01WHAT YOU NEED TO KNOW ABOUT CYBER LAW AND CYBER CRIME

Cyber law refers to the area of law that regulates how people use the internet and internet-related technologies. Cybercrime describes both crimes directed at computers, data or information communication technology (ICT), and crimes committed by people using computers or ICT. Cybercrime may be committed against an individual or a group; it can also be committed against government and private organizations.

03WHAT YOU NEED TO KNOW ABOUT DATA SECURITY AND DATA PROTECTION

Although the rise of the internet and digital revolution holds many benefi ts, generally people do not necessarily stop to consider the extent and scope of what their digital activity may reveal about them and whether such personal information is safely stored and protected, or how such information is used. After all, the identity of data collectors engaging in the collection, processing, usage and storage of personal information is not always identifi able and many consumers unassumingly click “accept” when an online terms and condition page pops up.

02HOW CYBERCRIME IS REGULATED IN SOUTH AFRICA

To date, the South African legal framework regulating cybercrimes has consisted of various pieces of legislation and our common law. Unfortunately, these often fall short of eff ectively regulating the complex world of cybercrime. This has necessitated the need for a consolidated framework to address cybersecurity and to criminalize cybercrimes specifi cally. The Cybercrimes and Cybersecurity Bill (“Cybercrimes Bill”) is in the process of being enacted and passed into law and has been introduced to assist in providing such a framework for combating computer-related crimes and improving the cybersecurity of South African citizens.

04THREATS TO DATA SECURITY

Although there are many advantages, there are also areas for concern and/or risks that need to be considered when participating in the digital arena. While the internet and the digital economy present a signifi cant opportunity for businesses to market and sell their products and services, as well as being a convenient tool for users to access these products and services, it is also an enabling platform for criminal activity, such as online fraud, digital identity theft and data breaches.
