For Immediate Release Debra Smit, Breathe Project [email protected] 412-760-7677 Environmental Groups, Residents Seek PA DEP Denial of Shell Pipeline Company’s Falcon Pipeline Applications The Breathe Project held a rally today, Sept. 6, 2018 at 10 a.m., on the doorstep of the Pittsburgh offices of the Pennsylvania Department of Environmental Protection to ask the agency to deny Shell Pipeline Company’s application for the Falcon Ethane Pipeline. Shell’s permit proposes the construction of a 97-mile pipeline that would transport more than 107,000 barrels of ethane per day across 22 townships in Ohio, West Virginia and Pennsylvania to a Shell Appalachia ethane processing facility in Potter Township, Beaver County, Pennsylvania in order to produce polyethylene pellets for plastic products in mostly Asian markets. The rally followed a review of Shell Pipeline’s (Aug. 1, 2018) responses to the 101 deficiencies that the DEP found with Shell Pipeline’s original Falcon application, submitted in April 2018. DEP issued the deficiency notices to Shell Pipeline after environmental and resident groups submitted written comments and verbal testimony during three days of public hearings held in Allegheny, Beaver and Washington counties. The DEP deficiency letters (June 1, 2018) required many additional responses by Shell. The DEP deficiency letters confirmed that Shell Pipeline failed to execute sound technical judgment in the proposed routing of the Falcon pipeline, especially as it pertains to sedimentation and erosion control and ultimately to public safety and health. “Shell’s lack of attention to these important technical details to the DEP showed us, once again, that Shell has not done its due diligence,” said Bob Schmetzer of Citizens to Protect the Ambridge Reservoir. “Shell’s statements to the DEP are misleading. The Ambridge Water Authority and Ambridge Borough Council have publically stated their concern regarding the risk this pipeline poses to the region’s water supply, which provides drinking water to 40,000 people.” Based on Shell’s failure to adequately respond to these technical concerns and because of the concerns raised by both organizations and citizens, we urge the DEP to DENY the Falcon Pipeline sedimentation and erosion control permits. TheDEPdeficiencyletters(June1,2018)requiredmanyadditionalresponsesbyShell.TheDEPdeficiencylettersconfirmedthatShellPipelinefailedtoexecutesoundtechnicaljudgmentintheproposedroutingoftheFalconpipeline,especiallyasitpertainstosedimentationanderosioncontrolandultimatelytopublicsafetyandhealth.

“Shell’slackofattentiontotheseimportanttechnicaldetailstotheDEPshowedus,onceagain,thatShellhasnotdoneitsduediligence,”saidBobSchmetzerofCitizenstoProtecttheAmbridgeReservoir.“Shell’sstatementstotheDEParemisleading.TheAmbridgeWaterAuthorityandAmbridgeBoroughCouncilhavepublicallystatedtheirconcernregardingtheriskthispipelineposestotheregion’swatersupply,whichprovidesdrinkingwaterto40,000people.”

BasedonShell’sfailuretoadequatelyrespondtothesetechnicalconcernsandbecauseoftheconcernsraisedbybothorganizationsandcitizens,weurgetheDEPtoDENYtheFalconPipelinesedimentationanderosioncontrolpermits.

AmongthechiefconcernsexpressedduringtherallyonThursday:

• TheAmbridgeWaterAuthorityandAmbridgeBoroughCouncilhavepubliclyexpressedseriousconcernsabouttheriskpresentedbytheproposedethanepipelinethatwouldcrossthroughthehigh-quality

headwatersoftheAmbridgeReservoirandundertherawserviceline.ShellfailedtogivetheAmbridgeWaterAuthorityanyassurancesthattherewillbenorisktotheregion’swatersupplyandfalselyreportedAWA’spositiononthepipeline.

• TheDEPdeficiencylettersdirectedShellto“evaluateanddiscusstheproject’spotentialtoimpactany

publicwatersystemsandtheirsourcesthatarewithin1-mileofyourproposedpipelinesystem.”Thisincludesprivatewellsnearschools,churches,publicinstitutionsandprivatelandowners.Shellsuggestswatertruckswouldbesuppliedintheeventofdisruptionofwaterservices.LocatingtheFalconpipelinenearsourcesofdrinkingwatershouldnotbepermitted.

• Shell’sremediationofwetlandsinMercerandWashingtoncountiesisanunacceptableswapfor

destroyingpreciousconservancyareasinBeaverCounty,includingtheBeaverCountyConservationDistrict,abeautifulnaturepreservethatservesasaneducationalareaforschoolchildren.ShellhasproposedroutingtheFalconpipelinethroughthisconservationarea.

• TheDEPmustupholdthePennsylvaniaEnvironmentalRightsAmendment:Thepeoplehavearightto

cleanair,purewaterandtothepreservationofthenatural,scenic,historicandestheticvaluesoftheenvironment.Pennsylvania’spublicnaturalresourcesarethecommonpropertyofallthepeople,includinggenerationsyettocome.Astrusteeoftheseresources,theCommonwealthshallconserveandmaintainthemforthebenefitofallthepeople.–ArticleI,Section27ofthePa.stateconstitution–theEnvironmentalRightsAmendment.

“ThismarksacriticalmomentintimenotjustforSouthwesternPennsylvaniabutforpeoplebeyondourstate’sbordersinWestVirginiaandOhiowhowillbeforcedtolivewiththetoxichealthandsafetyrisksofanindustrythatwillpushourplanetovertheedgeoncarbondioxide,greenhousegasemissionsandrampantplasticcontamination,”saidMattMehalik,executivedirectoroftheBreatheProject.
