DEED OF UNDERTAKING
KNOW ALL MEN BY THESE PRESENTS:
I, ROSALINDA G. CARIO, of legal age, married, and a resident of
Pagdaraoan, San Fernando City, La Union, Philippines, after being
sworn to in accordance with law, depose and state:
1. That I undertake to buy for SPS. RUFINO BADUA and ELSIE
GASCON-BADUA the following parcels of land:
TCT No. 025-2010001590A parcel of land (Lot 737-A, being a
portion of Lot 737 Cad. 739-D, San Juan Cadastre plan
Csd-01-013016-D, LR Case No. 2521, LRA Record No. N-75681) situated
in the Brgy. Ili Norte, Municipality of San Juan, Province of La
Union, Island of Luzon. Bounded on the NW., points 1-2 by lot 1221
(Road Lot) (Lot 10, Pcs-1-00064, Eastmont Enterprises Inc., on the
NE., points 2-3 by Lot 738, Lot 4, Psu-249784, Artemio Esperanza;
on the SE., points 3-4 by Lot 737-F-Lot 19273 Road Right of Way

situated in the Barangay of Ili Norte, Municipality of San Juan,
Province of La Union, Island of Luzon. Bounded on the North by Lot
36; on the East by Lot 37, on the South by Lots 40, 39, 38, and on
the West by Lot 42. Containing an area of NINETY NINE (99) SQUARE
METERS.
Lot 737-D (Road Right of Way)A parcel of land (Lot 737-F)
situated in the Barangay of Ili Norte, Municipality of San Juan,
Province of La Union, Island of Luzon. Bounded on the North by Lot
41; on the East by Sec. 0008, on the South by Lot 51, and on the
West by Lot 38, 41. Containing an area of FORTY SEVEN (47) SQUARE
METERS.
2. That I declare that the money to be given as price or
consideration for the buying of the above described properties is
given by SPS. RUFINO BADUA and ELSIE GASCON-BADUA;
3. That I further declare that the true buyer of the above
described properties are RUFINO BADUA and ELSIE GASCON-BADUA;
4. That I further expressly undertake to redeliver the physical
possession and ownership through the execution of a deed of
transfer or conveyance of the above described properties to SPS.
RUFINO BADUA and ELSIE GASCON-BADUA in good, clean, and free from
any and all occupants and encumbrance after the full transaction
for the sale of the above described parcels of land;
5. That should I fail to comply with the above-mentioned
undertakings, then SPS. RUFINO BADUA and ELSIE GASCON-BADUA, their
duly authorized representatives or any person acting in their
behalf, shall have the right to immediately enter and take
possession of the above described parcels of land, with full power
and authority to open, enter, repossess, secure, enclose the means
of entrance and exit, and otherwise take full and complete physical
possession and control of the premises, without need of any further
notice or demand or proceeding in court, holding in trust and
custody all our belongings found therein after an inventory of the
same is made in the presence of a witness, all these acts being
hereby agreed to by me as tantamount to my voluntary vacation of
the subject house and lot without necessity of any further action
in court;
6. That the above undertakings shall also be valid and binding
on all the members of my family, heirs, agents, representatives,
successors, and assigns.

ACKNOWLEDGMENT
BEFORE ME, a Notary Public for and in the City of San Fernando,
Province of La Union, personally appeared ROSALINDA G. CARIO,
personally known to me and whom I have identified through competent
evidence of identity as noted and who represented to me that her
signature on the foregoing instrument was voluntarily affixed by
her for the purposes stated in the instrument and who declared that
she has executed the foregoing instrument as her free and voluntary
act and deed.
This Instrument consists of only three pages, including this
page in which this acknowledgment is written, duly signed by
ROSALINDA G. CARIO and her instrumental witnesses on each and every
page hereof.
