ATTACHMENT 5 OF 5: Summary of Applicant's Justification DV18.108 - LOT 395 (NO. 114) ROSEDALE STREET, FLOREAT APPLICANT'S JUSTIFICATION The proposed residence allows a stepped progression of the front setback within the streetscape (Rosedale Street) with the existing new northern property setback 4.5m, our proposal at 6m and the existing old southern property at 10.5m. The 7.5m Front setback allows for better utilisation of the site area, with external living areas concentrated to the rear north facing aspect, this compensates for the narrowness of the rear of the block, providing more usable and well oriented outdoor living spaces. The building height is predominately single storey and significantly below the maximum height allowance, this enhances the streetscape and is in keeping with the vernacular of the Floreat Precinct. This also reduces visual bulk to the adjoining neighbours by not implementing a predominately two storey scheme. Utilising an undercroft garage which is setback 8.5m further strengthens the residences connection to the vernacular. The proposal seeks to retain the natural contours of the site where possible to conceal the undercroft further diminishing the scale of the residence All adjoining neighbours have been consulted and the north and south Rosedale Street neighbours have provided sign-off on the proposed 6m front setback. Setbacks The proposed residence has been designed to achieve the mandatory building setbacks in accordance with the R-Codes and the Town of Cambridge, Town Planning Scheme Policy Manual (TPSPM). Refer to attached drawings with neighbours sign-off. Front / Streetscape: To maintain the amenities and openness of the streetscape, the main building is setback 7.5m from the front boundary, furthermore the garage is setback 8.5m, the overall appearance of the garage meets the requirements of the TPSPM, to achieve a garage form that isn’t visually dominant from the street. A street facing balcony with breeze block screening has been incorporated into the design to promote interaction and visual surveillance of the street without affecting the amenities of neighbouring properties. The front landscaping looks to minimise the amount of hard surfaces and enhance the presentation within the street setback. Landscaping consist of low, medium and high density landscaping, distributed across the front to soften and reduce the visual bulk of the proposed residence. Side Setbacks: The side setbacks are in accordance with the performance criteria of the R-codes requirements ensuring the amenities of adjoining neighbours is maintained, with considerations to solar access, ventilation, privacy and visual bulk. Some minor variations form the Deemed To Comply provisions are proposed along the South boundary to improve the effective use of space on the site whilst not imposing any additional impact on the Southern neighbours amenity. The following has been proposed to offset the impact of the reduced setback:

limit (Refer to Drawing A009) minimising visual bulk and overshadowing. - The reduced setback has been positioned adjacent to existing neighbouring driveways

and sheds to minimise impact of visual bulk and overshadowing.

Rear Setback: The rear setback is in accordance with performance criteria for 5.1.3 Lot Boundary Setback of the R-codes ensuring the amenities of adjoining neighbours is maintained, with considerations to solar access, ventilation, privacy and visual bulk as follows: - A 6m setback would provide a rear open space of 77m2, by reducing this to 3 m and

increasing the north boundary setbacks significantly to between 5Am - 6.3m, a much greater North open space area of 171 m2 is achieved. This also reduces the amount of lost space a typical side setback would produce improving the effective use of space.

- By utilising a larger setback to the Northern boundary greater access to direct northern sun and ventilation is achieved to both the internal and external living areas

- Total open space for the site is greater than the required 55%. - Maintaining a single storey for the majority of the site improves the amenity of the

neighbouring properties by reducing visual bulk and allowing better access to natural light and ventilation. This also improves privacy by removing the potential for overlooking into neighbouring properties that a two storey home would impose.

- The predominantly single storey residence enhances the prevailing development context of the locality.

- Future development of adjacent properties will benefit from the single storey nature of the home affording them the ability to access views to Bold Park and the adjacent bushland to the West via either a second storey or roof deck.

- Properties to the Rear (East) and South are predominately occupied by sheds in the areas adjacent to the rear setback area and thus there is no adverse impact on the amenity of these structures.

- Refer to Drawing A011.

Open Space - Open space is greater than the required for zone R 12.5 of the R-Codes open space

requirements of 55%. Refer to A004.

Building Height - The building is designed significantly below the height restriction, thus presenting

minimal bulk and scale to the neighbouring sites and street elevation, supporting the scale and balance of the existing streetscape. Refer to drawing A009.

Overshadowing - Overshadowing of the neighbouring block to the South is less than the maximum 25% of

the site area at 12 noon on June 21st. Refer to drawing A011.

Privacy and overlooking - The cone of vision diagram prepared for this application indicates that the design

complies with privacy and overlooking requirements of the R-codes. Refer to drawing A011.
