The Colorado Department of Public Health and Environment (Department) previously provided the following recommendation to the Colorado Oil and Gas Conservation Commission as a result of the consultation requested by Garfield County on URSA’s BMC B well pad and the Class II injection well. “URSA’s BMC B well pad includes a Class II injection well with six produced water storage tanks that the Department believes creates a significant contamination risk to the public water supply for Battlement Mesa. The Battlement Mesa Water Treatment Plant has a raw water intake structure in close proximity to this proposed well pad creating an unnecessary long- term risk for a spill or release to potentially impact the public water supply. This risk will persist for many years, and will continue as additional well sites are developed in Battlement Mesa area. There are options available when determining a location for a Class II injection well and the Department believes Class II injection wells should not be located in Urban Mitigation Areas. After considering the long-term risk to the public water supply and the flexibility available to the Operator when locating Class II injection wells the Department recommends that the COGCC deny the permit for the injection well and the associated storage tanks on the URSA BMC B well pad.” This recommendation has not changed and the Department believes URSA has not adequately demonstrated why this location, in close proximity to a drinking water intake, must be used for an injection well. recommend that Garfield County require URSA to provide an alternative analysis investigation specifically for potential locations of any proposed injection well. URSA has already provided an alternative analysis for the well pad as part of the original COGCC permitting process that included an existing surface use agreement covering the location of wells and production facilities and including discussion on the technical capabilities to reach the minerals. However, reaching the mineral resources is not a deciding factor when locating an injection well. There are options that should be considered when selecting a location for an injection well and the Department believes that alternative injection well locations should be evaluated to reduce the potential for accidental contamination to the Battlement Mesa public water supply. At the Monument Ridge/Watson Ranch receiving station, tanks overfilled due to malfunctioned high water alarms. During the night of 8/18/14, fluids dumps on the Monument Ridge pad directed produced water to the Monument Ridge/Watson Ranch receiving station. During the initial investigation in the early morning of 8/19/14, it was determined that high water alarms at the receiving station malfunctioned and allowed the tanks to overfill. Produced water overfilled the lined secondary containment and impacted soils on site, as well as approximately 30ft off the location to the west/northwest. Upon discovery, the wells on Monument Ridge were shut in and vac trucks were dispatched to the location to begin recovering the liquids. It is estimated that 200 bbls was captured and recovered within the secondary containment, 56 bbls impacted soils on the Monument Ridge/Watson Ranch receiving station, and 1.6 bbls impacted soils off site. At 10:58 pm on May 6,2016 (Friday) Briggsdale Fire Department received a call about the Wildhorse SWD smoking. At 12:13 am on May 7, 2016 BNN operator Adam Perez recieved a call from Whiting pumper Steve West about the possibility of a fire at the Wildhorse SWD. At 12:34 am Adam Perez arrived on location and confirmed that Wildhorse was on fire. Firefighters on location said that the fire was caused by lightning. The site has an incoming pipeline for delivering produced water and that line was sut down by closing valves. The pipeline was not damaged. The main power into the site was turned off and it appears that the building that houses the electrical gear and injection pumping equipment was unharmed. The injection well head was undamaged becasue it is located several hundred yard away.

The fire consumed the two seperation tanks and 12 fiberglass water tanks as well as associated items (staircase, pipe, valves, etc.) There are 12 other water tanks adjacent that were blackened by the fire but remained standing. The two steel oil tanks were also blackened but left standing. The fire was not full extinguished until the morning of May 7th (Saturday).

The fire was caused by a lightning strike. The facility was equiped with a lightning protection system but it did not protect the facility. Form 19 was submitted by BNN on Saturday May 7, 2016.

At approximately 7:00 AM on Wednesday, March 23, 2016, a lightning strike ignited three, 400 bbl fiberglass water tanks located at theNapali #1 SWD facility. Power was lost and the well was shut in. Operator personnel immediately notified the fire department and theCOGCC local inspector was notified at about 8:08 AM. The fire department extinguished the fire. Lincoln County Sherriff personnel and county hazmat personnel were also on the site. The existing battery berm contained all fluids. The operator has ordered metal containment and a liner to be installed when the site is rebuilt.

The injection well and its associated equipment was not damaged.
