FLEXIBLE/FLOATING TIME USAGE GUIDE AND

RESERVATION PROCEDURES

Palace View Resort (100) and Palace View by Spinnaker (200-600) – referred to as Palace View Resorts does everything possible to maximize the flexibility of vacation ownership making it as beneficial as possible for you. For example, Palace View Resorts vacation ownership is known as "Floating Time." Instead of being locked into vacationing during the same Annual or Biennial (Even/Odd) usage year after year, you are able to reserve different weeks each year within your designated Annual or Biennial (Even/Odd) and season. Few of us know years in advance which week of the year we will choose to vaca-tion. "Floating Time" enables you to choose any week your Annual or Biennial (Even/Odd) season of ownership. Weeks 1-9 offer usage during weeks 1-9. While you are deed-ed a specific week within this season for ownership purposes, use of that particular week is not guaranteed or required. Instead, you may reserve any week within weeks 1-9 on a first come, first serve basis. The same applies to ownership during Weeks 10-52 offering usage during weeks 10-52 on a first come first serve basis. To ensure fairness to all Pal-ace View Resorts vacation owners, "Floating Time" reservations should be made as far in advance as possible. A minimum of 30 days in advance and not more than 360 days in advance of the desired week of occupancy at Palace View Resorts. Interval International (II) exchange reservations may be made as far as two years in advance and are condition-al upon all maintenance/association fees and loan fees being current and a payment of the estimated maintenance/association fees for the second year. Each owner under-stands that an exchange fee must be paid by the Owner to II. Reserving your week six to twelve months in advance will better enable you to obtain the specific week you wish each year. Reservation System. All Unit Week Purchasers of Flexible Time Unit Weeks must contact The Palace View Resort Condominiums Flexible Time Reservations Department in writing to book a reservation. All Flexible Time Unit Weeks shall be scheduled solely and exclu-sively on a first come, first served basis. Unit Week Purchasers scheduling a Flexible Time Week reservation far in advance are more likely to reserve more desirable Unit Weeks than Unit Week Purchasers delaying their reservation request. Reservation requests will be honored by The Palace View Resort Condominiums Flexible Time Reservations Depart-ment in the order by which they are received. All reservation requests must be in writing. Go online at spinnakerresorts.com, click RESERVATIONS in the upper right corner to submit your reservation request online or email your request directly to [email protected], alternatively you can fax your reservation request to (843) 341-6504.

Reservation requests may be made Three Hundred Sixty (360) days in advance and not

less than Thirty (30) days prior to the first day of the period being reserved. Purchasers

delaying their reservation requests may lose their rights to use for that year during their

designated season.

Association reserves the right to change the reservation time periods as appropriate.

Reservations may be scheduled within the season corresponding to the Unit Week Purchaser’s Flexible Time Unit Week number as is more fully described below or within any lower tiered season, subject to availability. Seasons. Flexible Time Unit Weeks shall be allocated into two (2) seasons. The Interval International (II) Travel Demand Index (TDI) assisted in establishing the two (2) seasons comprising Palace View Resorts: Season: #1 - 1 thru 9 #2 - 10 thru 52 Interval International (II) the affiliated timeshare exchange company for Palace View Resorts reserves the right to modify its seasonal Unit Week allocations. All Unit Week Purchasers of Unit Weeks shall be bound by any subsequent changes by Association and/or the seasons which II or the then-affiliated timeshare exchange company for Palace View Resorts may make. Carry over: No Unit Week Purchaser shall be allowed to carry over into a subsequent year any Flexible Time Unit Week use rights which the Unit Week Purchaser failed to schedule during the subject year or was otherwise unable to schedule due to lack of availability. Miscellaneous: All Unit Week Purchaser’s shall vacate their Units no later than 10 a.m. on the last day of their ownership period. No Unit Week Purchaser shall take posses-sion of his Unit Week earlier than 4 p.m. on the day in which his ownership period commences. The Master Deed, By-Laws and Declarations and all amendments and supplements thereto shall be incorporated herein by reference and shall be read to-gether in determining the nature of a Unit Week Purchaser’s occupancy, ownership and use rights to Unit Weeks hereunder. Capitalized terms not otherwise defined here-in shall have those meaning assigned to them in the Declaration. The Declarant re-serves the right to amend these Rules until that point in time in which 80% of the Unit Weeks have been sold. The declarant reserves the right to amend these Rules at any time so as to reflect changes in seasonal allocations as may be subsequently promul-gated by Palace View Resorts affiliated timeshare exchange company.

PROCEDURES - Continued

Flexible Time Unit Weeks. All Unit Weeks as located within Palace View Resorts shall be desig-nated as Flexible Time Unit Weeks. Unit Week Purchasers of Unit Weeks falling within these flexible time periods are not guaranteed use of their Unit Week in accordance with those proce-dures set forth in the Palace View Resort Condominium Taney County, Missouri Declaration. Rather, a Unit Week Purchaser’s use of his Flexible Time Week during these periods shall be governed by that first come, first served reservation system as is more fully described herein. The declarant reserves the right to locate a Unit Week Purchaser in any comparable Unit within Palace View Resorts that the declarant may deem appropriate. For the purposes of this instru-ment, a comparable Unit is one possessing the same number of bedrooms, bathrooms and ap-proximate square footage as the Unit which is otherwise referenced in the Unit Week Purchas-er’s deed or contract for deed, without regard to the floor or location upon a floor of the Unit.

Palace View Resort owners has usage privileges in the 100 Building. Palace View by Spinnaker owners have usage privileges in buildings 200 – 600. The Association reserves the right to amend the Flexible/Floating Time Rules from time to time as may be necessary in the opinion of the Board of Directors of the Association to improve upon the quality and operation of these Rules and Regulations and to further the collective enjoy-ment of the use of the Unit Weeks.

On behalf of all of our owners; the association has the obligation to protect itself and its mem-bers from unpaid assessment fees. Owners who choose to sell or transfer their timeshares to third parties (to persons or entities) will be required to contact the management company prior to any transfer of ownership so that the proposed transferee is verified to be a bona fide pur-chaser of the timeshare interest. Otherwise, the transfer can be deemed as invalid and of no effect, and the present owner will remain liable for all future assessment fees for the timeshare interval. Reservations will be denied for any unpaid assessment fees.

Inter-family transfers or owners wishing to transfer into their trust for estate planning purposes are exempt from the Timeshare Transfer Policy. It is the Spinnaker family belief and that of your association that legacy is an important part of our business and a tremendous asset for the future generation.

PALACE VIEW RESORTS

RULES AND REGULATIONS

1. The sidewalks, if any, walkways and entrances must not be obstructed or encumbered or used for any purpose (excluding patios, decks and balconies) other than ingress and egress to and from the premises; nor shall any carriages, bicycles, wagons, shopping carts, chairs, benches, tables, or other objects of a similar type and nature be left therein or thereon.

2. The personal property of all Unit Owners or Unit Week Purchaser shall be stored within their Units.

3. No Unit Owner or Unit Week Purchaser shall allow whatsoever to fall from the windows, patios, decks, balconies, entry ways or doors of the premises, nor shall he sweep or throw from his Unit any dirt or other substances outside of his Unit.

4. Refuse and bagged garbage shall be deposited only in the area provided therefore. 5. No Unit Owner or Unit Week Purchaser shall store or leave boats, trailers, mobile homes,

recreation vehicle and the like on the common property, except in areas designated for same.

6. Employees of the Association or Management Firm shall not be sent off the Condominiums premises by any Unit Owner or Unit Week Purchaser at any time for any purpose. No Unit Owner or Unit Week Purchaser or resident shall direct, supervise, or in any manner attempt to assert any control over the employees of the Management Firm or the Association.

7. The parking facilities shall be used in accordance with the regulations adopted by the Man-agement Firm, as previously provided, and thereafter, by the Board of Directors.No vehicle which cannot operate on its own power shall remain on the Subdivision premises for more than twenty-four (24) hours, and no repair of vehicles shall be made on the Condominium premises.

8. No Unit Owner or Unit Week Purchaser shall make or permit any disturbing noises by him-self, his family, servants, employees, agents, visitors, and licenses, nor do or permit any-thing by such persons that will interfere with the rights, comforts or convenience of the Unit owners or unit Week Purchaser. No Unit Owner or Unit Week Purchaser shall play upon or suffer to be played upon any musical instrument, or operate or suffer to be operat-ed, a phonograph, television, radio or sound amplifier in his unit, in such a manner as to disturb or annoy other occupants of the Condominium. All party(s) shall lower the volume as to the foregoing as of 10:00 P.M. of each day. No Unit Owner or Unit Week Purchaser shall conduct or permit to be conducted, vocal or instrumental instruction at any time.

9. No radio or television installation, or other wiring, shall be made without the written con-sent of the Management Firm, as long as the Management Agreement remains in effect, and thereafter by the Board of Directors. Any antenna or aerial erected or installed on the exterior walls of a Unit or on the common properties, without the consent of the Manage-ment Firm, and thereafter, the Board of Directors, in writing, is liable to removal without notice and at the cost of the Unit Owner or unit Week Purchaser for whose benefit the in-stallation was made.

10. No sign, advertisement, notice or other lettering shall be exhibited, displayed, inscribed, painted or affixed, in, on or upon any part of the Unit or common properties by any Unit Owner or occupant without written permission of the Management Firm, and thereafter, the Association

11. No awning, canopy, shutter or other projection, shall be attached to or placed upon the outside walls or doors or roof of a Unit or building without the written consent of the Management Firm, as long as the Management Agreement remains in effect, and there-after, of the Board of Directors of the Association. All window coverings must be such color as the Management Firm determines in its sole discretion, and thereafter, the Asso-ciation. Patios, decks or balconies may not be enclosed nor anything affixed, where appli-cable, to the walls or railings within such patios, decks and balconies except with the pri-or written consent of the Management Firm, and thereafter, the Association, and said consent may be given as to certain Units and not given as to others.

12. Complaints regarding the service of the Association shall be made in writing to the Man-agement Firm, as long as the Management Agreement remains in affect, and thereafter, to the Board of Directors.

13. No inflammable, combustible, or explosive fluid, chemical or substance, shall be kept in any Unit or common properties except such as are required for normal household use.

14. Payments of periodic assessments shall be made at the office of the Management Firm as designated in the Management Agreement. Payments made in the form of checks shall be made to the order of such party as the Management Firm shall designate. Pay-ments of maintenance/association fees are due on the 1st day of each year, and if such payments are (10) or more days late, are subject to charges, as provided in the Declara-tion of Condominium.

15. Additional Provisions in the nature of Rules and Regulations are specified in the Declara-tion of Condominium.

16. The Management Firm, as long as the Management Agreement remains in effect, and thereafter, the Board of Directors of the Association, reserves the right to make addition-al Rules and Regulations as may be required from time to time. These additional Rules and Regulations shall be as binding as all other Rules and Regulation as previously adopt-ed.

17. No clothes line or similar device shall be permitted on any portion of the condominium property, nor shall clothes be hung anywhere except in such areas as are designated by the Management Firm, and thereafter, the Board of Directors of the Association.

18. Capitalized terms not defined herein shall have those meanings assigned to them in the Declarations of Condominium for Palace View Resort Condominium, Palace View by Spin-naker, Palace View South by Spinnaker.

19. Effective 2011, no owner, family member, tenant, resident, guest, business invitee, or visitor shall smoke cigarettes, cigars, or any other tobacco product within the vacation unit. Smoking will only be permitted on the balcony area of each unit. If found that an Owner and/or Guest has violated this policy a fine of $150 for a professional cleaning of the unit will be charged to the Owner and/or Guest who is registered at the Resort. If the next occupant to this unit must be relocated due to the smoke smell, the previous occupant will also be charged for any additional fees that may be incurred by the reloca-tion.

20. Effective 2016 the smoking policy has been amended to include no smoking of e-cigarettes and smoking will no longer be permitted on the pool deck/s or the unit balco-nies.

LOCK-OUT GUIDE

All 2 Bedroom/2 Bath that have a Lock-Out feature are designed to provide you

with the following extra benefits:

Option #1. You may opt to use the entire villa at your home Resort.

Option #2. You may exchange the entire villa through Interval Interna-

tional.

Option #3. You may exchange the Lock-Outs separately through II as sepa-

rate weeks or reserve these weeks separately back to your home

resort. For example, the 2 Bedroom Lock-Out will exchange/

reserve as 2 (two) 1 Bedroom units with two different weeks of

vacation.

Option #4. You may use one of the lock-outs at your home resort and

exchange the other lock-out through II.

You may, therefore enjoy two weeks of vacationing each year if you use alternate lock-out sides separately. However, only one annual maintenance /association fee is paid for each week owned.

Spinnaker Resorts, and each of our affiliates, respects the confidential nature of both your personal and account information. To ensure your privacy, we have, and will continue to safeguard the infor-mation with which we are entrusted. Below, we have outlined the type of information that is typi-cally collected from our owners and how this information is used. Please read this policy carefully and be assured of our commitment to safe-guard the privacy policy rights of our owners. I. Type of personal information collected

Information typically obtained for the purchase of property, from your purchase contract, credit application and other paperwork includes: your name, address, telephone number, social security number, employment, income, bank account information and monthly payment liability.

Information obtained from third parties, as part of the purchase process, include credit reports and bank account information necessary to maintain your account.

Information is also received from our regular transactions and experiences, which help us main-tain the accuracy of your account information.

II. Sharing your personal information We DO NOT share personal information on present or former customers with any nonaffiliated third parties, who are not directly involved in the process of handling or servicing your purchase. We do share your information with our title company to secure your title policy; and with our financial in-stitution, as part of the mortgage servicing and collection process. We also use information for our own (internal) marketing programs. We DO NOT SELL your name, address or telephone number to any unaffiliated third parties. Here at Spinnaker Resorts, your personal information is private and is used to help us make your vacation ownership experience the best that it can be. III. Control of your personal information Spinnaker Resorts, and its affiliated companies, safeguard your information, both physically and elec-tronically. Only parties with proper authority are permitted access to your personal information. All employees and related parties are required to adhere to the company’s privacy Assurance Policy and violations would result in disciplinary action. IV. Your right to "Opt Out" While Spinnaker Resorts does not presently share personal information with non-affiliated third par-ties, or have any plans to do so. you have the option to "opt out", please contact us at 866-455-3577 to notify us of your choice. We will process your request within thirty (30) days and maintain this information on file until we receive further direction from you. While we may, as permitted by feder-al law, continue to share information such as your account history and balance with affiliates of the company, no information will be shared with nonaffiliated parties. While our Privacy Assurance Policy is designed for the primary signatory on each account, we honor the opt out request of all joint signatories, as well.
