LEGISLATIVE GOALS• Increase the safe and efficient prearraignment and pretrial release of individuals

booked into jail by expanding own recognizance and monitored release.

• Implement monitoring practices of those released prearraignment and pretrial withthe least restrictive interventions and practices necessary to enhance public safety and return to court.

• Expand the use and validation of pretrial risk assessment tools that make their factors, weights, and studies publicly available.

• Assess any disparate impact or bias that may result from the implementation of these programs in order to better understand and reduce biases based on race, ethnicity, and gender in

pretrial release decision-making.

During the compilation of April – June 2016 quarterly data, questions arose as to the meaning, and validity of jail booking and release data as it applies to Pretrial Services. Specifically, jail booking and release data is frequently insufficient to categorize individuals booked as sentenced/unsentenced and/or eligible/non-eligible for pretrial release.

The problem stems from several sources, including an understanding of the specific uses of booking and release codes, the inconsistent use of such codes, incomplete information about the defendant at the time of booking, and an inability to capture intermediate data; e.g. defendant booked on local arrest, serves time on local case, then cited and released on an outside warrant. The booking/release may be coded as a local arrest with a cite and release outcome, lacking indication of intermediary local time served, or a hold by an outside agency.

To help with the review of data, new fields have been added to each dataset. For quarterly bookings, a release code, release date (if applicable), days in custody, and release comments have been added to the report. For release data, days in custody and release comments have been added. This information has vastly improved the ability to properly classify the data; however, additional efforts are required to ensure properly validated data.
