    Director of Facilities Planning and Con-struction.The Director of Facilities Planning and Con-struction reports to the Executive ViceChancellor for Business Affairs. The pri-mary duties and responsibilities of theoffice include:6.331 The provision of staff assistance

    to the Chancellor and the Execu-tive Vice Chancellors in the exe-cution of their responsibilities.

    6.332 General administration and super-vision of any new building con-struction and initial equippingthereof, or any new constructionof improvements other than build-ing; or campus planning exceeding$300,000 in cost, or of any insideor outside repairs, remodeling, orrehabilitation, exceeding $600,000in cost; managing any preliminaryplanning, feasibility studies, orinvestigations which are estimatedto ultimately develop into one ofthe above projects at any compo-nent institution of the System;advising and working with the con-sultants, arChitects and engineersemployed by the Board, sUbject tothe terms and conditions of thecontracts with those architectsand engineers.

    6.333 Serving as ex officio member ofall faculty building committees atthe component institutions.

    6.334 Preparing and executing all docu-ments relating to the acquisitionand the use of funds received fromthe federal government and stateagencies in connection with con-struction grant awards.

    6.335 Coordinating the preparation ofand approving of all grant appli-cations on approved constructionprojects filed with governmentalagencies.

    Coordinating the development ofand maintaining of master plansfor all component institutions,including but not limited to landutilization, utility and landscapeplans.Directing the negotiation andapproval of all contracts for com-mercially operated thermal energyplants.Complying with federal and stateaccessibility standards applicableto new construction and majorrepair and rehabilitation projectsof the System and its componentinstitutions.

    6.34 System Personnel Director.The System Personnel Director's primaryresponsibility is to plan, develop, andcoordinate System-wide personnel policiesand procedures. SUbject to delegation bythe Executive Vice Chancellor for BusinessAffairs, the System Personnel Director isresponsible for:6.341 Acting as liaison between compo-

    nent institution personnel offi-cers and the System officersrega~ding all personnel mattersrelating to classified personnel,administrative staff, and certainmatters relating to tAachingand/or academic personnel.

    6.342 Advising the System officers andmaking recommendations concerningdevelopment of methods and proce-dures desiqned to maximize theeffectiveness of System personnelPrograms.

    6.343 Reviewing and recommending allclassified personnel pay plans foreach component institution,including the establishment of

    their responsibilities. The Vice Chancellor for GovernmentalRelations has direct access to the Board of Regents of TheUniversity of Texas System and is expected to work directlywith appropriate committees of the Board in discharging theduties of the office.

    9.1 Appointment and Tenure.The Vice Chancellor for Governmental Relations shallbe appointed by the Board after nomination by theChancellor. The Vice Chancellor for GovernmentalRelations shall hold office without fixed term, sub-ject to the pleasure of the Chancellor. The Chancel-lor's actions regarding the Vice Chancellor fo~Governmental Relations are SUbject to review andapproval by the Board.

    9.2 Duties and Responsibilities.The primary responsibilities of the office include:9.21 The provision of staff assistance to the

    Chancellor and the Executive Vice Chancel-lors in the execution of their responsibili-ties.

    9.22 Representing the Board of Regents of TheUniversity of Texas system in its relationswith federal, state, and local legislativebodies and agencies.

    9.23 Making recommendations to the Chancellor inthe area of public policy as it affects therelationship of the system with the federal,state, and local governments.

    9.24 Informing appropriate administrative offi-cers of current operations and long-rangedevelopments on the federal and state level,which may affect the system.

    9.25 Maintaining and distributing information to,and advising appropriate System Administra-tion and component institution officials, inorder to assure proper action by the Systemwith respect to federal, state, and localgovernmental programs and activities.

    Sec. 10. Vice Chancellor for Development and External Relations.

    The Vice Chancellor for Development and External Relationsreports to the Chancellor and 1s responsible for the programsof the System related to private sector support, alumni rela-tions, pUblic information, and external constituencies as setout in SUbsection 10.2 of this Chapter. The Vice Chancellorfor Development and External Relations provides staff assis-tance to the Chancellor and the Executive Vice Chancellors inthe exercise of their responsibilities. The vice Chancellorfor Development and External Relations has direct access tothe Board of Regents of The University of Texas System and isexpected to work directly with appropriate committees of theBoard in discharging the duties of the office.

    The development, organization, and adminis-tration of activities to obtain privatesector funding for programs of the System.The organization and administration of pro-grams for providing information to the pUb-lic relating to the System and coordinatingthose programs with the pUblic informationprograms of the component institutions.Directing the administration of the SystemOffice of Special Services.To assist in the development, organization,and administration of programs and activi-ties related to alumni of System componentinstitutions in coordination with appropri-ate personnel of the component institutions.Coordinating the policies and activities ofthe System and the component institutionsrelated to internal and external foundationsthat provide support for the System and thecomponent institutions.The performance of such other duties andresponsibilities as may be assigned by theChancellor.

    Sec. 11. Other Code lOOO Staff and Officers of System Administration.

    Staff and officers of System Administration designated ascode 1000 shall be appointed by the Chancellor, the ExecutiveVice Chancellors, or Vice Chancellors to whom they willreport. Persons so appointed shall not have tenure by virtueof their respective positions. They shall serve withoutfixed term, subject to the pleasure of the officer to whomthey report. The actions of the appointing officer concern-ing such positions are in turn SUbject to review and approvalby the Chancellor or the Board as reguired by the Regents'Rules and Regulations.

    The system council.The System Council is composed of the Chancellor, theExecutive Vice Chancellor for Academic Affairs. theExecutive vice chancellor for Health Affairs, theExecutive Vice Chancellor for Business Affairs, thevice Chancellor for Asset Management, the Vice chan-cellor and General Counsel, the vice Chancellor forGovernmental Relations, the Executive and ResearchAssistant to the Chancellor, the Executive Directorfor public Affairs and Development, and the chiefadministrative officers of all the component institu-tions of The University of Texas system. The chan-cellor shall serve as the Council's permanentchairman and shall conduct regular meetings to dis-cuss those matters of general concern to the opera-tion of The University of Texas System.

    The Council of Academic Institutions.The Council of Academic Institutions is composed ofthe Executive Vice Chancellor for Academic Affairsand the chief administrative officers of the generalacademic institutions of the System. The Chancellor,the Executive vice Chancellor for Business Affairs,the Vice Chancellor for Asset Management, the ViceChancellor and General Counsel, the vice Chancellorfor Governmental Relations, the Executive andResearch Assistant to the Chancellor, and the Execu-tive Director for Public Affairs and Developmentserve as ex officio members of this Council. TheExecutive Vice chancellor for Academic Affairs shallserve as the council's permanent chairman and shallconduct regular meetings to review common problems ofplanning, development, and operation of the severalinstitutions represented.

    The council of Health Institutions.The Council of Health Institutions is composed of theExecutive Vice Chancellor for Health Affairs and thechief administrative officers of the component insti-tutions of thQ System concerned directly with health

    affairs. The Chancellor, the Executive Vice Chancel-lor for Business Affairs, the Vice Chancellor forAsset Management, the Vice Chancellor and GeneralCounsel, the Vice Chancellor for Governmental Rela-tions, the Executive and Research Assistant to theChancellor, and the Executive Director for PublicAffairs and Development serve as ex officio membersof this Council. The Executive Vice Chancellor forHealth Affairs acts as the Council's permanent chair-man and shall conduct regular meetings to reviewcommon problems of planning, development, and opera-tion of the several institutions represented.

    The Business Management Council.The Business Management Council advises the SystemAdministration in the areas of component budgeting,business management, data processing, physical plantoperations, planning, construction, and accountingsystems development. The Council is composed of theExecutive Vice Chancellor for Business Affairs and thechief business officers of the component institutions.The Chancellor, the Executive Vice Chancellor forAcademic Affairs, the Executive Vice Chancellor forHealth Affairs, the Vice Chancellor for Asset Man-agement, the Vice Chancellor and General Counsel, theVice Chancellor for Governmental Relations, the Execu-tive and Research Assistant to the Chancellor, and theExecutive Director for Public Affairs and Development,or their delegates, serve as ex officio members ofthis Council. The Executive Vice Chancellor forBusiness Affairs shall serve as the Council's perma-nent chairman and shall conduct regular meetings ofthe Council.

    Sec. 13. Chief Administratiye Officers of Component Institutions.

    13.1 The Board selects the chief administrative officer ofeach component institution.13.11 When there is a vacancy or it is known that

    there is to be a vacancy in the office of achief administrative officer of a componentinstitution having faculty and students andthe Board does not have candidate(s) from

    recent searches at other component institu-tions, from within the U. T. System, and/orof national prominence from outside the U. T.System to advance for consideration, an Advi-sory committee shall be established to recom-mend candidates to the Board. The ExecutiveVice Chancellor having responsibility for theoperation of the institution where thevacancy has occurred or is to occur shall bechairman of the Advisory Committee. In cir-cumstances where this Executive Vice Chancel-lor may be a candidate for the office, thechairman of the Advisory Committee shall bethe Chancellor or the Chancellor's designee.In addition to the chairman, committee mem-bership is as follows:

    The Chancellor;Two Chief AdministrativeOfficers;

    (to be appointed by theChairman of the Boardfrom two of the componentinstitutions)

    Two Regents;(to be appointed by theChairman of the Board)

    Three Faculty members of theinstitution involved, atleast two of whom shallhave the rank of asso-ciate professor orhigher; (method ofselection to be deter-mined by the GeneralFaculty of the campus)

    Not more than two representativesof the cornponent1sexternal constituency whohave demonstrated a deepinterest 1n and supportof the institution, itsprograms and its role incommunity activities tobe appointed by theChairman of the Board ofRegents. Where a compo-nent institution has astatewide mission; spe-cial area programmaticrelationships or part-nerships with junior orcommunity colleges, pri-vate universities orpublic schools, busi-ness/corporate entities,community or public ser-vice agencies; or otherunique constituencies,the Chairman of the Boardof Regents may appoinc anadditional representa-tive.

    Campus constituent groups withresponsibility for selection ofAdvisory Committee representa-tives are expected to considerdiversity I particularly as itrelates to minority and femalerepresentation. Unless there areunusual delays in faculty, staff orstudent representative selectionWhich postpone initiation of thecommittee process, the Chairman of

    the Board will make his or herappointments to the Advisory Com-mittee after campus selections inorder to maximize the prospect thatthe total committee compositionreflects diversity.

    The Advisory Committee shall set up selectioncriteria that relate to the needs of theindividual component, initiate mechanisms todevelop an appropriate candidate pool, seekinformation on the several candidates andinquire from competent sources as to thecandidates' academic, administrative andbusiness ability. The Committee may alsointerview candidates as a part of its selec-tion process keeping in mind that the con-fidentiality of the process is important toits ultimate success.Finally, the Advisory committee shall submit,through its Chairman, a recommended list ofnot less than five or more than ten candi-dates with no preference indicated. Candi-dates submitted shall have received amajority vote of the Committee. The recom-mended list should be developed and submittedwithout regard to the Advisory Committee'sassessment of the potential availability ofany candidate. I f none of the names sub-mitted in the report of the Advisory Commit-tee is satisfactory to the Board, then theBoard in its discretion may either name a newcommittee or proceed to select a chief admin-istrative officer under such other proceduresas in its discretion it may deem proper andappropriate.When the Board has candidate(s) from recentsearches at other component institutions,from within the U. T. System, and/or ofnational prominence from outside the U. T.System to advance for consideration, theChairman of the Board of Regents shallappoint a Special Committee to provide theBoard of Regents with advice and evaluation

    consistent with that usually provided by anAdvisory Committee. The Special Committeeshall be composed as specified above for theAdvisory Committee but will not include mem-bers of the Board of Regents. The advice ofthe Special Committee shall be provided tothe Board through the appropriate ExecutiveVice Chancellor and the Chancellor. TheSpecial committee shall not extend its con-sideration beyond those nominees referred toit by the U. T. Board of Regents withoutspecific concurrence from the Board.

    Each chief administrative officer reports to and isresponsible to the Executive Vice Chancellor havingresponsibility for the institution, and serves withoutfixed term, subject to the pleasure of the appropriateExecutive Vice Chancellor and approval by the Chancel-lor and the Board. The chief administrative officerhas access to the Chancellor and is expected to con-sult with the appropriate Executive Vice Chancellorand the Chancellor on significant issues on an asneeded basis.

    Within the policies and regulations of the Board, andunder the supervision and direction of the ExecutiveVice Chancellor having responsibility for the insti-tution, the chief administrative officer has generalauthority and responsibility for the administration ofthat institution.13.31 specifically, the chief administrative

    officer is expected, with the appropriateparticipation of the staff, to:13.311 Develop and administer plans and

    policies for the program, organi-zation, and operation of theinstitution.

    13.312 Interpret the System policy to thestaff, and interpret the institu-tion's programs and needs to theSystem Administration and to thepUblic.

    Develop and administer policiesrelating to students, and whereapplicable, to the proper manage-ment of services to patients.Recommend appropriate operatingbudgets and supervise expendituresunder approved bUdgets.Nominate all members of the facultyand staff, maintain efficient per-sonnel programs, and recommendstaff members for promotion,retention, or dismissal for cause.Insure efficient management ofbusiness affairs and physicalproperty; recommend additions andalterations to the physical plant.Serve as presiding officer atofficial meetings of faculty andstaff of the institution, and asex officio member of each collegeor school faculty (if any) withinthe institution.Appoint, or establish proceduresfor the appointment of, all fac-ulty, staff, and student commit-tees.Cause to be prepared and SUbmittedto the appropriate Executive ViceChancellor the rules and regula-tions for the governance of theinstitution. When such rules andregulations have been finallyapproved by the Chancellor orappropriate Executive Vice chan-cellor, they shall thereafterconstitute the Handbook ofOperating Procedures for thatinstitution. Provided, however,that whether or not finallyapproved by the Chancellor, anyrule or regulation in any suchinstitutional Handbook of OperatingProcedures that is in conflict with

    any rule or regulation in theRegents' Rules and Regulations, isnull and void and has no effect,and whenever any such conflict isdetected, the Chancellor and thechief administrative officer of thecomponent institution shall immedi-ately make such amendments to theinstitutional Handbook of OperatingProcedures as may be necessary toeliminate such conflict.

    13.31(10) Assume initiative in developinglong-range plans for the programand physical facilities of theinstitution.

    13.31(11) Assume active leadership indeveloping private fund supportfor the institution in accordancewith policies and proceduresestablished in the Regents' Rulesand Regulations.

    Sec. 14. Appointment of Other Officers and staff.

    14.1 The Board delegates to the Chancellor and the Execu-tive Vice Chancellor having responsibility for theinstitution and they, in turn, delegate to the chiefadministrative officer of each component institutionthe responsibility for the appointment and dismissalof all other administrative officers of each componentinstitution, including vice presidents, deans, direc-tors and their equivalents.     The Board delegates to the Chancellor and the Execu-tive Vice Chancellor having responsibility for theinstitution and they, in turn, delegate to the chiefadministrative officer of each component institutionthe responsibility for the permanent or actingappointment of department chairmen, department heads,and their equivalents. Such department chairmen,department heads and their equivalents serve withoutfixed terms and subject to the pleasure of the chiefadministrative officer of the institution.

    The Board endorses the principle of reasonable facultyand student consultation in the selection of adminis-trative officers of the component institutions, andthe primary operating units, and expects the cniefadministrative Officer, as he or she deems appropri-ate, to consult in the selection process with therepresentatives of the faCUlty and student body.However, the chief administrative officer of the com-ponent institution is responsible for executing theduties of the office and consequently shall not bebound by nominations to administrative positions bycampus selection committees, and the Handbook ofOperating Procedures of each component institutionshall so state.

    Honorary Titles.The titles Chancellor Emeritus, President Emeritus andsimilar honorary designations shall be conferred onlyby appropriate action of the Board on individuals whoare fully rQtired. No person is authorized to use anysuch title unless it has been bestowed by the Board.

    evidence and reconsidering its findings,recommendations, and suggestions, if any.Reasons for approval, rejectlon, or amend-ment of such findings, recommendations, orsuggestions will be stated in ~riting andcommunicated to the accused.Nontenured faculty members who are notifiedin accordance with Subsection 6.7 that theywill not be reappointed or who are notifiedin accordance with Subdivision 6.23 or Sub-sections 6.7 or 6.8 that the subsequentacademic year will be the terminal year ofappointment shall not be entitled to astatement of the reasons upon which thedecision for such action is based. Such adecision shall be SUbject to review only todetermine whether the decision was made forreasons that are unlawful under the laws orconstitution of this state or the Unitedstates. A review may be granted only inthose cases where the affected faculty mem-ber submits a written request for a reviewto the chief administrative Officer thatdescribes in detail the facts relied upon toprove that the decision was made for unlaw-ful reasons. If the chief administrativeofficer determines that the alleged facts,if proven by credible evidence, support aconclusion that the decision was made forunlawful reasons, SUch allegations shall beheard under the procedures in Subsection 6.3as in the case of dismissal for cause, ~iththe following exceptions:(1) the burden of proof is upon the

    (3) the hearing tripunal shall make writ-ten findings and rQcommendationsbased on the evidence presented atthe hearing and shall forward suchfindings and recommendations with thet~anscript and exhibits from thehearing to the chief administrativeofficer;

    (4) the chief administrative officer mayapprove, reject, or amend the recom-mendations of the hearing tribunal ormay reach different conclusions basedupon the record of the hearing. Thedecision of the chief administrativeofficer shall be final.

    6. (10) Each faculty member shall keep the chief administra-tive officer of the component institution or his orher delegate notified of his or her current mailingaddress. The written notice required by Sec-tion 6.23, 6.7, or 6.8 shall be sent by certifiedmail, return receipt requested, to the last addressgiven by the faculty member.

    6. (ll) The chief administrative officer of a componentinstitution has the responsibility tor determiningwhen to eliminate occupied academic positions, thetitle~ of which are given in subsection 1.8 of thisChapter, or abandon academic programs or both, sub-ject to approval oy the appropriate Executive viceChancellor. Tne decision of the chief administrativeofficer and the implementation of that decision shallbe subject to the following minimum procQduralrequirements:6.(11)1 An academic program under consideration for

    abandonment or an academic position that isunder consideration for elimination for Donafide academic reasons should be reviewed indepth through procedures determined by thechief administrative officer;

    6.(11)2 Tenured faculty in a program that is underconsideration for abandonment or in an aca-demic position that is under considerationfor elimination will be notified andafforded an opportunity to contribute to thereview process and have those contributionsfairly considered;

    6. (ll)) Upon completion of the review process, arecommendation with supporting rationaleshould be SUbmitted to the academic vicepresident for review and recommendation tothe chief administrative officer;

    6. (11)4 If the chief administrative officer deter-mines that an academic program should beabandoned or that one or more academic posi-tions occupied by tenured faculty should beeliminated, or both, a request for approvalwith supporting documentation should be for-warded to the appropriate Executive ViceChancellor;

    6. (11)5 The date for abandoning or phasing out anacademic program should take into consid-eration the time required for anticipatedcompletion by students currently enrolled orto facilitate their placement in acceptablealternative programs;

    6.(11)6 The administration will notify tenured fac-ulty in a program to be abandoned or in anacademic position that is to be eliminatedand ask each faculty member to inform thechief administrative officer or desiqnee inwriting at the faculty member's request forreassignment to other academic program(s)and to provide details of the faculty mem-ber's qualifications to teach in such aca-demic program(s);

    6. (11)7 The chief administrative officer or designeewill meet individually with tenured facultywho respond to discuss possible employmentalternatives to termination;

    6.(lllB If the decision is not to retain, the chiefadministrative officer or designee will senda written response stating reasons for notretaining the tenured faculty member;

    6. (11)9 If retention of a tenured faculty memberresults in displacement of a tAnured facultymember in another area, the displaced fac-ulty member is entitled to above procedures;

    6. (11)10 Any faculty member whose Amployment is ter-minated pursuant to this subsection shall beinformed of applicable benefits availableupon termination, such as retirement,accrued leave and opportunity to continueinsurance coverage;

    6. (11)11 U. T. system components should provide~ppropriate assistance to affected facultymembers concerning available alternativeemployment opportunities.

    6.(12) When such reductions are necessary as a result offinancial exigency, the procedure for the selectionand notification of those academic positions that areto be terminated shall be governed by this Section,

    the administration of theinstitution need not state thereasons for the questioneddecision or offer evidence insupport thereof unless theaffected faculty member pre-sents credible evidence that,if unchallenged, proves thedecision was made for unlawfulreasons;the hearing tribunal shall makewritten findings and recommen-dations based on the evidencepresented at the hearing andshall forward such findings andrecommendations with the tran-script and exhibits from thehearing to the chief adminis-trative officer;the chief administrative officermay approve, reject l or amendthe recommendations of the hear-ing tribunal or may reachdifferent conclusions based uponthe record of the hearing. Thedecision of the chief adminis-trative officer shall be final.

    b. Subsection 6.(11) was amended to read as follows:

    6. (11) The chief administrative officer of a compo-nent institution has the responsibility fordetermining when to eliminate occupied aca-demic positions, the titles of Which are givenin Subsection 1.8 of this Chapter, or abandonacademic programs or both, SUbject to approvalby the appropriate Executive Vice Chancellor.The decision of the chief administrative offi-cer and the implementation of that decisionshall be subject to the following minimumprocedural requirements:6.(11)1 An academic program under con-

    sideration for abandonment oran academic position that isunder consideration for elimi-nation for bona fide academicreasons should be reviewed indepth through proceduresdetermined by the chief admin-istrative officer;

    6.(11)2 Tenured faculty in a programthat is under considerationfor abandonment or in an aca-demic position that is underconsideration for eliminationwill be notified and affordedan opportunity to contributeto the review process and havethose contributions fairlyconsidered;

    6.(11)3 Upon completion of the reviewprocess, a recommendation withsupporting rationale should besubmitted to the academic vicepresident for review and rec-ommendation to the chiefadministrative officer;

(11)4 If the chief administrativeofficer determines that anacademic program should beabandoned or that one or moreacademic positions occupied bytenured faculty should be eli-minated, or both, a requestfor approval with supportingdocumentation should be for-warded to the appropriateExecutive vice Chancellor;

    6. (11)5 The date tor abandoning orphasing out an academic pro-gram should take into consid-eration the time required foranticipated completion by stu-dents currently enrolled or tofacilitate their placement inacceptable alternative pro-grams;

    6. (11)6 The administration will notifytenured faculty in a programto be abandoned or in an aca-demic position that is to beeliminated and ask each fac-ulty member to inform thechief administrative officeror designee in writing of thefaculty member's request forreassignment to other academicprogram(s) and to providedetails of the faculty mem-ber's qualifications to teachin such academic program(s);

    6. (11)7 The chief administrative offi-cer or designee will meetindividually with tenured fac-Ulty who respond to discusspossible employment alterna-tives to termination;

    6. (11)8 If the decision is not toretain, the chief administra-tive officer or designee willsend a written response stat-ing reasons for not retainingthe tenured faculty member;

    6.(11)9 If retention of a tenured fac-Ulty member results in dis-placement of a tenured facultymember in another area, thedisplaced faculty member isentitled to above procedures;

    6.(11)10 Any faculty member whoseemployment is terminated pur-suant to this Subsection shallbe informed of applicable ben-efits available upon termina-tion, such as retirement,accrued leave and opportunityto continue insurance cover-age;

    6. (11)11 U. T. System components shouldprovide appropriate assistanceto affected faculty membersconcerning available alterna-tive employment opportunities.

    The amendments to SUQdivision 6.35 clarify that appealsof institutional decisions related to nonreappointment ofnontenured faculty are limited to allegations of reasonsunlawful under the state or federal laws and constitu-tion. Additionally, the amendments provide that thedecision of the chief administrative officer, reachedfollowing recommendation by the hearing tribunal, isfinaL

    The amendments to Subsection 6. (II), which provide theminimum procedural requirements for academic programand/or position reduction not resulting from financialexigency, comply with a recent decision of the FifthCircuit Court of Appeals.

    The Master of science and Doctor 0 Philosophy in Envi-ronmental Science and Engineering rograrns are mUlti-disciplinary and will require en ring students to have asolid background in science andi r enginQQring. The newmaster's and doctoral degrees 11 be administeredthrough the Graduate School w· h a Committee on GraduateStudies for Environmental Sc· nee and Engineering to becomposed of faculty from th principal participatingdepartments in the COlleges of Science and Engineeringand the School of Urban an Public Affairs.

    The master's degree will require a minimum of 27 hoursof course work plus six ours of thesis or 3) hours ofcourse work and 3 hour for a research project andreport. The master's degree is expected to be the pro-fessional terminal d gree for persons seeking appliedwork in the pUblic nd private sectors. The doctoraldegree, which will ave a basic requirement for )0 hoursof course work be and the master's level preparation plUSthe research for and defense of the dissertation, willprepare student for careers in research in academic,industry, and overnrnent settings as well as for manage-ment and poli supervision at the highest levels.

    Executive Associate for Economic Affairs.

    9.1 The Executive Associate for Economic Affairs iselected by the Board, serves at the pleasure of theBoard, reports to and is responsible to the Board,and receives such compensation as may be fixed bythe Board.

    9.2 Duties.--The Executive Associate on a continuingbasis concelves and develops long-range plans andstudies with respect to the development and manage-ment of economic affairs of the component institu-tions, and upon request, conSUlts and advises withthe Board and the Vice Chancellor for Asset Manage-ment regarding plans and studies and shall have suchother duties and responsibilities as may be directedby the Board.

    Sec. 10. Signature Authority for Documents Executed on Behalf of theBoard.

    10.1 Except as may be otherwise provided in these Rulesand Regulations or in the resolution or order of theBoard with respect to the approval of a specificdocument or with respect to the approval of a pro-gram or project requiring the execution of one ormore documents, the Chairman of the Board, the Des-ignated Vice-chairman of the Board, the Chancelloror his or her designee, or the appropriate ExecutiveVice Chancellor may sign on behalf of the Board:10.11 all contracts, agreements, leases, convey-

    ances, deeds, easements, rights-of-way,bonds, licenses, or permits and all amend-ments, extensions or renewals of same thathave been approved, authorized or grantedby the Board as an item on the Agenda ofthe Board at a regular or special meeting;

    10.12 applications for permits or licenses to beissued to the Board or a component institu-tion that have been approved or authorizedby the Board;

    6.2(13) Directing the management of the System-wideinsurance programs (except the System Planfor Professional Medical Liability Self-Insurance), inclUding approval of all poli-cies and coverages, such programs toinclude:

    6.2(14} Implementing policy for the receipt, dis-bursement, and custody of funds; for termsof depository agreements with banks; and forcustody of bearer securities owned by Systemfunds that are maintained in bank safetydeposit boxes and are not in custody withthe state Treasurer.

    6.2(15} Forwarding debt issues for approval by theBoard of Regents following the concurrenceof the Vice Chancellor for Asset Management.

    pirector of Accounting.The Director of Accounting of The Universityof Texas at Austin serves also as directorof accounting for System Administration andis the accounting officer for both The Uni-versity of Texas at Austin and for SystemAdministration. With respect to SystemAdministration matters, the Director ofAccounting reports to and is responsible tothe Director of the Office of Budget andFiscal Policy. With respect to other mat-ters, the Director reports to the appropri-ate officers of The University of Texas atAustin. SUbject to delegation by the Execu-tive Vice Chancellor for Business Affairs,the duties of the office include:6.321 Having responsibility for custOdy,

    6.323 Maintaining a full and completeset of records that accuratelyreflect the balances and transac-tions of all financial and prop-erty accounts of the System (ascontracted with such accounts ofthe component institutions).

    6.342 Advising the System officers andmaking recommendations concerningdevelopment of methods and proce-dures designed to maximize theeffectiveness of System PersonnelPrograms.

    6.346 Reviewing and recommending to Sys-tem officers any rUles and regula-tions or changes thereto that,after proper consultation withofficers of component institu-tions, are considered beneficialor necessary for the proper admin-istration of the System-wide Per-sonnel Program.

    6.347 Establishing employee developmentand training programs for all com-ponent institutions, includingparticularly supervisory trainingprograms.

    6.348 Formulating policies and proce-dures concerning labor relationsand employer-employee relation-ships.

    6.349 Assisting and establishing person-nel data systems and proper prac-tices and procedures concerningthe personnel records of allemployees.

    6.34(10) Conducting System-wide wage andsalary research studies and for-mulating data for proper implemen-tation of personnel pay programs.

    6.352 Approving the organi2ationalstructure for police departmentsat the component institutions ofthe System.

    6.353 Establishing and supervising alltraining programs for Systempolice, including basic andin-service training, as well ason-the-job training at each compo-nent institution of the System.

    6.354 Conducting the System training inaccordance with the standards ofthe Texas Commission on LawEnforcement Officer Standards andEducation, in order to maintainaccreditation with this stateagency.

    6.355 Maintaining liaison with theDirector of Training, TexasDepartment of Public Safety, andthe Coordinator of Training, Fed-eral Bureau of Investigation, andbeing aware of new training tech-niques, procedures, programs, andequipment.

    6.356 Establishing a uniform reportingand record system for policedepartments at the componentinstitutions of the System andapproving any changes thereto.

    6.357 Conducting periodic inspection ofthe police departments at the com-ponent institutions of the Systemand evaluating their performanceas police agencies.
