now comprised in West Virginia. Yet it would be a great error to imagine that this step was easily or speedily accomplished. It required a quarter century of constant agitation,. The legislature of Virginia was bombarded by petition after petition before it saw fit to accede to the wishes of the people in the Preston area. The first of these papers, dated July 25, 1792, presents the following statement : ["]Your Petitioners humbly sheweth, that it is Inconvenient, for the Inhabitants on the East Side of Laurel Hill, to attend at the Court House, at the time of Election, or on any other account whatsoever, occasioned by the Extensive Distance to the amount of forty miles for some, and having to cross that Ridge of Mountains where there is no Inhabitant, nor never can be. Therefore your Petitioners humbly Prayeth, for that Part of Monongalia County, Eastward of the Laurel Hill to be struck off to compose a New County.["]In this first petition, Thomas Butler, Thomas Chipps, Russell Potter, Andrew Ramsey, and John T were recommended as justices for the court of the new county. . . . Thomas Chipps settled in the Craborchard in 1770, but seems to have relocated on the Monongalia side before 1800. He was a justice and leading citizen, yet his son John, of Roaring Creek, was of bad reputation. It is alleged that he was a horse-thief and the slayer of a negro. Thomas Chipps was one of the first settlers in Monongalia County, Va, Now Preston County West Virginia in 1766 along with Thomas Butler, Jacob Corzel, John Scott, James Clark, and John or Jacob Judy. Thomas was the owner of an Ordinary in Morgantown, Va. He was Justice of the Peace in 1788 and Sheriff from 1793 to 1796. The following Land Grant Information is from a series of postings on Ancestry.com CHIPPS Board, "Thomas, Joanna and Basil" by Strflwr1 (Jo Fjelstad) Land Grants in Monongalia County from Library of Virginia microfilm reels for Land Office Grants (LOG) Thomas Chipps Land Grants. 1.) 1 May 1784 – 400 acres at Big Crab Orchards on Muddy Creek including his 1771 settlement. LOG L, 1784, p123, reel 52. 2.) 1 May 1784 – 400 acres on Crabtree Creek adjacent to Ezekiel Jones and including his 1776 settlement. LOG L, 1784, p234, reel 52. 3.) 1 May 1784 – 375 acres on Roaring Creek including his 1772 settlement. LOG L, 1784 p339, reel 52. 4.) 9 July 1787 – 400 acres on Decker’s Creek. LOG No. 11, 1787, p 367, reel 77. Joanna Chipps Land Grant. 27 Feb. 1805 – 400 acres on Dunker Creek adjacent to Abraham Hiley. LOG No. 55, 1805-1806, p110, reel 121. A "settlement" appears to be either living on the land for one year or raising a crop of “corn”, (grain). Additionally Thomas purchased 850 acres from Bartholomew London on 11 Oct. 1788. These land purchases establish his presence in the county at an early date. However many settlers moved their families to a safer area during these time frames as there was a lot of fighting with Native Americans. Monongalia County Deed book Records 1784-1810 1.) 14 April 1800 – Thomas & Johanna sold portion of land purchased from B. London in 1788 to Stephen Workmen. Recorded OS 2:484. 2.) 18 Oct. 1800 – Deed of Trust. (this holds land belonging to John Downer in trust until such time as J. Downer can repay $984.50) Jacob Pindell is trustee and must sell 800 acres at Dunkard Creek belonging to J. Downer if debt is not paid off before 18 Oct. 1801. Proved by witnesses July 1801. Recorded OS 2:126-127. (Thomas Chipps had signed this document in Oct. 1800) 3.) 10 Feb. 1801 – J. Downer sold land other than that listed in item 2. Thomas Chipps and Thomas Chipps Jr. both witnessed sale/deed. Recorded OS 2:409. 4.) 5 May 1801 – Estate of Thomas Chipps appraised or appraisal ordered. From West Virginia Estate Settlement Book. (Thomas Sr. was witness in item 3 above. He must have died between 10 Feb. and 4 May 1801.) 5.) 13 Nov. 1801 – Deed of Trust (item 2) lists Thomas Chipps as deceased. Proved by witnesses Dec. 1801. Recorded OS 2:309. 6.) 14 Jan. 1802 – Jacob Pindell, trustee for Thomas Chipps, deceased, and for J. Downer, sells land as agreed. Joannah Chipps is high bidder. Amos Roberts is among witnesses. Acknowledged in court June 1802. Recorded OS 2:484. 7.) 11 June 1804 – John, William, Thomas R. and Amos Chipps with Jacob & Hannah Pindall, and Simeon & Elizabeth Rice, Roys or Royce), heirs and legal representatives of Thomas Chipps sell land. The relinquishment of dower by Joannah Chipps, widow and relict of Thomas, 8.) 12 June 1804. Recorded OS 4:230-231. 9.) 20 Feb. 1806 – sale of land by heirs of Thomas Chipps. Recorded OS 3:326-327. 10.) 13 Oct. 1806 - sale of land by heirs of Thomas Chipps. Recorded OS 3:432-433. 11.) 1807 (No date given) - John & Hanna Chipps, Willian & Hanna Chipps, Thomas R. & Rachel Chipps, Amos Chipps, Jacob & Hanna Pindall, and Simeon & Elizabeth Royce, children and legal heirs of Thomas Chipps, deceased sell land. Recorded OS 4:215-217. (This document is important because it lists all the children of Thomas as well as spouses names). 12.) 14 Sept. 1807 – Basil & Johanna Lucas, Harrison County, to Thomas R. Chipps, release of dower on a lot in Morgan Town, (land grant from 27 Feb. 1805 – 400 acres Dunker Creek.) “Joanna is the widow of Thomas Chipps, deceased, and Basil her resent husband”. Acknowledged in Harrison Co. 5 Aug. 1808. Recorded (Monongalia Co.) OS 4:339-340. In conclusion: The widow of Thomas Chipps, Johanna Chipps, married Basil Lucas sometime between 12 Jun 1804 and 14 Sep 1807, probably in Harrison Co but maybe in Monongalia Co. The land grant was 27 Feb 1805 but it is possible it was given to the name she used when she applied, which would have been at least a year earlier. This proves that Johanna Roberts Chipps married Basil Lucas after the death of Thomas. Some sources list Basil Lucas as her first husband. Monongalia County Court Records : James Jenkins summoned to answer Thomas Wilson, assignee of Alexander McIntire, assignee of Thomas Chipps, in a plea of debt for $200 with interest from 5 July 1798 and $50 damage, 17 February 1801... Attachment 'levied on one Negro man named Sam, so says Deputy John W. Dean for Sheriff John T. Goff."[Zinn, Monongalia County , (West) Virginia : Records of the District, Superior and County Courts Volume IV: 1800 - 1802, 1810 (1992), 236] John T. Goff, Sr., High Sheriff of Monongalia County, summoned to answer Thomas Chipps in a plea of trespass $300 damage, 12 March 1801. 'This action is brought for taking a negro girl from the plaintiff.' May 1801 term of court, 'abates by the plaintiff's (Chipps) death.'"[Zinn, Monongalia County , (West) Virginia : Records of the District, Superior and County Courts Volume II: 1800 - 1803 (1990), 190] The Following material was compiled by Blaine and Irene Shriver from research done at the State Archives in Charleston, West Virginia, Monongalia Court House Records, and from family records of Mrs. Aaron Chipps (Grace Stump) and by Norman Chipps. During the fall of 1993 the original homestead of Thomas Chipps from 1776 was found. The stone base is still visible and a spring with cool water still running. It is located 1 mile south, south-west of the intersection of Brandonville Turnpike and route 22. The log house appears to have been about 15 by 20 feet with a spring nearby to cool the milk and a small storehouse to keep the foodstuffs. Trees are growing in the middle of the foundation and in another 30 to 50 years any signs of habitation will be lost forever. Before Thomas Chipps’ son John left the area about 1815 he was known to have kept stolen horses in a cave near the intersection of Lick Run and Roaring Creek. During the early days it was known as Chipps Cave. John maintained this cave near Willey, WV until after the war of 1812. The horses were being broken to a rideable condition then sold to the government. Many horses were bought locally and mixed with the stolen ones to help disguise them. The cave was used as a barn, and is out of the way. As many as 15 horses could be kept there at a time. People could be 100 feet from the entrance and not know it was there because heavy overgrowth and the noise of the Lick Run would cover most of the horse noises. For many years the cave was lost except to a few local residents until about 1930 or so during the depression when roving band of gypsies used it as a home in the woods. From that time it came to be known as Gypsy Cave. About 1970 an archaeological dig was made there but no interesting artifacts were found relating to early ownership. A covered picnic table area is now also at the fallen in mouth of the cave where local residents have summertime picnics and children can wade and swim in the creek while a nearby clearing can be used for ball games. Several area deer trails can be roamed for a pleasant walk in the woods. Notes for JOHANNA ROBERTS: COURT RECORDS: WILL OF JOANNA (ROBERTS) CHIPPS— LUCAS (2nd marriage) AS FOUND IN WILL BOOK NO 1 PAGE 37 Monongalla County, West Va. In the name of God Amen: I Joanna Lucas of Monongalia County and State of Virginia, being sick and weak in body but of sound mind and disposing memory, for which I thank God and calling to mind the uncertainty of human life and being desirous to dispose of all such worldly estate as it has pleased God to bless me with. I give and bequeath the same in manner following that is to say: Item 1st.- After all my just debts and funeral expenses are payd out of my personal Estate the remainder I devise as follows, with my real estate all so. Item 2nd.- I give to my grandson Thomas P. Chipps, seventy acres of land beginning at a poplar, Morrison Shafhers Corner, from thence with Morrises line to the Monongahela River and down the same with it's meanders ten poles thence running back so as to include one third of the shugar camp on the side of the rige, thence running back so as to include one half of the field the said Thomas lives in: including the part Peter Hess sowd in grane. I wish to be understood the Thomas is to have that side of the place where his buildings and little medow is and also his spring, thence running to Scott and Shafher for quanty, thence to Shafher line to the beginning, to him and his heirs or assigns forever. Item 3rd,- I give my grand-daughter Joanna Chipps daughter of William Chipps deceased, the dwelling house I now live in and twenty five acres of land running as follows, threw my entry South towards my barn and thew the barn so as to have one half of the barn and the stable next to the dwelling house, thence out across the road towards Thomas Chipps so as to include the small field Peter Hess has sowd in grane

thence with Thomas Chipps line Scoffs thince up a small drean and back to the house, which will include the above named quanity of acres, further more I give to the said Joanna one ther part of my perishable property, which she may have at the Appraisement if she choses otherwise. I wish it to be understood that my Grand-daughter Joanna Chipps is not to sell her land to incommode her mother Hanna Chipps while her mother is living, the if her mother is ded she can sell when she pleases or if her mother wishes to purchase I have no objections so that her mother may not be interrupted. I further add that my will and desire is that Joanna my grand-daughter shall have the privilege of the water and orchard paster for small stock. Item 4th,-I give to my daughterinlaw Hannah Chipps wife of William Chipps deed, one hundred and five acres of land to have and to hold the same for during her natural life and then my will and desire is that the above named tract of land shall be equally divided between the said Hannah Chipps children my daughter inlaw and also heirs at law of W. Chipps Dec’d that is to say Evelina Chipps, Faubus B. Chipps, Bazell Chipps, Jemima Chipps, Franklin S. Chipps, Judy Chipps, William Chipps and David heirs at law for Wm. Chipps Dec'd and Joanna Lucas to them and their heirs and assigns for ever and running as near as we can jude beginning at Thomas Chippses corner when he shall have his line run thence down the river which is the line we speak of thence running through the field where some Louises stand and across the road where a little drean crosses Thomas Chipps line to beginning. Item 5th,-My will and desire is that the balance of the said tract of land more or less may be sold at the discression of my executors or so soon as can be made convient and the moneys rising from such sail I devise as follows, one fourth to be equally divided between my daughter Hannah Pindle and Philip Combs and one fourth part to be equally divided between the five children of John Chipps Dec'd that is to say, Elizabeth, Simon, Joanna, Amos and John Chipps heirs at law and one fourth to my daughter Elizabeth and out of the lagacy left to my daughter Elizabeth, my will is that her daughter Vianna shall have one hundred dollars and the other fourth part I give and bequeath to my son Amos and the heirs of his body. Item 6th,-I give to my grand-daughter Elizabeth Chipps, Daughter of John Chipps Dec d one of my best feather beds, boleters and pillows and two sheats one blanketts and one doble coverlid with two good pare of pillow caus all so one pare of silver mark’t T.B.L. U tongues. Item 7th,-My will and desire is that grandson John Chipps son of John Chipps Dec d six silver t spoons mark't J.B.L. These spoons I devise to his oldest daughter if he should live to have one and if not to his sister Joannah Chipps daughter of the said John Chipps Dec'd. Item 8th,-I devise to my grand-daughter Joannah Flours one small sarvey and three knives and forks and ten dollars of my perishable property to be giveing to her at the appraisement by my executors. Item 9th,- and the balance of my perishable property I give to my daughterinlaw Hannah Chipps and Bazell L. Chipps wife and son of William Chipps Dec'd and to my daughter Elizabeth to be equally divided between them. item 10th,- I will and bequeath to my daughter Hanna Pindle one new chanabl silk and the rest of wearing apparel I wish to be equally divided between my daughter Elizabeth and my daughter-in-law Hanner Chipps wife of Wm. Chipps dec'd. I also appoint and obtain Philip Combs and my grand son Thomas Pindle and James Robertson to be my executors. I acknowledge this to be my last will and testament in witness whereof I have to hear unto set my hand & affix my seal this 28 the day of November 1828. heirs executors administrators and assigns the following personal property to wit: One Negro Woman named Sarah; One Negro Girl named Betty The said Betty, being child of the said Sarah. The said Sarah and Betty being the same negroes that my deceased husband Thomas Chipps purchased of Elisha Griffith on the second or third day of September in the year 1800, and the said Negroes being the same purchased at the sale of my deceased husband Thomas Chipps, to have and to hold the aforesaid negroes and every one of them unto said Thomas R. Chipps his heirs and assigns forever in full peaceable and quiet posession wish Negroes I have this day delivered to the said Thomas R. Chipps and I do hereby covent to and with the said Thomas R. Chipps his heirs to be that the aforesaid Negroes are now slaves and that I will warrant and defend the title of same to the said Thomas R. Chipps his heirs and assigns from all person or persons claiming the same. In testimony whereof Joanna Chipps hath hereto set her hand and seal the 6th day of February 1804 Witnesses: Amos Chipps Thomas Flowers George Flowers This bill of sale signed and acknowledged then added to and for and in consideration of four hundred dollars additional making a total of (1000) one thousand dollars. Two more slaves were added to the same Bill of Sale. I Negro boy named Charles and I Negro girl named Nellie Signed and acknowledged as above. Same contract as above. Joanna had purchased the two Negroes at the estate sale of her husband Thomas on Feb. 6, 1804. Witnesses George Flowers and Thomas Flowers, were brothers. Thomas Flowers was married to Elizabeth Chipps, daughter of Joanna and her husband Thomas, deceased. This entry bears no date, though the other entries on the page are for 1810. He returned to Bayou, Livingston, Kentucky where his gold profits bought him 8000 acres of property that became the family homestead.

In 1813 John was listed as a private in Captain James Morgan's Company in Monongalia County. (War of 1812). John, of Roaring Creek, was of bad reputation. It is alleged that he was a horse-thief (refer to Notes for Thomas Chipps) and the slayer of a Negro. According to Melba Pender Zinn's Monongalia County Court Records, Vol. 8, John may have experienced losses in having his house and effects destroyed by fire and other losses. On Pg 191, John "occupied and enjoyed the land once owned by Thomas Chipps (his father) until the fall of 1812 when he went into the army and was not a resident thereafter except for his privilege as a drafted militia man" According to Melba Pender Zinn's Monongalia County Court Records, Vol. 9, page 58, March - April 1813. "John Chipps summoned to testify....John Chipps not found his family has removed down the river." The river in question is Likely the Monongahela. The following Biographical sketch of Abia Chipps appeared in the publication listed below: Portrait and Biographical Record of Shelby and Moultrie Counties, Illinois, 1891 - p. 206/207 Located in the fertile valley of Jonathan Creek, is a farm of four hundred acres, located on Section 15, of the township, which takes its name from the water supply. Picturesque and beautiful are the meadows, pasture, orchard and woodlot of the farm, and happy should be the owner of so fine a place. The fortunate man, who is possessor of this land, is he whose name is at the head of this sketch. He settled in the county in the fall, November 26, 1858, and since that time, has here made his residence, applying his time and attention to the up building and cultivation not only of his own possessions, but also to the improvement and the elevation in tone, of the whole community. Abia Chipps was born in Harrison County, W.V., June 8, 1852, and is a son of Asa W. and Melvina E. (Duvall) Chipps, natives respectively of Morgan and Harrison Counties, W. Va. They were married in their Native State, in 1851. The family came to this county in 1858, and purchased eighty acres of raw land. This is now beautified and made valuable by a fine walnut grove which was planted by our subject. The mother of the family died April 1, 1863. She had six children, of whom four lived to be grown. They are Abia, Kate, Adie and Jefferson E. Kate is now the widow of John Landers; Adie is the wife of R.D. Curd, and resides in Des Moines, Iowa; Jefferson E. operates a farm of his own. Our subject's father was a second time married, this union being with Mrs. Mary S. Adams nee Barton, and in 1877, he removed with his family to Columbia, Mo., remaining there for fourteen years and then returned to this county. By her previous marriage, Mrs. Chipps, Sr., was the mother of one son, whose name was James Williams. Politically the father was a Democrat, and held local office. Our subject was reared on a farm and educated at the Academy of Mount Zion, Ill. A thoughtful young man, fond of study and of original research, he developed a liking for pedagogic work, and engaged for some time in teaching, in which he continued even two years after his marriage, which was solemnized January 1, 1877, his bride being Miss America E. Lilly, who was born in this county. After marriage our subject purchased eighty acres of land, and this amount with its proceeds, he so carefully husbanded, that he is now the owner of four hundred acres of land. He is engaged in the business of stock raising, which he finds very profitable, bringing much of his stock to the metropolitan markets. Our subject and his wife are the parents of seven children, whose names are as follows: Hallie, Willis; Clifford, who is deceased; Raymond, Earl, Alta and Paul. Politically our subject is a member of the Democratic party. He has been Supervisor of the township for five terms, and has held various minor local offices. He married MARIAN RUTH BUSER February 08, 1947 in Toledo, Ohio Washington Congregational Church, daughter of JACOB BUSER and ESTELLA MCINTOSH. Notes for RICHARD EARL CHIPPS: At the age of twelve Richard (Dick) started working for Morris Greenberg at the G & W Market at Monroe and Collingwood in Toledo. He ran errands and cleaned the store for Mr. Greenberg who has in many respects like a second father figure. At one point well before his sixteenth birthday, Mr. Greenberg asked if Dick knew how to drive. "No", came the answer. "Well it's time to learn". A quick explanation of a clutch and gear shift followed, with directions for a delivery. Dick never got a drivers licence until after returning from WWII. Mr. Greenberg often let Dick use his car for personal use, including a trip to Detroit with friends to see the Big Bands of the time. Dick kept in touch with Mr. Greenberg through out his life. Richard served in WWII, in the 83rd Infantry Division, 331st Reg, "L" Company. He entered France as a Staff Sergeant in charge of the Mortar section of the Weapons Platoon. He became First Sergeant during the Battle of The Bulge. (First Sergeant - Principal NCO and life-blood of the company: the provider, disciplinarian and wise counselor. Instructs other SGTs, advises the Commander and helps train all enlisted Soldiers. Assists Officers at the company level). His unit spent 288 days on the front line, he received two Purple Hearts, a Bronze and a Silver Star for gallantry in action. Dick said that the war had little to do with who he was. However I believe it had a profound impact on how he chose to live his life. Dick used his V.A. Loan so that his parents could buy a home at 2260 Putnam. Dick worked for Ohio Bell after the war as an installer, later as an estimate assigner. He always answered

his phone "7442 Chipps". The site of the big 20 foot diameter revolving wheel with the department binders and records near Dads desk, and the small wooden cube with family photos labeled Chipps off the old block remains vivid. At one time in the late 60's he was department head. However he gave that position up rather than purposely under rate employees on annual evaluation forms as management had requested. He retired in 1984. Dick broke his leg in a fall on ice in January 1983, spending 16 weeks in the Hospital. It was June before he could walk with the assistance of a walker. However the first week of July found him dancing to Big Band Music with Midge, walker and all. Before the year was over, he had remodeled the basement, including installation of a drop ceiling, all before he could walk unaided. Dick was the kind of man others came to when troubled about an up coming election. Notes for MARIAN RUTH BUSER: Most people know her as Midge. She worked at Ohio Bell, Toledo Edison, First Federal and as a Real Estate Agent. On Thanksgiving evening November 22, 1945 Marian took the Lincoln Street bus to 1821 Glenwood, the home of a co-worker at Ohio Bell. She was going to spend the evening with Jean and her husband Larry Jones, as well as Jean's brother Richard Chipps. Housing being scarce after the war, Jean lived with her parents. Marian was sitting on a stool when Richard came back from visiting friends. He was in his Army uniform and looked so tall. Jean later said that she could see sparks flying in both directions. They went to a club called "Ka-sees" on Lagrange Street. After a fun evening watching the shows, Richard escorted Marian to her families home in a cab. "Oh Boy could he kiss". Just over a year later Midge and Dick arranged to meet at the Lucas County Court House to get their Marriage License at lunch time. It was during an ice storm, with many power lines and tree branches down. The department official commented, "You must really want to get married coming out in this weather". Midge's father Jacob was a quiet man, not inclined to show his emotions. But during her wedding service as he gave her hand, Jacob turned and said, "Take care of her Dick, she's a good girl". Midge was almost speechless. After giving birth to three sons Midge was hoping that her fourth pregnancy would bring a girl. When she was born, Dr. Zollinger said "Here is your rosebud".
