John J. BarthelmesCommissioner of Safety

John J. Barthelmes was sworn in by Governor John H. Lynch as Commissioner ofSafety on April 6, 2007.

Commissioner Barthelmes is a life-long law enforcement officer. He began his ca-reer in 1976 as a state trooper assigned to patrol duty at Troop F in northern New Hampshire.In 1983 he was promoted to sergeant and assigned to the Major Crime Unit as an investiga-tor. In 1989 he was promoted to lieutenant in command of the Major Crime Unit.

In 1993 Commissioner Barthelmes was named captain and commander of the Inves-tigative Services Bureau, in charge of the Narcotics Investigation Unit, Special Investiga-tions Unit, Major Crime Unit, Missing Persons Section, Auto Theft Section, Criminal Intel-ligence Section and the State Police Forensic Laboratory.

Governor Steven E. Merrill appointed Commissioner Barthelmes Colonel of StatePolice in 1996. He was subsequently reappointed by Governor Jeanne Shaheen.

In 1999 Commissioner Barthelmes left state service to join the New England HighIntensity Drug Trafficking Area, based in Methuen, Mass., a federal effort to coordinatedrug enforcement in the region. He was deputy director and then director of that program.

Commissioner Barthelmes is a 1975 graduate of the University of Massachusetts,with a B.A. in psychology, and a 1993 graduate of the FBI Academy in Quantico, Va.

The multi-faceted mission of the Departmentof Safety encompasses protection of the livesand safety and preservation of the qualityof life of New Hampshire citizens and visi-tors to our state on the highways, on thewaterways, and in their homes and busi-nesses. We enforce motor vehicle and high-way safety laws, criminal laws, commercialvehicle regulations, fire safety, building andequipment safety laws and regulations, andboating safety laws and rules. We also pro-vide enhanced 911 emergency communica-tions statewide, and are responsible forhomeland security and emergency manage-ment activities.

The Department of Safety is the third largestdepartment of state government, with1,585 full- time and 185 part-time employ-

ees – both uniformed and civilian – deployedthroughout the state.

The Department affects the lives of all NewHampshire residents by enforcing criminal, motorvehicle and boating laws, and providing for firesafety, emergency communications and disasterplanning.

The Department was established by the N.H.General Court in 1961. It originally consisted ofthe divisions of State Police, Motor Vehicles andSafety Services.

In Fiscal Year 2012, the Department was madeup of seven divisions: Administration, State Po-lice, Motor Vehicles, Fire Safety, Fire Standardsand Training and Emergency Medical Services,Emergency Services and Communication, andHomeland Security and Emergency Management.

Under legislation passed in the 2012 session,the Division of Safety Services was eliminated andits activities were allocated to other divisions. TheMarine Patrol became a bureau of the State Po-lice. Tramway and Amusement Ride Safety wasplaced under the Division of Fire Safety.

Legislation this year also transferred the tele-communications functions of the Department ofAdministrative Services to the Division of Emer-gency Services and Communications.

The activities of each of the divisions are de-scribed in detail in separate chapters of this report.

Commissioner’s OfficeThe Commissioner of Safety is appointed by

the Governor and confirmed by the ExecutiveCouncil to provide executive leadership and direc-tion to the Department.

The Commisioner and Assistant Commissionerserve coterminous four-year terms.

The Commissioner’s Office is made up of theCommissioner, Assistant Commissioner and the

Chief of Policy and Planning. All seven divisionsreport directly to the Commissioner.

The Bureau of Hearings and the Grants Man-agement Unit report to the Assistant Commissioner,who also serves as the Department’s liaison to theN.H. General Court. More than 600 bills that af-fect public safety are filed in the Legislature in atypical year.

The Assistant Commissioner also handles la-bor relations and is a member of the Governor’sCollective Bargaining Team for management.

The Legal Unit, Information Technology liai-son and the Public Information function are the re-sponsibility of the Chief of Policy and Planning.

Also under the Commissioner’s Office is theDepartment of Safety’s Information and AnalysisCenter.

Information and Analysis CenterThe NHIAC is a clearinghouse for information

and intelligence on natural and human-causedthreats to the State of New Hampshire, its peopleand the environment. Its goal is to function as afocal point of two-way communication among allits public safety and private sector partners.

It is a cooperative effort between the Divisionsof State Police and Homeland Security and Emer-gency Management, housed at the state Incident

Planning and Operations Center on the grounds ofthe N.H. Fire Academy.

Information and intelligence that comes to theNHIAC is evaluated and analyzed to determine ifit is an indication of possible terrorist or other ille-gal activity. The information is then shared withthe appropriate law enforcement, emergency man-agement, critical infrastructure, or private sectororganizations. The intent is to prevent activity thatwould threaten the safety and security of NewHampshire citizens.

The center monitors information from a vari-ety of open and classified sources. It uses that in-formation to provide alerts, warnings, notifications,and situational awareness reports developed withinor received by the NHIAC.

The center was created by legislation passedin May 2010. It began operations in August of thatyear.

Bureau of HearingsThe Bureau of Hearings, established by RSA

21-P:13, is composed of four units: Administra-tive Adjudication, Criminal Prosecution, Litigation,and the Motor Vehicle Industry Board.

To ensure that the bureau’s decisions are madein a fair and impartial manner, it is a separate en-tity, and therefore is not attached to another divi-sion. It is responsible for conducting administra-tive hearings, criminal prosecution in select cir-cuit courts, litigation of hearings appeals, and con-ducting hearings of the New Hampshire MotorVehicle Industry Board (NHMVIB).

The bureau is managed by the Administratorof Hearings who chairs the NHMVIB and over-sees Prosecution, and the Chief Hearings Exam-iner who acts as the litigation attorney.

Thanks to a generous grant from the N.H. High-way Safety Agency, the bureau has implemented aprogram of hearings by video conference. This al-lows individuals to participate in the hearing onlineby use of a computer and web camera. This hassaved tremendous amounts of travel time and ex-pense for individuals required to appear at hear-ings.

In many cases, this has given deserving citi-zens restoration of their driving privileges sooner.

Moreover, this program has saved police officersmany hours and the expense of driving to Con-cord, which has resulted in more available patrolhours for those officers.

In addition, bureau attorneys provide legaltraining in a variety of settings. For example, theChief Hearings Examiner conducted training withNew Hampshire judges concerning commercialdriver licensing laws. The bureau administratorregularly lectures at training programs at N.H. Po-lice Standards and Training on administrative hear-ing procedures.

Criminal Prosecution UnitThe unit is composed of four attorneys and

three paralegals. The unit prosecutes criminal casesin select circuit courts for the State Police and otherDepartment of Safety law enforcement agenciesthroughout the state.

The unit prosecutes the trial of misdemeanorcases in 15 of the state’s busiest circuit courts inthe State Police Troops A, B & D regions. In eachof those regions there is one attorney prosecutorand one paralegal. The fourth attorney is respon-sible for prosecuting cases from Troops C, E andF. In addition, the unit provides legal training andother legal assistance to the department’s law en-forcement agencies. The unit prosecutes thousandsof criminal complaints every year.

Attorney prosecutors ensure the most effectivecase preparation and presentation of serious caseslike assault and driving while under the influence,in New Hampshire courts. This work includes pre-senting cases in court, filing and responding to le-gal motions, obtaining documents necessary toprove cases, issuing subpoenas and preparing wit-nesses for trial, and directing additional investiga-tion.

Moreover, prosecutors reach negotiated dispo-sitions of cases with defense attorneys that resultin resolution before trial. This drastically reducestrial costs and allows troopers to spend more timeon patrol.

The unit is committed to providing the highestquality prosecutorial services to all of theDepartment’s law enforcement agencies. In thecoming months the unit will implement a new case

management system that will increase efficiencyand provide information to allow us to determinehow to best deploy limited resources and to trackcase sentences.

Administrative Adjudication UnitSeven attorney/hearings examiners conduct all

administrative hearings for the Department ofSafety covering the entire State of New Hampshire.Hearings are open to the public.

The unit is supervised by the Chief HearingsExaminer with the support of nine legal assistants.Hearings are decided pursuant to statutory and ad-ministrative rule authority, which governs the ad-judicative process.

Administrative decisions have the force of law,but unlike court proceedings, are conducted infor-mally in an office setting and are based on a lowerlegal standard, specifically, a preponderance of theevidence.

The due process clauses of the New Hampshireand U.S. Constitutions entitle citizens to hearingsto review the loss of an important privilege, likethe ability to drive. The majority of hearings in-volve the suspension or restoration of driver’s li-censes. For example, an individual with too manymotor vehicle convictions is subject to suspensionfor demerit points.

The accumulation of serious motor vehicle con-victions will subject a license holder to mandatoryhabitual offender certification with an associatedlicense suspension for a term of one to four years.

Also, under the implied consent law, individu-als found driving while impaired by alcohol ordrugs who refuse a chemical test or test over thelegal limit are subject to mandatory license sus-pension. A substantial number of hearings havebeen scheduled in order to implement the federalregulations relating to Commercial Driver’s Li-cense (CDL) holders. This is a particularly impor-tant area of public safety that is monitored closelyby the U.S. Department of Transportation.

Finally, drivers under age 20 convicted of mo-tor vehicle infractions are subject to license sus-pension under the original license suspension law.This single area accounts for the largest number ofhearings held each year.

Hearings, however, involve subjects besidesdriving. Therefore, the scope of hearings is vast,and the bureau holds hearings involving all areasthat are regulated by the department. Some ex-amples are inspection station, mechanic, and au-tomobile dealer license suspension, abandonedvehicle and towing issues, security guard licens-ing and suspension, fireworks and explosives li-censing and suspension, and the regulation of speci-fied public waterways.

An individual may appeal the hearingsexaminer’s decision to the Superior Court in mostinstances, and the Supreme Court in others. Onappeal, the court will not conduct a new hearingbut will review the written record for errors of law.

After the conclusion of each hearing, the hear-ings examiner provides a written report with find-ings of fact and rulings of law and, where neces-sary, a legal analysis supporting those findings.Some reports are provided to the person at the con-clusion of the hearing and, in more complex cases,the reports can be completed as much as 30 busi-ness days after the hearing is concluded.

During FY 2012, the bureau completed 15,231hearings. Of those, 226 were held by video tele-conference. In addition, in cooperation with StatePolice Troop G, a new habitual offender serviceprogram was initiated. New Hampshire law re-quires all people subject to habitual offender certi-fication to be given in-hand service of hearingdocuments.

Previously, state troopers have had to servethese documents to people at their homes or placesof business. This typically took several attemptsand proved to be quite costly. With the new pro-gram, each person subject to a hearing is sent aletter requesting them to come to the bureau’s Con-cord offices, where they are all served at one timeby a trooper already on duty.

This has streamlined the process. Of the 1,039habitual offender hearings held during FY 2012,404 were initiated by service in Concord. This rep-resents a significant cost savings.

Moreover, several laws were passed during the2012 legislative session that will increase the au-thority of the bureau and provide hearings exam-iners with additional tools to effect positive change.

House Bill 1240 amended RSA 265-A:14 by add-ing paragraph VI which will allow implied con-sent license suspension time to run concurrentlywhere a person has not driven in 10 years, doesnot have more than two driving under the influ-ence convictions and no negligent homicide con-victions.

To be eligible, the person must have a hearingand demonstrate good cause to be entitled to thiswaiver. Moreover, House Bill 1304 amended RSA262:22, II to allow a wavier of the financial re-sponsibility requirement for good cause for an ha-bitual offender who has not driven a vehicle in vio-lation of the license suspension order and has notheld a license in five years or more.

Finally, Senate Bill 282 added a new section tothe ignition interlock laws, RSA 265-A:36-a, toallow the Commissioner of Safety to require theinstallation of an ignition interlock as a conditionof license reinstatement where doing so will en-hance public safety, for a broader number of of-fenses than currently exists.

Prior to this change, only the court could orderan interlock device. This will result in a greaternumber of interlock devices in use in New Hamp-shire, which will enhance public safety.

Litigation UnitAn attorney is responsible for representing the

Department in the N.H. Superior Courts in the ap-peal of administrative hearing decisions. Currently,the Chief Hearings Examiner handles appeals withthe help of a legal assistant. This entails the prepa-ration of comprehensive legal briefs and arguingcases in court.

A summary of all cases decided is online inthe compendium of cases on the Bureau of Hear-ings section of the Department’s web site. As ofSeptember 2012, 15 appeal cases have been com-pleted.

N.H. Motor Vehicle Industry BoardThe NHMVIB is responsible for resolving dis-

putes between motor vehicle dealers, manufactur-ers and distributors. Established by RSA 357-C forthe enforcement of the provisions of that chapter,the board is composed of six individuals with ex-

pertise in the automobile business.In order to ensure fairness, they may not, how-

ever, have a current financial interest, or work inthe industry. Members are appointed by the Gov-ernor and Executive Council. Members are cho-sen from different areas of the state in an attemptto create a geographic balance of membership.

In addition, the board is one of several oper-ated under the authority of the Commissioner ofSafety, who acts as the chair of the board or desig-nates a chair. Currently, the Administrator of Hear-ings is designated by the Commissioner to act asthe board’s chair. A legal assistant in the bureauacts as the board’s clerk.

The board holds public meetings and conductshearings based on requests submitted by automo-bile dealers, distributors or manufacturers. Boardhearings, like administrative hearings, are open tothe public and are conducted based on statutorylaw and the board’s administrative rules. The boardissues written decisions, which may be appealedto the Superior Court.

Grants Management UnitThe Grants Management Unit (GMU) is re-

sponsible for searching for, applying for, adminis-tering, and reporting on federal grants, Congres-sional earmarks, and other sources of funding forthe Department of Safety. It also handles auditpreparation for the majority of these federal andstate projects.

The unit currently has 5.0 full-time equivalentpositions. In addition to grants for all divisions ofthe Department, the Grants Management Unithandles the majority of pass-through federal grantsfor cities, towns and counties from the U.S. De-partment of Homeland Security/FEMA.

The J-One project continues to make progress.J-One, or “Justice - One Network Environment”is a criminal justice information exchange projectdesigned to improve the ability of the state’s crimi-nal justice system to track a particular offender fromarrest or summons through completion of all re-quirements of a resulting sentence.

This project links local and state law enforce-ment; Corrections, including probation and paroleofficers; and the court system to allow for secure

exchange of critical, up-to-date information in anelectronic format. The GMU is integral to thisproject’s development, administration and federalcompliance.

The unit administers the majority of FederalMotor Carrier grant funds on behalf of the StatePolice. These grants buttress commercial vehicleenforcement and related safety initiatives statewide.They total more than $1.32 million annually.

The GMU has administered approximately$100 million from various federal funding sourcesover the past 10 years. Currently, approximately$50 million in grants is in the active administra-tion phases on behalf of the Department of Safetyand various statewide stakeholders who benefitfrom these funds.

These grants provide equipment for local firstresponders, as well as targeted funds for overtimepatrols, commercial vehicle inspections, variousforms of communications interoperability, and sup-port for the N.H. Information and Analysis Center.Homeland Security grants are primarily directedto improve protection of potential high-threat tar-get areas for chemical, biological and radiologicalfacilities by county, and local partners. Other grantssupport disaster drills and first responder trainingstatewide.

Federal grants are also being used to improveNew Hampshire’s all-hazards emergency prepared-ness. This includes increased capacity to respondto hazardous materials incidents, medical surge andmass prophylaxis capabilities, intelligence gather-ing and information sharing and infrastructure pro-tection and disaster preparedness.

In 2012, there was a major redirection of fund-ing priorities in the Homeland Security grant pro-gram which allowed for up to $4 million in train-ing for local jurisdictions as devised by statewidefire and EMS stakeholders and the distribution $4million in new portable radios to local and countylaw enforcement and State Police.

This radio project is the first major statewidelaw enforcement upgrade in portable radios in morethan a decade. A group of local and county offi-cials partnered with Safety to select and test theradios prior to order.

A major objective of the Grants Management

Unit is to fiscally and administratively supportcommunications interoperability among publicsafety agencies, increasing the ability of first re-sponders from different agencies and disciplinesto talk to each other by radio during emergencies.

Since Homeland Security grants to the state andlocal governments began in 2003, New Hampshirehas received a total of nearly $85 million. Eightypercent of these funds went to local first respond-ers, as required by law. The GMU also led the tech-nical analysis of the statewide microwave systemin the past year as well as completing a federally-mandated statewide communications assessment.

With the aid of Homeland Security grants, NewHampshire made significant progress in improv-ing communications interoperability during the pastnine years. Nearly $30 million worth of radios,consoles, repeaters, and ancillary communicationsequipment that meets interoperability requirementswas distributed to fire, emergency medical, and lawenforcement agencies in the state.

An additional $5 million in grant funds con-tinued to build local microwave infrastructure andprovide for training and radio programming needs.Nearly 14,000 radios were reprogrammed at thelocal and state levels to meet the interoperabilitygoals of the state as well as to comply with theNational Public Safety Telecommunications Coun-cil (NPSTC) National Naming Nomenclature forInteroperability.

Legal UnitThe Legal Unit is composed of two attorneys

assigned to the Commissioner’s Office. It is respon-sible for providing legal services to all divisionsand programs within the Department of Safety. Thestaff also assists the N.H. Department of Justice inlitigation in which the Department of Safety is in-volved.

The duties of the Legal Unit include advisingmanagement on the legal issues concerning policyand procedures, administrative rulemaking, opera-tions, personnel issues, labor-management issues,contracts, civil liability, intergovernmental agree-ments, Right-to-Know requests and other issues.

The Legal Unit is also charged with represent-ing the Department in administrative and certain

judicial proceedings.

Public InformationThe Public Information function coordinates

providing information to the public and news me-dia on Department of Safety policies and activi-ties.

Responsibilities include the preparation anddistribution of news releases; development, design,writing and editing of a variety of publications andother department materials serving as informationaltools to the public, and dissemination of preparedmaterials via the Internet or printed materials.

Public Information also monitors the newsmedia and assists news organizations during inci-dents and emergencies. It develops communica-tions strategies for promoting public safety in NewHampshire.

Building Code Review BoardThe Assistant Commissioner’s secretary pro-

vides secretarial services to the Building Code Re-view Board, whose chair is appointed by the Com-missioner, and also to the Department’s Labor/Management Committee.

Division responsibilities include support for allother Divisions within the Department of Safety.Support activities include budget development andmanagement; accounting for purchases, payablesand receivables; human resources for the Depart-ment including payroll and assisting the Divisionswith hiring and personnel issues; maintaining con-trol of all fixed assets (both acquisition and dispo-sition); remote site building maintenance, and theHazen Drive automotive garage.

Business OfficeThe Business Office is responsible for coordi-

nating operating and capital budget development,financial management and reporting for the De-partment of Safety.

The Business Office coordinates and processesall of the Divisions’ requests presented to the Gov-ernor and Executive Council and the Fiscal Com-mittee for approval. The Business Office providessupport to each Division by aiding with the com-pilation of required documentation, by reviewingthese documents for accuracy and consistency, andby ensuring these requests are submitted to theDepartment of Administrative Services in a timelymanner.

The accounts payable section processes all De-partment invoices, requisitions, purchase orders,and encumbrances. In addition, the accounts pay-able staff is responsible for compiling Departmentenergy usage information, gasoline billings forother agencies, and intra-agency transfers for ware-house supplies and automotive repairs.

The accounts receivable section is responsiblefor overall receipt of all revenues and billings. Thesection processes more than $300 million annu-ally in highway funds, general funds, and otherdedicated funds.

The Department of Safety has also seen a re-cent increase in credit card transactions due to theincrease in online services offered to the public.The Business Office supports this endeavor asonline services are increased.

The human resources unit is tasked with all HRand payroll functions for the Department of Safety’smore-than 1,700 employees, including the coordi-nation of recruitment, appointment, compensation,promotion, transfer, layoff, removal, and disciplineof classified state employees, managing the back-ground investigation process for sensitive positionsand keeping job descriptions up to date.

The unit works to administer the employeebenefit programs, the new hire orientation process,and working to expand a wellness education pro-gram with the help of representatives throughoutthe Department. The unit works to properly admin-ister the collective bargaining agreements, the per-sonnel rules, and manage FMLA, ADA, USERRAand Workers Compensation programs. In addition,the unit establishes, maintains and manages the per-sonnel records for all Department employees.

In January 2012 this unit was instrumental as apilot agency in the implementation of the NH Firstemployee time management system.

Road Toll AdministrationThe mission of the Road Toll Administration

is to collect motor fuel taxes in the most cost ef-fective manner and achieve the highest level of vol-untary compliance with the State of NewHampshire's Motor Vehicle Road Toll Law, prima-rily through education, audit, and enforcement ini-tiatives.

Road Toll Administration collects more than$150 million in Highway Fund revenue including

the administration of the Unified Carrier Registra-tion Program and approximately $17 million inrelated Oil Discharge and Pollution Control Feeson behalf of the Department of EnvironmentalServices.

Road Toll Administration is also responsiblefor New Hampshire’s administration of the Inter-national Fuel Tax Agreement (IFTA). IFTA, amulti-jurisdictional agreement, establishes andmaintains the concept of one fuel use license, andadministering base jurisdiction for each licensee.

The Road Toll Field Audit Bureau is respon-sible for auditing the following:

• Motor Fuel Distributor licensees, IFTA licens-ees, and Motor Fuel & Petroleum ProductsTransporter licensees for Road Toll Administration.

• International Registration Plan registrants forthe Department of Safety's Division of MotorVehicles.

• Oil Discharge and Pollution Control licenseesfor the Department of Environmental Services.

Equipment ControlEquipment Control includes the following sec-

tions: 1) warehouse, 2) mailroom, 3) plate room,and 4) the automotive garage.

The warehouse maintains fixed and mobileassets for the Department of Safety, both acquisi-tion and disposition, as well as annual inventoryreporting. Mobile asset responsibility includesmanagement and reporting for a fleet of approxi-mately 800 vehicles.

The warehouse also designs, stores, and dis-tributes forms and printed materials for the depart-ment, and stores and distributes consumable sup-plies to all Department of Safety locations through-out the state.

Lastly, the warehouse maintains the fueling sta-tion at Safety Headquarters; however, that func-tion will cease during FY 2013 as the Departmentconsolidates fueling operations with the Depart-ment of Transportation.

The mailroom sorts approximately 1.8 millionpieces of incoming mail annually and distributesthe mail throughout the Department. The section

also processes and mails more than 2 million piecesof outgoing mail annually. The plate room is re-sponsible for ordering, receiving and the distri-bution of license plates and validation decalsneeded to register vehicles. Order fulfillment ismade to 224 municipal agents, typically town andcity clerks, and 13 remote DMV locations as wellas police departments and District Courts through-out the state.

The automotive garage provides repair andmaintenance services for Department vehicles. Theautomotive garage completes approximately 500state inspections each year, and provides vehicletowing service for the Department and other agen-cies when available to do so.

Central MaintenanceCentral Maintenance provides 24-hour support

for both owned and leased properties utilized bythe various Divisions of the Department. CentralMaintenance coordinates and oversees buildingmaintenance and renovations ranging from majorcapital budget construction projects to designingand building office fit ups, to providing landscap-ing and lawn care services at eight locations dur-ing the summer.

Central Maintenance has assisted the Divisionof Motor Vehicles in numerous office relocationsand reconstructions, including the new Dover Pointlocation set to open in September 2012.

Central Maintenance also supervises the main-tenance of generators, the acquisition of permitsfor underground storage tanks, the preventive main-tenance of mechanical equipment, and coordinatesenergy efficiency projects for the Department.

ReprographicsReprographics produced more than 3 million

documents during the year. The unit also micro-films all documents related to the Division of MotorVehicles registration, licensing and title transac-tions.

DIVISION OFMOTOR VEHICLES

To enhance public safety on theroadways of New Hampshire byensuring that our drivers, vehicles,and service providers are properlycredentialed and by providingresources forthe maintenance ofour roadway infrastructure.

Mission Statement:

The Division of Motor Vehicles oversees motorvehicle and driver regulations for the State ofNew Hampshire. It enhances traffic safety

through five main bureaus: Driver Licensing, FinancialResponsibility, Operations, Registration and Title, alongwith several smaller sections and units. Detailed infor-mation regarding the bureaus, sections and units of theDMV is provided below.

Bureau of Driver LicensingThe Bureau of Driver Licensing underwent sev-

eral changes during FY 2012. The biggest impact tothe bureau was substation closings and or moving tonew locations. The Belmont location was permanentlyclosed and personnel were reassigned to other loca-tions. The Salem substation was relocated to 154 MainStreet. The Merrimack substation was relocated to110 Broad Street in Nashua with the Department ofTransportation EZ-Pass office. The Dover Point Of-fice is being renovated in an effort to enhance cus-tomer service and become more efficient. The DoverPoint office is at a temporary location at the PeaseInternational Tradeport.

The Bureau of Driver Licensing continues to offerCommercial Driver License testing through the NewHampshire State Police Troop G personnel in six lo-cations. The Windham test site has been replaced bythe new Nashua DMV facility allowing applicants totake both the knowledge and practical test at the samelocation. The Division of Motor Vehicles has alsopartnered with the University of New Hampshire toconduct commercial tests on the Durham campus. Al-though the change is not significant for the DMV, it willbe a cost savings for the University system.

The automated testing system has been deployedand has been operational in all substation locationssince April of 2010. A total of 159,984 exams wereadministered throughout the state during FY 2012, in-cluding commercial, motorcycle and operator knowl-edge examination.

A total of 28,527 road skills examinations wereconducted during FY 2012, including operator, mo-

torcycle and commercial examinations. The averagepassing rate for FY 2012 is 78 percent.

A total of 335,890 driver licenses, ID cards andschool bus certificates were produced and issued duringFY 2012. Although this was an increase over last year,the staff and production systems were able to handlethe work load.

The Bureau of Driver Licensing was staffed bytwenty five full-time and one part-time DMV person-nel and six Division of State Police personnel duringFY 2012

Driver Licensing - Motorcycle Rider TrainingProgram

The MRT Program has sites in Concord,Hooksett, Keene, Laconia, Londonderry, Nashua,North Haverhill, Portsmouth, and Whitefield. Classesare conducted from early April to the beginning of No-vember. All locations offer courses on the weekends,and weekday courses are offered at the Concord,Hooksett and Laconia sites.

The MRT Program uses a curriculum that is con-stantly evolving to keep up with the changes in themotorcycling world. The Motorcycle Safety Founda-tion (MSF) develops the curriculum and provides pro-gram support.

To accommodate the needs of the students, theMRT Program now offers three MSF courses for stu-dents of all levels: the Beginner Rider Course, the In-termediate Rider Course and the Experienced RiderCourse. During FY 2012, the MRT Program trained3,027 students which is an increase from the 2,909

students trained in FY 2011. Through grant funds, theMRT Program purchased 21 new motorcycles of dif-ferent sizes and styles to accommodate the studentrequirements.

The MRT Program also purchased an enclosedRider Education Vehicle (REV) trailer. The purposeof the REV is to draw attention to the MRT Programas well as motorcycle awareness and education as awhole. The REV includes a SMARTrainer motorcyclesimulator, which allows individuals to get a feel for mo-torcycle controls and situations they may encounteron the road.

During this past year, the MRT Program enhancedthe quality assurance requirements for the three pri-vate training companies under contract with the DMV.On-site quality assurance reviews to each site duringclassroom and range exercises are being conductedmultiple times throughout each season.

The Motorcycle Rider Training (MRT) Programwas staffed by three full-time employees, one part-time employee and 42 part-time seasonal RiderCoaches during its 23rd year of existence.

Bureau of Driver Licensing – Driver EducationUnit

The Driver Education Unit provides oversight andsupport to the public high schools and private highschools throughout the state, as well as the commer-cial driver education schools. There are approximately228 driver education instructors, each having takenand passed the nine-credit driver education instructorcurriculum that is offered through Keene State Col-lege, as well as a comprehensive written and drivingtest administered by the Driver Education Unit.

The Driver Education Unit also oversees the DriverEducation curriculum, instructor certification, profes-sional development approval, and secondary schoolapproval. The Driver Education Unit has completed31 classroom reviews to ensure compliance with statelaw and administrative rules.

New Hampshire RSA 263:19 requires all 16 and17 year-olds who apply for a driver’s license to com-plete an approved driver education program. Approxi-mately 13,000 students participated in driver educa-tion through a high school or commercial driving schoolduring FY 2012.

Driver improvement and point reduction programsare also approved and reviewed by the Driver Edu-cation Unit. There are currently 12 approved driverimprovement programs. The Driver Education Unitwas staffed by one full-time DMV and one full-timeState Police employee during FY 2012.

own program.• 87 public or private high schools contracted

their driver education program to a commercialdriver school

• 6 public or private high schools do not offerdriver education.Thirty-eight commercial driver education schools

are not associated with any high school.

Bureau of Financial ResponsibilityThe Bureau of Financial Responsibility adminis-

ters and enforces motor vehicle statutes that have adirect effect on an individual’s driving record historyand the status of driver license and vehicle registrationprivileges. It is the central site for data gathered fromall law enforcement agencies, District and Superiorcourts, and out-of-state motor vehicle agencies.

The bureau is responsible for receiving, process-ing and maintaining records of all information enteredto an individual’s driving record, including convictions,suspensions/revocations, restoration dates and crashinvolvement.

The bureau is divided into seven sections:

lated to suspension/revocation actions, convictions, andcrash involvement, to a computerized document im-aging and retrieval system.

Driving RecordsProcesses requests received from businesses, law

enforcement agencies, courts and individuals for NewHampshire driver records, crash reports and varioussuspension and restoration notices within the param-eters laid out by the N.H. Privacy Act.

SR22/AlcoholProcesses SR22 Certificates of Insurance forms, SR26

Cancellation of Insurance forms, impaired driver interven-tion program certificates of completion, and defensive driv-ing certificates of completion. This section verifies the ac-curacy of the documents as established by motor vehiclelaws and administrative rules.

Plea by MailProcesses traffic complaints/citations received from

local and state law enforcement agencies throughout thestate. This section receives an average of 9,900 trafficcomplaints or citations each month. During peak periodsvolume can exceed 10,500 complaints or citations receivedper month. The section processes payment of fines as wellas not guilty pleas. Payments are processed via check,cash and credit card transactions. Since December of 2010,the N.H. DMV has been accepting on-line payments fortickets paid within 30 days from the date of issuance.

Court ProcessingProcesses conviction and default information received

from District and Superior courts for both minor and ma-jor offenses. Examples of minor offenses/convictions in-clude speeding, traffic signal violation, negligent driving,etc. Examples of major offenses/convictions include DWIoffenses, conduct after an accident, operating after sus-pension/revocation, and reckless operation.

Out-of-StateProcesses information received from out-of-states

courts as well as other state registries of motor vehicles. Information received includes convictions, defaults, andsuspension information.

CrashProcesses information obtained from Operator and

Unformed Police Crash Reports. Information related toreportable and non-reportable crashes is captured for sta-tistical purposes. The section also maintains records andgenerates suspensions resulting from uninsured motoristcrashes, defaulted agreements, and civil judgments awardedby New Hampshire courts.

The bureau is currently working with State Police andthe Department of Information Technology to implementthe electronic receipt of crash information (CRMS Project)which is scheduled for implementation in the fall of 2012.

New InitiativesDuring FY 2012, the bureau continued to

work with the Bureau of Driver Licensing, Bu-reau of Hearings, and the Department of Infor-mation Technology to implement changes in theMotor Carrier Safety Improvement Act (MCSIA)laws.

During FY 2012 the bureau worked closelywith N.H. State Police and the Department of In-formation Technology on a joint venture titled

eTicketing which would allow State Police to printPBM tickets (citations/complaints) which would thenbe transferred to DMV, thus greatly reducing themanual effort needed to receive, file and enter the in-formation into database records.

As indicated, this project was implemented in April2012. Since implementation through June 30, 2012,more than 2,300 tickets were electronically enteredinto database records.

The bureau also partnered with the AdministrativeOffice of the Courts and the Department of Informa-tion Technology on the ECitation Project which es-tablished a protocol /process thru which DMV wouldprovide electronic files of Plea by Mail citations/com-plaints filed with a plea of Not Guilty to the respectivecourt thus eliminating the need for the court to manu-ally enter the information shown on the tickets into thecourt reporting system (Odyssey).

The bureau continues to process information re-lated to the establishment of an Alcohol Ignition Inter-lock Program.

The bureau was staffed by 25 full-time employeesand two part-time employees during FY 2012.

Bureau of Financial Responsibility - FatalityAnalysis Reporting System (FARS)

Since 1975, the National Highway Traffic SafetyAdministration (NHTSA) has operated the FatalityAnalysis Reporting System (FARS). FARS is a na-tional data collection system that contains informationon all motor vehicle traffic crashes in which there wasat least one fatality.

Substantive identification of fatalities under FARSoften comes from Police Accident Reports (PARs).Detailed information on the circumstances of the crashand persons and vehicles involved may be obtainedfrom a variety of sources including state and local po-lice departments, other state agencies, drivers licens-ing files, vehicle registrations, state highway depart-ment data, emergency medical services records, medi-cal examiner or coroners reports, toxicology reports,hospital records, and death certificates.

The FARS unit in New Hampshire is funded byNHTSA and the N.H. Highway Safety Agency. FARSdata are used to identify problems, evaluate safetycountermeasures and facilitate the development of traf-fic safety programs at the national and state levels. An

extensive annual analysis is performed and publishednoting demographic trends in fatal crashes. The FARSunit was staffed by one full- time employee during FY2012.

Bureau of OperationsThe Bureau of Operations is responsible for over-

seeing the daily interactions with the customers of theDivision of Motor Vehicles in person and over the tele-phone. FY 2012 represents the first full year as anindependent bureau.

The mission of the Bureau of Operations is to im-prove and enhance customer service by providing anintegrated, one-stop shopping experience for DMVcustomers. To accomplish this, the Bureau of Opera-tions started with employees who previously special-ized in only one DMV function and expanded theircapabilities with cross-training and re-organization toallow employees to process many different types oftransactions. The cross-training effort results in cus-tomers being able to complete more of their motorvehicle transactions with less trips to a DMV office.

At the close of FY 2011 all Operations personnelat the 13 substations were fully cross-trained in theservices currently offered at those locations. For FY2012, Operations had a goal to continue with thecross-training at DMV Headquarters and the substa-tions in order to begin offering additional services atthose locations.

FARS StatisticsFY 2012

Operations Headquarters consists of the follow-ing units and sections:

Contact CenterThe Contact Center is responsible for answering

telephone calls coming into the DMV, as well as an-swering customer e-mails. The Contact Center handlesthe public lines for the DMV main line, Driver Licens-ing, Registration and Credit Card Payments. The Con-tact Center also answers numerous calls for Title andFinancial Responsibility. The Contact Center receivesan average of 1,423 calls on a daily basis. In FY2012, Operations expanded it’s capabilities of answer-ing telephone calls by training the substation personnelto be able to answer customer calls when theirworkload allows. This practice will continue to ex-pand.

Information CounterThe Information Counter acts as the first point of

contact for customers entering the Concord DMV andseveral of the substations. The staff answers basicquestions pertaining to all aspects of the DMV, checksdocuments to ensure all paperwork is complete, ad-ministers the Driving License vision screening test anddirects customers to the correct customer servicecounter to complete their DMV transactions.

Driver Licensing Customer Service CounterStaff members are able to assist customers with

all types of Driver Licensing transactions including theissuance of any type of Driver License or Non-DriverIdentification Card, administer the eye test, administerthe computerized written exam, check documents forauthenticity as well as answer Driver Licensing ques-tions.

Financial Responsibility Customer ServiceCounter

The Financial Responsibility Customer ServiceCounter complete a variety of tasks including issuingdocuments pertaining to an individual’s motor vehiclerecord, assist customers with payment of a traffic ci-tation/complaint, restoring an individual’s privileges,and ensuring that all court and program documentsare complete prior to restoring privileges. Staff in thisarea also began the process of cross-training with the

Operations Contact Center and in FY 2013 will con-tinue this cross-training.

Registration and Title Customer Service CounterThe Registration and Title Customer Service

Counter staff assist customers with a variety of ques-tions and transactions pertaining to vehicle registra-tions and titles of automobiles, motorcycles, mopeds,trailers, and any other type of motor vehicle requiringa registration or title. This service counter also is in-volved with inspection station inventory sales as wellas completing walking disability applications. Staff inthis area also began the process of cross-training withthe Driver Licensing Customer Service Counter andwill continue this cross-training in other areas.

At the close of FY 2012, the Bureau of Opera-tions was staffed by 78 full-time positions and 18 part-time positions at the DMV Headquarters and substa-tions located throughout the state.

Bureau of RegistrationThe Bureau of Registration oversees the registra-

tion of any type of vehicle, trailer and boat required tobe registered, with the exception of Off-Highway Rec-reational Vehicles (OHRVs) and snowmobiles. Thebureau is responsible for the collection of the appro-priate fees in accordance with the provisions of thestate motor vehicle and boating laws. The purpose ofthe registration requirement is to protect the public andto facilitate vehicle identification in the case of a colli-sion, theft or violation of law.

During FY 2012, the Bureau of Operations wascreated, which oversees the daily operations of thestate registration offices. The Bureau of Registrationsacts as a support staff to the Bureau of Operations.The bureau is also responsible for the registration ofboats and the regulation of all New Hampshire BoatRegistration Agents, overseeing all dealers and inspec-tion stations and managing the Municipal Agent pro-gram.

The Municipal Agent Automation Project (MAAP)was implemented on July 11, 2005. MAAP is a ve-hicle registration and title computer system which con-nects the Division of Motor Vehicles to many townsand cities throughout New Hampshire which issue reg-istrations. On March 8, 2010, boat registration pro-cessing was added to the MAAP system. MAAP al-

lows Municipal Agents to process both the local andstate portions of registrations.

As part of the ongoing MAAP process, the bu-reau was responsible for assisting in the implementa-tion of a new style registration certificate. This newstyle registration certificate includes many new fea-tures, such as a bar code which law enforcement canscan on the roadside, and is printed using newer tech-nology on a laser printer. As of June 30, 2012, therewere 225 Municipal Agents throughout the state.

During FY 2012, the Bureau of Registration wasin the process of working with DoIT to implement anupdated webpage for easier customer use. The Bu-reau also continues to work with DoIT and the MAsto improve connectivity to MAAP by exploring VPNconnectivity verses hard lines. In addition, DoIT andthe Bureau of Registration are testing the reprogram-ming of MAAP to allow for the elimination of obsoleteimpact printers still necessary in registration and titleprocessing.

The Bureau of Registration was staffed by 17 full-time DMV personnel, one State Police employee andthree part-time staff during FY 2012.

Municipal Agent ProgramThe registration of motor vehicles in New Hamp-

shire is a service performed by authorized MunicipalAgents (MAs) in most towns and cities. Subject toapproval by the Commissioner of Safety and the gov-erning body of a city or town, the Director may ap-point municipal officials as agents to issue, renew ortransfer motor vehicle registrations.

At the close of this fiscal year, all 225 MunicipalAgents were on-line and connected to the state com-

puter system through the Municipal Agent AutomationProject (MAAP) performing registration transactionsin real time. The duties of the program consist of moni-toring compliance with New Hampshire laws, admin-istrative rules and procedures, and the MA contractsin conjunction with the Division of Motor Vehicles AuditSection.

The MA program conducts the required trainingfor MAs and their staff, and additionally will attendworkshops and conferences statewide hosted by theNew Hampshire City and Town Clerks’ Association.The MA program and Bureau of Registration as a wholealso work in conjunction with the Office of Informa-tion Technology to assist with the implementation andmonitoring of computer programs connecting Munici-pal Agents to MAAP. The Municipal Agent Programalso operates the Agent Help Desk. The Agent HelpDesk answers telephone calls, e-mails and faxes fromall 234 towns and cities throughout New Hampshire,as well as the 114 authorized boat agents.

In addition to the other duties of the program suchas municipal agent and boat agent training, the AgentHelp Desk answers an average of approximately 8000calls per month with a minimum of two and maximumof six employees on the telephones. This year the staffcreated a new Agent Desk Help Manual as well asdeveloped a new Advanced Training Class in an effortto reduce call volume.

Boat Registration UnitThe Bureau of Registration works in conjunction

with the Division of Safety Services with the registra-tion of all vessel (boat) registrations. Boat registra-tions are renewed annually and all expire on Decem-ber 31st of each year. As of December 5, 2011, therewere 92,621 boats registered. At the close of FY2012there were 114 authorized boat agents, including 65online agents, and 49 off-line agents. There are 14state locations able to process boat registrations.

During FY 2012, the Bureau of Registration addedan additional 14 boat agents to process boat registra-tions on-line. There will be twelve other on-line townscurrently utilizing vendor software that will be able toprocess boat registrations by the end of the year.

for the registration of vehicles that travel in two or moremember jurisdictions. It is a registration reciprocityagreement among American states and Canadian prov-inces that provides for payment of license fees on thebasis of fleet miles operated in the various jurisdic-tions. Under the terms of the agreement, one jurisdic-tion will collect the apportioned fees and divide themamong the other IRP jurisdictions according to a for-mula based on percentage of mileage traveled in eachjurisdiction, vehicle identification information, and maxi-mum weight. During FY 2012, there were approxi-mately 3,128 active IRP accounts and 10,900 regis-tered vehicles.

On average, $776,000 in monthly fees was col-lected. After apportioned fees are distributed to otherstates, approximately $277,000 remained with NewHampshire. IRP currently operates in two locations inthe state, at the Twin Mountain substation and the mainDMV office in Concord.

Dealer and Inspection ProgramThe Dealer and Inspection Program controls the

distribution of motor vehicle inspection stickers, dealerplates, applications, and other various forms used byNew Hampshire dealers and inspection stations. Deal-ers are required to renew in March while inspectionsstations are required to renew their appointment inSeptember.

During FY 2012, the dealer program monitoredthe operation of 2,267 dealers, including 924 new andused, 43 automotive recycling, 77 motorcycle, 437repair, 184 transport, 183 utility, 197 wholesale and222 retail dealers without plates. There were a total of11,512 active dealer plates of all kinds in use in thestate during FY 2012. The inspection program moni-tored the operation of 2,384 inspection stations, in-cluding 288 fleet, 15 replacement glass, 105 munici-pal and 1,976 public inspection stations.

On-Board Diagnostics and SafetyInspection Program

The On-Board Diagnostics (OBD) system is anintegral part of the computer systems of all passengercars and light trucks manufactured after 1995. OBDIIdetects the deterioration of power train componentsor emission controls that may result in increased ve-hicle exhaust emissions. By detecting such problems

early, OBD enables the consumer to have repairs madebefore the problem(s) become more severe and moreexpensive to correct.

New Hampshire’s On-Board Diagnostics (OBD)and Safety Inspection Program is a decentralized pro-gram with more than 1,900 DMV-licensed vehicle in-spection stations throughout the state. Safety andOBD test results for approximately 1.3 million OBDqualifying vehicles are reported electronically to thestate through a sophisticated computer-basedsystem. In addition to assuring that New Hampshireremains compliant with EPA emissions regulations; thissystem provides valuable benefits to our state’smotorists. Inspection technicians must specify the ex-act reason(s) for failing a vehicle, or list what itemswould need repair in order to pass the safety inspec-tion.

The vehicle’s emission system reports the OBDstatus of the vehicle and any conditions requiring diag-nosis and repair. This record helps to protect con-sumers from fraudulent additional charges for unnec-essary repairs. The DMV’s computerized reporting/analysis system can identify inspection stations whosebehavior indicates possible inspection fraud. This hasproven extremely useful in prosecuting inspection fraudcases and has promoted a positive consumer imagefor the OBD Program and the DMV in general.

The New Hampshire OBD & Safety InspectionProgram continues to lead the nation with its innova-tive approaches to fraud detection and customer ser-vice. The OBD Program Manager regularly providestechnical assistance to many of the state’s licensed in-spection stations and works closely with industrygroups such as the New Hampshire Automobile Deal-ers Association (NHADA) and government/law en-forcement agencies, such as the U.S EnvironmentalProtection Agency, N.H. Department of Environmen-tal Services, the Attorney General, State Police, DOSHearings Bureau, and local New Hampshire policedepartments.

She also manages the Economic Hardship WaiverProgram (EHW) as mandated by the Legislature. TheEHW program provides New Hampshire residentswho cannot afford to make necessary emissions re-pairs with an opportunity to apply for a waiver thatexempts their vehicle from emissions testing for oneinspection cycle.

True to the Legislature’s original intent, the pro-gram is administered using the broadest possiblecriteria. The only requirements are that the vehicle musthave passed the safety inspection, failed the emissionstest, and the owner must provide a written estimate ofthe needed emissions repairs, together with an expla-nation detailing their reasons for requesting the waiver.Since its inception in 2006, the program has processedan annual average of 125 waiver applications with anapproval rate of more than 85 percent.

In 2011 the DMV put out a request for proposalson a new contract for the OBD program as the cur-rent contract was expiring in 2012. There were fourcompanies that responded and one that withdrew theirproposal because they were bought out by anothervendor who also bid. The Governor and ExecutiveCouncil approved a new five-year contract in May,2012.

Bureau of Registration - Pupil TransportationUnit

The Pupil Transportation Unit oversees over 100public school bus companies. This unit is responsiblefor conducting criminal and motor vehicle backgroundchecks on over 4300 school bus drivers who are em-ployed in the state of New Hampshire.

In addition to safety inspections by an official in-spection station, school buses are mechanically in-spected once each year by a state trooper before theyare authorized to carry passengers.

The unit inspects more than 2,600 school buses inthe state. State troopers, who are commercial motorvehicle qualified, conduct these inspections. This sec-tion is an integral part of the investigation of all schoolbus crashes and thoroughly investigates complaints re-garding school buses and school bus drivers. This unitworks in conjunction with local police departments

and other state agencies.The section also participates at the state Emer-

gency Operations Center, in case of an emergencywhere school buses may be needed for an evacua-tion. The unit supervisor, a state trooper, is respon-sible for coordinating this task with the bus compa-nies. This includes participation in graded exercisesfor the Vermont Yankee and Seabrook Station nuclearpower plants, which are conducted in alternating years.

The unit supervisor is also responsible for the train-ing and certification of school bus drivers and schoolbus driver instructors in the state. Once per year, aforty-hour class is taught for the school bus trainingcertificate.

The unit supervisor also conducts audits on theschool bus companies to ensure compliance on theSaf-C 1300 rules for School Bus Transportation. Thisentails an audit of the driver files and periodic inspec-tions of school buses.

Bureau of Title and Anti-TheftThe Bureau of Title and Anti-Theft is responsible

for issuing motor vehicle titles. The Bureau also de-termines the legal ownership of motor vehicles on liens

and initiates DMV investigations of criminal and con-sumer fraud. New Hampshire partners with the Na-tional Motor Vehicle Title Information System(NMVTIS) which shares title information among theparticipating states and jurisdictions to ensure that is-sues such as brands odometer discrepancies are notomitted.

The Bureau works closely with the Division of StatePolice on criminal investigations involving titles issues,and works with federal, state, county and local lawenforcement agencies to identify stolen vehicles. TheBureau assists in cases of insurance fraud, dealer vio-lation, consumer complaints, odometer fraud coun-terfeit titles and statutory liens.

The Bureau participates in training classes for themunicipal agents and DMV partners educating themon all the administrative rules and laws pertaining totitles and liens that include New Hampshire licenseddealers, town and city clerks and lending institutions.

The Bureau also processes all abandoned motorvehicles, mechanic liens, storage liens, junked motorvehicles and surrendered titles from other jurisdictions.The Bureau was staffed by twenty three full-time per-sonnel and two part-time personnel during FY 2012.

ArbitrationSeventeen arbitration demands during FY 2012

were resolved prior to the hearing, either through settle-ment with the manufacturer or repair of the vehicle.

After the Board’s acceptance of a consumer De-mand for Arbitration, the manufacturer has the legis-

lated right to a Final Repair opportunity. In many in-stances the vehicle is repaired at this time, giving theconsumer the right to withdraw their demand only toreinstate it within a year of that repair should the de-fect reoccur.

During FY 2012, ten manufacturers have been rep-resented in arbitration submissions. Of the cases filedduring FY 2012, 22 hearings were held over 11 meet-ing dates. Also to date, no cases were appealed byeither party to N.H. Superior Court during the pastyear.

The Motor Vehicle Arbitration Board assists con-sumers who have new vehicles with defects to get thevehicles repaired or to obtain some relief.

Audit SectionThe Audit Section is an independent, objective unit

providing oversight and strategic planning designed toadd value and improve efficiencies by bringing a sys-tematic, disciplined approach to evaluate and improvethe effectiveness of risk management, control and gov-ernance of the Division of Motor vehicles.

The Audit Section is responsible for the prepara-tion and oversight of the Division’s biennial budget,oversight of Municipal Agent compliance requirements,and the development and oversight of fiscal policies.Other essential functions include performing bothMunicipal Agent and substation audits, oversight ofDMV Federal Grant Awards, and to establish andmonitor agency internal controls.

In the past fiscal year one hundred and fifty threeMunicipal Agent offices were audited. The Audit Sec-tion continues on course to visit each of the two hun-dred twenty five Municipal Agent locations annually.

The regular audit schedule has been well acceptedby the Municipal Agents as it reinforces their under-standing of the rules and procedures established toguide them in the performance of their duties. Theaudit also establishes a cutoff point for many of therecord retention procedures.

The auditors spend time observing office proce-dures, identifying areas of concern and discussing theseitems with the Municipal Agent. To the extent pos-sible, the auditors address their questions and con-cerns. In some locations the audit is the only regularopportunity for Agents to interact with DMV person-nel on a face to face basis.

In addition to the above, eleven DMV substationswere audited during the past fiscal year with invento-ries and cash being reconciled. In addition, the mainheadquarters located in Concord was also audited withinventories and cash being reconciled.

Other Significant Actions:• Efforts to relieve the current inventory system of

obsolete data continue. With each audit, a listingof obsolete inventory is compiled that can be removed from the inventory system.

• Review DMV invoices prior to their final processing. This insures the validity of the payments andkeeps the Division up to date on pending expensecharges.

• Audit and approve all refund requests prior to sub-mitting to Treasury for processing.

• Reconcile the IRP revenue recorded in VISTA tothe revenue recorded in IDMS on a monthly ba-sis.

• Review the documentation of ReplacementDriver License transactions.

After hours classes were offered as well astraining delivered to the site. During this period, therewas an increase in attendance from other non-DMVemployees from the Department of Safety.

DIVISION OF STATE POLICE

Dedicated to providing the highestdegree of law enforcement servicethroughout the State of New Hamp-shire while maintaining the traditionsof fairness, professionalism and in-tegrity.

Mission Statement:

The New Hampshire State Police was cre-ated by an act of the Legislature on July 1,1937, the 15th such force in the United

States. At its inception, the State Police consistedof 43 officers supported by eight civilian employ-ees.

In July 2012, N.H. State Police celebrated its75th anniversary.

As a state law enforcement agency, State Po-lice patrols New Hampshire’s state highways, tollroads and interstates, enforcing state criminal,motor vehicle and other public safety laws.

The Division has concurrent jurisdiction intowns under the population level of 3,000 and pri-mary jurisdiction on all interstate highways. Divi-sion members are empowered to carry out law en-forcement functions in all other locations when theyobserve a law violation, are in pursuit of an inves-tigation or a violator, or are requested to assist bylocal authorities, the Attorney General or the Gov-ernor.

The Division of State Police is organized intothree bureaus, Field Operations, Investigative Ser-vices and Support Services. In addition, there arethree units, Executive Security, the Forensic Labo-ratory, and Professional Standards, that report di-rectly to the Director.

Headquartered at the James H. Hayes SafetyBuilding in Concord, the Division of State Policeoperates from seven troop stations around the state

and provides a visible law enforcement presenceacross New Hampshire.

Field Operations BureauThe Field Operations Bureau oversees the daily

operations of seven field troops composed of uni-formed troopers and troop-level investigators. Thetroops are divided into Field Areas I, II and III.

The primary function of the Field OperationsBureau is to provide patrol services. These patrolservices are provided throughout the state to allcommunities. Communities with small or part-timepolice departments may request assistance to pro-vide full, 24-four hour police service.

The purpose of standard patrol services is toseek voluntary compliance with the motor vehiclestatutes and to serve as a deterrent for criminalactivity. Investigation of criminal activity withineach troop area is the responsibility of uniformedtroopers and detectives assigned to the barracks.

In addition to patrol services, the Field Opera-tions Bureau provides various specialized services.The Special Services section of the Bureau is re-sponsible for overseeing the following units: theDrill Team, Drug Abuse Resistance Education(D.A.R.E.), the Drug Recognition Expert Unit, Ex-plosives Disposal Unit, Motorcycle Unit, PublicRelations Unit, Special Enforcement Unit, andTechnical Accident Reconstruction Unit.

Additionally, the Special Events ResponseTeam and Special Weapons and Tactics Unit areadministered through the Field Operations Bureau.

selected for their service and assigned throughoutthe state.

Troop AHeadquartered in Epping, Troop A provides

police services to Rockingham and Strafford Coun-ties. The geographical area is a blend of metro-politan, suburban and rural communities, rankingamong the most important centers of commerceand tourism within the state.

Three major highway systems, joined by a hostof secondary roads, intersect the region connect-ing it with other areas throughout New England.

During the fiscal year, Troop A troopers stopped37,133 vehicles, arrested 311 impaired drivers, in-vestigated 971 traffic crashes, and conducted 755case investigations.

In April, troopers were dispatched toGreenland, where members of the Greenland Po-lice Department and the Attorney General’s DrugTask Force were serving search and arrest warrants.The wanted subject had barricaded himself insidethe residence after firing multiple shots at the of-ficers. Greenland Police Chief Michael Maloneywas shot and killed by the subject and four otherofficers were seriously injured. Upon arriving onscene, troopers assisted with maintaining a perim-eter around the suspect’s residence and evacuatinga neighboring family from their residence. MajorCrimes detectives conducted the review and inves-tigation of the incident.

In May, troopers were dispatched to thePiscataqua River Bridge on Interstate 95 north-bound in Portsmouth for a possible suicidal sub-ject. Upon arrival, troopers observed a young malesubject standing on the outside edge of the guard-rail.

A trooper engaged the man in conversation and,once he became distracted, grabbed him with theassistance of another trooper and a Portsmouth po-lice officer. The subject was pulled over the guard-rail to safety.

During June, detectives assisted the FBI, At-torney General’s Office, U.S. Attorney’s Office,U.S. Drug Enforcement Administration and theExeter Police Department with the investigationat the Exeter Hospital for tampering with a con-

sumer product and diverting a controlled substance.

Troop BHeadquartered in Bedford, Troop B provides

police services throughout Hillsborough County.The area includes 31 towns and the cities ofManchester and Nashua, as well as 146 miles ofhighway in the most heavily populated area of thestate.

During the fiscal year, Troop B troopers stopped23,476 vehicles, arrested 310 impaired drivers, in-vestigated 1,202 traffic crashes and conducted1,568 case investigations.

Enforcement of impaired drivers continued tobe a primary focus for the troop. A trooper, in hiscruiser, was struck on the F.E. Everett turnpike byan impaired driver while working an enforcementdetail patrolling for impaired drivers.

The trooper sustained non-life-threatening in-juries. The suspect fled on foot in Nashua. fficersfrom the Nashua Police Department, Massachu-setts State Police and Troop B successfully trackedand apprehended the suspect with the help of a K-9.

A trooper was involved in a police shooting inthe town of Pelham. Members of the Lowell and

Dracut, Mass. Police Departments pursued a vio-lent suspect armed with a weapon into the town ofPelham. A stand-off ensued. The suspect was fa-tally shot after he pointed a weapon at officers,posing an imminent deadly force threat. No policepersonnel were injured during the incident.

K-9 teams continued to provide a very valu-able service to the troop and surrounding policecommunities. Windham Police requested the as-sistance of a K-9 after reporting a home invasionin which two suspects fled from the residence af-ter being confronted by the homeowner. After sev-eral miles of K-9 tracking through the woods anda residential area, a suspect was found hiding onthe roof of a house several miles away.

Troop CHeadquartered in Keene, Troop C is respon-

sible for providing police services throughoutSullivan and Cheshire counties. Located in thesouthwest corner of the state, the troop provideslaw enforcement coverage to 38 communities.

There are 18 towns in which troopers are theprimary law enforcement agency. In addition,troopers are frequently requested by full-time po-lice departments to provide patrol coverage andinvestigative assistance.

During the fiscal year, Troop C troopers stopped18,923 vehicles, arrested 213 impaired drivers, in-vestigated 260 traffic crashes and conducted 1,005criminal investigations.

In July, troopers received a “be on the look-out” call for a male subject suspected of shootingand killing his mother and step-father in New York.Authorities advised that the suspect had family ties

to the Town of Gilsum. It was also reported that thesuspect had numerous firearms in the vehicle aswell as his girlfriend (possibly held against herwill) and an infant. Troopers spotted and monitoredthe vehicle, and were able to verify the presence ofa female and an infant. A perimeter was establishedand the Special Weapons and Tactics (SWAT) Unitwas activated. Negotiators established communi-cations and the suspect eventually surrendered. Thesuspect is currently in custody in New York.

In July, Troopers from Troop C and the MajorCrime Unit assisted the Keene Police Departmentwith a gang-related homicide in which the victimwas stabbed. The suspect is in custody awaitingtrial.

In April, troopers responded to Cornish for areport of an armed robbery involving the dischargeof a shotgun. Within four hours of the call, the sus-pect was tracked down and confessed. The sus-pect was taken into custody and is incarceratedawaiting trial.

Troop DHeadquartered in Concord, Troop D is respon-

sible for providing police services throughoutMerrimack County. The area includes 25 townsand two cities. In addition, Troop D covers Inter-state 93 from the Hooksett Toll Plaza to the Ashlandtown line and all of Interstate 89 from Bow to theVermont state line. This encompasses approxi-mately 230 miles of interstate highway.

The State Capital is located within the areaunder the responsibility of Troop D. Troopers areincreasingly tasked with being the primary law en-forcement provider to many of the state facilities,properties and agencies, including the State House,the Governor’s Mansion, State Prison, New Hamp-shire State Hospital and the New Hampshire Com-munity Technical Institute.

During the fiscal year, Troop D troopersstopped 32,951 vehicles, arrested 232 impaireddrivers, investigated 1,277 traffic crashes, and con-ducted 1,010 case investigations.

In March, Troopers responded to a report of amotor vehicle rollover with ejection on Interstate393 eastbound in Pembroke. Initial investigationrevealed that the accident was precipitated by a road

rage incident between a boyfriend and girlfrienddriving in separate vehicles.

The female attempted to pass the male’s ve-hicle on a curve and lost control, striking a metalguardrail and rolling several times, striking theother vehicle as it rolled. The girlfriend was unre-strained and was ejected from the vehicle as itrolled over. The boyfriend was charged with Vio-lation of Parole, Reckless Conduct, Criminal Mis-chief, and Endangering the Welfare of a Child.

In May, a trooper arrived on the scene of a com-mercial motor vehicle rollover accident on Inter-state 89 in Grantham. The trooper observed fuelspilling from the vehicle, smoke billowing fromthe engine compartment, and the driver trappedinside. The trooper breeched the windshield withhis axe, and pulled the driver out of the cab to safety.

In June, a trooper stopped a motor vehicle onInterstate 93 for speed in excess of 90 miles perhour. The operator was subsequently arrested forAggravated DWI. It was discovered that the sub-ject had three extraditable warrants out of Floridafor Grand Theft Auto, and the vehicle the driverwas operating was stolen.

Troop EHeadquartered in Tamworth, Troop E provides

police services throughout Belknap and Carrollcounties. This area encompasses 29 towns and theCity of Laconia. Within the geographical area ofTroop E are several lakes, ski areas, state parks,notches, scenic byways, and the White MountainNational Forest, resulting in a large influx of tour-ists and vacationers throughout the entire year.

During the fiscal year, Troop E troopers stoppeda total of 15,126 vehicles, arrested 120 impaireddrivers, investigated 132 traffic crashes, and con-ducted 975 investigations.

In December, troopers responded to a report ofan escaped inmate from the Carroll County Houseof Corrections in Ossipee. Troop E provided uni-formed personnel for the perimeter security, twoK-9 units for tracking the inmate, and a detectiveto assist in the investigation. The N.H. State Po-lice Aviation Unit also assisted in this search. Thecoordinated response lasted well into the night. Theescaped inmate was subsequently located a week

later and apprehended by the U.S. Marshal’s Fugi-tive Task Force.

Also in December, Troop E personnel assistedin the felony investigation of the severe beating ofa 2-year old male in Albany. Fortunately, the childis recovering from his injuries and the investiga-tion led to the arrest of two adults.

In June, Troop E personnel assisted theTamworth Police Department and the FBI with aninvestigation into the manufacturing and distribu-tion of child sexual abuse images. The investiga-tion concluded with the arrest of two adults. Onefaced federal charges and the other, state charges.

Troop FHeadquartered in Twin Mountain, Troop F is

responsible for providing police services through-out Coös and Grafton Counties. The area comprises39 percent of the state, including 3,610 square milesof rugged, rural terrain.

Within this boundary lie 74 towns and unin-corporated places, 60 miles of interstate highway,3,000 miles of state and local highways and hun-dreds of miles of back country roads. New Hamp-shire shares 42 miles of international border withCanada to the north. This region also hosts morethan seven million vacationers who visit this partof the state during the year.

Of the 74 towns and unincorporated areas inthis region, State Police personnel have primaryjurisdiction in 47 towns and 12 unincorporated ar-eas, each having a population of less than 3,000residents. Because of the low resident populationsin the many towns which make up Troop F, anddue to the fact that many of the police departmentsin these towns are small or part-time departments,State Police personnel handle in excess of 50 per-cent of all emergency calls for service in 44 of thesetowns. In many towns, State Police handle nearly100 percent of the calls for service.

During this fiscal year, Troop F troopersstopped 19,284 motor vehicles, arrested 155 im-paired drivers, investigated 532 traffic crashes, andconducted 2,118 case investigations.

In July, troopers initiated an investigation intoa missing juvenile in the northern part of the statethat quickly developed into a massive search in-

volving many local, county, state and federal agen-cies. After seven days of searching, the juvenile’sbody was discovered in the Connecticut River, turn-ing the case into a homicide investigation that cur-rently remains open.

In August, during Hurricane Irene, troopers as-sisted with road closures and the evacuation of resi-dents and visitors from flooded areas.

In May, troopers began a collaborative enforce-ment effort working with the U.S. Border Patrol toprevent the illegal smuggling of drugs and peopleacross the Canadian Border.

During the winter months, troopers participatedin a training mission with all of the agencies innorthern Coös County designed to test radiointeroperability and coordinate available resources.

Troop GHeadquartered in Concord, Troop G enforces

all state criminal and motor vehicle laws and rulesas well as federal regulations governing commer-cial vehicles. Troop G is composed of four primarysections: the Driver Licensing Task Force, FieldOperations, Commercial Motor Vehicle Enforce-ment, and Special Services.

The Driver Licensing Task Force assists the Di-vision of Motor Vehicles in the issuance of opera-tor, motorcycle, and commercial driver licensesthroughout the state; oversees the certification ofdriver education instructors; oversees a documentverification section headquartered in Concord re-sponsible for the verification of foreign documentspresented by non-US citizens; routinely conductscommercial vehicle and school bus road skill ex-aminations, and oversees the Pupil TransportationProgram which is responsible for the oversight of

the state’s school bus industry.During the fiscal year, the unit conducted 2,460

commercial driver license tests, certified 144 ap-plicants as school bus instructors and/or commer-cial driving school instructors, licensed 83 drivingschools and prosecuted 100 administrative hear-ings pertaining to school bus drivers and/or driv-ing schools.

The Field Operations section enforces the lawsand rules governing the operation of approximately2,200 vehicle dealerships and approximately 2,400official automotive safety inspection stationsthroughout the state; conducts classroom instruc-tion and practical examinations of persons seek-ing certification as automotive safety inspectors;enforces the laws and rules governing approxi-mately 10,000 certified automotive safety inspec-tors statewide; conducts physical examinations ofvehicles deemed by insurance companies to havebeen salvaged; locates and serves notice to per-sons eligible to be deemed Habitual Offenders;locates persons and retrieves driver’s licenses and/or registration plates from those that have beensuspended or revoked; conducts examinations ofcommercial vehicles for certification to carry ad-ditional weight; prosecutes all Administrative Hear-ings pertaining to vehicle crashes that resulted inthe death or serious injuries and further representsthe state’s interests upon subsequent petition(s) ofdrivers of such vehicles to have their driving privi-leges restored.

During the fiscal year, efforts of Field Opera-tions members resulted in 594 investigations of au-tomotive dealerships, inspection stations and re-ports of vehicle safety inspection rejections and1,351 audits. Troopers were tasked with locationand serving notice to 1,002 habitual offenders andlocating and retrieval of 45 suspended or revokedregistrations and/or driver licenses. Section mem-bers conducted 781 tests of applicants as automo-tive mechanics for certification as safety inspec-tors and examined 2,097 salvaged vehicles.

Troopers inspected 2,805 school buses andgenerated 46 administrative actions regardingdriver licenses as they pertained to fatal and/or se-rious personal injury crashes.

The Commercial Motor Vehicle section has a

number of troopers dedicated to the enforcement offederal laws and regulations governing the move-ment and examination of commercial vehicles thattravel through the state involved in inter- and intr-astate commerce as well as commercial driverqualifications and the enforcement of weight limitson roads and bridges.

The section also has two troopers assigned ex-clusively to the New Entrant Program which pro-vides all the educational and technical assistancefor new commercial motor carriers.

The combined efforts of the troop during thefiscal year produced 12,275 individual commer-cial vehicle inspections and the weighing of110,664 commercial vehicles. Troopers attachedto the New Entrant Program conducted 256 motorcarrier company safety audits and other investiga-tions.

During the fiscal year, 28,954 commercial ve-hicle violations were documented, of which 3,577vehicle and 843 driver violations were such thatthey were subject to an out-of-service order.

The section also administers the applicationprocess of intrastate-exclusive, non-hazardous ma-terial-carrying commercial drivers who petition theCommissioner of Safety for a Waiver of PhysicalDeficiency which would otherwise preclude themfrom receiving a commercial driver license. Dur-ing FY 2012, 101 such applications were processed.

As the primary criminal investigative resourcefor the Division of Motor Vehicles (DMV), theSpecial Services section of Troop G works closelywith the Attorney General’s Office Residency TaskForce and the State Insurance Commission, inves-tigating fraud related to illegal uses of DMV docu-ments, such as driver licenses, vehicle registrationsand automotive titles. Personnel work closely withthe US Attorney’s Office, Immigration and Cus-toms Enforcement and with Diplomatic Securityto assist in the identification of illegal/undocu-mented persons fraudulently seeking to procureDMV documents, and thereby contribute to thedeportation of such persons. To that end, the Spe-cial Services section conducted 79 criminal inves-tigations during the fiscal year.

Crisis Negotiation UnitThe goal of the Crisis Negotiation Unit is to

save lives and resolve critical incidents through theuse of proven verbal crisis management techniqueswhile striving to avoid unnecessary risk and injuryto law enforcement personnel, citizens and victims.

The Crisis Negotiation Unit is used to diffusepotentially life-threatening situations. Members arelocated throughout the state to allow for a quickresponse to situations no matter where and whenthey occur.

The Crisis Negotiation Unit responded to 14calls for service in Fiscal Year 2012. The nature ofthe calls ranged from suicidal and barricaded sub-jects to hostage situations. Unit personnel were in-volved in resolving a hostage situation in Gilsumwith a homicide suspect, and a standoff with a vio-lent, barricaded and possibly armed suspect in theTown of Richmond.

The majority of requests for service were theresult of an activation of the Special Weapons andTactics (SWAT) Unit, however, the Crisis Nego-tiation Unit receives calls independently and re-sponded to five calls for service as the primarymeans of resolution during this fiscal year.

Also during the fiscal year, members attendedscenario-based training and training on mentalhealth as it pertains to offenders.

Drill TeamThe Drill Team celebrated is 25th Anniversary

during Fiscal Year 2012. Originally begun as amilitary style rifle team, the unit has grown to coverceremonial and honor guard duties.

The volunteer unit participated in 31 events in-cluding the N.H. Police Memorial, the autumnNASCAR race, a funeral for a Massachusetts statetrooper, and a September 11 memorial service.

Several events were new to the team includingthe Portsmouth Military Parade, the ManchesterMonarchs D.A.R.E. game and a meeting of theGovernor’s Council. Throughout these events, theunit performed in front of an estimated 150,000people, the largest crowd being at the NASCARrace in Loudon.

In April of this year, the Drill Team assistedofficers from New Hampshire and New England

in paying final respects to Chief Michael Maloneyof the Greenland Police Department. The team alsoparticipated in the funeral services for two retiredtroopers, Lieutenant Larry Landry, who began hiscareer after returning from World War II, andformer Colonel George Iverson.

Drug Abuse Resistance Education (D.A.R.E.)The Drug Abuse Resistance Education

(D.A.R.E.) program has been in operation since1989.

The Division of State Police is responsible foroverseeing the program throughout the state andworks with D.A.R.E. America to ensure the properdelivery of the program. State Police D.A.R.E. per-sonnel are responsible for planning and conduct-ing the training of new D.A.R.E. officers in theNortheast Region and maintaining the certificationsof current New Hampshire D.A.R.E. officers.

There are approximately 128 D.A.R.E. Offic-ers in New Hampshire. The program was presentedin almost 100 schools and the K-4, elementary andmiddle school programs were delivered to nearly10,000 students during FY 2012.

The New Hampshire Motor Speedway hostedthe 21st Annual State Police D.A.R.E. Classic 5KRoad Race in August. The event raised $22,773.90for the program.

In September, the Northeast Regional Train-ing Team hosted the annual D.A.R.E. Officer Train-ing school, training new D.A.R.E. officers fromNew Hampshire, Maine, Massachusetts, NewYork, Kansas, Rhode Island, New Jersey andCanada.

At the annual in-service trainings in March andJune, D.A.R.E. officers were trained in the new“Keepin’ it Real” Elementary Curriculum. The new“KiR” elementary and middle school curricula areboth listed on the National Registry of Evidence-based Programs and Practices.

Drug Recognition Expert UnitThe Division of State Police has been partici-

pating in the Drug Recognition Expert (DRE) pro-gram since 1991. Unit members are trained to de-tect drivers impaired by alcohol or drugs. This isaccomplished by administering an evaluation of a

suspect that includes a breath or blood test, an in-terview of the arresting officer, a series of psycho-physical tests, checks of vital signs, and a series ofeye examinations including measuring pupil sizesunder various conditions of light.

At the completion of the evaluation a DRE isable to offer an opinion on a category or categoriesof drugs which impair the suspect from safely driv-ing a motor vehicle. This opinion is then confirmedby the toxicology results of a blood test.

During Fiscal Year 2012, the DRE Unit con-ducted 95 evaluations for prosecution. Some of thedrug categories detected were central nervous sys-tem depressants, central nervous system stimulants,narcotic analgesics, and cannabis.

Also during the fiscal year, DRE instructorsprovided alcohol and drug training to recruits andin-service officers at the Police Standards andTraining Academy. Instruction was also providedto several groups and organizations, including theDepartment of Transportation, the N.H. HighwaySafety Agency, the N.H. Sheriffs Association(Court Security Officers), the Driving TowardsZero Coalition, N.H. State Prison Corrections Of-ficers, Hesser College, New London-area policedepartments, the N.H. Police Cadet Academy, N.H.Hospice, N.H. Society for Physician’s Assistants,Massachusetts School of Pharmacy, Elliot Hospice,N.H. Public Radio, Salter School of Nursing, andseveral N.H. hospitals.

Explosives Disposal UnitThe Explosives Disposal Unit takes custody

and disposes of all found, abandoned, forfeited,and seized materials and devices containing ex-plosives, explosive materials, or explosivechemicals. Unit members are trained and equippedto assess, diagnose, and if required, render safe anysuspicious packages or improvised explosive de-vices.

The Explosives Disposal Unit is available tosupport agencies in protection details when therehave been threats involving the use ofexplosives. Explosives Disposal Unit troopers aretrained to conduct post-blast investigations, pro-vide technical support to investigators in the areaof explosives and hazardous devices, and testify

in court as expert witnesses.The unit also maintain explosive storage maga-

zines for the safe storage of explosives and explo-sive materials that are seized in criminal investi-gations, or are otherwise in the custody of publicsafety agencies.

The Explosives Disposal Unit has certified ex-plosive detection canine teams available to respondanywhere in the state.

All troopers assigned to the unit receive theirbomb technician training and certification atRedstone Arsenal in Huntsville, Alabama. They arerequired to recertify every three years. In additionto the bomb technician certification, unit membersare trained to the Hazardous Materials Technicianlevel through an accredited program from the In-ternational Association of Firefighters.

The Explosives Disposal Unit maintains a fullyequipped emergency response vehicle in Concord. To aid in the safe removal of explosives, chemi-cals and improvised explosive devices, the unitutilizes a NABCO TCV (Total Containment Ves-sel) that is designed for the total containment ofup to ten pounds of C-4 plastic explosives, and isalso designed to safely contain chemical, biologi-cal or radiological hazards that may be encoun-tered.

There were 225 requests for service during thisreporting period.

K-9 UnitK-9 teams, composed of a specially trained

troopers and dogs, are assigned to all troops withinthe state. They are trained and certified to New En-gland State Police Administrators’ Compact(NESPAC) standards. The K-9 Unit continues toprovide in-service training for canine teams fromEpsom, Plymouth, Goffstown, Laconia,Londonderry, Manchester, Middleton, Pittsfield,and Plaistow. The unit also trains with and assistswith certification of teams from Connecticut,Maine, Massachusetts and Rhode Island State Po-lice.

During this reporting period, the K-9 Unit wasinvolved in 857 missions, which included narcoticdetection, tracking, evidence recovery, buildingsearches, public relations demonstrations, cadaver

detection and crowd control.Narcotics teams assisted several communities

with school searches and assisted the Departmentof Corrections and Sheriff’s Departments with cor-rectional facility searches. They also assisted U.S.Postal Inspectors, the U.S. Drug EnforcementAgency, Immigration and Customs Enforcement,and local agencies with the detection of hiddencompartments, cash and illicit drugs on the high-ways and in residences.

Narcotics teams were involved in 286 detec-tion calls during the fiscal year resulting in the sei-zure of more than $40,000 in illicit cash.

A Troop A team assisted the Narcotics and In-vestigations Unit and Manchester Police Depart-ment with a search warrant in Manchester. Twopounds of marijuana and $15,000 in U.S. currencywere seized.

A Troop A team initiated a traffic stop on In-terstate 95 in Hampton. As a result of the investi-gation, the canine alerted on the vehicle. One ounceof crack cocaine was located hidden in the vehicle.

Several teams played an important role in theapprehension of subjects who fled from law en-forcement and in the securing of evidence fromburglaries and robberies.

A Troop B team assisted the Nashua Police De-partment in locating two suspects who fled from aserious assault at a night club. The canine teamlocated the first suspect hiding in the woods. Thesecond suspect was located hiding in a railroadyard. The canine also located the handgun used inthe assault.

A Troop B Team tracked and located a suspectfrom an armed home invasion in Windham. Thecanine team tracked through woods and swampsbefore locating the suspect hiding on the roof of ashed in a residential area.

A Troop C team assisted the Charlestown Po-lice Department in tracking a suspect from a resi-dential burglary. The subject was located hiding inan apartment building three-quarter of a mile fromthe burglary scene. The suspect confessed to morethan 100 burglaries in New Hampshire, Maine,Massachusetts and Vermont.

Patrol teams were also involved in searches formissing persons, including individuals with medi-

cal conditions such as Alzheimer’s disease, eld-erly persons and suicidal individuals. Manysearches involved hours of tracking in wooded ar-eas.

A Troop A team assisted the Nottingham Po-lice Department in locating two missing childrenlast seen playing in the woods behind their resi-dence. The canine tracked and located the childrenapproximately two miles into the woods.

A Troop D team assisted the Concord PoliceDepartment with a missing 11-year-old disabledchild. The child had walked away from the resi-dence in the middle of the night. The canine teamtracked and located the child hiding approximatelyone-half mile from his residence.

K-9 units also provided crowd control supportfor sporting and large events at the state’s variouscolleges and during Motorcycle Week in June inLaconia.

Motorcycle UnitThe Motorcycle Unit is a valuable asset to the

Division as a high visibility, high impact trafficenforcement tool as well as a positive public rela-tions tool.

Members of the Motorcycle Unit were utilizedwithin their respective troop areas during the fis-cal year. Three members were assigned to the Spe-cial Enforcement Unit to assist with aircraft speedenforcement details. They proved to be a strongasset to the Division in this capacity. Members of the Motorcycle Unit were assignedto numerous special duty assignments and publicrelations events, such as the annual MotorcycleWeek in Laconia, the D.A.R.E. Classic 5K, theNew Hampshire Police Memorial Ceremony, andthe N.H. Police Cadet Academy.

New Hampshire Hospital SecurityMembers of the New Hampshire Hospital Se-

curity Unit provide police coverage to the HughGallen State Office Complex, which includes theNew Hampshire Hospital, enforces federal, state,and local laws, and internal policies and proce-dures.

Officers provide general and specialized ser-vices to customers by providing a safe and secure

environment that allows patients/residents, em-ployees, volunteers, and visitors to deliver and re-ceive quality services. The campus population ona typical business day ranges from 2,500-3,000people.

The New Hampshire Hospital Security Unit co-ordinates with various non-profit and local orga-nizations in planning on-campus events, focusingon traffic and crowd control. These events bringthousands of additional people to the campus.

Campus Officers responded to 8,541 calls forservice during the fiscal year, which included 488calls for assaults/attempted assaults, 114 threats,191 Domestic Violence Order services, 130 sex of-fender registrations, 46 arrests, and 317 motor ve-hicle contacts.

Public Relations UnitThe Public Relations Unit offers the citizens

of New Hampshire presentations, lectures, semi-nars, informational campaigns and demonstrationspresented by State Police personnel. Law enforce-ment topics of interest range from alcohol and drugabuse to canine demonstrations.

Every troop and unit contributes to the success

of the Public Relations Unit by committing the ap-propriate personnel with the most up-to-date in-formation available for their presentations. In thisfiscal year, 189 requests were fulfilled.

Special Enforcement UnitThe Special Enforcement Unit enforces motor

vehicle laws, with the goal of making the high-ways safer. This is accomplished through use ofaircraft, marked and unmarked cruisers and mo-torcycles. The Special Enforcement Unit often usesits Bell helicopter to provide assistance in searchesfor missing and wanted persons, drug surveillance,Presidential and Vice-Presidential security, publicrelations events, observation of disaster damage,and aerial photography of traffic collisions andcrime scenes.

During this fiscal year, the plane flew 189 traf-fic enforcement missions equating to 564 flighthours and resulting in 5,384 event numbers. Dueto these efforts, some of the most aggressive driv-ers have been removed from New Hampshire’sroadways.

On a morning traffic flight in July, a vehiclewas observed operating erratically after reportedlystriking another vehicle and then leaving the sceneof the accident on Interstate 89 southbound inGrantham. The driver was subsequently stoppedby troopers on the ground, directed by the helicop-ter, and arrested for conduct after an accident anddriving under the influence of drugs.

On a morning traffic flight in October, a ve-hicle was observed traveling 127 mph on Interstate93 in Bow; the driver was stopped and subsequentlyarrested for Reckless Driving.

On a morning traffic flight in April, a vehiclewas observed traveling at 103 mph and weavingerratically on Interstate 89 in Hopkinton. The driverattempted to elude troopers on the ground, but con-tinued to be followed by the plane until stoppedand arrested for aggravated driving under the in-fluence of drugs.

During this fiscal year, the helicopter provedto be a valuable tool in many search and rescueoperations. In September, the helicopter was on atraining flight when it was requested in Raymondto search for a driver who had fled from a traffic

stop. The helicopter arrived and was able to pinthe suspect down under some bushes until a StatePolice K-9 unit arrived and arrested him.

In November, the helicopter was called out dur-ing the evening to search for three lost hikers whohad been missing for approximately eight hours.After searching for more than two hours the pilotand tactical flight officer, using their night visiongoggles, observed a faint light in the woods. TheTFO was then able to utilize the FLIR thermal im-aging camera to confirm that the light belonged tothe three lost hikers. Ground personnel were di-rected to their location, where they were escortedout of the woods without injury.

Special Events Response Team (SERT)The Special Events Response Team (SERT)

consists of 50 troopers extensively trained in riotcontrol formations and Mobile Field Tactics. SERTmembers are routinely assigned to the N.H. MotorSpeedway races and the Laconia Motorcycle Clas-sic.

In the past the team was activated and assignedin the towns of Durham, Keene and Plymouth dur-ing sporting championship events involving theBoston Red Sox and the New England Patriots.The team is also utilized during searches for miss-ing persons.

Special Weapons and Tactics (SWAT) UnitThe Special Weapons and Tactics (SWAT) Unit

was created in 1972 to respond to critical incidentsinvolving armed suspects or hostages. The missionof the unit is to ensure public safety by resolvinghigh risk incidents that are beyond the capabilityof patrol units.

During the fiscal year, the SWAT Unit was ac-tivated five times to communities all over NewHampshire.

Unit members served high risk warrants for theAttorney General’s Drug Task Force in Gilford andFranconia. In April, the unit responded toGreenland in the wake of a failed drug raid thatresulted in several fatalities.

Also in April, the unit responded to Lancasterfor an incident involving a feud between neigh-bors. A suspect and his wife committed suicide.

In May, the SWAT Unit responded to Mason for asubject who committed suicide after being con-tacted by local officers on a welfare check.

This period of time also included the begin-ning of the presidential election campaign. TheSWAT Unit participated in several dignitary pro-tection details to safeguard President Obama, VicePresident Biden, First Lady Michelle Obama andGovernor Mitt Romney.

State House SecurityThe New Hampshire State Police State House

Security Unit was founded in 1998 to provide high-level security to State House complex, includingthe State Capital building, Legislative Office Build-ing, State House Annex, and State Library. In or-der to accomplish their mission, the members ofthe unit work with a variety of other agencies, in-cluding the State Police Executive Security Unit,General Court Protective Services, Concord Po-lice and the U.S. Secret Service.

Unit members are required to maintain a po-litically neutral status while demonstrating a highlevel of law enforcement professionalism and fair-ness to all elected officials, visiting dignitaries, em-ployees and citizens.

Technical Accident Reconstruction (TAR) UnitThe Technical Accident Reconstruction Unit

(TAR) consists of 14 members who have receivedspecialized training in the field of motor vehiclecollision investigation.

Unit members receive training in Motor Ve-hicle Reconstruction, Crash Data Retrieval, Foren-sic Mapping, Computer Aided Drawing and theVericom Brake Testing Computer. Unit personnelrespond throughout the state to assist, investigateand reconstruct motor vehicle collisions involv-ing technical issues and/or unusual circumstances.

During the fiscal year, unit members conducted76 investigations, a record number of case investi-gations for a one-year period. Of the total investi-gations, 38 resulted in various felony and misde-meanor arrests from negligent homicide to negli-gent driving and are pending litigation in Superiorand District Courts throughout the state.

with several police cruiser-involved crashes, ofboth local police and State Police vehicles.

In June, the unit received three new Total Sta-tions devices, paid for by a generous grant fromthe New Hampshire Highway Safety Agency. ATotal Station is an electronic instrument used tocollect data, which is stored electronically and laterdownloaded for transfer and creation of a scaledscene drawing. The instrument allows for datapoints to be measured in three dimensions, therebymapping roadways, evidence locations and con-tiguous terrain with a high degree of accuracy.

Investigative Services BureauThe Investigative Services Bureau directs and

coordinates the Division’s investigative operationsthrough its specialized units: Major Crime, Nar-cotics and Investigations, Terrorism and Intelli-gence, and Polygraph.

The Bureau’s diverse programs, modern equip-ment, training and technical expertise provide pro-fessional police investigative services to supportfederal, state, county and local law enforcementagencies, including the state Attorney General’s of-fice.

Major Crime UnitThe Major Crime Unit was created out of the

necessity for highly trained investigators assignedto handle the most egregious and sensitive offenses.Specialized sections within the unit include CrimeScene Services, Computer Crime, Cold Case, Fam-ily Services, Amber Alert, Missing Persons, ViCAP,and Corrections Liaison.

Unit personnel work in partnership with otherlaw enforcement agencies on a variety of jointprojects, including the New England State PoliceInformation Network (NESPIN), Violent CriminalApprehension Program (VICAP), Northeast Re-gional ViCAP (NERV), Violent Crime LinkageAnalysis System (VICLAS), Homicide Assessment& Lead Tracking (HALT), Child Abduction SerialKiller Unit (CASKU), and National Center forMissing and Exploited Children (NCMEC).

Unit members work cooperatively with pros-ecutors from the U.S. Attorney’s Office, the N.H.Attorney General’s Office, and the various county

attorneys’ offices during their investigations, includ-ing arraignment, indictment and trial.

During the fiscal year, the Major Crime Unitconducted 116 investigations that included 22 ho-micides. Tragically, included in the homicide sta-tistics is the line-of-duty death of Greenland Po-lice Chief Michael Maloney. The homicides in-cluded two fatal police-involved-shootings duringwhich the officers’ actions were justified. Four ofthe homicides remain under investigation, includ-ing the investigation into the death of young CelinaCass from West Stewartstown. Her disappearanceset off a massive search operation beginning in July2011.

The Major Crime Unit conducted 18 otherdeath investigations. These investigations includedfour deaths in the state prisons and several suspi-cious deaths that were later determined to be sui-cides or accidental deaths.

The Major Crime Unit prison liaison handled23 fugitive from justice cases in the state prisons.The liaison investigated six escapes and processed10 in-state arrest warrants. The prison liaison con-ducted 14 other investigations, including three druginvestigations, four investigations concerning thedelivery of contraband to inmates, one sexual as-sault, and one unarmed assault.

The Major Crime Unit assisted the New YorkState Police with an Amber Alert and the arrest ofa suspect wanted for a triple homicide in thatr state.The Major Crime Unit was involved with severalother high profile situations this past fiscal year,including a violent home invasion in Deerfield anda quadruple shooting in Mason. In April, the unitwas called out to eight homicide scenes over a pe-riod of 19 days.

Narcotics and Investigations UnitThe Narcotics and Investigations Unit investi-

gates all drug and vice-related crimes. It also main-tains a staff of undercover personnel and special-ized equipment, including a state-of-the-art wire-tap facility.

The activities performed by the unit includeundercover and controlled buys of illegal drugsincluding marijuana, cocaine, crack-cocaine, andheroin. Working in collaboration with other law

enforcement agencies, some members of the unitare assigned to task forces such as the N.H. Attor-ney General’s Drug Task Force, FBI Safe Streets,and DEA High Density Drug Trafficking Area.

The unit investigated 101 cases during the fis-cal year involving marijuana, cocaine, heroin,oxycodone and other prescription drugs. Therecontinues to be an alarming increase in cases in-volving controlled prescription drugs, particularlyoxycodone.

In January, the unit along with the ManchesterPolice Department concluded an investigation intoa major crack cocaine distribution ring with ties toNew York. An undercover trooper was able to in-filtrate the organization and make purchases ofcrack cocaine which eventually led to the execu-tion of search warrants and multiple arrests.

Approximately $15,000 was seized along withseveral pounds of marijuana and a quantity of crackcocaine.

In June, the unit along with the Nashua PoliceDepartment, U.S. Postal Inspectors, and Immigra-tion and Customs Enforcement conducted an un-dercover operation into the illegal trafficking ofMDMA (Ecstasy) via China and several other for-eign countries. This investigation resulted in theseizure of more than one kilogram of MDMA witha street value of approximately $35,000.

More than two ounces of methamphetaminewas seized during the execution of multiple searchwarrants. Three arrests have been made and a num-ber of additional indictments are pending.

The Drug Diversion section is responsible forinvestigating all diverted prescription medicationcases and crimes such as “doctor shopping” or pass-ing fraudulent prescriptions. The Drug Diversionsection investigated 31 cases. These investigationsresulted in the arrest of 27 individuals.

The Marijuana Eradication Program involvesmembers of the unit working in cooperation withlocal jurisdictions in an effort to eliminate thecultivation of marijuana. A total of 26 sites werelocated and 2,986 plants were identified and eradi-cated. These cases led to 21 arrests.

Polygraph UnitThe State Police Polygraph Unit has provided

forensic polygraph services since 1970. The Poly-graph Unit is composed of certified Forensic Poly-graph Examiners. These examiners provide valu-able support to local, county, state, and federal lawenforcement agencies, as well as to the Departmentof Corrections, Office of the Attorney General andthe various county attorneys’ offices throughout thestate. During the fiscal year, a total of 75 polygraphexam requests were received.

The polygraph examiners of the New Hamp-shire State Police are routinely tasked with apply-ing their investigative training and experience, fo-rensic polygraph skills, interviewing techniques,statement analysis, and body language interpreta-tion to affirm or dispel suspicions of individualssuspected of being involved in criminal activities.

Combining these skills with the polygraph in-strument as an investigative tool enables the ex-aminers to identify and narrow relevant investiga-tive issues, identify culpable individuals, obtainadmissions and confessions, and uncover previ-ously unknown information.

Some of the most common polygraph examsthe State Police Polygraph Unit conducts includeexams related to homicides, sexual assaults, childabuse, arson, drug investigations, burglaries, thefts,and other physical assaults.

The Polygraph Unit is also tasked with admin-istering examinations as part of the law enforce-ment employment selection process for all NewHampshire state trooper candidates as well as ap-plicants seeking employment with other state agen-cies.

The other agencies that utilize the State PolicePolygraph Unit for pre-employment screening ex-ams include the Office of the State Fire Marshal,the Fish and Game Department, the Liquor Com-mission Enforcement Bureau, Marine Patrol, andthe Division of Homeland Security and EmergencyManagement.

The Polygraph Unit also conducts pre-employ-ment exams for local law enforcement agenciesupon request.

In April, the Polygraph Unit assisted the ColdCase Unit with a homicide investigation where thevictim was shot twice while laying in his bed. Inthis case the Polygraph Unit was tasked with test-

ing two possible suspects. One suspect admitted tobeing present during the homicide, but not beingthe one who pulled the trigger.

This first suspect subsequently identified a spe-cific person as the actual shooter. This suspectedshooter was soon identified and located by ColdCase Unit personnel. Upon initial questioning byCold Case Unit investigators, this person deniedany involvement in the homicide and agreed tosubmit to a polygraph exam.

After completion of the exam this subject wasdeemed to have been non-deceptive when he de-nied shooting the victim. Next, the initial suspectwas asked to submit to a polygraph exam.

This subject agreed and was found to be de-ceptive when denying that he had shot the victim.During a post-test interview with this suspect, theexaminer ultimately obtained a full confession,including details of the disposal of the murderweapon.

Terrorism Intelligence UnitAs part of the New Hampshire Information and

Analysis Center, it is the responsibility of the NewHampshire State Police Intelligence Unit to col-lect and analyze intelligence information relatingto criminal and terrorist activity and to coordinatethe dissemination of this intelligence among state,federal, county and local law enforcement agen-cies, ensuring compliance with the guidelines setforth within 28CFR, Part 23 of the Code of Fed-eral Regulations.

The unit also maintains links to local, state andfederal law enforcement agencies throughout thenation and world, including the FBI’s New Hamp-shire Joint Terrorism Task Force (JTTF) and theUnited States Attorney’s Anti-Terrorism AdvisoryCouncil (ATAC).

The Intelligence Unit continues to be theDivision’s liaison with the Financial Crimes En-forcement Network (FinCEN), the National WhiteCollar Crime Center (NW3C), the Regional Infor-mation Sharing System (RISS) through the NewEngland State Police Information Network(NESPIN), the El Paso Intelligence Center (EPIC),the International Criminal Police Organization(INTERPOL), Law Enforcement Online (LEO),

eGuardian and the Homeland Security IntelligenceNetwork (HSIN).

At present, the Intelligence Unit provides criti-cal terrorist/criminal updates and officer safety in-formation to State Police and approximately 265federal, county and local law enforcement agen-cies through an Internet based e-mail system.

In Fiscal Year 2012, the unit disseminated 943intelligence and officer safety bulletins to the NewHampshire law enforcement community throughthis system. This is a 132 percent increase fromFY 2011.

During the fiscal year, the unit reviewed ap-proximately 4,526 pieces of information receivedfrom numerous law enforcement sources across thecountry. The unit also reviewed 3,592 New Hamp-shire Motor Vehicle foreign-national driver licenseapplications. Once reviewed, this information isforwarded to Immigration and Customs Enforce-ment for further review.

The unit processed 1,075 intelligence andLENS reports dealing with individuals involvedin criminal activity. The unit also processed 4,407arrest reports by state police personnel. The Intel-ligence Unit reviewed 166 e-mail tips and leadssent to the Investigative Services Bureau via theState Police web portal related to criminal activityor wanted subjects and forwarded them to the ap-propriate jurisdictions for investigation.

One of the primary missions of the unit is re-sponding to requests for information (RFIs) fromlocal, state, county, and federal agencies. In FY2012, the Intelligence unit responded to 6,783 RFIs.This is a 198 percent increase from FY 2011. Theincrease was largely due to the continuing devel-opment of the NHIAC.

In FY 2012, the unit continued its presence inthe New Hampshire office of the FBI by assigninga trooper to its Joint Terrorism Task Force (JTTF).

The New Hampshire JTTF is responsible forthe investigation of all terrorism-related activitywithin the state. The Terrorism and IntelligenceUnit continues to maintain contact with the UnitedStates Department of Homeland Security (DHS),through the Homeland Security Information Net-work (HSIN). This communications system deliv-ers real-time interactive connectivity among state

evaluated periodically and deleted when it becomesstale or has been proven not to be useful.

Activities are guided in this regard not only bythe provisions of 28 CFR 23, but also by RSAChapter 651-F, New Hampshire’s more stringentpersonal privacy statute, and whichever statute pro-vides the most protection for personal privacy in aparticular case is the one that takes precidence.

Oversight of the IAC is provided by the Assis-tant Commissioner of Safety, the ACEPS Commit-tee and its Intelligence Subcommittee, and peri-odic briefings to a group of individuals consistingof legislative representatives and representativesof the Attorney General’s office and the NewHampshire Branch of the American Civil Liber-ties Union. In addition, the Assistant Commissionerof Safety conducts an annual in-depth review ofthe IAC to verify its compliance with the statutesand regulations that govern its operations.

Support Services BureauThe Support Services Bureau provides many

of the behind-the-scene services necessary to keepthe Division functioning.

The bureau comprises Auxiliary Troopers,Communications Maintenance, Criminal Records,Fleet Maintenance and Equipment Supply, Head-quarters Communications, National Crime Infor-mation Center, Permits and Licensing, and Recruit-ment and Training units.

Auxiliary TroopersAuxiliary troopers are certified part-time troop-

ers who provide services, partially on a volunteerbasis, by assisting division members with publicrelations events, communications, patrol, trafficcontrol, and select background and criminal in-vestigations.

A number of retired troopers have joined theauxiliary force, bringing vast investigative experi-ence, along with reduced costs, that has been uti-lized for conducting applicant background inves-tigations and assisting the Major Crime Unit.

Auxiliary troopers also participated in paiddetails including Motorcycle Week in Laconia, raceevents at N.H. Motor Speedway, county fairs, andcivic activities.

and local partners and with the DHS Homeland Se-curity Operations Center.

The Terrorism and Intelligence Unit continuesto develop and maintain the Law Enforcement In-formation Network Exchange (LINX), a centralcomputerized criminal intelligence/informationmanagement system designed for the purpose ofassisting state and local law enforcement agencypersonnel in ongoing multi-jurisdictional investi-gations and prosecutions.

During this period, the unit continued to pro-vide LINX User Training to local and county of-ficers as well as Division members.

To date, 264 officers representing 75 agenciesand 158 Division members have been trained andhave access to the LINX system.

The unit participates in a biweekly electronicchat session and telephone conference call with 14Fusion Centers located in the Northeast Region ofthe United States. This chat and conference callkeeps the intelligence analysts informed about allterrorism and criminal issues being seen through-out the northeast region.

The unit continues to be an active participantof the New England State Police AdministrativeCompact (NESPAC) intelligence working group,and hosts bi-monthly law enforcement analystworking group meetings.

The Information and Analysis Center, of whichthe Terrorism Intelligence Unit is a component,takes extremely seriously both its statutory and itsmoral obligation to ensure that any criminal or ter-rorism intelligence information received is sub-jected to a stringent verification process before itis entered into a database, that there is a criminalpredicate involved, and that the information is re-

Communications Maintenance UnitThe Communications Maintenance Unit is re-

sponsible for the installation, programming, andservicing of two-way voice and data communica-tions equipment owned or operated by all Divi-sions within the Department of Safety and otheragencies, including the Department of Resourcesand Economic Development, Fish and Game De-partment, and state and local public safety agen-cies. During the fiscal year, the unit logged 4,050work orders for the installation or repair of mo-bile, portable or fixed communications equipment.

During FY 2012, personnel continued their in-volvement with large grant projects under the U.S.Department of Homeland Security (DHS) and theAmerican Recovery and Reinvestment Act(ARRA). Funds provided under the DHS andARRA programs supported the purchase and in-stallation of IP-based microwave infrastructureequipment for the Public Safety InteroperabilityCommunications (PSIC) project and the BroadbandTechnologies Opportunity Program (BTOP) initia-tive.

The installation and acceptance testing of thesesystems was overseen by Communications Main-tenance personnel as arranged in a partnership ar-rangement with the N.H. Department of Resourcesand Economic Development, the N.H. Departmentof Transportation, the University of New Hamp-shire, N.H. Public Television, and the N.H. Na-tional Guard.

Personnel continued to provide installation,software upgrades, and unit level repair servicesto Project 54-equipped vehicles. Updated laptopcomputers and wireless air card systems have beeninstalled into P-54 equipped State Police vehicles.These enhancements increase the trooper’s directaccess to cell carrier services in support of mul-tiple in-vehicle devices such as bar code readers,driver license scanners, and on-board E-ticket print-ers. Installation of these devices is scheduled tocontinue through the remainder of 2012 with fullcompletion expected by the summer of 2013.

Criminal Records UnitThe Criminal Records Unit maintains the

state’s Criminal History Record Information

(CHRI) Repository, the Automated FingerprintIdentification System (AFIS), and the UniformCrime Reporting (UCR) System.

Central Repository – During this reporting pe-riod, 167,976 CHRI requests, 100,305 court dock-ets, 4,327 annulments, and 47,833 criminal and ap-plicant fingerprint cards of scans were processedby the Central Repository. Work continues on thefunctional and technical upgrade of the criminalhistory Central Repository to incorporate the J-ONE initiative, with a tentative completion in thespring of 2013.

Automated Fingerprint Identification System(AFIS) –The Biometric Identification Section’sAFIS system continues with its upgrade, throughNational Criminal History Improvement Program(NCHIP) federal funding to enable a seamless uni-lateral interface from the AFIS to the criminal his-tory repository to automatically populate arrest de-mographic data. Additional system improvementsare being sought to enable “batch scanning” ofinked fingerprint cards for more rapid processingand electronic data transmittal to the FBI criminalhistory record database.

Uniform Crime Reporting – During this report-ing period, the Uniform Crime Reporting sectioncontinues to roll out “Beyond 20/20,” a techno-logical package designed to enable access to crimestatistical data by New Hampshire law enforcementagencies and the public. Law enforcement can nowaccess this statistical data online. Efforts are con-tinuing to soon offer the same service for publicaccess. UCR has also been very instrumental intraining and assisting the Records ManagementSystem (RMS) vendor with incorporating NationalIncident-Based Reporting System (NIBRS) report-ing by Division members for more complete state-wide crime statistical reporting.

Fleet Maintenance and Equipment SupplyFleet Maintenance and Equipment Supply is

responsible for the testing, bidding, procuring, is-suing and maintaining marked and unmarked ve-hicles for the Division of State Police. Fleet Main-tenance is responsible for the oversight of regularmaintenance performed at the Department of Safetyautomotive garage, as well as any maintenance per-

formed at independent facilities. The unit is alsoresponsible for procuring, issuing and maintain-ing an inventory of all Division uniforms and equip-ment.

The Division is currently implementing an E-ticketing program allowing for the ease of issuingtraffic tickets, information processing, and docu-mentation.

During the transitional phase, collaboration willoccur with the Communications Maintenance Unit,the automotive garage and vendors to complete thenew cruiser passenger compartment set-ups.

Headquarters Communications UnitThe N.H. State Police Communications Cen-

ter is currently located at the Department of Safety’sIncident Planning and Operation Center (IPOC).

Communications personnel are responsible fordispatching all personnel assigned to Headquar-ters, Troop B, Troop D, Troop G, Marine Patrol,the Bureau of Liquor Enforcement, the Office ofthe State Fire Marshal, the Department of Re-sources and Economic Development (DRED), andthe Fish and Game Department. The unit has alsoabsorbed shifts of coverage for Troops A, C and E.

The unit is also the after-hours provider forother state agencies such as the Division of Home-land Security and Emergency Management, Attor-ney General’s Office and the Medical Examiner’sOffice. It also operates the Emergency Alert Sys-tem alerting systems for the Seabrook and VermontYankee nuclear power plants.

The center is also responsible for receiving allnationwide law enforcement electronic messages,which includes the data entry system for both theNational Criminal Information Center (NCIC) andthe National Law Enforcement Telecommunica-tions System (NLETS). This also includes enter-ing information from state and local agencies intothe State Police On-Line Telecommunications Sys-tem (SPOTS) and NLETS, including the NCICState database for In-State Misdemeanor Warrantsand Domestic Violence Petitions (DVP). With theimplementation of the Computer Aided Dispatch(CAD), the center can provide an immediate print-out of all calls received by the Division.

National Crime Information Center (NCIC)Unit

The National Crime Information Center(NCIC) Unit plays an integral role in the exchangeof data between the law enforcement communityand the FBI. The NCIC Unit focuses on officersafety, public safety, the protection of the agenciesentering information, and the protection of the per-sons being entered.

Entries made include wanted persons, missingpersons, stolen vehicles, stolen guns, protectionorders, and records of sexual offenders and theirwhereabouts. Unit members provide quality con-trol by reviewing every entry made into NCIC as-suring that each meets the federal criteria in orderto keep the state fully connected and compliant.

Nearly 27,000 records from New Hampshireremain active in the NCIC database and 29,520records remain active in the in-state database. TheState Police On-Line Telecommunications System(SPOTS) system provides information directly tomore than 150 law enforcement agencies in NewHampshire. During the fiscal year, unit personnel providedspecialty instruction to various federal, state, countyand local agencies to better inform dispatchers andpolice officers of the FBI updates and systemchanges. One change is the ability to input andaccess image files in NCIC.

A significant project during this reporting pe-riod is the Justice One Network (J-ONE). Thisproject promises to integrate information from thecourts, corrections, police departments and othercriminal justice agencies.

Criminal warrants are currently being electroni-cally sent from all ten Superior Courts to their re-spective sheriff’s departments. The next phase ofJ-ONE will include the ability to electronicallytransmit disposition data from the court directlyinto the New Hampshire Criminal Records Unit,expediting the process of updating criminal recordswith minimal manual intervention.

Permits and Licensing UnitThe Permits and Licensing Unit performs back-

ground checks on individuals applying for non-resi-dent pistol permits, private investigators licenses,

security guard licenses, bail bondsman licenses andcertificates of competency for non-permissible fire-works and for the use of explosives.

The Permits and Licensing Unit works with theOffice of the State Fire Marshal to inspect non-permissible fireworks displays throughout the state.

The inspection of explosives and fireworksstorage facilities throughout the state is directedthrough the Permits and Licensing Unit and per-formed by personnel from the Explosives DisposalUnit. During this reporting period, 8,608 individualpermits and licenses were issued. Of those 6,935were for non-resident licenses to carry concealedhandguns.

In addition, 219 licenses for the sale, use, pur-chase, transport and storage of explosives and fire-works were issued.

The unit is also responsible for the licensingand auditing of all private investigator, securityguard and bail recovery agencies throughout thestate. During this period, 74 agency licenses wereissued.

The State Police Gun Line is operated by thePermits and Licensing Unit. It received 36,622 callsfrom Federal Firearms Licensees (FFLs) during thefiscal year requesting background checks on NewHampshire residents purchasing handguns. In ad-dition, the New Hampshire court system requested612 background checks on pending motions forthe return of seized firearms.

Recruitment and Training UnitThe Recruitment and Training Unit maintains

an active list of qualified applicants for the posi-tion of State Trooper I. Testing for the position ofState Trooper I is conducted three times during thefiscal year. Qualified applicants are initially invitedto attend the physical fitness test, followed by awritten test. Applicants who are successful in thesetwo examinations are invited to participate in astructured oral board.

Applicants successful in completing the oralboards are then considered for background inves-tigations. The command staff reviews applicantswho receive a favorable recommendation for em-ployment after the background investigation. Onlya select few applicants are invited to the final two

days of testing, which consist of a polygraph ex-amination, Director’s interview, psychological ex-amination, physical examination, and drug testing.Twenty-one probationary troopers were sworn intothe ranks of the State Police during this fiscal yearto fill vacant positions.

Newly enlisted troopers attend 14 weeks oftraining at the Police Standards & Training Acad-emy. Upon graduation they are assigned a patrolresponsibility under the supervision of a field train-ing officer. Once released to solo status, the pro-bationary trooper continues to work in a patrolfunction under supervision of the troop field train-ing officer supervisor.

Close supervision and evaluation are criticalduring the initial phase of a trooper’s career. Theunit is closely involved in the career-long devel-opment of an employee through the Field TrainingOfficer program and followups.

The Division offers an on-the-job training pro-gram approved by the U.S. Department of Veter-ans Affairs, meeting all state and federal require-ments for the education and training of eligiblemilitary personnel, veterans and their dependentswishing to utilize their GI Bill Educational Ben-efits. The Recruitment and Training Unit screensall probationary troopers for potential enrollmentinto this program.

Another military-related initiative is a Veteran’sAffairs program that ensures military-deployedtroopers have a smooth pre-deployment exit andreintegration upon return. The program helps keepdeployed troopers in contact with their State Po-lice family.

The Recruitment and Training Unit is also re-sponsible for ensuring that Division members areassigned appropriate training so that they may bet-ter serve the citizens of New Hampshire. EachDivision member must attend at least eight hoursof in-service training per year for continued certi-fication as a police officer. They must also undergosem-annual firearms qualification and use-of-forcetraining. They also must pass a physical fitnessexam every three years thoughout their careers.

It is the responsibility of the unit to registertroopers for classes at the Police Standards andTraining Council or other available training venue.48

In addition, the unit coordinates in-service train-ing, firearms and use-of-force training, defensivedriving training, and criminal interview/interroga-tion training and serves as a representative to thetraining committee of the New England State Po-lice Administrators’ Compact.

The Recruitment and Training Unit also over-sees the administration of the college intern lawenforcement program. This program offers unpaidpositions to students who either reside in or attendcollege in the state, and aspire to enter the law en-forcement field.

Sex Offender Registry UnitThe Sex Offender Registry Unit is responsible

for maintaining the database of all registered sexoffenders within the State of New Hampshire. Of-fenders are now required to register with their lo-cal police departments either quarterly or semi-annually; they must also register any change in theirpersonal information within five business days.This includes temporary addresses, vehicles, tele-phone numbers and e-mail accounts. The informa-tion is sent to the Registry for daily updates. On aweekly basis the information from the database isupdated to the State Police public website. Thisinformation includes an up-to-date warrants list andupdated information on offenders against children(Meagan’s Law), including the photographs of of-fenders available to the public. Offenders pay anannual $50 registration fee. If an offender is indi-gent, he or she may request a hearing through theBureau of Hearings, which is attended by StatePolice personnel.

In addition to the registration requirements, theDivision is also responsible for verifying the ad-dress of every sexual offender twice a year. This isdone by certified mailings and in-person compli-ance checks by troopers.

The Sex Offender Registry is also responsiblefor determining the “reasonably equivalent of-fense” for out-of-state sexual offenders who moveto New Hampshire. If an offender does not agreewith the Sex Offender Registry’s determination,he or she can request a hearing to dispute the de-termination.

as new offenders are released from prison or moveinto the state. At the end of the fiscal year, therewas a total of 5,099 offenders (an increase of 237from July 2011), with a total of 2,465 actively reg-istering throughout New Hampshire, and a total of2,197 on the Meagan’s Law list.

As new laws go into effect, the Sex OffenderRegistry must stay current with the registration re-quirements and assist local police departments incomplying with these changes. The Sex OffenderRegistry offers training to local and federal lawenforcement agencies in order to achieve this goal.

Executive Security UnitThe Executive Security Unit is responsible for

the protection and transportation of the Governorand the First Family. The unit also strives to pro-vide protection and assistance for visiting digni-taries to the state.

During the fiscal year, the Executive SecurityUnit continued its association with the NationalGovernors’ Security Association, an important al-liance for threat updates on local and national lev-els, as well as for sharing information on NationalExecutive Protection Standards.

Forensic LaboratoryThe State Police Forensic Laboratory is the sole

provider of traditional forensic laboratory servicesin New Hampshire.

The Forensic Laboratory receives and analyzesevidence from more than 200 city and town policedepartments, several state law enforcement agen-cies including the State Police, 10 county sheriffdepartments, numerous city and town fire depart-ments, and, on occasion, federal law enforcementagencies conducting criminal investigations in thestate.

The Forensic Laboratory is nationally accred-ited by the Association of Crime Laboratory Di-rectors – Laboratory Accreditation Board (ASCLD/LAB). The Forensic Laboratory is composed oftwo main laboratory facilities – the CriminalisticsGroup and the Toxicology Group. Technical ser-vices currently offered by the Criminalistics Groupinclude firearms/toolmarks, latent impressions (fin-ger/palmprints, footwear and tire track), serology,The Sex Offender Registry continues to grow 49

DNA, digital evidence, trace, and controlled sub-stances examinations.

Technical services currently offered by theToxicology Group include blood and breath alco-hol testing as well as the analysis of controlled sub-stances in urine, blood and other biologicalsamples.

Staffing includes 45 criminalists, administra-tion and support staff that has enabled the Foren-sic Laboratory to become a state-of-the-art facilitywith highly trained and experienced specialists ineach discipline.

During FY 2012, the Forensic Laboratory con-tinued to prepare for the transition to InternationalStandards rganization-based standards during thenext laboratory inspection, which is scheduled totake place in 2014. Legislation was passed in 2012that will expand the impaired driving statute andrequire additional resources to be used for validat-ing new methods of analysis.

Throughout these projects, the Forensic Labo-ratory staff continues its central mission of pro-cessing cases in order to meet court and other in-vestigative deadlines. An increase in case activitycontinues to be linked to the economic climate.

Professional Standards UnitThe Professional Standards Unit ensures that

all conduct by Division members is consistent withNew Hampshire statutes and the New HampshireState Police Professional Standards of Conduct.The unit investigates all use of force incidents,vehicle pursuits, and citizen complaints againstTroopers.

In this fiscal year, 119 complaints were filed,which includes sworn and civilian support staffmembers of State Police, New Hampshire Hospi-tal Security, and Marine Patrol. Of these, 56 weregenerated by civilians and 63 were generated bythe Division itself.

Approximately 57 percent of Division-gener-ated complaints are due to at-fault cruiser accidentsor other equipment damage.

DIVISION OF HOMELANDSECURITY AND EMERGENCYMANAGEMENT

Mission: The mission of the Division ofHomeland Security and Emergency Man-agement is multi-faceted: We serve as thepersonal representatives of the Governor ofNew Hampshire and coordinate state re-sources during declared emergencies andserve as the Governor’s liaison to the fed-eral Department of Homeland Security andFEMA, the Federal Emergency Manage-ment Agency. We maintain a constant “leanforward” posture to ensure that the statereceives timely awareness of actual and po-tential human-caused and natural disastersand maintains the capability to respond tothem whenever and wherever they occur.This is accomplished through liaison withthe federal Homeland Security IntellegenceNetwork and with state, local and regionallaw enforcement, monitoring informationfrom a variety of classified and non-classi-fied sources, constantly updating disasterplanning in conjunction with local emer-gency management directors and public andprivate sector representatives, maintainingstrategic caches of supplies needed in caseof various emergencies, conducting pro-grams to identify and protect the state’scritical infrastructure, conducting trainingand preparedness exercises, educating thepublic regarding preparedness and re-sponse to terrorist acts and disaster, staff-ing the emergency operations center anddirecting mitigation efforts, administrationof state and federal disaster aid programsand conducting after-action reviews of thestate’s responses to disasters and terroristincidents.

N.H. Division of Homeland Secu-rity and EmergencyManagement Mission Statement

The Division of Homeland Security andEmergency Management (HSEM) is re-sponsible for coordinating New

Hampshire’s response to major natural or human-caused disasters.

For natural disasters, such as hurricanes, floodsor severe winter storms, it has the primary respon-sibility for leading that response. For emergenciesinvolving public health or law enforcement inci-dents, it takes a supporting role.

The HSEM staff forms the core of the state’semergency response organization and operates theState Emergency Operations Center (SEOC). Dur-ing major disasters, the SEOC is augmented withliaisons from a variety of state, federal and privatesector agencies.

During FY 2012 the state received Presiden-tial Disaster Declarations for Tropical Storm Irene,in August 2011, and for flooding in CheshireCounty communities triggered by heavy rain inJune 2012.

Tropical Storm Irene had been downgradedfrom a hurricane by the time it moved into north-ern New England on Aug. 24.While it still packeddamaging winds, the most serious damage fromthe storm resulted from more than nine inches ofrain that it brought, primarily to the White Moun-tains region.

That rain caused serious flooding on rivers andstreams in Belknap, Carroll, Grafton, Merrimack,Strafford and Sullivan counties. The floodingcaused nearly $14.7 million in damage to publicinfrastructure and emergency response costs. Inaddition, 304 individuals and families receivedfederal, state and charitable assistance in cleaningup and restoring flooded homes.

That figure does not include extensive dam-age to roads and bridges in and around the WhiteMountains National Forest.

The second Presidential Disaster Declarationcame for flooding in Cheshire County on May 29.The entire state received a significant amount of

rain, but eight communities received more than sixinches during a short period of time, causing sig-nificant damage to roads and other infrastructure.

Damage was estimated at $3 mil-lion and restoration work was still un-derway at the end of the fiscal year.

The SEOC may be activated at anyof four levels appropriate to an inci-dent. Level 1 is normal business. TheHSEM Operations Section is in chargeof incidents that occur during a work-day while the agency duty officer takesover after business hours. Level 2places several Division staff in theSEOC to monitor a potential incident.Level 3 brings in additional HSEMstaff and liaisons from other appropri-ate agencies. Level 4 is a full-scale activation for amajor incident.

The SEOC was activated 10 times for incidentsat Level 2 or higher during FY 2012. These in-cluded major snowstorms on Halloween weekendand March 1, 2012; monitoring and assistance dur-ing a drug raid gone bad in Greenland on April 13,2012, that resulted in a number of casualties; and amajor fire at the Portsmouth Naval Shipyard onMay 22, 2012.

The SEOC was also operational for the 2012Ingestion Pathway Exercise sequence for theSeabrook Station Nuclear Power Plant and the 2012National Level Exercise, involving a cyber attackscenario.

HSEM is organized into sections based onfunction: Administration, Operations, Planning,Technological Hazards, Field Services, and Com-munications.

Administration includes the Director and As-sistant Director, financial administrators, and thePublic Information Officer. It provides for overallagency leadership and direction. By statute, theDirector of Homeland Security and EmergencyManagement reports to both the Governor and theCommissioner of Safety.

The Operations Section manages the StateEmergency Center and internal agency functions.

The Planning Section administers federal grantprograms and documents disaster assistance re-

quests to the Federal Emergency ManagementAgency.

The Technological Hazards Section is prima-rily responsible for maintaining the RadiologicalEmergency Response Plans for the Seabrook Sta-tion and Vermont Yankee nuclear power plants.

The Field Services Section is made up of fieldrepresentatives who are assigned to each of thestate’s 234 cities and towns to assist in the devel-opment of local emergency plans and grant appli-cations. Field representatives act as liaisons be-tween the towns they represent and the state.

The Communications Section operates theSEOC’s communications room, which includes avariety of radio and telephone communication sys-tems to maintain contact with state and local pub-lic safety agencies and entities such as the NationalWeather Service and the nuclear power plants.

SEOC communications facilities also includepositions for amateur radio operators, who play asignificant role in emergency operations. Amateurradio operations, via the Amateur Radio EmergencyService (ARES), provide technical skills, equip-ment and designated radio frequencies.

The agency’s newest project, the N.H. Infor-mation and Analysis Center (NHIAC) began op-eration in August 2010 at the state Incident Plan-ning and Operations Center. (See page 9.)

HSEM was established in 1951 as the state’sOffice of Civil Defense. During the Cold War, itsprimary function was to plan to protect the state’scivil population in the event of a nuclear attack bythe Soviet Union. Fortunately, that attack nevercame, and the agency’s focus changed over time

to planning for natural and home-grown manmadedisasters.

In 1982, the agency became the Governor’s Of-fice of Emergency Management, and it was taskedwith development of emergency plans for theSeabrook Station nuclear power plant, which wasthen under construction.

When Seabrook came online in 1990, theagency continued to develop those emergency plansto keep up with a growing population in the Sea-coast and to conduct regular graded exercises forSeabrook and Vermont Yankee.

It became part of the Department of Safety in2002, partly in response to the terrorist attacks ofSept. 11, 2001. In 2006, it became the Division ofHomeland Security and Emergency Management.

N.H. Bureau of EmergencyCommunications Mission andVision Statements:

DIVISION OF EMERGENCY SERVICESAND COMMUNICATIONS

The Division of Emergency Services andCommunications consists of the Bureauof Emergency Communications which op-

erates the state’s Enhanced 911 emergency system;the Bureau of Telecommunications, which providesthe state’s telephone system; and the Bureau ofCommunications Maintenance.

The Bureau of Emergency Communicationsprovides instant access to police, fire and emer-gency medical assistance from any wired or cellu-lar telephone in the state.

The New Hampshire E-911 system provides anationally accredited, state-of-the-art service toresidents and visitors to the state. It continues tohave one of the lowest telephone surcharges in thecountry; currently at 57 cents per month per tele-phone line.

During FY 2012, the Division worked on anumber of projects to improve service. These in-cluded:• Emergency Medical software upgrades for E-

911Emergency Medical Dispatchers and Stateof New Hampshire remote dispatch agencies.

• Data Operations statewide multi-tenant struc-ture data collection.

• NH VIEWW inter-agency shared GIS system.• Multi-Agency design and implementation of

state-of-the-art VoIP telephone system.

Administrative Support Section

Administration UnitThe unit provides necessary administrative sup-

port that is necessary to assist all areas within theDivision. The staff answers administrative tele-phone lines and directs telephone calls to the ap-propriate destination. Because the facility is se-cured, administrative staff are responsible forphysically directing the public within the building.

The unit is responsible for the following func-tions:

Ordering – Ordering supplies such as

consumables, computers, software, furniture andother items the Division may need to conduct busi-ness. The ordering process includes acquiringquotes and finding vendors.

Payments – Payments are processed once aninvoice has been received from a vendor. Staffverify the invoices to be sure all items have beenreceived and then processes the invoice for pay-ment. Invoices are processed through the LawsonSystem. The Department of Safety business officeand the Bureau of Accounts verify the Lawson en-tries and then a check is issued to the vendor.

Inventory – The staff tags items that requireinventory stickers and keep track of the locationof these items. They remove items from the track-ing database when rquipment is surplused. A re-port is sent quarterly to the Department of Infor-mation Technology on all data processing equip-

ment.Surcharge – When a telephone company sub-

mits a surcharge check, staff verifies that the re-ported number of telephone lines matches the dol-lar amount of the submitted check. Occasionally,staff are required to contact telephone companiesto discuss discrepancies. Also, staff will field callsfrom telephone companies regarding surchargerates, forms, and other miscellaneous questions.

Expenditures - Track expenditures for the Di-vision including Emergency Communications,Statewide Telecommunications and Communica-tions Maintenance.

Payments – Enter payments into the Lawsonsystem.

Electronic Timesheets – Staff are participat-ing in training for the electronic timesheet process.

Budget – Prepare dedicated funds reports,Form 1 definition and Form 2 Analytical Statement.Track the Division’s expenditure history andproject necessary funding for the upcoming bien-nial budget.

Public Information UnitThe Public Information/Education section con-

tinues to coordinate the integration of EmergencyInterpreter Referral Service (EIRS).

In FY 2012, E-911 received 28 requests for in-terpreters. In order to provide the best possible ser-vice for the deaf and hard of hearing, we continueto keep an open dialogue and communicate withour stakeholders in the hearing impaired commu-nity.

In June 2012, a survey was sent to all inter-preters listed with the N.H. Registry of Interpret-ers for the Deaf (NHRID). The intent of the surveywas to improve participation in the EIRS program.The results were compiled and distributed to E-911 supervisors. Communication and responsetime have improved as a result.

Enhancements are continually being made tothe Division’s web site reflecting changes that haveoccurred in FY 2011. The web site provides an

overview of New Hampshire’s E-911 system,which includes up-to-date Enhanced 911 Commis-sion meeting minutes, personnel listings, town andcity mapping progress status, public informationbulletins and public education events.

Public education in its strictest sense encom-passes all levels of schooling from kindergartenstudents to college students who have an interestin public safety as a profession. School presenta-tions continued throughout FY 2012.

In an effort to keep the E-911 message toschools up to date with telephony technology, anew educational program was purchased to replacethe outdated ‘Red E. Fox’ program. ‘911: GettingHelp is Easy” teaches a young child about calling911 for emergencies and addresses different typesof telephone technology. A statewide distributionof the new program is slated for FY 2013.

In the past fiscal year, Division staff has pro-vided 911 presentations and tours of the 911 callcenters to a variety of civic and professional orga-nizations. In addition, newly elected state legisla-tors, facilities engineers, senior citizens and for-eign speaking groups have been instructed in pub-lic education classes.

Wireless/Cellular education continues to be in-corporated within both the public information andpublic education curriculum. In an effort to bringthe public up to speed in the world of technology,we work closely with in-house technical expertsto add a much needed component to our curricu-lum regarding up and coming technology, its rel-evance to the consumer, and its rapidly growinginfluence on society.

Operations Section

Operations UnitThe Division’s Operations Section employs 62

Emergency Medical Dispatchers, Assistant Super-visors and Supervisor. The Assistant Supervisorand Supervisor positions are evenly split betweenthe two Public Safety Answering Points (PSAPs),Concord and Laconia.

During FY 2012, the Division handled 413,581emergency calls. The percentage of cellular andVoIP calls versus traditional landline calls is on a

steady increase and the Division’s policies regard-ing handling of these calls have evolved to reflectthat. The daily call count frequently hits 1,200 –1,500 calls per 24-hour period.

The Duty Supervisors assisted in 860 policerequests to contact judges for emergency orders.The total for judge requests remains steady andwithin reasonable expectations compared to lastyear.

There were 47 hospital diversions also com-pleted, an increase of 14 compared to last fiscalyear. The breakdown is as follows:

A diversion means we notify area responding agen-cies that a hopital’s emergency room has reachedcapacity and is temporarily diverting calls to otherhospitals.

More calls are being received for out-of-stateemergencies which totaled research for out-of-stateemergency dispatch centers on 286 calls. Record-ing requests are on the rise and now require addi-tional supervisors assigned to meet the growingdemands; this fiscal year saw approximately 500requests for recordings.

Various weather-related situations have beentracked for call volume and weather related callssuch as Hurricane Irene and the October snowstorm, as well as tracking elderly fall calls for theFalls Task Force of the Division of Public HealthServices. Heat-related emergencies were alsotracked during August of 2011 due to the extremeweather this past summer.

The Division obtained national reaccreditationas a Center of Excellence in Emergency MedicalDispatch in March 2011. The accreditation is validfrom 2011 through 2014. The updated version ofMedical Priority Dispatch System (MPDS), ver-sion 12.2 is slated to be installed this year.

Training UnitThe Division instructed and coordinated two

new hire training classes during this fiscal year.Each class consisted of four to eight new employ-ees and each session was 15 weeks in length. TheTraining Unit also coordinated and instructed aCommunications Training Officer class through theAssociation of Public Safety Communications Of-ficials (APCO); the class was 40 hours and wastaught by four Division staff and employees of lo-cal and regional dispatch agencies.

The unit offered 24 opportunities for continu-ing education hours, averaging three to four classesper month, as well as 15 opportunities for refreshertraining, totaling 117 hours.

The unit is responsible for coordinating andtraining all Public Safety Answering Point person-nel in the following: Updated versions of the Medi-cal Priority Dispatch System (MPDS), ALI Trakker(mapping program), Computer Aided Dispatch(CAD) and all APCO certified programs (Telecom-munications Specialist I and CommunicationsTraining Officer).

The unit participated in the N.H. EmergencyDispatch Association conference in April of 2012,holding three classes with 20-40 dispatchers in at-tendance for each. The Training Unit has activemembers in NHEDA and sends a Bureau repre-sentative every month to NHEDA meetings in aneffort to keep communication lines open with lo-cal and county agencies.

The unit went out to three dispatch agenciesand held training classes on Computer Aided Dis-patch (CAD), ALI Trakker and an overview of NewHampshire E-911.

The Training Unit also offers training oppor-tunities in CPR, First Aid, use of Automated Ex-ternal Defibulators and two different 40-hourAPCO courses for New Hampshire’s local, regionaland county dispatch agencies.

Data Operations Support SectionThe Data Operations Support Section is com-

posed of three different units dedicated primarilyto the maintenance of the E-911 Telephone ALI(Automatic Location Information) Database andthe E-911 Geographic Information System (GIS)Database.

These two databases are mission-critical to the

operation of E-911, especially the location of cel-lular calls, are essential for the migration to NextGeneration 911 and are the basis of the statewideEmergency Notification System. These units, Map-ping, Database, and Community Relations, haveseparate dedicated tasks but most workflows re-quire daily interactions between these units.

Since 1994, the Mapping Unit in the Data Op-erations Support Section utilized GPS (Global Po-sitioning System) Technology and GIS software toprovide addressing systems and emergency re-sponse maps for communities across New Hamp-shire. The use of this technology and equipmenthas enabled us to provide accurate location infor-mation for wireless Phase II locations.

The E-911 GIS database currently containsmore than 370,000 locations of addressable at-tributes such as houses, businesses, hospitals, po-lice stations, fire stations, campgrounds, etc. In thepast year, the Data Operations Support Section hasadded over 40,000 points to the database bringingthe total number of fully collected cities, towns andunincorporated areas up to 204.

The Data Operations Support Section contin-ues to encourage cities and towns to change dupli-cate and similar sounding street names as well asto change addresses that are confusing or incon-sistent.

The Database Unit maintains the AutomatedLocation Information database, working to increasethe accuracy of phone subscriber listings, their lo-cations and the associated table of Emergency Ser-vice Numbers (ESN) that directs emergency callsto the appropriate police, fire and EMS dispatchagencies.

The unit compares telephone subscriber recordsagainst a Master Street Address Guide (MSAG)that is constantly checked for internal consistencyand compares data to correct discrepancies.

Maintenance of the ALI Database requires pro-cessing and quality checking Service Order activ-ity from more than 20 different local telecommu-nications providers in New Hampshire. In the pastyear, the Database Unit processed more than 5,000service order files, for a total of more than 400,000individual transactions.

The Community Relations Unit is responsible

for maintaining relationships with local officialsat 234 municipalities and more than 90 local dis-patch centers. DESC representatives work on var-ied projects, including GIS data collections, ALIdiscrepancy resolutions, address conversions, anddata Quality Assurance/Quality Control proce-dures. All interactions from the DESC to local of-ficials are directed through these representatives.

Data Operations has instituted a new projectof collecting highly detailed information for allmulti-tenant structures in the state. Next Genera-tion 911 national standards dictate that there is oneGIS site feature for each address, including any“sub-address” which includes designations such asunit, apartment and suite.

This data will be used to validate addressrecords for any device with the capability to dial911, and also used to provide a more complete pic-ture of where an emergency is occurring and howto most efficiently respond to that emergency.

Technical Support SectionThe Division’s Technical Support Section con-

sists of an IT Manager and five Technical SupportSpecialists.

FY 2012 continues the challenging pace of FY2011 in maintaining and keeping up with the everexpanding role of the Technical Support Section(TSS).

The primary function of the TSSection is tomaintain and support the Enhanced 911 call centerand the 71 remote ANI/ALI workstations deployedover the frame relay wide area networks whichconnect to all dispatch agencies in the state.

The TSS is also responsible for support of theadministrative local area networks, coordinationwith all vendors, support of building access sys-tems, and coordination with municipalities regard-ing pertinent Enhanced 911 system informationsuch as Emergency Service Numbers (ESN)

In addition to the daily support requests fromboth inside and outside of the agency, four majorprojects were assigned to the Technical SupportDepartment, as follows:

and expanding reliance on accurate geographic datapoints illustrated the need for an inter-agencyshared GIS system. The Technical Support Sec-tion (TSS) delivered a high-availability serverframework to the Special Projects Section that wasfront-ended with the ESRI ArcGIS software suite.

This system was used by the Office of Eco-nomic Stimulus to accurately reflect and track theexpenditures of Federal Recovery/Stimulus Actfunds.

Numerous agencies are eager to leverage thepower of this exciting new initiative. Once rolledout, this project, the New Hampshire Visual Infor-mation and Emergency Watch Web, will provide asignificant step forward in Geographic Informa-tion Systems availability to government at all lev-els and our citizens.

Emergency Medical Software UpgradeThe medical software used by the Emergency

Medical Dispatchers (EMD) and remote dispatchagencies has been upgraded to the next major re-lease. This required not only updated software oneach position (PSAP and remote agencies), but anew server solution for enhanced storage and re-trieval.

System VirtualizationAfter FY 2009’s successful virtualization pi-

lot, significant effort was placed on moving allcurrent systems to virtual platforms where techni-cally possible.

The Division continues to see increased ben-efits from this conversion including but not lim-ited to additional survivability, performance in-creases, consolidated management, reduced powerconsumption, and an extended equipment usecycle.

VoIP System DeploymentThe state-of-the-art Cisco Voice over Internet

Protocol phone system which was deployed in theIncident Planning and Operations Center has be-come the new model for the state as it upgrades itstelephone system from its legacy copper wireCentrex system.

The Technical Support Section has been tasked

with the design and implementation of this migra-tion based upon our working knowledge and ex-perience administering the Cisco IP phone infra-structure, which includes high-availability serversfor calls, voicemail, and call center applications.The Department has brought nine agencies online,bringing with it a total of 1,000 users that we nowsupport.

Special Projects & NH VIEWW SectionThe Special Projects & NH VIEWW Section

collects geographic data throughout the state to sup-port the delivery of emergency services at the re-gional and local levels. The unit maintains andupdates electronic mapping data layers that are in-tegrated in the location identification software uti-lized in the two PSAPs in Concord and Laconia.

The data are used by the Emergency MedicalDispatchers to accurately location wireless E-911calls for processing to the local public safety dis-patch centers. The unit maintains an inventory ofcomprehensive maps for the PSAPs. These includehighway reference maps, high incident areas suchas Lake Winnipesaukee and popular recreation ar-eas in the White Mountain National Forest, andsnowmobile maps.

The unit maintains location verification foreach registered cellular telephone tower in NewHampshire.Verification and maintenance of thisinformation is critical to the accurate location iden-tification of a Phase I cellular E-911 call. This isan ongoing task as new cellular towers are installedthroughout the state.

Revisions to previously created comprehensivemaps for large dispatch and regional response ar-eas continue to be developed and expanded.

These regional maps include information suchas hiking trails, recreation areas, and emergencyhelicopter landing areas, in addition to the stan-dard road networks and transportation features.

These comprehensive maps assist EmergencyMedical Dispatchers in locating callers using E-911, as well as the local dispatch and responseagencies in directing appropriate resources to thescenes of incidents. They have also proven to be avaluable resource for emergency planning andpreparation activities. 59

Each year the unit revises special event mapproducts and data sets for events such as NASCARraces, Motorcycle Week and other events that drawlarge crowds.

The unit works with the N.H. Bureau of Trailsto map snowmobile trails, including all groomedsnowmobile trails in Coös, Grafton and Carrollcounties, totaling more than 2,200 miles.

Trail junctions and other important locationssuch as 24-hour accessible wired phones, emer-gency helicopter landing zones, and landmarks con-tinue to be addressed according to E-911 address-ing standards and are added to the geographic da-tabase.

The use of all-terrain vehicles (ATVs) onsnowmobile trails is increasing. The unit is work-ing with stakeholders to utilize existing snowmo-bile mapping standards and trail names to ensurethat a trail used in the winter for snowmobilinghas the same name as an ATV trail in the summerto reduce confusion among first responders.

The unit is planning to continue this work withthe N.H. Bureau of Trails and local agencies inGrafton, Carroll and Belknap counties during thecoming fiscal year.

The Special Projects Unit utilizes current emer-gency response data and location information toassist the Division of Homeland Security and Emer-gency Management in revising its radiologicalemergency response plan maps.

The plan maps provide emergency responderswith detailed maps of important town features suchas municipal buildings, traffic control points andevacuation routes in areas surrounding theSeabrook Station and Vermont Yankee nuclearpower plants.

The unit also assisted HSEM with digital andpaper displays of response-relevant data duringState Emergency Operation Center activations andprovided a geographical situational awarenessfunction during those activations in addition to asustained mapping effort.

The unit continues to develop New HampshireVisual Information and Emergency Watch Web, aweb based interactive mapping interface.

NH VIEWW leverages substantial geographicdata collected and maintained by the Division to60

answer the question “Where?” It contains the foun-dations for reporting and notification to identifiedpublic safety groups for increased situationalawareness.

The system incorporates tools for public safetyofficials to use for planning and response purposes.

NH VIEWW has also provided a platform fortwo large state agencies, Department of Safety andthe Department of Transportation, to collaborateand create a road closure database and graphicaluser interface to enable the accurate collection andefficient entry of road closure information; a criti-cal need during statewide emergencies.

Initial training on the application has been con-ducted, and the unit is working with NHDOT onan implementation schedule. The Department ofHealth and Human Services has joined theNHVIEWW platform, and is using services fromthis system to provide geographic support for theirpublic health analytical and reporting systems.

NH VIEWW is designed to be a user custom-ized common operational picture (COP) and hasbroken new ground in the development of a truecommon operating picture demonstrated by the in-teraction between state civilian response organi-zations, primarily the N.H. Department of Safetyand the N.H. National Guard.

The New Hampshire VIEWW platform is be-lieved to be the future of state agency informationlocation validation, geographic analysis and report-ing; leading the way to a transformation in stategovernment efficiency.

In 2011, the New Hampshire Department ofSafety, Division of Emergency Services was a ple-nary session presenter at the ESRI Federal Userconference to share our vision and design of theNHVIEWW platform.

DIVISION OF FIRE STANDARDS AND TRAINING& EMERGENCY MEDICAL SERVICES

The Division of Fire Standards &Training and Emergency MedicalServices primary mission is to increasethe capability of the entire New Hamp-shire Fire and Emergency MedicalServices through training, education,and best practices.

We believe in the achievement ofexcellence in our services throughdedication, teamwork, and opencommunication.

We are committed to exceeding expec-tations through the efficient research,development, and delivery of allaspects of fire and emergency medicalservice training, education, and admin-istration.

Mission Statement:The Division of Fire Standards & Trainingand Emergency Medical Services is dedi-cated to ensuring cutting-edge training to

more than 8,000 municipal, volunteer, and on-callfire and EMS responders statewide.

The Division is continuously improving itscomprehensive statewide EMS system to ensurethe highest level of out-of-hospital emergencymedical care possible to all within the State of NewHampshire, which translates to lives saved.

Fiscal Year 2012 was a tremendous year forthe Division of Fire Standards & Training andEmergency Medical Services, filled with manychallenges and accomplishments that kept thehardworking staff extremely busy, which is clearlydepicted throughout this report.

The Division operates the Richard M. FlynnFire Academy and training programs that offer in-struction in a multitude of fire, rescue and emer-gency medical service disciplines. Overall activ-ity at the Academy is up 27 percent to an all-timehigh of 29,874 attendees.

Although the budget for Fiscal Year 2012 was$6,155,841, the Division is not funded through theGeneral Fund or other state tax revenues. The Di-vision is funded through a fee charged to insur-ance companies for motor vehicle records thatmakes up a dedicated Fire and EMS Fund.

Not only does this dedicated fund support thisDivision, but it also funds the Division of FireSafety (Fire Marshal’s Office) and 11 percent ofthe budget of the Division of Homeland Securityand Emergency Management.

Fire training programs conducted by the Divi-sion carry a fee to the user. The certification pro-grams are subsidized, with the Division charging“actual expenses incurred,” less 65 percent for stu-dents affiliated with New Hampshire fire depart-ments.

The revenue generated by this fee structure forFiscal Year 2012 was up 28 percent, to $771,042,which includes tuition, fees for services, licensing

of for-profit emergency medical service providers,and sales of training manuals.

The Division is divided into three major func-tional groups. Although these three bureaus arelinked together by their outstanding service to thecitizens of this state, each has a separate and dis-tinct role in keeping New Hampshire citizens andemergency providers safe.

Bureau of Training and CertificationThis bureau oversees all New Hampshire fire

and rescue certification and training programs, bothon site and in the field. Participation in trainingprograms is at an all time high:· Students Enrolled – 17,194 (up 9 percent)· Courses Offered – 543 (up 14 percent)· Certifications Achieved- 7,388

Bureau of Emergency Medical ServicesThis bureau is responsible for managing the

training, testing, and licensing of EMS providers,units, instructors, training agencies, EMS dispatch-ers, and EMS vehicles, including wheel chair vans.Bureau activity continues to be on the increase.• Licensing of 4,804 EMS Providers

Bureau of Facilities & SupportThis bureau oversees all of the logistical ser-

vices required to fulfill our mission including cleri-cal, equipment purchasing and maintenance, recep-tion, facility maintenance & reservations, payrolloversight and transcript maintenance.

The Bureau also covers heavy vehicle mainte-nance for the entire Department of Safety. In addi-tion, the Division recently created a Fire AcademyBookstore to promote our services; the idea for thestore came from customer feedback from state fireand EMS providers.

Trauma and EMS Information SystemAs with any medical profession, recordkeeping

is a vital part of quality patient care. New Hamp-shire Emergency Medical Services has a statewideelectronic patient care record system calledTEMSIS (Trauma and EMS Information System).This system is a secure, web based, mandatory elec-tronic reporting system provided free of charge toevery licensed EMS service in New Hampshire.

The information entered in the system is avail-able to the EMS services, hospitals, and state andnational EMS stakeholders with appropriate legalprotection for personal health information.

In 2011, there were 295 New Hampshire EMSservices with more than 4,500 EMS providers whoentered approximately 195,000 EMS incident

records for the year. As of June 30, 2012, therewas a total of 921,939 records in the system.

N.H. Trauma SystemThe Bureau of EMS manages the N.H. Trauma

System. Hospitals, ambulance services, and firstresponder groups throughout the state work along-side the system’s leadership - the Trauma MedicalReview Committee and the N.H. Bureau of Emer-gency Medical Services (NHBEMS) - to meet andexceed standards set forth for trauma care. Hospi-tals were asked to participate in a voluntary as-sessment of their administrative and clinical capa-bilities in trauma care by the system leadership.

New Hampshire currently awards four levelsof hospital assignment within the trauma system(Level I, Level II, Level III and Level IV) to thoseactively participating in the system. Members ofthe Trauma Medical Review Committee and theNHBEMS work together, along with participatinghospitals, to continuously improve the delivery ofcare to seriously injured persons in New Hamp-shire.

This program continues to be successful asthere are 13 hospitals with current Trauma Leveldesignations, which includes 1 Level I designa-tions, 1- Level II designation, 9- Level III designa-tions, and 1- Level IV designation. The committeecontinues to work with many other hospitals thatare in various stages of the process.

N.H. Patient Care ProtocolsAll New Hampshire EMS providers work un-

der a statewide protocol system which providesthem medical direction and is overseen by the Bu-reau of EMS.

These protocols are a “living document” de-veloped and drafted by the Protocol Committee ofthe New Hampshire Emergency Medical ServicesMedical Control Board.

Keeping these protocols up-to-date and rel-evant takes continuous time and effort. At the op-tion of the Bureau of EMS and the Medical Con-trol Board, the protocols can be edited and updatedat any time. However, they are formally reviewed,edited, and released every two years. The next edi-tion is scheduled to be released in 2013.

Automated External Defibrillation Project(AED)

One of the Bureau of Emergency Medical Ser-vices most successful projects is the AED project.AED devices are known to significantly improvethe chance of survival in a patient experiencingcardiac arrest. Therefore, one of the manyNHBEMS goals is to increase accessibility toAEDs in all sections of the state.

In July 2002, the New Hampshire Legislaturepassed Automated External Defibrillator laws re-garding the intent, definitions, training, limited li-ability and an AED Registry to encourage the avail-ability and use of AED devices throughout the state.

The N.H. AED Registry is a database of AED’slocated in fixed locations throughout the state, andis a collaborative effort between an AED purchaserand NHBEMS created to record AEDs located inNew Hampshire.

The “AED Registry” assists NHBEMS in con-tacting AED owners in the event of device recallsor providing updated AED-related information.NHBEMS provides the N.H. Bureau of EmergencyCommunications (N.H. E-911) with the AED lo-cation information for inclusion in their call screendatabase.

When a 911 telecommunicator receives anemergency call from the assigned phone number,this screen will prompt them to tell the caller aboutthe location of the AED if the emergency is a po-tential cardiac arrest. There are currently more than2,700 AEDs registered and located throughout thestate.

The New Hampshire Bureau of Purchase andProperty, Department of Administrative Serviceshas established a statewide contract to provide re-duced pricing on AED equipment. This “AED di-rect purchase opportunity” is available to any NewHampshire organization.

The Bureau also teamed up with the NewHampshire Affiliate of the American Heart Asso-ciation to develop a “HeartSafe Communities” des-ignation program for local communities. The in-tent is to promote and recognize the availability ofaccessible AED’s statewide. To date there are 19“HeartSafe Communities” in the state.

Training Grant Needs Assessment and GrantFunding

Over the past 12 months, the Division did ex-tensive fact finding pursuant to a training needsand emergency preparedness assessment. Staff at-tended no fewer than 40 mutual aid and other as-sociation meetings to solicit feedback from theState’s first responder community.

In addition to these efforts, the Academy hasteamed up with the N.H. Association of Fire Chiefs,the Professional Firefighters of New Hampshire,the State Fireman’s Association and the N.H.Hazmat Collaborative to conduct further fact find-ing.

The team reviewed in-depth studies such as thegrant funded Tetra Tech Hazmat Study and NewHampshire’s Infrastructure Report Card (2011) aspart of their decision process.

After this fact-finding mission, it was extremelyclear that the State needs to improve its prepared-ness in the area of technical rescue and hazardousmaterials.

The team of stakeholders met and developed adetailed plan to address these training needs. In aneffort to address these needs, the Division secured$4.4 million dollars through the Homeland Secu-rity Grant Program specifically for “boots on theground” training.

This “one time” money will give the NewHampshire first responder community an outstand-ing opportunity to raise the training and prepared-ness levels of full-time, call and volunteer first re-sponders while keeping the training cost neutral toparticipating communities.

Training programs offered under the HomelandSecurity Grant Program will include a host of tech-nical rescue courses, including rescue skills, Res-cue Systems I & II, technical trench rescue, tech-nical rope rescue operations, technical confinedspace rescue, and swift water rescue. Train-the-trainer courses for the new IAFF Fire Ground Sur-vival will also be conducted.

In addition to the technical rescue courses, wewill fill some training gaps in the area of hazard-ous materials. A primary focus will be to providecurrent Hazmat team members a much needed 40-hour refresher course. Additional Hazmat programs

will include Hazmat operations, decontamination,as and some initial technician programs.

This grant program has an extremely shorttimeframe to provide all this training. The grantaward began May 1, 2012 and concludes on Nov.1,2012. Scheduling these classes, enrolling students,training instructors, and actually conducting theseclasses has put a tremendous burden on theDivision’s entire staff.

The Department of Safety appreciates the sup-port and assistance of the N.H. Association of FireChiefs, the Professional Firefighters of NewHampshre, the State Fireman’s Association, andthe N.H. Hazmat Collaborative in this process.

Fire Fighter Entry Level Testing ProceduresThe Division conducts the statewide entrance

testing which is used by fire departments through-out the state.

The candidate testing includes a general knowl-edge written test to measure a candidate’s abilityto read, comprehend, and solve simple math andtechnical problems which would indicate that theyare able to learn the basic skills of fire training andeducation. Following the written exam, each can-didate must pass the nationally recognized Candi-date Physical Ability Test.

Although the physical agility test does not re-quire any prior firefighting education or back-ground, it does require the candidate to run an agil-ity course of eight specific tasks that are highlyrelevant skill sets for firefighting.

Enrollment in this testing process continues tobe extremely high and 495 candidates signed upfor this year’s exam.

Once candidates have passed both written andphysical agility testing, they are placed on a state-wide list depicting their contact informationand certification level for both in fire and EMS.This list is then distributed to all participating firedepartments. This program is funded by $100 test-ing fees assessed to each candidate.

Course/Program Evaluations and AuditsIn an effort to ensure all programs conducted

or overseen by the Division are of the highest qual-ity possible and meet the recommended standards,

a Peer Review and Auditing Program has beenexpanded.

Numerous audits have been conducted state-wide for both Fire and EMS classes. Although theseare time consuming, they are vital in ensuring thestudents receive the highest level of education pos-sible, which will transfer down to an increased levelof care and greater public safety.

North Country Burn FacilityThis year started with an intense fact finding

mission, meeting with numerous fire service groupsto see where the Division could improve. Duringthese meetings in the North Country, it was evi-dent there were significant challenges in that partof the state.

In the current economy, sending personnel andapparatus to Concord for training costs money thatmany smaller departments do not have. The hard-est hit are those in the three northern counties:Coös, northern Carroll, and Grafton. Most of theirfirefighters and EMTs are volunteers who mustbalance their training needs with the demands ofday jobs.

The Division examined the cost of erecting andequipping a small training center with a classroomand burn building to serve the northern three coun-ties, consisting of 39 fire departments covering 60communities.

The Division, in cooperation with a group ofNorth Country fire chiefs, reviewed several poten-tial sites for such a project. They discovered anabandoned piece of land in Bethlehem owned bythe U.S. Forest Service which is centrally located.It is within 60 miles of any fire department in thecoverage area escept for Pittsburg and Shelburne,which are 67 miles from the proposed location. TheNew Hampshire legislative leadership granted acapital project to fund the construction of this fa-cility.

The project continues to move forward andshould be completed in 2013.

It is the mission of the Division of FireSafety, Office of the State Fire Marshal, toprevent deaths, injury and property lossby promoting a safe fire, building andhazardous materials environment for thecitizens and visitors of New Hampshirethrough education, engineering, investiga-tion and enforcement.

The Division of Fire Safety, Office of theState Fire Marshal, is responsible for theprotection of the public and the state’s fire

service with coordinated efforts in code enforce-ment, public education, hazardous materials support,and fire incident investigation, thereby reducing the lossof life and property due to fire, building collapse, ex-plosives incidents and other emergencies Hampshire.

The Division is divided into three bureaus: Investi-gations, Building Safety and Construction, and Ad-ministration, Special Operations and Communication.

Bureau of Investigations

Fire InvestigatorsThe Bureau of Investigations consists of two

district chiefs who oversee seven fire investiga-tors who are assigned geographically throughoutthe state. The fire investigators are law enforce-ment officers who specialize in fire origin and causeinvestigation, criminal investigations involvingarson, and other crimes. They also lead investiga-tions into fatal fire deaths, building collapses, ex-plosions and carbon monoxide related incidents.

Investigators frequently attend training throughvarious educational opportunities provided in co-operation with the National Fire Academy, the St.Anselm College Arson Seminar, Post-Blast Investiga-tion conducted by the U.S. Bureau of Alcohol, To-

bacco, Firearms and Explosives and other entities.These training opportunities allow the investigators tokeep up with current trends involved with fire originand cause investigations as well as criminal investiga-tions.

The U.S. Bureau of Alcohol, Tobacco, Firearmsand Explosives currently details a special agent tothe State Fire Marshal’s Office. This agent assists theinvestigators with cases that involve violations of fed-eral law as well as cases that involve the use of fire-arms and explosive devices.

The Bureau of Investigations responded to andinvestigated a total of 174 fires and related inci-

dents during FY 2012. These incidents occurred at allhours of the day and days of the week. Investigatorswere frequently called out from home to begin an in-vestigation. There were 18 arrests made in connec-tion with incendiary fire investigations and violationsof the fire and life safety code during that time period.

The investigators and the six part-time inspectorsassigned to the Bureau of Investigations conduct fireand life safety inspections on all state buildings andassist local fire departments with any fire and life safetycode inspections or code interpretations. Collectively,the investigators and inspectors conducted 153 totalfire and life safety inspections.

Ignitable Liquid Detection CaninesThe New Hampshire State Fire Marshal’s Office

has two canines. Canine Molly, a yellow Labradorretriever, is located in Coös County and Andre, a blackLabrador retriever, is located in Belknap County.

Both canines and their handlers are certified as ateam through the Maine State Police Accelerant De-tection Canine program and are re-certified annually.The dogs train 365 days a year. In FY 2012 they as-sisted the investigators on 43 cases and have been toapproximately 200 fire scenes for other agencies toassist in investigations or for training.

Bureau of Special Operations andCommunications

Fire Investigators assigned to the Bureau ofSpecial Operations are responsible for conductinginspections, investigations and other enforcementactivities relative to the use, handling, storage,transportation, and sale of fireworks throughout theState of New Hampshire.

The Bureau of Special Operations FireworksProgram licenses and issues permits to anyone uti-lizing pyrotechnic, flame, or special effects beforea proximate audience, and approves permits forthose events. Fire Investigators from the bureauwork in cooperation with the N.H. State PolicePermits and Licensing Unit for the inspection andenforcement of the Department’s Display Fire-works Rules (Saf-C 5000), and the licensing of per-missible firework retail sales facilities throughoutthe state.

sonnel. One of the key programs is the DisplayFireworks Emergency Response Training(DFERT). In the short time this program has beenoffered it has been attended by more than 150 pub-lic safety officials throughout the state and has at-tracted students from surrounding states, includ-ing New York.

During the winter of 2011-12, Fire Investiga-tors also had the opportunity to work closely withthe Maine State Fire Marshal’s Office while theydeveloped their new rules for the retail sales ofconsumer fireworks.

Hazardous Materials SectionThe division has one full-time Hazardous Materi-

als Coordinator. The Hazardous Materials Sectionprovides technical assistance and guidance to the Re-

gional Hazardous Materials Teams and communitiesthroughout the state.

It also assists communities with the developmentof hazardous materials emergency action plans, trans-portation, manufacturing, usage, storage and disposalquestions regarding hazardous materials, as well asgeneral hazardous materials questions regarding firstresponders and communities.

Hazardous materials reporting through the U.S.Environmental Protection Agency TIER 2 systemis collected and compiled to assist communitieswith hazardous materials response planning.

This system assists state and local fire inspec-tors as they inspect buildings for fire and life safetycode violations with regard to any hazardous ma-terials issues. The section also provides technicalassistance to fire investigators in cases where haz-ardous materials are involved. It assists federalagencies with technical expertise on known or po-tential hazardous materials involved in Chemical,Biological, Radiological, Nuclear, Explosive (CBRNE)incident, or clandestine laboratory activities, includingthe dismanteling of clandestine meth labs.

The Hazardous Materials Section presents nu-merous outreach programs to police, fire, and emer-gency medical services, as well as private busi-ness and industry throughout the state with regardsto hazardous materials awareness and operationalsafety at incidents.

Public EducationThe division has one part-time Public Educa-

tion Administrator and one part-time Public Edu-cation Specialist. They provide fire safety educa-tion and outreach programs throughout the state.During FY 2012, the public education personnelprovided outreach resources through public serviceannouncements, represented the division on safetycommittees, Risk Watch educators, Safety Sec-onds-via social media and literature. Public edu-cation resources are also available to fire depart-ments throughout the state. These resources includethe lending library, Sparky the Fire Dog suit, Sparkyrobot fire truck, Sparky safe house, and two fire safetyeducation trailers. The Public Education section re-cently hosted the Campus Fire and Exit Strategy Con-ference that was held at the N.H. Fire Academy.

They have also participated in numerous pub-lic safety events throughout the state, including;Discover Wild NH – camping safety day, Safe Kids,Cold Springs Resort Camper Safety Fair, PeaseFamily Day, N.H. Emergency Preparedness Con-ference, Nashua Family Emergency PreparednessConference, Concord National Night Out, WinterCarnival, and numerous other safety fairs.

Building Safety and Construction

Engineering and Plans Review SectionThe Engineering and Plans Review section

employes three part-time reviewers. The section ischarged with ensuring that all state-owned projects,Department of Health and Human Services-li-censed facility projects and public school projectsare constructed in a manner that complies with theState Fire Code.

The section also enforces the state building codein state-owned buildings and properties.

When requests for variances or waivers to the firecode are submitted to the State Fire Marshal, this sec-tion provides the technical research required by theState Fire Marshal so that he can render an informeddecision. In the past year we have also assumed a rolein assisting businesses and state agencies in complyingwith applicable codes using some non-traditional meth-ods involving the newest and most up to date technol-ogy and practices.

The section meets regularly with the three stateuniversities and several other state agencies on theirnew projects to provide technical assistance throughthe entire design and construction process. The sec-tion also provided technical assistance to local fire of-

ficials and building departments as requested.Over the past year the section has been actively

involved in several high profile projects including: theBridges House renovation in Concord, the new PeterPaul Business School at UNH, Grafton County Houseof Correction, the TDS Center at Keene State Uni-versity and many others. This section also receivesand provides technical interpretation from code offi-cials and citizens of the state on an average of 6-10code related questions each day.

Mechanical Safety and LicensingThe Mechanical Safety and Licensing Section

is responsible for the administration of the FuelGas Fitting Licensing Program, the Oil HeatingTechnician Certification Program, and the Fire Pro-tection Technician Certification Program.

In addition to overseeing the development andadministration of the educational programs re-quired for licensure or certification, the Mechani-cal Safety and Licensing Section employs two full-time field inspectors and a full-time supervisor whoare dedicated to compliance through education. Thisprocess places a priority on public safety throughoutthe trades.

Plumbing Safety and LicensingThe Plumbing Safety and Licensing Section is

responsible for the administration of the Plumb-ing Licensing and Inspection Program and theWater Treatment Technician Certification Program.FY 2012 was the first full year the Plumbing Sec-tion has been with the Division of Fire Safety.

The alignment with compliance to budgetary com-mitments and legislative mandates resulted in a staffingrestructuring within the section. Currently the Plumb-ing Safety and Licensing Section employs three fieldinspectors and a clerical staff member. The field in-spectors are supervised by the Mechanical Safety andLicensing Section Chief.

Modular HousingThe Modular Housing Section continues to re-

spond to consumer complaints as well as work withthe industry on rules development and implemen-tation.

In FY 2012, the section issued 351 ModularHouse Labels for units by 71 manufacturers.

This past year the section assisted consumerswith complaints as well as responded to supportlocal building officials.

Inspectors from this unit worked closely withthe Department of Safety’s attorney to correct nu-merous code and safety violations in a Lakes Re-gion community. The Modular Housing Sectionwas instrumental in coordinating and providingemergency inspection services to Conway in the wakeof Tropical Storm Irene.

The bureau supervisor worked with sectionchiefs from Engineering and Mechanical Safety tosupply four teams of inspectors to assess the dam-age and address the immediate needs of residentswho were flooded out of their homes. The swiftaction by staff resulted in accelerated aid to theresidents so that they could proceed with rebuild-ing their homes.

Electrical Safety and LicensingThe Electrical Safety and Licensing Inspectors are

responsible for the enforcement of electrician licens-ing and apprentice regulation, laws and rules. The in-spectors from this section visit construction sites on aregular basis to ensure that the work that is being per-formed is completed by the proper New Hampshire-licensed electricians. They are also available to pro-vide code interpretation advice and answer questionsregarding the electrical code.

The Chief Inspector and three Electrical Licens-ing Inspectors cover the state geographically, serv-ing three separate regions as a resource, offering tech-nical assistance to licensed electricians, local buildingofficials, and fire departments.

The inspectors are also utilized by the Bureauof Investigations as well as local fire and policedepartments in investigations where electricity wasinvolved and victims were injured or killed.

AdministrationThe Administrative Section of the Division of

Fire Safety is responsible for providing customerservice, issuing licenses, certifications and identi-fication cards for the division, collection of rev-enues, purchasing, statistical record keeping, andday-to-day operations for the Division.

Additional duties were added to the adminis-trative staff with the transfer ofthe Aerial Tram-way and Amusement Ride operations under the De-partment of Safety when the Legislature abolished theDivision of Safety Services.

Safety and Licensing, with an Administrative Assis-tant, Licensing Clerk and Clerk, Mechanical Safetyand Licensing with an Administrative Supervisor, andPlumbing Licensing and Safety with a Clerk.

The Licensing Section is also responsible for theaccountability of revenue for Aerial Lift and CarnivalRide Safety, Fire Protection Equipment Firms andTechnicians, Lightning Rod Dealers and Installers, theModular Building Program, Pyrotechnics Permits, Li-censed shooters and Oil Heating Technicians.

This section moved from 110 Smokey Bear Blvd.to 33 Hazen Drive in the fall of 2011 for easy accessi-bility and convenience for the licensees.

The N.H.Fire Incident Reporting System(NHFIRS) featured a new section on the Division’swebsite by graphically displaying each firedepartment’s reporting status. The reporting sys-tem is also used to track trends throughout the state.Informational bulletins are being posted monthlyon the Division’s website to assist fire departmentswith questions regarding the NHFIRS and to pro-vide training information.

The administrative section is also responsiblefor assisting the fire departments reporting data onfire calls. The NHFIRS is managed by the DataControl Clerk III, who is responsible for maintain-ing the intake and validation process for the datacollected.

In FY 2012, New Hampshire Fire Departmentsreported 113,458 total reported incidents of whichthere were 5,055 fires and an estimated total dol-lar loss of $21,694,768.00.Safety Services Section

Tramway and Amusement Ride SafetyTramway and Amusement Ride Safety was es-

tablished to oversee the safe and enjoyable use ofthe state's ski industry resources. It also ensurescompliance with safety regulations for the carni-val and amusement ride operators in New Hamp-shire.

One function of Tramway and AmusementRide Safety is to oversee the registration, inspec-tion, and compliance with the laws and safe oper-ating procedures for all mechanical ski lifts, tramways,portable and fixed tows in the State of New Hamp-

shire.Tramway and Amusement Ride Safety also over-

sees the registration, inspection, and compliance withthe laws and safe operating procedures for any me-chanical amusement rides operating in the State of NewHampshire.

In FY2012, inspectors conducted 592 amuse-ment ride registrations and 179 tramway registra-tions.
