It has been my privilege and honour to havebelonged, for nearly three decades, to the BharatPensioners Samaj which is the biggest and oldestpensioners’ organization in India. On its behalf, lextend my greetings to the respected Chief Guest,esteemed Special Guests of Honour & SpecialInvitees and all our esteemed Delegates to this61 st AGM of this All India Federation of over 680Pensioners’ Associations from all over theCountry. BPS has to its credit severalachievements for the pensioner community oversix decades since its foundation in 1955 by JusticeShankar Saran (Retd) of Allahabad High Court.Bharat Pensioners Samaj has played a significantand leading part in the Standing Committee ofVoluntary Organizations (SCOVA) ever since itwas established by late Shri Rajiv Gandhi in 1985.From the 4 th Central Pay Commission (effective1.1.1986) we were able to get Dearness Reliefon the same pattern and same levels asDearness Allowance for the serving employeesand with a fitment @ 20% increase over basicpension. Even though the Vth and Vl CPCsrecommended the same 20% fitment formula, wecould get an enhanced fitment increase of 40%due to the personal intervention of Prime MinisterInder Kumar Gujral and Home Minister IndrajitGupta in 1997 when the Vth CPC wasimplemented. But the more substantial gain thatwe could get from that CPC V was “modified parity”with the past pensioners whereas, our demandfor which we had been agitating for long, was forfull parity. But we graciously accepted whatever(i.e., partial parity) was presented to us on theplate as the Chairman Justice Pandian told us tobe patient on this account as they were introducinga new policy which could be enhanced by thefuture Pay Commissions. Similarly, we got thefitment enhanced to 40% again in 2008 under theUPA-I Government led by Dr Manmohan Singh.From the Vth CPC, we also got, for the first time,the Fixed Medical Allowance of Rs. 100 per month.Similarly, we were able to persuade the then Uniongovernment (UPA-ll) to announce the formationof the Vlth CPC in March, 2014, nearly two yearsahead of the agreed date of implementation witheffect from 1.1.2016 as recommended by the VthCPC in 1997. The Vlth CPC acceded to another

long-pending demand for grant of “additionalpension” for the older pensioners. As is now well-known, we got 20% increase at 80, 30% @ 85, 40% @ 90, 50% @ 95 and 100 % @ 100. It alsorecommended a conversion formula of the newpension as on 1.1.2016 @ 2.57 fitment of the basicpension as on 1.1.2006, incorporating theassumed 125% DR as on 31.12.2015, ascompared to 2.26 times by the previous PayCommission. Acceding to our long-delayed butcrucial demand for grant of “full parity” (Option-1),another option was also recommended. Thepresent NDA government broadly accepted therecommendations of VlIth CPC which wereimplemented vide Gazette notification dated25.7.2016 and an O.M. dated 4.8.2016.

No organization can, or,should survive on laurels of its past achievements.The new challenges for us are: Full parity, asdescribed above, since the Government has sofar NOT agreed to implement Option-1, on theground that as its feasibility (according to theirfindings), is limited to 82%. But Bharat PensionersSamaj and the staff side of the NC JCM have toldthe Government that is positively feasible for the

I seek your kind permission to submit thisreport in this august house. Our 60 th AGM washeld at Amritsar on 29.11.2015. W ith a view toproviding more convenience to the participants,we have organized this AGM at Delhi in thespacious Mavalankar Hall in Constitution Club inspite of the high cost. I, on behalf of BPS, expressmy sincere thanks to all of you for coming all theway from different parts of the country and makingthis AGM a great success. I am also thankful toPunjab National Bank and M/s Portea Medical whoare co-sponsoring this 61 st BPS AGM.

As you all know, Federation Bharat PensionersSamaj is a non-political, non-profitable and non-governmental organisation with the sole missionthe Government that is positively feasible for the

remaining 18% too. W e also explained how it isfor the Government to get the commonmultiplication factor of 2.57 enhanced by revisionof minimum salary based on the hackneyed &colonial ‘family unit’ concept in the 1948 formulaof Dr Aykrod. Our third major challenge is to get afixed Medical Allowance of at least Rs. 3,000 forpensioners residing outside the CGHS areas.Similarly, we demand universal application of VllthCPC to the state Government Pensioners andremoval of the injustice to EPS 95 pensioners byway of reducing even their meagre minimumpension of Rs. 1,000 through the so-called proratasystem.

W e have also given an openinvitation to all other organisations with similarthinking to join with us as MOU partners/affiliates.

Bharat Pensioners Samaj submitted itsMemorandum to the 7 th CPC on 25.5.2014 raising24 issues relating to Pension & Healthcare.National Council Joint Consultative Machinery(NCJCM-Staff Side) also supported our demandsthrough their Memorandum. 7th CPC invited BPSon 23.7.2014 and again on 17.2.2015 fordiscussions on the demands raised. PayCommission listened to us very patiently with theirpositive response on several issues promptingus to have high expectations. The Commission

submitted its report on 19.11.2015. But alas!Inspite of the fact that the 7th CPC agreed to severalof our demands in principle, the final outcomehas not been very encouraging.

After the declaration of 7 th CPCrecommendations, the period between 60th tothis 61 st AGM has been very crucial with severalnew challenges thrown up. Alongwith severalother demands we had represented that wide gulfbetween minimum and maximum paid shouldbe narrowed down and brought back to 1.7.1996level of 1:8 and a common multiplication factor forrevision of pay and pension be worked out so thateveryone gets a uniform raise. BPS for the pastover 30 years has been struggling for 100% parityi.e. OROP for every pensioner. At the same time,we represented to the 7 thCPC (as also to earlierCPCs) also that there should be 100% paritybetween pre and post CPCs Pensioners. Insteadof reducing the gap this Commission furtherraised it to 1:13.88 and worked out 2.57 ascommon multiplication factor (CMF) for all, gave aparity formula through notional fixation of pay &accepted our demand for merging postaldispensaries with CGHS. Evidently, the Pay

case of pensioners it is 7,875/- to 9,000/- after agap of 10 years i.e. an increase of Rs.112.5 Peryear. This has happened because of incorrectcalculation of minimum revised salary resultednot only by adoption of lower prices ofcommodities but also due to adoption of Dr.Aykroyd formula of 1948 without updating it. It issurprising as to how a gender-biased 1948formula adopted by Indian Labour Conference(ILC) in 1957, without updating it, in the digitalIndia of 2016. In today’s scenario, how can theIndian Civil Society accept a formula for minimumrequirement which treats the lady of the house as0.8 unit compared to the adult male of the houseas 1 (one) unit. Further, this formula does not atall take into consideration the minimumrequirement of today’s 21 st century Digital Indiai.e. a smart mobile phone with an internetconnection, I Pad etc. Considering the wife to be.8unit is a gender bias indicating colonial mindsetof Dr Aykroyd. In the present scenario, a wife tooputs in the same amount, in fact rather more, ofphysical and intellectual work as compared to thehusband. She needs more nutrients andhealthcare to keep herself fit to be a mother anddispensaries with CGHS. Evidently, the Pay

Commission did in principle accept oursubmissions, regarding CMF and parity betweenpre & post 2016 retirees. But the multiplicationfactor of 2.57 is very much on the lower side. It isa ratio between minimum revised pay ofRs.18,000/- & existing minimum pay of 7,000/-which, after 10 years gives a raise of 14.29% i.e.1.429 % per year. Even for the existing employees,it comes to the same & even if, in case workingemployees, their 3% per year increment is added,it is a raise of 4.29 % per year which is not onlyhistorically low in past 70 years which any Govt.has given but also much less than that of anyPrivate sector enterprise. And yet, the mediacreated a big hype and thrown up false perceptionin the Civil Society that the pay of C.G. employeeshas been raised from Rs 7,000/- to 18,000/- andthat Pension is raised from Rs.3,500/- to 9,000/-which, according to them, was too much, ratherextravagant for the govt. employees whom theyconsider to be inefficient and what not! Forgettingthat raise is from Rs.15,750/- to 18,000/- and thatfinal take home advantage after deductions is onlyRs.500/- per month after 10 years. Similarly, in

healthcare to keep herself fit to be a mother andas an educationist for her school going children.She needs better clothing than 1957. A ladywhether she is a wife of a labourer or of a Secretaryto Govt. of India, has a basic right to keep herselfreasonably presentable for which she needssome minimum add-ons. As such treating her tobe less than a unit is gross injustice, gender biasand unconstitutional. Similarly, growing childrenof upto 14 years of age need more of proteins,fats & carbohydrates, need to take sufficientexercise & field activities for healthy growth. Todaythey need much better and more clothing, bettereducation & healthcare compared to the 50s. TheNation needs healthy and stout young citizens. Itis against the National interest to restrict theirneed-based minimum requirement to.6 unit. ThusBPS submitted a Memorandum to the Govt. thatthe Minimum Salary & correspondingly the fitmentbenefit of 2.57 need an upward revision. As ofnow, the Govt. has referred the issue to acommittee and the outcome is still awaited. BPSasks the media, the Civil society & the Govt that, ifgovt employees are/were not working then whohas been/is running the Govt, the Railways, the

On the issue of 100% parity

Similarly, in respect of Pensioners, BharatPensioners Samaj wants the media, the civilsociety, the Govt and all those who considerpension to be a burden on the exchequer tounderstand that existing pensioners were nevera burden on exchequer and that their pension isnot completely a non-contributory defined benefit.While in service, they contributed sufficiently welltowards their pension and it is their deferred wagewhich is now being paid after their retirement. Assignificantly pointed out by the Hon’ble SupremeCourt, Pensioners while in service let the Govtkeep 8.33% (with interest) of their salary everymonth and, by any conservative estimate,cumulatively today this amount stands at morethan Rs. 3,75,000/- crores. Over 33% pensionexpenditure can easily be met with the interest onthis amount.

As far back as 17.12.1982, ConstitutionBench of the Apex Court in case of D S Nakara vs

intentionally designed at lower level to cater forpension after retirement. (Chapter 2 page 22-24).Going down the memory lanes we remember thatduring our service lives whenever, the TradeUnions, on the basis of the equal work equal payformula, demanded parity in pay with PSUs, theGovt. replied that as pension is to be paid afterretirement, Govt. employees pay cannot be at parwith PSUs. The senior citizens’ corner in thepensioners’ portal of the Government of Indiareads as follows: “Senior citizens are a treasureto our society. They have worked hard all theseyears for the development of the nation as well asthe community. They possess a vast experiencein different walks of life. At this stage, they need tobe taken care of and made to feel special.” Trueafter independence, by the dint of their hard work,today’s pensioners have considerably contributedto whatever progress the country has made sincethen. Even today, pensioners make endlesscontributions to their families, communities andsociety. It is a deferred wage andthat pension should be such that pensioner isable to live with the ‘standard equivalent at pre-retiral level’….. (Para 184 of SC judgement,7th CPCPara 10.1.4 & Paras 127.3 to 127.6 of Vth CPCreport Part III). 5th CPC had appointed TECS (TataEconomic Consultancy Services) as consultantswho suggested 67% of the last pay drawn (LPD)to be the pension (Para 127.9 of 5 th CPC report).The Govt. has been paying us only 50% of LPD &17% of LPD, still continues to contribute towardspension. Present-day pensioners while in serviceworked on pay scales which were intentionallydesigned at lower level to cater for Pension. Govt.of India’s 6 th CPC sponsored a study on retirementbenefits of Central Government employees in2007 by Dr Gayithri of Centre of Economic Studies& Policy, Institute for Social Economic Change,Bangalore. It came out in her report that the payscales of pensionable Govt employees were

motivating pensioners to indulge in social welfareof the civil society. W henever there is a naturalcalamity, pensioners come forward not only withmonetary assistance but physically andemotionally also they stand shoulder to shoulderwith civil administration and the fellow citizens indistress. W ith our enthusiastic motivation,Pensioners are coming forward to donate not onlyorgans but even their whole bodies so thatsomeone, after their departure, can survive to seethis beautiful world. Several of our affiliates aremonetarily helping underprivileged children tocontinue their studies. Similarly, poor ladies indistress are being helped to earn honourableliving. Thus, we are not a burden on the exchequer,society or the govt. Even in our death we are ableto give life to 5 persons.

: The 7th CPCrecommended vide their Para 10.1.67 that: All thecivilian personnel including CAPF who retired priorto 01.01.2016 shall first be fixed in the Pay Matrixrecommended by the Commission, on the basisof the Pay Band and Grade Pay at which theyretired, at the minimum of the corresponding levelin the matrix. This amount shall be raised, to arrive

at the notional pay of the retiree, by adding thenumber of increments he/she had earned in thatlevel while in service, at the rate of three percent.Fifty percent of the total amount so arrived at shallbe the revised pension. To this Govt. said, “it maynot be feasible to implement” and wanted to rejectthe recommendation outright. However, on NC-JCM (Staff Side) & BPS insistence thisrecommendation has been accepted by the Govt.subject to feasibility. On this issue we could reachconsensus with S-30 & S-29 Associations andhave represented that the required records areavailable in 95% cases (Govt has subsequentlyaccepted during the meeting with NC-JCM on6.10.2016 that records are available in 82 %cases) & the remaining can be recast. If in anycase records are not available & cannot be recast,the LPD which is invariably available in PPOs,can be updated Pay Commission after PayCommission & can be placed at appropriate levelin Pay Matrix. Thus, the recommendation, caneasily be implemented. But the DOP&PW is stillinsisting that it will not be feasible and is pushingfor modified parity of 5th CPC.

Commission recommends that CGHS shouldempanel those hospitals which are alreadyempanelled under CS (MA)/ECHS for catering tothe medical requirement of these pensioners ona cashless basis. This would involvestrengthening of administrative capacity ofnearest CGHS centres. However, this step will goa long way in ameliorating the pending grievancesof these pensioners.

2. The Commission recommends that theremaining 33 postal dispensaries should bemerged with CGHS. The Commission furtherrecommends that all postal pensioners,irrespective of their participation in CGHS while inservice, should be covered under CGHS aftermaking requisite subscription.

3. Currently, there are various health careschemes in the Central Government catering tospecific sets of employees. For example, apartfrom CGHS, there are Ex-Servicemen ContributoryHealth Scheme (ECHS) and Railways EmployeesLiberalized HealthScheme (RELHS) which coverthe Ex-servicemen and Railway employees/pensioners, respectively. Although the patterns

pensioners, respectively. Although the patternsin these schemes vary, a combined entity ofCGHS, ECHS-RELHS would result in a verystrong network of health facilities for theCentralGovernment employees across the lengthand breadth of the country.

Summing up the deliberations, Prez ShyamSunder recalled the journey covered by BPS andits acheivements for pensioner community oversix decades since its foundation in 1955 by JusticeShankar Saran (Retd) of Allahabad High Court.He advised the house not to go into lull as noorganisation can, or, should survive on laurels ofits past acheivements. Pensioners should stayalert and continue their fight for: i) “Full Parity” i.e.

Dear Pensioner Brother! Haven’t you and all of uswatched the current logjam and adjournments in thewinter sessions of our Parliament, both in the RajyaSabha and the Lok Sabha and the highly difficultsituations handled most impartially, tactfully and patientlyby the respective Presiding Officers of the two Houses?We must applaud the self- restraint, discipline and dignitywith which these Dignitaries commandeered the volatileproceedings of the highest chambers of the largestDemocracy in the world. W hat practical lessens canwe draw in the conduct of pensioners meets from thelocal to national levels ? Retired Justice Sankar Saranof Allahabad and a handful of a few other pensionersmet, at his then residence, at 35, Western Court, Janpath,New Delhi in 1955 to found this All India PensionersOrganisation. An office was soon established in a smallroom in W W-II relic Theatre Communication barracks inConnaught Place on the ground where the new hustle-bustle underground Palika Bazaar majestically standstoday. It shared the rent with the Bharat Sevak Samajled by the late Gulzari Lal Nanda until it had to shift, dueto its financial constraints, to the residence of its thenGeneral Secretary at the Todarmal Road in Bengali Marketarea.

It functioned smoothly and also orderly (at someother sites too) until it was jolted by a sudden rift andsplit led by one late Major Partap Singh. He thenestablished a rival All India Organisation of Pensionerswith a few branches here and there but all of them haveslowly withered away by lapse of time though amicroscopic number still survives at some stations butalso mostly affiliated now to BPS. W e, however, stillhighly respect its present ‘headquarters’ at Kanpur.Bharat Pensioners Samaj is a secular, non-political, non-Option-1 recommended by 7 CPC for pre-2016

pensioners which the GOI, till-date, has not agreedto implement on grounds of non-feasibility ofavailability of records and contrary to its ownfindings that records of 82% of pensioners areavailable. BPS and the staff side of NC JCM havesounded the govt for positive feasibility ofremaining 18% too; ii) upward change of CMF2.57 by revision of minimum salary based on thehackneyed & colonial ‘family unit’ concept in the1948 formula of Dr Aykroid; iii) FMA to be atleastRs.3000/- per month for pensioners residingoutside the CGHS areas; iv) universal applicationof VIIth CPC to the state Government Pensioners;and v) removal of injustice to EPS 95 pensionersby way of reducing even the meagre minimumpension of Rs.1000/- through prorata system.

How could the BPSsurvive and even expand speedily not onlyorganizationally but also financially, to its zenith ofheights to-day? Both the objective circumstances andthe dedicated spirit and discipline of the leadership teamsof this great organisation for the last over three decadesis the answer. First, the objective conditions for whichdue credit must go to the late youthful Prime MinisterRajiv Gandhi. (Disclaimer: I am not, or have ever been,either a salve or even a fan of the Nehru Gandhi or anyother Family.)

1. The Bharat Pensioners Samaj,which is an All India Federation of Pensioners’Associations will represent all categories, groupsand classes of Pensioners, who draw Pensionarybenefits from the Central or State Governments,or Public Sector Undertakings, Corporations orlocal bodies and their dependents with a view topromoting general welfare of pensioners andageing persons and to help them in all possibleways. Active members of the Samaj will beencouraged to utilize their time and experience insocial work, to raise the status and strength of thepeople and to improve the image of India bybringing about a change in their attitudes andthinking.

2. The Samaj shall be a non-political, non-commercial, Secular and social welfareorganization, free from party, group, provincial orlinguistic affiliation. Its Registered office shall beat Delhi/New Delhi.

need not be enumerated by me here. But can we forgetthe contribution made by messers M L Batra and BehariLal Vig at New Rajinder Nagar, New Delhi before age-related problems hit the latter? Or, the extraordinaryefforts and dedicated work by the “Jangpura GROUP”(so called because of their audacious act of shiftingand stabilizing a new the Samaj headquarters atJangpura from New Rajinder Nagar) in 1983, of SarvshriP N Kumra, P N Gadi, Ripudaman Singh (W estNizamuddin), M S Sachdeva, V S Goswami, C L Mohan,Y C Rai & others for nearly one and a half decades andthen this humble guy (myself), S P Vatta, Mohan Lal, MrsP K Goswami and others and yet the last but not theleast those contemporaries at the helm of affairs today?

The point that I want to discuss with all myaffectionate and dear pensioner brothers is: W hat is thebasic internal strength of Bharat Pensioners Samaj,sustaining it for over six decades and still marchingahead and facing yet ever new challenges today and inthe future. It is, of course, UNITY, UNITY & UNITY! andunity demands discipline which includes dedication andself-restraint. Paying a tribute to the late iconic Cubanleader Fidel Castro, Kerala MP Shashi Tharoor (formerlyan Under Secretary in the UNO) says: “At one UN summit,a five minutes limit had been imposed upon Heads ofGovernment that no one expected Castro to adhere to.With his impish sense of humour, Fidel ostentatious byplaced a red handkerchief over the blinking light installedto warn speakers their time was up, signalling hisapparent intention to ignore it and Fidel holds the recordfor the longest speeches in the U N: 4 hours 29 minutesin Sept,1960; 7 hours and 30 minutes on February, 1998”!!! Our own V K Krishna Menon spoke for over 11 hoursat that very grand high pedestal on Jammu & Kashmir, inthe fifties!

(g) A Pensioner means a person who retired fromCivil, Railways, Posts & Telegraph, or DefenceServices of the Government of India or any

the fifties!In our AGM @ Bahai Bhavan, New Delhi held in

2009, one Delegate from a not so prominent town inNorth Zone happended to exceed the time allotted. Thethen President twice politely requested him to concludebut he was unable; on a third request too, to do so. Hevociferously argued that all the items for the AGMassigned by his Association had as yet not beendiscussed in full detail. He used to regularly attend theAGM every year. And then suddenly decided todiscontinue this pratice. As an ad hoc response decisionto hold a two-day AGM failed to click as a solution. Idon’t know if a repeat experiment next year would leaveus happier on this account; or we may go for biennial ortriennial conferences now on wards. The ManagingCommittee would perhaps have to deliberate on thisissue shortly. The other problem would be to decideabout the manner in which discipline and order shouldprevail in the meetings of bodies like the ManagingCommittee in the periods between the AnnualConferences or Meetings. Is there not a need for moreself-restraint and order on the part of the members insuch meetings? It is appropriate for any member to raisehis voice or even shout to press his point of view beingaccepted by all others. Can they resort to such behaviouras they do in the highest pedestals of democracy as theUpper and Lower Houses of our esteemed Parliament?I would request all our affiliated Associations andindividual members to debate this in their meetings andsend their considered views to our Secretary Generalby the 28 th Febuary,2017 positively.

State Government or Union TerritoryAdministration in India or from the Governmentof undivided India or Burma, Pakistan, or fromthe service of any Local Body, Council, or PublicSector Undertaking/ industries covered by EPS95.4.

(a ) To promote the general welfare of Pensionersand elderly persons.

b) To promote such measures as may beconducive to material benefits of members ofthe Samaj.

(c) To accept donations, grants-in-aid, loans frommembers of the general public and otherorganizations including Government andSemi-Government bodies and localauthorities with a view to promote interests ofthe Samaj particularly in :-

(i) Providing medical and Social welfare facilitiesfor Pensioners and their dependents,

(ii) Arranging educational facilities for dependantwards of Pensioners.

(iii) Establishing homes, hostels, health resorts

and useful literature of interest to Pensionersand elderly persons.

(h) To affiliate itself with International Associationswith similar aims and objects.

(i) To encourage members to utilize their time andexperience in social and welfare work.

(j) To take such steps as may be necessary tocarry out the above objects in co-operation withother Associations and social welfareorganizations with similar objects in views.

(k) To establish branches of the Samaj in variousStates and Districts and associate itself withother Association working with similar aimsand objects. 5. Every Pensioner irrespective

of community, caste, creed or religion is eligibleto become a member of the Samaj on payment ofsuch fee and on such conditions as may be laiddown by the Managing Committee of the Samajwith a majority of two-third members present inthe meeting.

(a) An office bearer/Member(iii) Establishing homes, hostels, health resortswith or without facilities for board and lodgingfor recreation of Pensioners on a no-profit no-loss basis and

(iv) To acquire, by purchase on lease or free-holdbasis, any land/built-up premises for office etc.of Bharat Pensioners’ Samaj.

(v) Helping pensioners and their dependents indistress.

(d) To take such steps as may be necessary tohelp Pensioners in the redress of theirlegitimate grievances and complaints.

(e) To establish Information Centres to guide,help and assist pensioners in matters relatingto their rehabilitation on retirement, providingcounsel and other information of interest tothem.

(f) To carry out survey, collect statistics andmaterial on living conditions of Pensionersand their dependents and disabilities fromwhich they suffer and plan projects forpromoting their welfare.

(g) To publish books, periodicals, newspapers

(a) An office bearer/Memberof Bharat Pensioners Samaj ManagingCommittee who pays Rs. 2500/- will become aLife Member .A life member of Bharat PensionersSamaj will be entitled to receive monthly Journal ‘‘Bharat Pensioner’ for a period of Ten years fromthe date of enrolment. This rule applies to allexisting & future life members.

(b) Any person may become a subscriber to‘BHARAT PENSIONER’ /or any pensioner maybecome Member of BPS on payment of perannum fee as prescribed from time to time by theManaging Committee. Presently it is 300 Yearly,580/- Biennial, 800/- Triennial. He will be entitledto receive ‘BHARAT PENSIONER’ Journal byordinary post free of cost during the currency ofhis/her membership *Note :1. The rates ofsubscription for Life Members, Annual, Biennial& Triennial Members and for AffiliatedAssociations, including cost of single copy of‘BHARAT PENSIONER’, may be revised byManaging Committee from time to time”. Currentrates are effective from 01.04.2016.

6. - Any person who is in sympathywith the aims and objects of the Samaj andsubscribes a sum of Rs. 11000/- or more maybecome a Patron of the Samaj. The ManagingCommittee of the Samaj may also nominate anyperson as Patron for reasons of distinguishedservices to the country or to the Samaj.

7. An Affiliated body ofPensioners shall pay to Bharat Pensioners’Samaj an annual fee *Rs. 600/ - and receive allpublications of BPS including ‘BHARATPENSIONER’ for one year. W ill be able to raisegenuine grievances & pensioners’ issues throughBharat Pensioners Samaj. Their activities will alsobe highlighted in ‘Bharat Pensioner’.

7-A : The Managing Committee may, forreasons to be recorded, revise the above rates,as and when necessary, and notify the same onemonth before the new rates are Implemented.

8. Cessation of Membership : Membership ofBharat Pensioners’ Samaj shall cease onmember’s:(i) Death(ii) Resignation when accepted by Managing

(ii) Two delegates from each of the AffiliatedFederation/Associations having membershipupto 1000. Affiliated Federations/Associationshaving membership over 1000 will be entitled totwo(2) additional delegate for every 1000additional members. As per the preamble, BPSis a federation of Pensioners Associations, thesedelegates will have right to vote. Vote value of eachdelegate of an affiliated association/federationshall be equal to 100 votes of individual members.Affiliated Associations shall provide complete listof their members with contact Nos etc in the firstquarter of the year. However, those representingassociations in the Managing Committee will nothave right of additional vote by virtue of their beingin Managing Committee.

10. The GeneralBody shall have supreme authority over the affairsof Bharat Pensioners Samaj. Its functions shallbe as follows:-i. To consider the Annual Report on the working

of the Samaj.ii. To pass such resolutions as are considered

necessary in the interest of the Samaj and to(ii) Resignation when accepted by ManagingCommittee,

(iii) Expulsion by Managing Committee for reasonsto be recorded, General Body may withoutgiving any reason expel any office bearer orMC member or may nullify election of any officebearer by voice vote of authorized delegates.Managing committee subject to post factoconfirmation by Genl. Body may also drop anyoffice bearer /MC member for non performanceor for working against the interest oforganization.

(iv)Conviction in a Court of Law on groundsinvolving moral turpitude,

(v) Failure to pay the dues of the Samaj within 3months after the end of the period to which thesubscription relates.

(vi) Not attending 3 Managing Committeemeetings without intimating valid reasons inadvance and

(vii) Anti Organisation activities. 9. (i) Patrons, Life Members and Other Members.

v. In case of contest for election to any office or formembership of the Managing Committee andto pass any Resolution the procedure forvoting shall be by show of hands by theauthorized delegates having voting right.

vi. To amend the Constitution.

11.Procedure for holding Meetings of theGeneral Body.

(i) A meeting of General Body shall be heldonce a year and shall be presided over by thePresident, in his absence by the W orkingPresident. In the absence of both, Vice- Presidentfrom Delhi; and in the absence of all three by aperson elected to take the Chair. In the event of anequality of votes the Chairman shall have a secondor a casting vote. The quorum for such a meetingshall be fifty. Every Pensioner who has enrolledhimself/ herself as a member of BharatPensioners’ Samaj or is an authorizedrepresentative of an Affiliated Association and haspaid the subscription by 30th Septemberpreceding the date of the AGM in which electionsare to be held, is entitled to vote and stand forelection as a member of the ManagingCommittee.

(ii) However, to be an office bearer, he/sheshould agree to be a Life Member of the Samajand should pay the subscription on being elected/nominated by the Annual General Meeting .

(iii)The agenda proposed for the General Body

(viii) A record of the proceedings shall be keptby the Secretary General and be signed by thePresident (or the Chairman). Important decisionsshall be published in the ‘BHARAT PENSIONER’for general information of members of the Samaj.

(ix) Progress on action taken on the recomme-ndations or resolutions passed by the GeneralBody shall be reported in the ‘BHARATPENSIONER’ by the Secretary General.

12. (a) ManagingCommittee shall consist of the following who mustbe primary members of BPS:(i) Advisor ............................................................ ONE(ii) President ......................................................... ONE(iii) Working President ........................................ ONE(iv) Vice-Presidents cum Zonal organizers ...... SIXOne from Delhi and five others elected ornominated at State level bodies by rotation fromeach Northern, NorthEastern, Southern, Easternand W estern Zones. They will also act as ZonalOrganizers in their respective zones. These Zoneswill comprise:(iii)The agenda proposed for the General Body

Meeting shall be published one month before thedate of the meeting in the ‘BHARAT PENSIONER’notifying the date, time and place of the meeting.,Voters list will be updated one month in advanceof AGM in which election is to be held and onlyvalid voters & authorized delegates of affiliatedAssociations will be invited to attend AGM in whichelection is to be held.

(iv) An extraordinary Meeting of the GeneralBody may be called by the President or by theSecretary General at the request of fifty members,after giving 30 days notice and specifying theagenda for the meeting.

(v) If within an hour from the time appointed forthe meeting of the General Body quorum is notcomplete, the meeting shall stand adjourned forhalf an hour and proceed with the agendathereafter,

Study all aspects of the possibleadvancement of Aims and Objects of the Samajand all matters referred to the Samaj by AffiliatedAssociations or Individuals and submit to theGeneral Body such measures as it considersnecessary. It will co-ordinate the work of AffiliatedAssociations, deal with State and CentralGovernment and other matters relating to theinterest of members, lay down policy and line ofbe called by the Secretary General for transaction

of the affairs of the Samaj as often as necessaryand on such date, time and place as may beconsidered convenient, provided that ordinarily anotice of ten days for such a meeting shall begiven to members of the Committee.

d.) Quorum for meetings of the ManagingCommittee shall be seven of whom 3 will be nonoffice bearers. If a member of the ManagingCommittee fails to attend three (3) consecutivemeetings without prior notice or reasonablecause to the satisfaction of the ManagingCommittee, his name may be removed from thelist of Managing Committee Members.

shall exercise directional authority over all officebearers and appellate authority over allemployees of the Samaj. He may, in consultationwith Wkg President/ Secretary General, fix suitableremuneration for any person (s) engaged for theactivities of Bharat Pensioners Samaj.

(c) The Secretary Generalshall be the Principal Executive Authority for theworking of the Samaj under the general directionand guidance of the President and shall be theadministrative authority over all employees of theSamaj, He shall:

(i) In maintenance of upto-date register ofMembers and Affiliated ‘Associations and toorganize campaign for their enrolment;

(ii) To deal with correspondence with States ,Districts, affiliates, individual subscribers.

(iii)In publishing list of members periodicallyas may be decided by the Managing Committee.Samaj, He shall:

i) Implement all decisions of the General Bodyand of the Managing Committee,

ii) Carry on all correspondence with theCentral and State Governments and with AffiliatedAssociations.

iii) Hold an Imprest of Rs. 6000/ and renderits account to the Treasurer.

iv) Prepare and present annual report on theactivities and achievements etc. of BPS.

v) Mobilize resources of the Samaj with theassistance of other members of the ManagingCommittee.

vi) Printing and publishing of ‘BHARATPENSIONER’ with the assistance of his staff.

vii) Bharat Pensioners Samaj shall sue or besued in the name of the Secretary General.

(d) All the Eight Secretaries willexamine and dispose of the problems ofPensioners of the related wings, in accordancewith the Rules of Bharat Pensioners Samaj,directly; except in policy matters which will requireprior consultation/ consent of the President and

accounts maintained by the Accountant and shallsee that BPS accounts are operated by any two ofthe following three: President, Secy Genl &Treasurer.

He shall maintainclose liaison with sister organizations, Tradeunions, various Ministries and Departmentsconcerned with pension and welfare ofPensioners and also with the Press and Massmedia for publicity & promotional activities work.

(i) In consultation with Secy Genl, hewill collect material for the Journal BHARATPENSIONER, prepare editorial, fix up prioritiesand supply the same to publisher to ensure itsdispatch to members by the prescribed due dates.

(j) Will assist editor.(k) With the help of the Treasurer, the

Auditor shall audit accounts of the Samaj.14. The

General Body of Bharat Pensioners’ Samaj shallhave the power to amend, add, alter or rescindany provision of the Constitution with consent of3/5th majority of the members present in a meetingand voting and to frame rules there under and toamend or rescind them.

14-A. However, for day-to-day working of theSamaj, in all its prescribed activities, the ManagingCommittee may decide, by a majority vote onamending/introducing any new operationalmeasure, but without interfering with the basicAims and Objects of the Organization. Thereasons for the same will be duly brought onrecord in the minutes of the Managing Committee.Any such new amendment/ addition will be later

quoting of PAN in respect of cash deposits inexcess of Rupees fifty thousand in a day, quotingof PAN will now also be mandatory in respect ofcash deposits aggregating to Rupees two lakhfifty thousand or more during the period 09thNovember, 2016 to 30th December, 2016 as perAny such new amendment/ addition will be later

The Samaj may be dissolved by a vote of3/5th of the members of the General Body andafter such dissolution the assets of the Samajshall, after discharge of all liabilities, be donatedto such charitable purposes as may be directedby the General Body authorizing such dissolution.

The Income Tax Department prescribes a listof transactions for which quoting of PermanentAccount Number (PAN) is mandatory. These arelisted in Rule 114B of the Income Tax Rules, 1962which were first inserted with effect from 1stNovember, 1998 and have been amended from

November, 2016 to 30th December, 2016 as peran amendment notified by CBDT on 15-11-2016.

The Department has already issued close to25 crore PAN till date. The persons requiring aPAN for complying with the above requirementmay do so by applying to the NSDL in a prescribedformat with the necessary documentary proof. The provisions relating toregulation of DR where a pensioner is in receiptof more than one pension will remain unchanged.

6. In the case of retired Judges of the SupremeCourt and High Courts, necessary orders will beissued by the Department of Justice separately.

7. It will be the responsibility of the pensiondisbursing authorities, including the nationalizedbanks, etc. to calculate the quantum of DR payablein each individual case.

The undersigned is directed to say thatsubsequent to implementation of the decisiontaken by the Government on the recommendationof the 7th Central Pay Commission, the Presidentis pleased to decide that the Dearness Reliefadmissible to Central Government pensioners/family pensioners shall be as follows:

(iv) CPF beneficiaries, their widows andeligible children who are in receipt of ex-gratiapayment in terms of this Department’s OM No.

authorised Pension Disbursing Banks arerequested to arrange payment of relief topensioners etc. on the basis of these instructionswithout waiting for any further instructions fromthe Comptroller and Auditor General of India andthe Reserve Bank of India in view of letter No.528-TA, 1I/34-80-II dated 23/04/1981 of theComptroller and Auditor General of Indiaaddressed to all Accountant Generals andReserve Bank of India Circular No. GANB No.2958/GA-64 (ii) (CGL)/81 dated the 21st May, 1981addressed to State Bank of India and itssubsidiaries and all Nationalised Banks.

assessment. Here the A.O can open yourassessment for the last 6 financial years i.e. hecan ask you to explain source of your income,provide income related proofs etc for the last 6years. The A.O can ask for all the documents hethinks are necessary for him to compute your trueincome and finally assess your correct income andthereafter issue you a notice under section 156demanding the amount of tax payable by you (asre-calculated by him), along with interest andpenalties and prosecution.

After detecting your unaccounted incomedeposits, the tax department may decide to conductan income tax raid at your place to find out otherassets like gold, property papers, benamitransactions etc in your possession/ ownership.In such a case you would not get any advancenotice. Such search and seizure proceedings arethe most aggressive step which can be taken bythe income tax department and hope that you arenot the one who gets in its ambit.

If the assessee does not comply with the income tax return for any year is already beingassessed under any section other than the normalself assessment, then your case could be hurt ifyou are detected depositing unaccounted income.The tax law permits the joint commissioner toinstruct your A.O to take a stricter view of your casepending before him.

5. Accordingly, the rate of DA admissible toemployees of Central Government and CentralAutonomous Bodies who continue todraw theirpay in the pre-revised pay band/grade pay as per6th CPC recommendations, shall be enhancedfrom the existing 125% to 132% w.e.f. 01.07.2016.

Disability pension and familypension, under CCS(EOP)Rules is more than50%/30%of last pay/average emoluments onaccount of the disability element. Therefore, it isclarified that the ceiling of pension/family pensionindicated in para 4.4 of Department of Pensionand Pensioners W elfare OM dated 04.08.2016referred to above is applicable only in the case ofpension/family pension under CCS(Pension)

The undersigned is directed to state that inpursuance of Government’s decision onrecommendation of 7th Central Pay Commission,orders have been issued for revision of provisionsregulating pension/gratuity/commutation ofpension etc. vide this Department’s OM 38/37/2016-P&PW (A) dated 04.08.2016. In para of thesaid OM, it has been mentioned that there will beno change in the provisions relating tocommutation values, the limit upto which thepension can be commuted or the period afterwhich the commuted pension is to be restored.

2. As per Rule 10 of CCS (Commutation ofPension) Rules, 1981, an applicant who hascommuted a percentage of his final pension andafter commutation his pension has been revisedand enhanced retrospectively as a result of

additionally commutable on revision of pay/pension on implementation of recommendationsof the 7th CPC. The Cases where the additionalpension after 7th CPC has already beencommuted will not be re-opened.

4. In their application to the employees ofIndian Audit and Accounts Department, theseorders issue in consultation with Comptroller andAuditor General of India.

5. This issues with the concurrence of Ministryof Finance, Department of Expenditure ID No.192/E.V/2016, dated 30.09.2016.

Department of Pension and Pensioners’Welfare is responsible for formulation of policyand coordination of matters relating to pensionpolicy and welfare of Central Governmentpensioners. It has been seen that despite detailedguidelines and instructions to the contrary a largeproportion of retiring employees do not get theirretirement benefits and the Pension PaymentOrder(PPO) in time. It is likely that such retiredemployees find it difficult to get the processcompleted after retirement. The sanction processstarts more than a year before the date ofretirement and requires cooperation amongstvarious agencies. This department has, therefore,launched Bhavishya – an online pension sanctionand payment tracking system. The system bykeeping track of the progress of each caseintroduces transparency and accountability. Boththe retiring employees as well as administrativeauthorities can monitor progress at each stage.

2. The system has been running successfullyin the main Secretariat of all ministries/departments for the last one year. It has sincebeen extended to cover over 3000 Drawing andDisbursing Officers and Pay and Accounts Offices

and enhanced retrospectively as a result ofGovernment’s decision, the applicant shall bepaid the difference between the commuted valuedetermined with reference to enhanced pensionand the commuted value already authorised. Forthe payment of difference, the applicant shall notbe required to apply afresh.

3. References have been received in thisDepartment that many pensioners who retiredafter 01.01.2016 and have drawn pension/commuted value of pension based on their pre-revised pay/pension do not wish to commute thepension which has become additionallycommutable on revision of pay/pension onimplementation of recommendations of 7th CPC.The matter has been examined in consultationwith Ministry of Finance (Department ofExpenditure), It has been decided that thosepensioners who retired from 01.01.2016 till04.08.2016 i.e. the date of issue of orders forrevised pay/pension based on therecommendations of the 7th CPC may be givenan option, in relaxation of Rule 10 of CCS(Commutation of Pension) Rules, 1981, not tocommute the pension which has become

BusinessDepartments/Units are requested to monitor thedisposal of grievances on daily basis and toensure that all grlevances received through CPAOare settled within 30 days and the status updated/responded on W RPS invariably. The period wiseinformation of pendency is available on thedashboards of Heads of CPPCs & Heads of Govt.Business Departments/Units.

revision in civil Ministries/Departments. Highestpendencies pertained to Home Affairs (963),Atomic Energy (442), CBEC, HRD, and PrasarBharti. It was informed by the CCAs/CAs that thesecases are pending due to non-availability ofrequired information either with PAOs or withHOOs & Banks in spite of all out efforts made.Following points decisions were taken:

(i) CPAO to prepare fresh list of live pendingcases on the basis of e-scrolls received whichmay reduce the number of pending cases. Thislist would be provided to the concerned Ministries/Departments to again review the pendency andcheck the availability of records. If records are notavailable even after this exercise, the certificate ofnon availability of records would be furnished byconcerned CCAs/CAs to CPAO to enable it to takefurther necessary action. If any pensionerrepresents for revision of his/her pension in futurethe same would be revised on the basis of recordsprovided by him/her subject to verification of therecord.

(ii) The above list would also be provided to

He stressed that all Pr. CCAs/CCAs/CAs must use their dashboards provided byCPAO to monitor the disposal of grievances anduploading of lists of retiring employees andsubmission of pension cases.List of participants is at Annexure-I (not published)

Following agenda items were discussed anddecisions taken:-

(ii) The above list would also be provided toconcerned pension disbursing banks to checkthe genuineness of these pensioners on thebasis of KYC records available with them and getthe relevant records required for revision for suchpensioners. The banks will also be asked tofurnish the copies of life certificates received fromthese pensioners to CPAO by 15th Feb, 2017.

It was observed that only 29 percentof fresh PPOs were received in CPAO from PAOsbefore the date of retirement of governmentservants. All the CCAs/CAs present in the meetinginformed that delay in finalizing fresh pensioncases is because of late submission of pensionpapers by the HOOs to concerned PAOs. holding the meetings with senior officers so thattimely receipt of cases in PAOs may be ensured.CGA appreciated the efforts of Atomic Energy andadvised other CCAs/CAs also to take up the matterregularly with concerned Administrative Authoritiesi.e. HODs/DOOs/DDOs for receiving the pensioncases in PAOs as per prescribed time scheduleand use the dashboards provided under W RPSto monitor the delays.

Significant progress was observed inrespect of Aadhaar Seeding in fresh PPOs by theMinistries/Departments as overall seedingpercentage had reached 61%. Ministries/Departments where seeding percent was lowwere Home Affairs, PPG and Supply. In someMinistries/Departments, like Health & FamilyWelfare, HRD, Prasar Bharti and UD seeding wasmore than 90%, CCA, MHA was requested toensure increasing the number of Aadhaar seedingin fresh PPOs as the low percentage of MHA hadbrought down overall percentage very significantly.

B. Listsof only 1734 retiring employees were uploadedso far by the PAOs of concerned Ministries/Departments. Since annually about 35 thousandof fresh pension cases are received in CPAO, thissmall number of uploading of lists showed thatstill either many PAOs are not uploading completelists of retiring employees or not uploading at all.To ensure the timely submission of list of retireesby the HOOs to the concerned PAOs the CCAs/CAs present in the meeting were advised to takeup the matter with their HODs on regular basis tobrought down overall percentage very significantly.

Representative of PPG&P pointed out that lowpercentage of Aadhaar seeding in PPG&P wasdue to low Aadhaar seeding by Director ofAccounts, Cabinet Secretariat (DACS) which usesPAO code of PPG&P but they are not in theadministrative control of CA, PPG&P. On thisissue, it was decided that while CPAO may takeup the matter with DACS; PPG&P was also advisedto coordinate with DACS to resolve this issue onregular basis. Most of the CCAs/CAs informedthat PAOs are indicating Aadhaar numbers infresh PPOs wherever the same is made availableby the concerned HOOs and efforts are made tomake it 100%.

A. Under W RPS, total 570grievances were received, out of that 375 pertainedto the concerned 15 ministries. Out of these 375grievances, 70 grievances were replied back byPAOs to CPAO and 56 settled. 305 grievanceswere still pending with PAOs. CGA advised all

up the matter with their HODs on regular basis toget the complete list of retiring employeeswherever the same is not being provided by theHOOs. CGA advised CCAs/CAs to pay specialattention to those PAOs where details of not evensingle employee has been uploaded so far.

It was observed that there were manydiscrepancies in the booking of expenditure underpension grant No.35 in the year-2016-17 (up to2nd quarter) by many Ministries/Departments i.e.expenditure in excess of budget, expenditurewithout budget, misclassification betweencharged and voted expenditure, expenditurebooked in minus etc. An OM dated 11.11.2016with details of discrepancies had already beenissued to CCAs/CAs. All concerned CCAs/CAswere advised to regularly review the booking ofexpenditure under various heads of pension grantin their Ministries/Departments with the help ofreports available under e-lekha/PFMS and ensure

Pursuant to implementation of Government’sdecision on the recommendations of 7th CentralPay Commission regarding revision of minimumpension to Rs 9000/- it has been decided toamend the proviso below Para 2(C)(vii) of RailwayServants (Pass) Rules, 1986 (Second Edition-1993) as follows:-

“Provided that a person shall not beconsidered to be a dependent relative if his/hermonthly income from all sources includingpension, dearness relief, etc., exceeds 15% ofthe basic pay of the Railway servant or the amountarrived at by adding minimum pension/familypension of Rs. 9,000/- (excluding the element ofadditional pension to old pensioners) and thedearness relief admissible to the pensioner/family pensioner thereon, rounded off to thenearest ten rupee figure, whichever is more.”

BPS has learnt with profound grief of thesudden demise of Dr. Sugan Bhatia, Sr.VicePresident, AISCCON, Mumbai on 26.11.2016 -BPS staunch supporter and a legend figure whotill his end struggled for the causes of seniorcitizens and pensioners of all streams. BPS hadthe pleasure of hearing his views in its 61st AGMon November 13,2016 at Mavlankar Hall,Constitution Club, New Delhi. His last addresswas on 24/25.11.2016 at 16th Conference of AISCConfederation held at Tirupati (AP). His futuristicvision for the aged in India was truly remarkable.May his soul rest in peace.
