TheDefenceForceServiceCommissionhascontinuedtofulfilitsmandateinitspursuittoimprovetheconditionsofserviceforSANDFmembersduringtheFinancialYear2016/2017.
TheCommissionhostedagroundbreakingconferenceonCivil-MilitaryRelationsConferenceinOctober2016.Ibelievethattheconferencewillsoughttoinitiateadialogueandraiseconsciousnessofthereciprocalrelationshipthatneedtoexistbetweenthemilitaryandthebroadercivilsociety.Itisimportantthatthereisappreciationofthecivil-militaryrelationshipstoco-existinournewdemocraticdispensation.ThismustberecognisedbyboththemilitaryandthecivilianmembersoftheDepartmentofDefenceasawholesoastoensurethatourconstructisinlinewiththeConstitutionoftheRepublic.
I am encouraged by the support of the Commission to the DOD and SANDF in the quest to secure funding for theimplementationoftheDefenceReview2015.ThisisfurthertestimonialinitsresiliencetocontinuemakingrecommendationsaimedatimprovingthelivesofSANDFmembers,notwithstandingtheeconomicchallengesencountered.
IwouldfinallyexpressmythanksandappreciationtotheCommissionandtheSecretariatintheircontinuedcommitmenttoadvancethemandateamidsttheencounteredbudgetaryconstraintscompoundedbychallengedeconomy.However,IamfilledwiththeconfidencethatthefoundingprinciplesandobjectivesoftheDefenceReviewwillberealised.

5. FOREWORD BY THE SECRETARY FOR DEFENCE, DIRECTOR-GENERAL, DR S.M. GULUBE
TheestablishmentoftheDefenceForceServiceCommissioninOctober2009wasaprogressivestepforSouthAfrica,andmorespecificallytheDepartmentofDefence,initsendeavourtoensurethewellbeingofallmenandwomaninthemilitary.
During theperiodunder review, theCommission,under theChairpersonshipofProfessorEdnavanHarte,continued topursueitsmandateintermsoftheDefenceAmendmentAct22of2010,bymakingrecommendationsontheimprovementofconditionsofserviceforsoldiers.SomeoftherecommendationsmadebytheCommissionhavealreadybeenactedupon.
During theperiodunder review, theCommission conducted various consultative visits to interfacewith soldiers, bothinsideandoutsidethebordersofSouthAfrica. Duringoneofthe internalvisits inBloemfontein, theCommissionhadtheopportunitytomeetandliaisewithProjectThusanoartisansfromCuba.SANDFsoldiersdeployedintheDemocraticRepublicoftheCongowerevisitedduringthelatterpartof2016.DuringtheDRCvisit,theCommissioninteractedwithSANDFsoldiersintheunitsandbasessituatedinBeni,GomaandSake.TheCommissionalsohadtheopportunitytomeetLtGenDerickMgwebi(previouslytheChiefofJointOperationsintheSANDF),nowtheForceCommanderoftheUnitedNationsOrganisationStabilisationMissionintheCongo(MONUSCO).
TheCommissiongazettedandpublishedthe"lnterimNationalDefenceForceServiceCommissionFinalReport,November2010",inGovernmentGazetteNo39920,dated15April2016.
Aspartofpoliticaloversight,theJointStandingCommitteeonDefencewasbriefedduringSeptember2016ontheimpactmadebytheCommissionin improvingtheconditionsofserviceofsoldiersandrelatedchallengesexperienced. Strategicissueswerediscussedwith theMinisterofDefenceandMilitaryVeterans inFebruary2017.Thisdiscussion included theestablishmentofamechanismtoensurethatrecommendationsmadebytheCommissionareconsideredforimplementation.
Iwish toexpressmygratitudeandappreciation toProfessor vanHarteand theCommission fordiligentlypursuing itsmandateandprovidingvaluableadviceandrecommendationsonimprovingtheserviceconditionsofoursoldiers.

TheDefenceForceServiceCommission(DFSC)hassteppedupitseffortstoensurethatthemembersoftheSANDFareaccordedacceptableserviceconditionsandservicebenefits. Inthisregard,theDFSCpublished inGovernmentGazettenumber39920dated15April2016thefinalreportoftheInterimNationalDefenceForceCommission.ThisreportwillinformthechoicesavailabletotheSANDFintermsofimprovingtheserviceconditionsandservicebenefitsformenandwomeninuniform.
ForusmenandwomeninuniformwearelookingforwardtotheDFSCtoensurethatweinuniformarebeingtakencareofbythegovernmentofthedayandSouthAfricansofallracesandpoliticaldenominations. This isaspecialbreedofpeoplewhoensurethatourcountryanditspeoplearesafeandenjoythebenefitsofthedemocracythatweallfoughtforandtothateffecttheyarepreparedtopayasupremesacrificeindefenceofthegainsofourdemocracy.Indoingsoitdistinguishesthemfromtherestofourpeoplebecausetheydothatasvolunteersandservantsofthepeople.Thatinitselfseparatesthemfromtherestthusmakethemaspecialbreedwithinourpopulation.Forthatreasontheycannotbetreatedlikeordinarycitizensbecausesacrificeispartoftheirjobdescriptionindefenceoftheircountryanditscitizens.ItisagainstthisbackgroundthatIexpecttheDFSCtoconvincegovernmentandcitizensofthiscountrytomakelifecomfortableforthisbreedofpeoplewhiletheyarestillalive.

7. STRATEGIC STATEMENT BY THE CHAIRPERSON OF THE DEFENCE FORCE SERVICE COMMISSION, PROFESSOR E.L. VAN HARTE
‘Life’smostpersistent andurgentquestion is:what are youdoing forothers?’ The abovequotebyDrMartin LutherKingissuitablewhenconsideringthestrategicroleofDFSCCommissionerstowhomthemandatewasgiventogeneraterecommendations to theMinister ofDefence andMilitaryVeterans (MOD&MV)on servicebenefits and conditions ofserviceformenandwomenoftheSouthAfricanNationalDefenceForce(SANDF).TheDFSCviewsitselfasoneofthevoicesforthecurrentmembersinuniformasperSection62BoftheDefenceAmendmentAct,Act22,2010.
TheHon.MinisterDefenceandMilitaryVeterans,Ms.N.N.Mapisa–NqakulaofficiallyopenedtheCivilMilitaryRelationsConferenceon26October2016.Throughthisconferenceauniqueandenablingplatformwascreatedforthosewhoholdcivilcontroloverthemilitary,senior-andmanagementlevelmilitaryleaders,andvariouscivilsocietymemberstoengageinaconstructiveandtransparentmanneronmanycomplexissuesthatimpactstheDepartmentofDefence(DOD).Theissueofmilitaryunionswasputunderthespotlightwherebytheconstitutionalrightsofunionstoexistwasaffirmed,butthethreattocommandandcontrolwithinthemilitarywasraisedasastrongdilemma,AnothersignificantaspectoftheconferencewasthatitbroughttolifetherecommendationmadeonCivilMilitaryRelationsbytheInterimDefenceForceServiceCommission(INDFSC).
DFSCcontinuedtovisitmilitarybasesandunits inBloemfontein,PortElizabethandtheDemocraticRepublicofCongo(DRC)togatherinformationfromsoldiersontheirconditionsofservice.ThevisitstounitsintheEasternCaperesultedinavaluablehalf-dayworkshopwiththeMilitaryCommandCouncil(MCC)duringwhichtimeattentionwasgiventourgentconcernsraisedbytheCommission.TheneedforatighterscrutinyoftheMemorandumofUnderstanding(MOU)thatexistbetweentheDODandtheUnitedNations(UN)wasbroughttotheattentionofCSANDFassomeaspectscontainedintheMOUnegativelyaffectstheconditionsofserviceofSANDFmembers.TheDFSCdelegationtotheDRCwasveryinspiredwiththelevelofprofessionalism,commitment,andhighmoraleobservedinthedeployedSANDFmembers.
DFSCsubmittedanaffordablerecommendation(approximatelyRM87)totheMOD&MVonDelinkingSalaryfromRank.Implementationofthisrecommendationwillpositivelyimpactthelivesofeightthousandeighthundredandninetyfour(8894)soldiers.
Throughtheconstructionof thesatelliteoffice,theDFSCexperiencedthestrategic importanceof theWorkFormationUnitstoenablememberstodevelopemployableskillsthatcouldbeutilizedforgainfulemploymentupontheirexitfromtheSANDF.

FortheperiodunderreviewtheorganisationbenefittedfrompartnershipswithDrHentievanRensburgandhisARMSCORteam,SAABGrintek,andSierraBurgersParkHotel.Inaddition,DFSC’sworkwasgreatlyenhancedbytheHeadofSecretariat’sattendanceofmeetingsheldbytheHumanResourcesDivision,HRCommandCouncil.DFSCexpressesitsgratitudetoallwhoco-operatedwithusthroughpartnerships.
Warmest appreciation is expressed to the Deputy Chairperson, Maj Gen (ret) B.H. Holomisa, and the other eightcommissionerswhocontributedtothedeepeningofperspectivesondeliveryoftheDFSCmandate.
ThetaskoftheCommissionerswasmademucheasierthroughtheresearch,administrativeandlogisticalworkdonebythepermanentmembersof theSecretariat,uniformedmembersondetachedduty,aswellasReserveForcememberswhooperatedundertheguidanceoftheHeadoftheSecretariat.TheyhelpedtheDFSCreacha95%performancetargetforthebudget,establishedourfootprintbyhavingasatelliteofficeatSASWingfieldNavalBaseintheWesternCape,andcontributedtousmeetingourcomplianceobligationsintermsofourmandate.TheCommissionthankedthemfortheirinvaluableservice.
AspecialwordofthankstotheMinisterofDefenceandMilitaryVeterans,MsN.N.Mapisa-Nqakula,MP,SecretaryofDefence,DrS.M.Gulube,ChiefoftheSouthAfricanNationalDefenceForce,GeneralS.Z.Shoke,ChiefsofServicesandDivisionsandallDODmemberswhohelpedtheCommissiontoreachitsperformancetargets.TheseindividualsstrengthenedDFSC’sbeliefthatthroughunityofpurposeandsolidpartnershipsitispossibletoreachthestrategicobjectivesoftheDOD.

8. REPORT OVERVIEW
INTRODUCTION
The DFSC continues to grow in its pursuit to advance its mandate. The growth is demonstrated in the deepenedunderstandingand internalisationof themandatebytheCommissionersandmembersof theSecretariat. It is furtherobservedinthecontinuedfosteringofrelationsandco-operationwiththeDepartmentofDefence(DOD)andtheSANDFleadershipandbymembersinuniformwhodisplayedalevelofeagernesstoknowandunderstandthevaluethattheycanderivefromtheCommission.
SIGNIFICANT ACHIEVEMENTS
TheDFSC,inpartnershipwiththeSwedishAerospaceandDefenceCompany(SAABGrintek),theIndependentMediaandtheAfricanEquityEmpowermentInvestment(AEEI)Limited,hostedasuccessfulCivilMilitaryRelations(CMR)conferenceon “Bridging the Gap: Advancing Civil Military Relations to deepen Democracy” overtheperiod27to28October2016attheCouncilofScientificandIndustrialResearch,Pretoria.ThesepartnershipswithexternalstakeholderslikeSAABGrintek,showrecognitionoftheDFSC’simportantrole.ThehostingoftheConferencewasfurthermotivatedbytherecommendationmade by the InterimNational Defence Force Service Commission (INDFSC) in November 2010, recommending to theMOD&MVtofindwaysandmeanstoproduceadefinitivestatementonCivil-MilitaryRelationsinSouthAfrica.
The MOD&MV, the Honourable Ms N.N. Mapisa-Nqakula, officially opening the CMR Conference on 27 October 2016
Twodeliverableswillbedeveloped,namely,acoffee-tablebookonCMRandConferenceProceedingsthatcanbeusedforresearchpurposesinfuture.
AdelegationoftheDFSCvisitedandinteractedwith590deployedSANDFsoldiersofapersonnelstrengthof799withintheDemocraticRepublicoftheCongo(DRC)duringNovember2016.Subsequenttothisvisit,theCommissionwasrequested

TheDFSChasstrivedsinceitsinaugurationtoberecognisedasanenabler,andthroughmultifacetedengagements,itisabletoreportthattheacknowledgementoftheDFSCasapartnerandsupportmechanismtoenhancetheConditionsofServiceofSANDFsoldiersandmembersoftherespectiveReserveForces,bytheDOD,ChiefsofServicesandDivisionsandotherseniormemberswithintheDOD,isincreasingandcommendable.
As a direct response to the acknowledgement of the DFSC, theHead of the Secretariatwas granted permission toattendHumanResourceCommandCouncil(HRCC)meetingsbytheChiefofHumanResources(CHR),asanadditionalmechanismtoexposetheDFSCtodevelopmentsinHumanResource(HR)mattersimpactingontheConditionsofServiceforSANDFmembers.
TheDFSCmadearecommendationtotheMOD&MVregardingaffordabledelinkingsalaryfromrankmodelthatwouldimproveconditionsofapproximately15%(8894)ofSANDFmembersstagnatedatlowerranks.
TheDFSCwasabletospend94.51%ofitstotalallocatedbudgetwithintheFY2016/17.
MATTERS UNDER OVERSIGHT
TheDFSC ismandated tomake recommendations to theMOD&MV in termsof the improvement in theConditionsofServiceofallSANDFmembers.
TheDFSChastheresponsibilitytoexerciseoversightovertheimplementationoftherecommendationsmadeandsubmittedtotheEAforconsideration.AlthoughthereisnotanofficialandestablishedfeedbackmechanismtoinformtheCommissiononprogressorinitiativesregardingtheimplementationofrecommendationstabledtotheEA,theCommissiondoesreceivefeedbackonimplementedimprovementsduringinformaldiscussionsandfollowupvisitstoMilitaryBasesandUnits.
PayandServiceBenefitsCommitteetabledrecommendationregardingthemodelonDelinkingSalaryfromRank.Itisregardedasanaffordablemodel thatwouldseek to improveserviceconditionsofapproximately15%(8894)ofSANDFmembersstagnatedatlowerranks.ThecommitteealsorecommendedthattheSANDFdevelopapayprogressionmatrix/salaryscalesforReserveForcememberswhichwillallowmemberstoprogresstothenextnotchafter12monthsofcumulativeserviceinarank.
Policy Review Committee tabled the following recommendations: (1) eradication of asbestos within the DOD;(2)ImprovementofthequalityofuniformformembersoftheSANDF;(3)SpecificmattersofconcernregardingtheMilitarySkillsDevelopmentSystem(MSDS)suchastherevisionofrecruitmentstrategiesintermsoftheintakeoftheacceptablenumberofMSDSmembers.Furthermore,theDFSCsubmittedreportsanditsfindingstotheMOD&MVonvisitstovariousbasesandunits.WealsoissuedanInterimReportofthevisittotheEasternCapethatledtoaproductivemeetingwiththeMilitaryCommandCouncil(MCC),asattachedinAnnexure1.
TheCommissionundertookconsultativevisitstoSANDFbasesandunits,includingthedeploymentmissionsintheDRCduringtheyearunderreview.SANDFmembersraisedsomeissuespertainingtoconditionsofservice,butnotlimitedtothefollowing:
• Leave during Deployment.TheSANDFdoesnotprovidesupportassistancewhendeployedmembershadtotakeleavewhileondeployment.Themembershadtomaketheirowntravellingarrangementsduringtheperiodofleave.

• Deployment Benefits. Members are concerned that the deployment benefits paid to SANDF members arecomparativelylessthanthebenefitspaidtomembersfromotherForcecontributingcountriesinthemissionareas.
• LeaseAgreements.Subsequenttothevisit,thecommissionsubmittedinputsthroughCSANDFtobeconsideredforinclusionintheMemorandumofUnderstanding(MOU)betweentheDODandtheUnitedNations(UN),inthequesttoaddresstheissuesregardingpaymentaccordingtoleaseagreementforequipmentinmissionareas.
• Reserve Force. The Commission has entered into an MOU with the Reserve Force Council to advance theimprovementofconditionsofservice forReserveForcemembers.ReserveForce formsan integralpartof theSANDFandaugmenttheRegularForceinmilitaryoperationsandday-to-dayactivitiesoftheDefenceForce.
• TransferandPromotions.SANDFmembersareconcernedbythemannerinwhichinstructionsfortransfersarecommunicatedandimplemented,withoutconsiderationtosocio-economiccircumstancesaffectingthemembersandthewelfareandwell-beingoftheirfamilies.Notwithstandingthemilitarycultureinthisregard,theprospectsoftransfersshouldbecommunicatedaheadoftime,toallowmemberstoplanproperly.
STRATEGIES IMPLEMENTED
TheDFSCstrovetoeffectivelyexecuteitsmandateasenshrinedinsection62.BoftheDefenceAmendmentAct,Act22of2010.Initspursuittothelatter,theCommissionundertookthefollowingstrategicprocesses:
ConsultativeMilitaryBasevisitswithintheCountry.TheCommissionconductedfourconsultativevisitstoSANDFBasesandUnitswithinthebordersofSouthAfrica(SA)duringFY2016/17.AlthoughtheCommissionfocusedonchallengesencounteredbySANDFmembers,theseconsultativevisitsexposestheDFSCdelegationtoactualchallengesexperiencedandencounteredbyallDODmembers,includingReserveForcemembersandPublicServantActPersonnel(PSAP)atespeciallyLevel3andLevel4Units,wherethemembersaredirectlyresponsiblefortheoperationalandtacticalimplementationofpolicies.
TheprocessfollowedbytheCommissionduringconsultativevisits,wasaninteractiveonewithallDODmembersacrossallranksandappointmentlevels.Theinteractionsculminatedintofindingsandrecommendationsthatwererecordedintherespectivevisitreports.

ComparativeStudyVisits. AlthoughtheCommissiondidnotconductcomparativestudyvisitstootherMilitaryForces,wehadinformalengagementsduringtheCMRconferencewithforeignmilitarymembersstudyingattheWarCollegeandsomeotherDefenceAttachés.TheDFSChadformalengagementswiththeDAfromRomaniaandtheDefenceAttachéfromThailand.TheCommissionbecamefurtherawareofsimilaritiesinconcernsregardinginadequateDefenceBudgetallocations,ConditionsofServiceandstructuralmattersespeciallyregardingtoaccommodation,throughitscontactswithsomeoftheDAs. ConsultationswiththeMOD&MV.TheCommissionhadoneofficialmeetingwiththeMOD&MVduringtheperiodunderreviewanditresultedinthesuccessfulhostingoftheCivilMilitaryConferenceduringOctober2016.ConsultationwiththeMOD&MVwasstrategic innatureas it required theurgent intervention fromtheMinister for the implementationoftherecommendationonDelinkingSalaryfromRankaspartofaquick-winstrategy.Subsequenttothismeeting,theCommissionwasabletopresenttotheHRCCtherecommendationontheDelinkingSalaryfromRank.
TheChairpersonoftheDFSCandmembersoftheCommissioncouldcontinuouslyinteractonstrategicmatterswiththeMinister during various formal functions and ceremonies that both parties attended. TheMOD&MV also invited theCommissiontoattendtheBudgetVoteSpeech,andfurtherinvitedtheCommissiontobepartofherdelegationduringhervisittotheDRCinNovember2016.Howeverthevisitwaspostponed.
DFSCbriefingtoParliament.TheCommissionwasinstructedbytheJointStandingCommitteeonDefence(JSCD)duringSeptember2016,togiveabriefingontheCommission’simpactmadethusfarintheexecutionofitslegislatedmandateandimpedimentsexperiencedbytheDFSCinitspursuit.
BriefingsbyrespectiveChiefsofServicesandDivisions. During itsscheduledDFSCPlenaryBoardmeetings,ChiefsofServicesandDivisions,andotherseniormemberswithintheDODwereinvitedtobrieftheDFSCPlenaryBoardonspecificareasof concern relating toconditionsof service. Oneof thebriefings receivedwas fromtheChiefDirectorateForcePreparationoftheSouthAfricanMilitaryHealthService(SAMHS)regardingtheimplementationoftheResilienceTrainingProgrammewithintheDOD.

OBSTACLES
On24November2015,theMOD&MVapprovedinprincipleeffortstoamendtheDefenceActsoastoaddressthelimitedpowersof theCommission. TheCommissionwas instructed to commencewith theadministrationprocessesand theMilitaryLegalServicesDivision(MLSD)wasapproachedtoassistinthisregard.
AneedwasidentifiedduringNovember2015toaligntheDFSCRegulationswiththeDefenceAmendmentAct,Act22of2010inthoseareaswhereitisnecessary.Thisprocessneedstheassistance,supportandinterventionoftheMLSDbutcouldnotbeaccomplishedduringtheperiodunderreviewduetoaninadequateHRcapacitywithintheMLSDthatmadeitimpossibletodedicatealegalexperttotheDFSCtopursuethismatter.
TheDFSCSecretariatcontinuedtohavecapacityconstraints.Only13members(68%)ofthealreadyinadequatestructureoftheSecretariatofonly19postsarepermanentlyemployed.ThecapacityconstraintswithinthesupportfunctionsoftheSecretariatwerealleviatedbycallingupeightReserveForcemembersandmakinguseofeightmembersondetacheddutyfromvariousArmsofServicethroughoutFY2016/17.FundsfortheremunerationoftheReserveForcememberswerereallocatedbymeansofaChangetoPlanfromunstaffedvacantPSAPpostswithinDFSCItem10HRBudget.
TheremunerationlevelofsomeofthecriticalcorefunctionpostswithintheSecretariatposesachallengeastheworkrequiredistoocomplexfortheauthorisedlevelofappointment.CostcontainmentmeasuresontheexpansionofstructurestheelevatingofappointmentlevelsandoutsourcingofessentialconsultancyservicesimpededtherecommendationsintermsofPayandServiceBenefitsandthelimitedpowersoftheDFSCasperDefenceAmendmentAct,Act22of2010.
CONCLUSION
TheCommissionexpressesitsdeepappreciationforthecontinuoussupportdemonstratedbytheHonourableMOD&MV,theDeputyMinisterofDefenceandMilitaryVeterans,theSecDef,CSANDFandtheChiefsofallArmsofServiceandDivisions.
TheCommissionwillcontinuetosupportthestrategiceffortsoftheleadershipoftheDODandSANDF,inadvancingtheaspirationscontainedintheDefenceReview2015.
HighestappreciationisexpressedtothecountlessindividualswhosupportedtheDFSCinmanydifferentwaysandfortheSecretariatwhoformedthebackboneoftheCommission.

10. CONSTITUTIONAL AND LEGISLATIVE MANDATES
BILLS TO PARLIAMENT
AlthoughnobillsweresubmittedtothelegislaturebytheCommissionduringthefinancialyear,itneedstobementionedthat the MOD&MV, the JSCD, the Portfolio Committee on Defence as well as the Military Command Council (MCC)unanimously agreed that theDefenceAct,Act22of2010 shouldbeamended toempower theDFSC. TheDFSC is inconsultationwiththeMLSDpursuingthismatter.
PRIMARY LEGISLATIVE MANDATE
ThelegislativemandateoftheDFSCiscontainedinSection62AtoLoftheDefenceAct,Act42of2002,asamendedbytheDefenceAmendmentAct,Act22of2010.
ThemandateisgivensubstancebytheDFSCRegulations.
TheDFSCcomprisesofaSecretariatwhichisestablishedintermsofSection62.IoftheDefenceAmendmentAct,Act22of2010.
ThefunctionsoftheCommissionintermsofSection62BoftheDefenceAmendmentAct,Act22of2010are:
"(1) The Commission must -
(a) on an annual basis, make recommendations to the Minister on improvements of salaries and service benefits of members;
(b) make recommendations to the Minister on policies in respect of conditions of service;
(c) promote measures and set standards to ensure the effective and efficient implementation of policies on conditions of service within the Defence Force and make recommendations to the Minister in this regard; and
(d) for the purposes of making recommendations contemplated in paragraphs (a), (b) and (c), - (i) enquire into or conduct research on conditions of service; (ii) review policies; (iii) evaluate and monitor the implementation of such policies (iv) consult with the Secretary for Defence, the Chief of the Defence Force, members of the Defence Force, Reserve
Force Council and any other interested person or body on conditions of service and any other matter relating to the purview of its functions;
(v) consider any representations made to the Commission; (vi) consult with National Treasury; (vii) confer with the Department responsible for public service and administration, the Public Service Commission
and any other relevant stakeholder within the public service; (viii) consider, among others- (aa) the rank structure of the Defence Force; (bb) the affordability of different levels of remuneration of the Defence Force; (cc) current principles and levels of remuneration in the public service generally; and (dd) inflationary increases.
(2) The Commission must perform its functions impartially, without bias, fear or prejudice.

Constitutional and Legislative Mandates
(3) The Commission may, in consultation with the Minister, call upon any member of the Defence Force or employee of the Department to assist it in the execution of its functions, and such person is obliged to provide the necessary assistance,
(4) The Minister determines the conditions of service for members of the Defence Force, in consultation with the Minister of Finance, after having received a recommendation from the Commission.

INTRODUCTION
TheDFSCiscommittedtoitslegislatedmandateandresponsibilitytowardsthewell-beingofallmembersoftheSANDFincludingtheReserveForces.InitsendeavourstoresearchonConditionsofService,theDFSCbecameincreasinglyawareoftheinterdependencebetweenthePermanentDefenceActPersonnel(DAP),thePSAPandtheReserveComponent.
THE COMMISSION
TheestablishmentandcompositionoftheDFSCisintermsofSection62AoftheDefenceAmendmentAct,Act22of2010.
TheapprovedstructureofeighttotenCommissionersappointedbytheMOD&MVisprescribedinsection62A.(1)oftheDefenceAmendmentAct,Act22of2010.
“The Commission consists of no fewer than eight and no more than ten members appointed by the Minister.
The Minister must designate one member as Chairperson and another as Deputy Chairperson of the Commission.
If the Chairperson is absent or for any reason unable to act as Chairperson, the Deputy Chairperson must act as the Chairperson of the Commission.”

AIM OF THE VOTE
ThePFMASec63(1)(a)stipulatesthattheExecutiveAuthoritiesofdepartmentsmustperformtheirstatutoryfunctionswithinthelimitsofthefundsallocatedforarelevantVote.TheVotefortheDFSCisvitalfortheexecutionofitslegislatedmandate,initiativesandprioritiesprovidedforbytheDefenceAmendmentAct,Act22of2010.TheDFSCensuredcarefulandtransparentexpenditureofitsVotethrougheffectivefinancialmanagementbymeansofregularscheduledBudgetControlCommittee(BCC)meetingsandwiththeassistanceandguidanceoftheSeniorStateAccountantwithintheDefenceSecretariat.

6. OVERVIEW OF THE DEFENCE FORCE SERVICE COMMISSION PERFORMANCE
SERVICE DELIVERY ENVIRONMENT
TheDFSC,aslegislatedintermsoftheDefenceAmendmentAct,Act22of2010,isresponsibletomakerecommendationstotheMOD&MVconcerningConditionsofService,ofmembersoftheSANDFandtoprovideformattersconnectedtherewithasreflectedinAnnexure2.
TheabilityoftheDFSCtoadvisetheEAbytablingviableandsoundrecommendationsisalsodependentonclosestrategiccollaborations with internal and external stakeholders to the DOD and SANDF. The DFSC continue to strengthen itsrelationshipswithkeyDODUnitssuchastheOfficeoftheSecDef,DefencePolicyStrategyandPlanningDivision,MLSD,DefenceLogisticalDivision,HRDivision,theOfficeoftheChiefFinanceOfficer(CFO)andseveralSANDFunits.ThestrategicrelationshipbetweentheDFSCandtheOfficeoftheMOD&MVisnecessaryinordertocomplywithmandatoryobligations.
ThecollaborationbetweentheDFSCandtheReserveForceCouncil(RFC)isastheresultoftheMOUsignedon05October2015thataimstoimproveConditionsofServiceofthemembersofrespectedReserveForces.
DelegationsoftheDFSCcontinuouslysupportedmajormilitary,civilandculturaleventssuchastheArmedForcesDayinDurban,theClosingCeremonyofthe350thCommemorationoftheCastleofGoodHope,theReserveForceCouncillekgotlaaswellasvariousotherprestigiouseventsofrespectiveArmsofServiceandDivisionsinordertostrengthenrelationshipswithstakeholdersandshowsupporttomembersoftheSANDF.
The DFSC is limited to make recommendations only and therefore cannot enforce the implementation of therecommendationsmadeonConditionsofServiceforthemembersoftheSANDF.EventhoughthePortfolioCommitteeonDefenceandMilitaryVeteransandtheMCCsupportedthenotionofamendingtheDefenceActtostrengthenthepowersoftheCommission,DODServicesandDivisionsstillneedtoviewtheCommissionasanenablerandforcemultipliertoimprovetheConditionsofServiceforallmembers,includingtheReserveForcemembers.

TheDFSC, as anOrganof State, is notdirectly involved in the implementationof theDefenceReview2015.HowevertheDFSCcontinuestoexpressitssupportatvariousplatformsandsectorssuchasthePortfolioCommitteeonDefence,JSCDandNTintermsofthefundingrequiredfortheimplementationofMilestone1.ThesuccessfulimplementationofMilestone1willcomplementvarioussignificantrecommendationstabledbytheDFSCconcerningvariousConditionsofServiceandtoolsoftradeforuniformedmembers.
8. DEFENCE FORCE SERVICE COMMISSION ACHIEVEMENTS
ProfessorM.W.Makgoba,inauguratedasaCommissionerbytheMOD&MVon01May2015,wasappointedbytheMinisterofHealth,DrA.Motsoaledi,asSouthAfrica’sfirsteverHealthOmbudsman.ProfessorMakgobawillbeprocessingpatientcomplaintsagainsthealthpractitioners,hospitalsandclinicsacrossboththeprivateandthepublicsectors.
TheFinalReportoftheINDFSCwaspublishedinGovernmentGazetteNo39920,Vol610,dated15April2016atacostofnearlyR167000.TheDFSCalsopromulgatedthisGovernmentGazetteontheDODPolicyWebsite.Thegazettedreportwasviewedandreadbytwothousandsfivehundredandsixtyeight(2568)members,accordingtotherecordedhitsontheDODintranet.
The Commission circulated a Bulletin dated 09May 2016 on the DOD Intranet. The intention of this Bulletin titled‘DFSC Pledges Support to all Deployed Soldiers of the SANDF’wasmultifaceted in that theDFSCencourageddeployedmembersoftheSANDFtomaintaindisciplineandstandards;tocommendalldeployedmembersfortheircommitmentandprofessionalism;forsupportingpeacekeepinginitiativesandfurthermoretocommunicatethecontinuouseffortsoftheCommissiontoimproveConditionsofServiceandservicebenefitsforallSANDFmembers..Thisbulletinwasviewedandreadbythreethousandsandseventy(3070)members,accordingtothenumberofhitsrecordedontheDODintranet.
ThecompliancewiththeannualperformanceindicatorandtargetforFY2015/16intablingtheDFSCAnnualReportforFY2015/16wasinlinewithNationalPrescriptsandSection62H(1)(b) oftheDefenceAmendmentAct,Act22of2010,statingthattheCommission“…must within two months after the end of each financial year submit a report on its activities and findings to the Minister”.AnelectroniccopyofthereportwassubmittedtotheOfficeoftheEAon31May2016andprintedvolumesweresubmittedtotheOfficeoftheMinistryon03June2016.65CopiesoftheprintedvolumesweresubmittedtotheParliamentaryLiaisonOfficeron14June2016fortablingtotheChairpersonoftheNationalCouncilofProvincesandtheSpeakeroftheNationalAssembly.
TheDFSCappearedbeforetheJSCDon9September2016whereitbriefedtheJSCDontheimpactitmadeinimprovingConditionsofServiceofSANDFmembers,andthechallengesencounteredthereto.
TheHeadoftheSecretariatoftheDFSCwasgrantedauthorisationtoattendtheDODHRCCaspartoffosteringrelationswithinternalDODstakeholders,andtogaininsightinthestrategicHRprocessesthathaveimpactonthemandateoftheCommission.
ADFSCdelegationvisitedfive(5)EasternCapeMilitaryUnitsovertheperiod22to26August2016,namelyAreaMilitaryHealthUnitEasternCape;NavalStationPortElizabeth;thePrinceAlfredGuardReserveForceUnitPortElizabethandtheArmySupportBasePortElizabeth.Thedelegationcouldnotcontinuewith itsconsultativevisittotheAirForceStationPortElizabeth,becausetheOCoftheUnitabscondedontheday.Emanatingfromthisvisit,apreliminaryvisitreportwassubmittedtotheOfficeoftheMOD&MV.

Anumberof strategic issues, including theestablishingofamechanismthatwillensurethattherecommendationstabledbytheDFSCareconsideredforimplementationwithintheDOD.TheMOD&MVinstructedtheCHRtoscheduleameetingwiththeCommissionregardingtherecommendationontheDelinkingSalaryfromRankthatwastabledinJune2016.TheDFSCpresentedtherationaleandcostimplicationfortheimplementationofthisrecommendationtotheHRCCon07March2017.DuringthispresentationtheCHRindicatedtotheCommissionthatitisenvisagedthattheDODwillincurasurplusofRm191onitsoverallHRBudgetforthecurrentfinancialyear.
AletterwastabledtotheOfficeoftheEArequestingauthorisationtoutiliseR87oftheRm191HRbudgetsurplus,tofundtheimplementationofdelinkingsalaryfromrankrecommendationthatwillbenefit8894membersoftheSANDFwhoarestagnatedinRanks.EventhoughtheaudienceavailedtotheDFSCisperceivedasanachievement,thewavingoftherequestforfundstobemadeavailablefortheDelinkingSalaryfromRank,isregretted.ThroughthismeetingwiththeMOD&MV,theMinisterinstructedthataworkshopbetweentheMinistry,keystakeholderswithintheDODandtheDFSCneedstotakeplacetoaddresstherelevantissuesaffectingtheDFSCandrespectiveDODstakeholders.

PART CGOVERNANCE
1. INTRODUCTION
TheMOD&MV,astheEA,isresponsibleforoversightofDefencerelatedOrgansofStatewithintheDepartment.DuringthereportingperiodtheMOD&MVengagedwiththeDFSCon08February2017.Anumberofstrategicissues,includingtheestablishmentofamechanismthatwillensurethatrecommendationstabledbytheDFSCareconsideredforimplementationwithintheDODwerediscussed.OthersignificantengagementswiththeMinisterincludedtheofficialopeningoftheCivilMilitaryConferencethatresultedinrobustdiscussionsbetweenallparticipantsduringthetwodayConference.
ManyotherinformalopportunitieswereinitiatedandfruitfuldialoguetookplacebetweentheMinisterandtheCommission,suchas the invitationof theOfficeof theMinistry to theDFSC toattend theBudget Speechof theMOD&MVand toaccompanytheMinistertoanofficialvisittotheDRC.DespitethefactthatthejointventuretotheDRCdidnotmaterialise,theDFSCappreciatedtheinvitationfromtheEA.
TheCommissionwasalsoinvitedbytheMOD&MVtoattendaCouncilonDefencemeetingofwhichthedatestillneedstobeformalisedbytheCOD.
TheDFSCaddressedtheMCConfindingssubsequenttoitsvisittoMilitaryBasesandUnitswithinPortElizabeth,EasternCapeProvinceon05October2016,aftertheDFSCsubmittedanurgentinterimreporttotheMOD&MVandCSANDF.
2. RISK MANAGEMENT
EventhoughnoCorporateRisksareregisteredontheDODEnterpriseRiskManagementRegisterfortheDFSC,theDFSCneedstoreportthatcapacityconstraintswithintheDFSCareimpedingrequiredstrategicoutputs.
RISKS AND MITIGATING ACTIONS
Capacity constraintswithin the support functions of the Secretariatwere alleviated by calling up eight Reserve Forcemembersduringtheyearunderreview.AlthoughnofundsweremadeavailablefortheremunerationofReserveForcemembers, the fundsto justify theremunerationof thesememberswerereallocated fromunstaffedvacantPSAPpostswithinDFSCItem10HRBudget.
Notwithstanding,thecontinuouscallupofReserveForcemembers,anadditionaleightmembersfromrespectiveArmsofServiceweredetachedtotheDFSCtoaugmentgapswithinthecoreresearchandsupportfunctions.
Theperformanceof theDFSC continues tobe challengedby resource limitations such as the level of appointmentofspecifically the researchers within the core function of the DFSC, and other critical support functionaries within thestructureoftheDFSCSecretariat;costcontainmentmeasuresimposedbyNTimpededamongstothertheutilisationofexternalactuarialservicestodetermine,assessandplanthefinancialimpactofvalidatedrecommendationsintermsofPayandServiceBenefits,andthelimitedpowersoftheDFSCasperDefenceAmendmentAct,Act22of2010.

4. CODE OF CONDUCT
TheCodeofConductforPublicServantActPersonnel(AnnexureB)isapplicabletotheCommissionersandtheemployeesoftheDFSC.MembersondetacheddutyandmembersoncallupareobligedtoconformtotheSoldierofAfrica:CodeofConductforUniformedMembersoftheSANDF.TheseCodesofConductstrengthenedtheethicalandlegalisticbehaviourofallmembersservingtheDFSC.
5. HEALTH AND SAFETY ISSUES
LocatedwithinthebuildingsleasedbytheSAMHS,membersoftheDFSCareobligedtoconformtotheOccupationalHealthandSafetyActandAmendmentsthataimstoprovideforthehealthandsafetyofpersonsatworkandthehealthandsafetyofpersonsinconnectionwiththeactivitiesofpersonsatwork.
During FY2016/17 urgent and essentialmaintenance and repair renovations took place at Kasteelpark andwithin theLeerdambuilding.Notwithstandingthenecessityoftheseconstructions,serviceswithintheDFSCwereinterruptedfornearlyeightweekswhenelectricity,waterandInformationTechnologyplatformswereintermittentlyshutdown.SomemembersoftheSecretariatwererelocatedinordertoperformcoreandsupportfunctions,duetohealthrelatedcomplaints.
TheDFSCtabledspecificrecommendationsattheendofthepreviousfinancialyearonmattersdirectlylinkedtoHealthand Safety issueswithin theDOD. TheMOD&MVacknowledged the receiptof these recommendations in June2016andindicatedtotheCommissionthattherecommendationswereforwardedtotheSecDefandtheCSANDFfortheirconsideration and implementationwithin the current FY2016/17 allocatedDODbudget. The critical aspects of theserecommendationscanbesummarisedas:
• TheprioritisingoftheeradicationofasbestosintheDOD.
• Therevisingofallpolicydocumentsonuniformsandprotectiveclothingwithspecialattentiontotheprotectivegearforfire-fighters.
• MatterspertainingtoMilitarySkillsDevelopmentSystem(MSDS)intakesthatimpactonHealthandSafetyIssueswithintheDODsuchastherevisingofrecruitmentstrategiesandthenumbersofmembersacceptedthatcanbeaccommodatedinETDfacilitiesanddormitoriesaccordingtoOccupationalHealthandSafetystandards.
TheprocurementprocessesforthepublicationoftheserecommendationsinaGovernmentGazettewasfinalisedintheperiodunderreviewandthepublicationisawaited.
6. PARLIAMENTARY COMMITTEES
JOINT STANDING COMMITTEE ON DEFENCE
TheDFSCappearedforthefirsttimesinceinaugurationon10October2013,beforetheJSCDon9September2016.TheCommissionbriefedthecommitteeontheimpactmadeinimprovingConditionsofServiceforSANDFmembers,andthechallengesencounteredthereto.
The Commission was commended for the work done and the Chairperson of the JSCD acknowledged the challengingcircumstancesexperiencedbytheCommissioninexecutingitslegislatedmandate.ThefollowingwasmadevisibletotheJSCD:

• FromthefinalreportoftheINDFSCinNovember2010,20recommendationsweremade.TheDFSCwasinformedviatheOfficeoftheSecDefthatfiveoftherecommendationswereimplementedbytheSANDFnamely:
─ “A properly funded and extensive Defence Review be undertaken as soon as possible to pay close attention to the relationship between mandate, capabilities and funding.”
─ “A review of the budgetary requirements of the SAMHS be undertaken at once with a view of improving the funding with the aim to retain Health Care Practitioners. To audit all the files of members who are remunerated in terms of Occupation Specific Dispensation (OSD), and the MOD&MV to appoint medical task team to address specific matters.”
─ “The implementation of a new grievance mechanism within the DOD.”
─ “A new salary grading system for Regular Force members; the implementation of a revised dispensation for Reserve Force members; the implementation of Technical allowances and OSD.”
─ “Establishment of a Defence Force Service Commission.”
• TheDFSChastabled12recommendationstotheMOD&MV,ofwhichonlyoneontheimplementationofOSDforMilitaryUniversityEducatorswasimplementedbytheDODinNovember2014.Wehaveobservedthatcertainissueswereportedonhavebeenchanged.
• TheDFSChasstaffed13(68%)postsofthe19approvedestablishment,and6(32%)postsarevacant.Althoughthe DFSC anticipates the staffing of the full complement of the DFSC Secretariat by 2017, the DFSC cannotpredictdefinitelywhenthevacantpostswillbestaffeddueto factorsoutside thecontrolof theDFSCsuchastheprotractedHRAcquisitionprocesseswithintheDOD;verificationofqualificationsbytheSAQAandvettingbyDefence Intelligence. The cost toadvertisevacancies innationalmedia requiresof theDFSC todivide thepublicationofadvertisementsovertwoyears.Threepostswithinthisinadequatestructurebecameunfundedasaresultofbeingvacantforthepastthreeyears.AlthoughtheCHRacknowledgedthatthestructureoftheDFSCistoosmall,theDFSCwasnotabletoaddressthisinadequacywithintheperiodunderreview.ThecostcontainmentmeasureimplementedontheexpansionofstructuresdelayedthestructuralanalysisprocessthatwasinitiatedthroughtheDIMS.
• In terms of negotiating salaries, the SANDF is excluded from the bargaining processes of the Public ServiceBargainingCouncilofSouthAfrica.TheSANDFisnotcoveredbytheresolutionsandagreementsthatDPSAentersintowithtradeunions.TheconcludedresolutionsandagreementsbetweentheDPSAandthetradeunionsareimplementedassuchwithintheSANDF.
• TheDFSCdidnottableanyrecommendationstotheMinisteronconditionsofservicethatspecificallyaddresstheconcernsofReserveForcemembers.TheconditionsofserviceasspecifiedintheDefenceAmendmentAct,Act22of2010,isequallyapplicabletoDAPandReserveForcemembers.TheimplementationoftheMOUbetweentheDFSCandtheRFCawaitedtheformalappointmentofthenewRFCmembers
• TheCommissioninformedtheJSCDthataccordingtoobservationsmadeduringseveralconsultativevisitstoMilitaryBasesandUnits, themoraleofmembersof theSANDF is low,militaryandETDfacilitiesacross thecountryaredilapidated,insufficientandnotmaintainedandcouldcontributetosporadicill-disciplineportrayedbythesoldiers.

Duringitsappearance,theCommissionreiteratedtheimportanceofadequatefundingfortheimplementationofMilestone1(ArresttheDecline)oftheDefenceReview2015,notonlytotheDefenceForce,buttoSouthAfricaandAfricaatlarge,asthiswillalsoimpactpositivelyandaddresstheinadequaciesinstructures,ETDopportunities,toolsoftradeandConditionsofServiceingeneral.
Duringthepreviousfinancialyear,theDFSCappearedbeforethePortfolioCommitteeonDefenceandMilitaryVeteranson21October2015.ThePortfolioCommitteethenmadeseveralconstructiveremarksfortheCommissiontoconsiderandtoacton,specifically:
• TheCommissionneeds to,asamatterofurgency,eitheroutsource the required researchcapacityorappointresearchconsultants.
• TheCommissionneedstoseekactuarialexpertisetoassistindraftingqualityrecommendationsthathavefinancialimplicationsfortheMinister.
Asaresultofthecostcontainmentmeasureswithsubsequentbudgetcutsthatwasinstituted,theacquisitionofconsultantsandActuarialexpertisecouldnotbeobtainedeventhoughstrongmotivationsforadditionalfundinginthisregardwaspresentedtotheDPBECduringJune2016.
TheDFSCiscognisantconcerningproperboundarymanagementandtakegreatcarenottooverstepintothedomainoftheMilitaryOmbud,byhandlingindividualgrievances.Insupportofthisnotion,theDFSCandMilitaryOmbudwillshortlysignaMOUtomanagesubmissionsforwardedtoDFSC.

TheHRcomponentwithintheSecretariatoftheDFSCwasseverelychallengedthroughoutthereportingperiod.TheDFSCismandatedintermsofSection62B(3)ofDefenceAmendmentAct,Act22of2010,to“…in consultation with the Minister, call upon any member of the Defence Force or employee of the Department to assist it in the execution of its functions, and such person is obliged to provide the necessary assistance”.Thissectionwithinitslegislatedmandate,assistedtheDFSCto,despitetheinadequateapprovedstructure,themoratorium/financialconstraintsposedbytheMinisterofFinanceontheexpansionofstructuresandtheprotractedDODappointmentsystems,toutiliseeight(8)DAPondetacheddutyforextendedperiodsandeight(8)ReserveForcememberstosupplementthestructureoftheSecretariat.
2. DEFENCE FORCE SERVICE COMMISSION: HUMAN RESOURCES STATISTICS
TheDFSCSecretariatwasestablishedintermsofsection62.IoftheDefenceAmendmentAct,Act22of2010,andprovidesadministrative,logisticalandsecretarialsupporttotheCommission.
TheDFSCSecretariathadaneventfulFY2016/17andcontinuestobeencouragedbythesupportandassistancefromtheDODandtheSANDF.TheDFSCbelievesthattheimportanceitplacesonrelationshipbuildingiscontributingtothesupporttheDFSCreceivesfromrelevantstakeholders.ItisworthnotingthatthestructureandthepostlevelsoftheSecretariatneedstobereviewedtoenabletheDFSCtoattractandacquirepersonnelwiththerequiredskillsandcompetencies.ItishowevercommendablethatthesenseofdutydisplayedbythemembersoftheDFSCSecretariatwaslargelypositive.
TheSecretariat isacriticalsupportarmof theCommissionwithspecificexpecteddeliverables. Indoingso, theSecretariatutilisesandreliesonprescribedDODprocessesandproceduresandthesupportandcooperationfromDODandSANDFofficials.

1. DEFENCE FORCE SERVICE COMMISSION EXPENDITURE
EventhoughtheDFSCformspartoftheDefenceVoteandisthereforeincludedinthefinancialreportingdonebytheSecDefandtheCFO,theCommissionremainsaccountableastohowandforwhatpurposesfundsarespenton.
TheDFSC,beinganOrganofState,reportstotheMOD&MV.TheDFSCscheduledweeklyBCCmeetingstoensureexpenditurewithintheallocatedbudgetcomplieswiththePublicFinanceManagementActandotherFinanceRegulations.AllexpenditureandFinancialAuthoritiesweretabledandapprovedbytheBCCpriortoprocurementandacquisitionprocesses.Inextremesituations,expenditureandfinancialauthoritieswereapprovedoutsidethemeetings,butcondonedatthenextBCCmeetings.
TheDFSCheld20quoratedandminutedBCCmeetingsoverthereportingperiodthatensuredeffectivemanagementandcontroloftheallocatedbudgetandfinancialdelegations.
TheDFSCwasallocatedatotalbudgetvoteofR12550859fortheperiodunderreview.ThisinsufficientallocatedvoteofR8690028forItem10HRBudget,andR3860831fortheOperationalBudgetwithinItems15to60necessitatestheCommissiontomotivateforadditionalfundingattheDPBECinJune2016.Theonce-offamountofR750000wasawardedtowardstheOperationalBudgettofundtheCivilMilitaryRelationConferencehostedbytheDFSCinOctober2016,whichincreasedtheBudgetVotetoR13300859.
TheDFSCwasabletospend94.57%ofitsallocatedHRbudgetduringtheperiodunderreview.ThedeviationwasaresultofthedelayedDODstaffingprocessesofmembersinfundedvacantpostsduetovettingbyDefenceIntelligenceandSAQAprocesses.ThefundsofthesevacantfundedpostswereutilisedtocallupeightReserveForcemembersthroughouttheyeartoassistincriticalvacanciessuchasresearch,driversandspecialprojects.AnamountofR1984069.35wasspentontheremunerationoftheseReserveForcemembers.
DFSCspent94.41%ofitsoperationalbudgetandreachedanoverallexpenditureof94.51%ofitstotalbudget.

2. EXPLANATORY REMARKS RELATING TO UNDER-EXPENDITURE
TheDFSCsubmittedFAsontimefortheprocurementofgoodsandservices,butpaymentsweredelayedduetoprotractedprocurementandpaymentprocesses,whichresultedinunder-expenditure.
TheDFSCcouldnothonourfinancialcommitmentstotheamountofR169441beforetheendofthefinancialyear.Thesecommitmentscouldnotbepaidwithintheprescribedperiodforwhichfinancialauthoritywasgranted.
During2014withthecompilationof theDFSCAnnualPerformancePlanFY2016/17,theDFSCenvisageda fullystaffedSecretariatcompliment.ThestructureoftheDFSCSecretariatwasnotfullystaffedduringtheperiodunderreviewandtherequirementtoutiliseReserveForcemembersincriticalsupportfunctionsbecameevident.NobudgetwasallocatedonItem10HRReserveForceWages.AnamountofR2034650oftheallocatedbudgetwasreallocatedwithinItem10bymeansofaChangetoPlan.AtotalamountofR1984069.35wasutilisedfortheremunerationofReserveForcemembers.AnadditionalamountofR20821wasalsopaidtowardsservicebonusesfortheReserveForcemembers.TheimplicationisthattheDFSCpaid97.51%ofthereallocatedbudgettowardstheremunerationoftheReserveForcemembers.Onememberclearedoutamonthbeforehisofficialcontinuouscallupperiodexpiredwhichresultedintheunderspendingofthe2.49%onItem10ReserveForceWages.
TheDPBECapprovedaonce-offadditionalfundingtotheamountofR750000(Item15)towardshostingaCivilMilitaryoffadditionalfundingtotheamountofR750000(Item15)towardshostingaCivilMilitaryRelationsConferenceinOctober2016.

ANNEXURE 1INTERIM REPORT ON CONSULTATIVE VISITS TO SOME MILITARY UNITS/BASES IN THE EASTERN CAPE CONDUCTED FROM 22-25 AUGUST 2016
1. TheDefenceForceServiceCommission(DFSC)undertookaconsultativevisittothefollowingunitsintheEasternCapeoveraperiod22-25August2016:

2. TheCommissioninteractedwithmembersoftheSANDFacrossallrankgroupsintherespectiveunits,exceptfortheAirForceStation.Membersraisedissuesofconcernduringtheinteractionsessions.AlthoughtheCommissionnotedsomeoftheseconcernsraisedbymembers,itcontinuedtocorrectfalseperceptionslevelledagainsttheSANDFleadership,andimpressuponthemtorespectCommandandControl,whichisanintegralpartofthemilitaryculture.ThereforetheissuespresentedasfindingsareviewedbytheCommissionashavingmerit.
FINDINGS WITH SOLDIER’S COMPLAINTS, CONCERNS AND FRUSTRATIONS
3. Someoftheissuesthatwereraisedbythemembersintheabovementionedunitsarecommonacrossthirtyone(31)unitsalreadyvisitedbytheCommission.Thefollowingaresomeofthecommonfindingsthatcontinuetoberaised,butthelistisnotconclusive.However,theCommissionisconcernedabouttheissuesraisedanditthereforedecidedtoissuethisinterimreport:
a. Transfer and Promotions. Most members are not opposed to transfers and understand that they cannot bearea-bound,howevertheyareconcernedthatthemanner inwhichtheprocessof transferswithintheSANDFoccurs,doesnot take intoconsideration thesocio-economiccircumstancesof themembers, in relation to thewell-beingofthetheirfamilies.Themembersarenotinformedaheadoftimeabouttheirtransfers,inordertogivethemopportunitytoplanproperlyfortherelocationofthefamily,whichincludessecuringschoolsfortheirchildren.Membersmentioned that theyareoften transferredwithoutproperly arrangedand securedmilitaryaccommodation to the areawhere theywill be stationed, and are left to rent accommodation that putmoreeconomicstraininthemember’sbudget.Prospectsoftransfersarenotcommunicatedaheadoftime,andimpactsnegativelyonthepossibilityofgettingformalemploymentforspouseswhentransferred.TheCommissionwasinformed that somemembers could not handle the socio-economic strain of transfers, which often result inmembersexperiencing instabilitywithintheir families,anddivorce,notseeingthechildrengrowup,andevenresortingtosubstanceabuseasawayofdealingwithstress.
“IfIdonotaccepttobetransferredduetofamilyorfinancialreasons,Iamlabelledasnon-transferable’,meaningthatIwillneverbetransferredevenifthereisavacantpostintheunit.”

b. Promotions. Members raised concerns regarding the criteria used to identify members that are eligible andqualifiedforpromotiontohigherranks.Therearemembersthatarecoursequalifiedbutcouldnotbepromotedduetolackofpromotionalranks,andremainstagnatedintheircurrentpostsandranksformorethanten(10)years,withouttheprospectsofpromotion.Thereareperceiveddiscriminatorypracticesraisedbythemembersinidentifyingmembersthatareeligibleforpromotion,and/ornominatedtoattendmilitarycoursesthatwillmakethemeligibleforpromotion.Sometimesmembersarerecommendedforpromotiontohigherranksonconditionthat themember relocates fromoneprovince toanother,where thevacancyexists. Itoftenhappens that theapprovedmemberisunabletorelocateduetoageandorsocio-economicfactors.Thelatter-mentionedfactorsresultsinmembersnotacceptingthepostcitingreasonsofbeingarea-boundduetolatter-mentionedreasons,whicharethenheldagainstthememberbytheircareermanagers.
“Iam37yearsasaPrivateintheDefenceForcesowhatpensionwillIretirewith.”Thishasresultedinsomememberstoreachtheceilinganddon’tqualifyfor2%salarypayprogression.
c. Accommodation.Theshortageofquality,aswellasthedilapidatingstateofmilitaryaccommodationinmostoftheunitsisnotconduciveforhumanoccupation.Atsomeunitstoiletsarebrokenanddysfunctionalandcannotbeproperlyflushed,posingaserioushealthrisktotheoccupants.
Forinstance,theCommissionwitnessedatsomeunitsopenplanswithoutdoorstodemarcatethesleepingareafromthebathroomandtoiletarea.Mostmembersinthelowerranksareexposedtotheseconditions,andtheyarefrustratedbythefactthattheydonothavetheeconomicmeanstoaffordandsecurealternativeaccommodation,especiallythosewhoweretransferredtootherunitsfarawayfromtheirfamilies.
Thepredicamentfacedbythesememberswhentryingtoacquirealternativeaccommodation,iswhentheyaretoldbygovernmentandfinancialinstitutionsthattheyearntoomuchtoqualifyforanRDPhouseand/orearntoolittletoqualifyforamortgagebond.TheCommissionisconcernedthatthestandardandqualityofaccommodationthatisnotconduciveforhumanoccupation,posessafetyandhealthhazards/risks.
d. Musketry(ShootingExercises).TheCommissionisextremelyconcernedthatmanymembersoftheSANDFdonotattendshootingexercisesasregularlyastheyaresupposedto.Mostmembersinthevisitedunitshaveexpressedconcernthattheylastwentonashootingexercisetwotothreeyearsago.TheCommissionisconcernedaboutthecalibreandthequalityofthesoldierthattheSANDFwouldliketodevelop,ifnotexposedtoregularshootingexercises.DFSCisoftheopinionthatinabilityoftheSANDFtoensurethatsoldiershaveregularlyshootingpractice,defeatstheprincipleofalwaysbeingcombatready.Itisofseriousconcernthatguardsaresometimesnotarmedasthisexposethemembertopotentialharmandisanincreasedsecuritythreat.
e. MedicalFacilitiesandSupply.Thereis lackofmedicalfacilities(sickbays)withinsomeoftheunitsoratcloseproximitytotheunits.MembersareexpectedtotravelfromPortElizabethtoeither2MilintheWesternCapeortotheextremeto1MilinPretoriaformedicalattention.Somesickbayswithintheunitsdonothaveadequatemedical supplies, and that exacerbates unhealthy status of themembers. Provision of health care should beprimaryintheSANDFtoensurehealthyandfitsoldiers.TheCommissionisconcernedthatmembersareoftenrequiredtoutilisepublictransportattheirowncosttoaccessthesemedicalfacilities.TheCommissionisfurtherconcernedwiththecontinuedutilisationofstudentdoctors,whoarenottrainedandcompetentenoughtodoproperdiagnoses,orconductcomprehensivehealthassessmentsformembersgoingondeployment.

“IhadtotransportmywifefromPEto2MilHospital justtogetaninjectiononherarmatacostofR5000,becausetherewasnoqualifiedandcompetentmedicaldoctortoadministerthemedicalprocedureinPE.”
f. Transport(DutyBusses).Thereisagrowingconcernacrosstheunitswithregardtothelackand/orinadequacyofdutybusses. Someof theunitshavevehicleswith90%of thefleeteitherbeyondeconomic repairand /orunserviceable.Membersoftheunitsareoftenrequiredtousetheirprivatevehiclestoreportfordutyonadailybasis,withthedimprospectsofbeingreimburseddueto insufficientbudget. Insomeinstances,vehiclesfromoneunitareexpectedtoserviceotherunits/baseswithincloseproximity,e.g.ASBPEservicingNavalStationPE.ItisincumbentoftheSANDFleadershiptoensurethatsoldiersareprovidedwithreliablemilitarytransportation,withouttheoptionofusingpublictransportwhileonduty.
g. MilitarySkillsDevelopmentSystem(MSDS).MembersareconcernedthattheMSDSsystemthatwasintroducedasasystemtocreateemploymentandalleviatepoverty,isnotlivinguptoitsexpectations.MSDSmembersareconcernedthat theyarenotgivenopportunity for furtherEducationandTraining,or that theyareexposedtotrainingopportunitiesthatarenotaccredited.UnaccreditedcourseswouldnotberecognizedoutsidetheDODandthathasadverseeffecttotheopportunitiesthatthemembershouldhavebeenexposedto,ifnottakeninaftertwoyearsintotheCoreServiceSystem.TheCommissionisawarethatnotallMSDScanbegivenopportunitiestoattendcoursesthatareaccredited,sothattheycanstillusetheacquiredknowledgeandskillsoutsidetheDOD.
h. Integration.MembershaveexpressedconcernthatthereisnoallegedintegrationwithintheSANDF.Itisperceivedthatthecriteriatopromotememberstohigherranks isnotbasedontherequiredskillsandcompetencies,butinfluencedby the former force thatonebelonged toprior to integration.The latter furtheraffects themannerinwhichmembersarenominatedtoattendpromotionalmilitarycourses.ThemembersareconcernedthatthediscriminatorypracticesareexacerbatedbythecurrentForceNumberSystemthatcategorisesmembersaccordingtoformerforce.TheCommissionisconcernedthattheplacementsandpromotionswithintheSANDFthatarenotbasedonskillsandcompetenciesbutonformerforce,contributestolowmoraleandill-disciplinewithintheSANDF.
“Itis22yearsafterdemocracy.Wedonotneedthisinourforceanymore.”
i. ReserveForceMembers.Membersareconcernedthatthe‘OneForceConcept’toensurethatthereisparityintermsof someconditionsof service forbothReserveandRegular forcemembershasnotbeen implemented.MembersraisedconcernsthattheyarenottreatedfairlyasReserveForcemembers,andareoftenvictimisedandpenalisedforseekingopportunitieselsewheretoimproveandenhancetheirskills,evenwhenthatopportunitywillimprovetheiremploymentconditionsofbecomingaRegularForcemember.
j. ImplementationoftheDefenceReview.TheCommissionwasapprisedbyconcernsraisedbymembersoftheSANDFregardingtheimplementationoftheDefenceReview2015.ThemembersbelievethattheDefenceReviewisthesolutionandananswertoaddressthedecayingstateandpostureoftheDefenceForce.Theycitedthatiffundedproperlyandmilestonesare fairlyandhonestly implemented, itwilladdress the ‘AgingDefenceForce’throughproperrejuvenationstrategyandpropersuccessionplanning.
k. ExternalDeployments.Membersdeployedonexternalmissionsareconcernedwiththelackofaneffectivesupportstructuretofamiliesofdeployedmembers,beitthesocialworkservicesorchaplaincyservices.Someofthemembersthathavebeendeployedandeligibletoutilisetheir10daysdeployment leave,areoftennotsupportedbytheirrespectiveCommanders intermsof logisticalandtravellingarrangements.Theyareoften lefttomaketheirowntravellingarrangementstovisithis/herfamilybackhomeoraspousevisitingthemember,attheirowncost.

l. Structure. Most of the SANDF Units are gravely understaffed, and the looming budget cuts will worsen thealreadydiresituation.Thelatteraffectthepromotionandmobilityprospectsofthememberadverselyandfoundthemselvesstuckinonerankfromten(10)totwenty(20)years,duetounfundedvacanciesthatcannotbestaffed.TheCommission is concernedwith the extra ordinary amountof stress onmembers having to copewith theworkloadof2-3people.
“Membersarenowrequiredtodoworkofthree(3)orfour(4)people.Soonerorlaterwecannotcontinueinthismanner.”
m. This report serves as an interim Report to highlight some of the common challenges with regard to member’sconditionsofservice,whichwouldrequireimmediateinterventionforimprovement.AlthoughadetailedreportwithrecommendationswillstillbesubmittedtotheMinisterofDefenceandMilitaryVeterans(MOD&MV),theCommissionkindly requests an audiencewith theMOD&MVand theMilitary CommandCouncil (MCC) to further discuss thisinterimreport.

MajGen(Ret)Holomisa(MP)co-foundedtheUnitedDemocraticMovementin1997andcurrentlyservesasitsPresident.WithinaperiodoftwentymonthssincetheUDMwasestablished in1997,hetogetherwith13othermembersofthePartywereelectedtotheRSAParliament.HewasaformerCommanderoftheTranskeiDefenceForce(TDF)andHeadoftheTranskeigovernment(formerindependenthomelandbetween1987and1994),uptothefirstdemocraticelectionsinSouthAfricain1994.HewasoneofthefirsttwoblackpersonsacceptedbytheSouthAfricanArmyCollegetodoaoneyearseniorstaffcourseforofficersin1984.Between1988and1989thegovernmentledbyMajGen(ret)Holomisaunbannedapproximately33organizationsthatwerebannedbyhispredecessors,andhisgovernmentcontinuedtoworkcloselywiththeliberationmovements.Asaresult,TranskeihadasmoothtransitionpriortotheSouthAfricannationalelectionsin1994. Since1989,hehas travelledandaddressed variousinternationalforumsaroundtheworld,amongothertheUnitedNationsSecurityCouncilontheneedfortheUNtomonitorviolenceinSouthAfrica.TheIndependentElectoralCommission(IEC)requestedhimtoactasamonitorintheJune2007electionsinEastTimor.Withhismilitary,securityandadministrativeskillsandknowledge,hewasappointedtotheInterimNationalDefenceForceServiceCommission(INDFSC)in2009.In2013,hewasappointedasDeputyChairpersontothefirstPermanentDefenceForceServiceCommission(DFSC).

Professor Malegapuru William Makgoba (born 1952 in Sekhukhune, South Africa) is a South African immunologist,physician,publichealthadvocate,apioneerinhighereducationtransformation,anacademicandformerVice-ChancellorandPrincipaloftheUniversityofKwaZulu-Natal.
Aninternationally-recognisedmolecularimmunologist,Makgoba'sresearchhasmadeseminalcontributionstoidentifyingandunderstandingthecellsurfacemoleculesandgenesimportantinthehumanimmunesystem'sresponse.AsagloballeaderinHIVvaccineresearch,ProfessorMakgobaservedintheleadershipoftheSouthAfricanAIDSVaccineInitiativeasthefoundingchairoftheUNAIDS/WHOAfricanAidsVaccineProgrammeandasafoundingmemberoftheGlobalHIVVaccineEnterprise.

TheeThekwiniLivingLegendsAwardwasawardedtoProfessorMalegapuruMakgobaforhiscriticalcontributiontothefieldofmedicine.TheAwardsacknowledgeindividualswith‘outstanding achievements, and those who have demonstrated a sustained and extraordinary contribution in various categories of expertise’.
ProfessorMakgobahasbeenawardedtheMRCPresident’sAwardforExceptionalContributionstoMedicalResearch.TheAwardwasmadeinrecognitionofhisexceptionalcontributionstomedicalresearchandisamongthehighesthonoursbestowedbytheMRC. In2015,hewasinauguratedastheCommissioner inthefirstpermanentDefenceForceServiceCommission.

ShewastrainedinMilitaryCombatWorkbytheEastGermansecretserviceStaci,andthereafterincounterintelligencebytheSovietKGB.ShewasdeployedinBotswana,screeningnewrecruitsintotheANC,guidingMKfreedomfightersfromZambiaintoBotswana,andsecuringsafehouses.Declaredpersonanongrataunderpressurefromtheapartheidregime,shewasredeployedtoMozambiqueandSwaziland.There,sheenrolledincognitointheUniversityofSwaziland,studyingBASocialScienceandrunningaweapontrailfromMaputotoSwaziland,untiltheentirestructuresofMKwereraidedbyapartheidagents.

MsMvelaseistheappointedGroupExecutiveresponsibleforStakeholderManagement&IntegrityintheSouthAfricanRevenueServices.SheservedastheHeadofIntegrityManagementUnitintheNationalProsecutingAuthority.ShewasalsotheExecutiveOfficerHumanResourcesattheJohannesburgPublicSafetyDepartment,andworkedasaProjectMemberoftheMetroPoliceTeam,whichestablishedtheJohannesburgMetroPoliceDepartment.In2013,shewasinauguratedasaCommissionerinthefirstpermanentDefenceForceServiceCommission(DFSC).
10. MR I. ROBERTSON: COMMISSIONER
Mr IanRobertsongrewup in Johannesburgat theheightofNational PartyApartheid rule.With adeep seatedmoralconsciencetofurtherthecauseofajustAfricansociety--andatgreatcostofcommunityostracisation--hebecamepartofasmallgroupofwhiteSouthAfricanswhopubliclyopposedApartheid.MrRobertsonjoinedtheANCundergroundintheearly1970’stofightforthecountry’sliberation.Houndedbytheapartheidstate,hehadtoleavethecountryweeksbefore completinghis BAatWits and lived in exile formore thannine years.While in exile he continued serving theliberationmovementinavarietyofroles.Hisworktookhimtomanycountriesaroundtheworldwherehelearntaboutdifferentsystemsofgovernance.HejoinedUmkhontoWeSizwein1985andunderwentvariousmilitaryandintelligencetrainingcoursesbothinAngolaandtheSovietUnion.MrRobertsonwaspartofanMKunitthatenteredthecountryin1987.EventuallyhewasarrestedbytheApartheidpoliceandsentencedtoatwentyyearjailtermforhisinvolvementintheliberationstruggle.
Mr Robertson was granted amnesty as a result of the negotiation process between the ANC and the National PartyGovernmentin1991.UponhisreleaseheimmediatelyjoinedaMilitaryResearchOrganisationcalledtheMilitary Research GroupwhichwasestablishedtoclosethegapbetweentheoldSADFandthenon-statutoryforceswhilstworkingfulltimefortheANC.HecompletedcoursesattheWitsSchoolforPublicandDevelopmentManagementinSecurityManagement,aswellasathreemonthcourseininternationaldiplomacyundertheDutchForeignMinistryattheKlingendaelInstituteinTheHague.

ANNEXURE 6CODE OF CONDUCT FOR PUBLIC SERVICE ACT PERSONNEL IN THE DEFENCE FORCE SERVICE COMMISSION
1. RELATIONSHIP WITH THE LEGISLATURE AND THE EXECUTIVE
Anemployee–
1.1 isfaithfultotheRepublicandhonourstheConstitutionandabidestherebyintheexecutionofhisorherdailytasks;
1.2 putsthepublicinterestfirstintheexecutionofhisorherduties;
1.3 loyally executes the policies of theGovernment of the day in the performanceof his or her official duties ascontainedinallstatutoryandotherprescripts;
1.4 strivestobefamiliarwithandabidesbyallstatutoryandotherinstructionsapplicabletohisorherconductandduties;and
1.5 co-operatewith public institutions established under legislation and the Constitution in promoting the publicinterest.
2. RELATIONSHIP WITH THE PUBLIC

4.12 honourtheconfidentialityofmatters,documentsanddiscussions,classifiedorimpliedasbeingconfidentialoresecret.
5. PERSONAL CONDUCT AND PRIVATE INTERESTS
Anemployee–
5.1 duringofficialduties,dressesandbehavesinamannerthatenhancesthereputationofthePublicService;
5.2 acts responsibly as far as the use of alcoholic beverages or any other substancewith an intoxicating effect isconcerned;
5.3 does not use his or her official position to obtain private gifts or benefits for himself or herself during theperformanceofhisorherofficialdutiesnordoesheorsheacceptanygiftsorbenefitswhenofferedasthesemaybeconstruedasbribes;
5.4 doesnotuseordiscloseanyofficialinformationforpersonalgainorthegainofothers;and
5.5 doesnot,withoutapproval,undertakeremunerativeworkoutsidehisorherofficialdutiesoruseofficeequipmentforsuchwork.
