For the purpose of replacing and upgrading NH Department of Safety, Marine Patrol facilities on Lake WInnlpesaukee in Gilford: 1) Temporarily impact 170 sq. ft. of lakebed to install a 226 linear ft. cofferdam; 2) Dredge 68 cu. yd. from and otherwise alter 4,212 sq. ft. of lakebed; 3) Alter 246 linear ft. of shoreline; and 4) Reconfigure a major docking system. The New Hampshire Department of Environmental Services (NHDES) finds that the applicant has demonstrated all of the following: 1. The permit for which the extension is being sought has not been revoked or suspended without reinstatement. 2. The extension will not violate a condition of law or rule. 3. The project Is proceeding toward completion In accordance with the plans and other documentation referenced in the permit dated March 24, 2015. 4. The applicant proposes reasonable mitigation measures to protect the public waters of the state from deterioration during the period of extension. The New Hampshire Department of Environmental Services (NHDES) imposed the following conditions as part of this approval: 1. REQUESTED ACTION

Approve the NH Department of Safety Marine Patrol's request for a five year permit time extension, in accordance with

RSA 482-A:3, XIV-a{a), to perform the following work on Lake WInnlpesaukee in Gilford. File #2015-00420. This project

was originally approved by the Governor and Executive Council on July 22, 2015, Item #92 to the NH Department of

Safety Marine Patrol, and will not have significant impact on or adversely affect the values of Lake WInnlpesaukee.

For the purpose of replacing and upgrading NH Department of Safety, Marine Patrol facilities on Lake WInnlpesaukee in

Gilford: 1) Temporarily impact 170 sq. ft. of lakebed to install a 226 linear ft. cofferdam; 2) Dredge 68 cu. yd. from andotherwise alter 4,212 sq. ft. of lakebed; 3) Alter 246 linear ft. of shoreline; and

4) Reconfigure a major docking system.

The New Hampshire Department of Environmental Services (NHDES) finds that the applicant has demonstrated all of the

following:

1. The permit for which the extension is being sought has not been revoked or suspended without reinstatement.

2. The extension will not violate a condition of law or rule.

3. The project Is proceeding toward completion In accordance with the plans and other documentation referenced in

the permit dated March 24, 2015.

4. The applicant proposes reasonable mitigation measures to protect the public waters of the state from deterioration

during the period of extension.

The New Hampshire Department of Environmental Services (NHDES) imposed the following conditions as part of this

approval:

1. All work shall be In accordance with revised plans submitted by Vanasse Hangen Brustlin, Inc. dated May 12, 2015,

and received by the NH Department of Environmental Services (DES) on May 13, 2015.

2. The DES Biology Bureau's Limnologist/Exotic Species Program Coordinator shall be notified in writing of the date onwhich dredging will begin 14 days prior to the beginning of the project.

3. If, at any time during the dredging, DES determines that rising water levels pose significant risk to the containmentof the site, DES may request that the work cease until water levels recede to an acceptable level. Work shall cease

6. All construction related debris shall be completely removed from surface waters and deposited outside of the DBSWetlands Bureau jurisdiction.

7. Equipment Initially entering surface waters shall be completely free of any Imported aquatic plants and animals.8. Equipment washlng/rlnsing shall not take place In areas In Wetlands Bureau jurlsdictlonal areas. 9. Appropriate

slltatlon, erosion, and turbidity controls shall be in place prior to construction, shall be maintained duringconstruction, and shall remain in place until the area Is stabilized.

9. The ramp approach shall be crowned so that drainage Is directed away from the slope of the ramp.10. The cofferdam shall be constructed prior to commencing work on structures located within surface waters.

11. The temporary cofferdam shall be entirely removed Immediately following construction.12. The work authorized Is also contingent on approval by the DES Alteration of Terrain Bureau.

13. This permit shall not be effective until It has been recorded with the Belknap County Registry of Deeds office by thePermittee. A copy of the recorded permit shall be submitted to the DES Wetlands Bureau by certified mail, returnreceipt requested, prior to construction.

14. Work shall be conducted In a manner so as to minimize turbidity and sedimentation to surface waters and wetlands.

15. Work shall be conducted In a manner that avoids discharges of sediments to fish spawning areas.16. Rip-rap shall be located landward of the shoreline at the normal high water, where practical, and shall not extend

more than 2 ft. lakeward of that line at any point.

17. Culvert outlets shall be properly rip rapped.

18. All activities shall be in accordance with the Shoreland Water Quality Protection Act, RSA 483-B. The owner Isresponsible for obtaining any Shoreland Permit that may be required per RSA 483-B, for construction, excavation orfill that will occur within the Protected Shoreland.

EXPLANATION

The NHDES approved this project on March 20, 2020. The NHDES supported Its decision with the following findings:

1. The owner, authorized agent or applicant certifies that this permit qualifies for a permit extension in accordancewith RSA482-A:3, XlV-a(a), and Env-Wt 502.01.

2. 2.This permit has been extended In accordance with RSA 482-A:3, XlV-a(a) and Env-Wt 502.01.

Application file documents are being forwarded to the Governor and the Executive Council In connection with their ^consideration of this matter pursuant to RSA 482-A:3,ll.(a) as It Is a major project In public waters of the state.

Project Description: the New Hampshire Department of Safety (NHDOS)Marine Patrol plans to demolish the existing Marine PatrolHeadquarters buildina located on Tax Map 242 Lot 184and construct a new facility on the same general footprint.Other general construction is planned to occur on Lots184, 186, and 199 including the demolition of the GlendaleMarine building, new parking areas, improved driveway toBelknap Point Road, general re-shaping and re-grading ofsurrounding landscape, and reconfiguration of utility lines.

The NH Natural Heritage database has been checked for records of rare species and exemplary naturalcommunities near the area rriapped below. The species considered include those listed as Threatened orEndangered by either the state of New Hampshire or the federal government. We currently have no recordedoccurrences for sensitive species near this project area. .

A negative result (no record in our database) does not mean that a sensitive species is not present. Our datacan only tell you of known occurrences, based on information gathered by qualified biologists and reported toour office. However, many areas have neyer been surveyed, or have only been surveyed for certain species.An on-site survey would provide better information on what species and communities are indeed present.

This report is valid through 12/7/2015.
