On the recommendation of Departmental Promotion committee and as per order passed on 05-07-2012 by the Hon'ble High Court of H.P. in CWP No. 1545 of 2011 titled as Vinod Kumar Vs State of H.P. and others the following Trained Graduate Teachers and Promotee Lecturers (School Cadre) promoted as Lecturer prior to 26-04-2010 and not opted for promotion as Lecturer at the time of promotion and now who have opted for promotion to the post of Headmaster are hereby promoted to the post of Headmaster I Headmistresses Class-11 (Non-Gazetted) in the pay band of Rs. 10300-34800 + Rs. 5400 Grade Pay and further posted against vacancy in Govt. All the above promoted Headmasters/Headmistresses are directed to join

his_lher new place of posting on or before 15.07.2017 positively, failing which their promotion orders shall

deemed to have been WITHDRAWN AUTOMATICALLY for ONE YEAR or next DPC whichever is later. No

extension will be given for joining in any case. No specific orders with reference to withdraw! of promotion will

be issued separately. Those who have been posted in newly upgraded High School will join as and when

school made functional.

The Principals/Headmasters of the concerned schools are directed to

relieve the newly promotee Hea~master/Headmistress immediately. Before relieving the official to join

at the new place of posting on promotion, Principals/Headmasters/000 of the concerned institutions

may ensure that :·

(i) The service particulars of every promotee be verified carefully. viz Name,

Seniority No., Category (SC/ST/Gen)

(ii) The above promotee has not been recru ited against the Ex.· Servicemen

quota.

(iii) The above promotee has not opted earlier to the post of Lecturer/PGT,

as the option once exercised cannot be changed.

(iv) The above promotee HM is not promoted as Lecturer/PGT after 26-04·

2010.

(v) There is no departmental inquiry/vigilance case pending against the said

official .

(VI) The above TGTs have not been consider for promotion as Lect./PGT

earlier as per his/her option.

The above promoted Headmasters will also send their joining to concerned'·

Deputy Directors as well as to this Directorate telegraphically immediately. In case of any bonafide mistake

as per above Sr. No. i to vi in the particulars of the promotee, the clarification may be sought directly

from this Directorate and the official be relieved only thereafter.

No promotee has any right to forego promotion in public interest and

promotion can be enforced. However, if someone applies to forego the promotion his/her request will be

considered only if the reasons adduced for refusal of promotion are acceptable to the appointing authority and

he/she will be debarred for one year or next DPC whichever is later.

Financial benefits will be admissible to the promotee from the date of joining _...

and their pay will be fixed under the provision of under Rule-11 of Revised (Pay) Rules 2009. In case of the

pay fixations of promotee Lecturers/PGT who are being promoted as Headmaster the benefit of under Rule-11

will ·be admissible to them from their feeder post of TGT's only. Official who wants to get their pay fixed

according to option, they will have to exercise their option within one month from the date of joining.

The above official will be entitled toTNDNJT as admissible under rule. If any

promotee has been transferred prior to issuance of these orders from the school mentioned against his/her

name, in such cases it will be the personal responsibility of the DDO of that school to send the promotion

orders to the concerned promotee under REGISTERED POST under intimation to this office.

These promotions. will however be subject to the final outcome of the SLP

8710 of 2009 pending before Hon'ble Appex Court, and any other litigation pending before Hon'ble Court or

any other decision taken/ order issued by the State Government from Time to time and subject to review due

to any consequential administrative reasons.
