Court of 1st Additional Sessions Judge Srinagar, Subash C Gupta acquit- ted Bashir Ahmad Mir, Nazir Ahmad Thoker, Manzoor Ahmad Thoker and Zahid Hussain Mir alias Bitta who were booked on the charges of murder of a duo, Abdul Aziz Mir and Mushtaq Ahmad Chopan, whose bodies were recovered from Kursoo Bund in Raj Bagh area of the city in 2007. Observing that the prosecution has remained unsuccessful to prove the allegations of murder and destroying of evidence against the accused, the court acquitted them of the charges and ordered their release. “Hence, accused deserve their acquit- tal for the commission of offence of murder punishable under section 302 RPC and of destroying of evidence relat- ing to same punishable under section 201 of RPC,” the court ruled in the judgement it had reserved after hearing counsel for accused Muhammad Abdullah Pandit and the prosecution. On April 16, 2007, police had recovered two bodies bundled into two gunny bags from Kursoo Bund in Raj Bagh area and a case ( FIR No 25 of 2007) was registered with Police Station Raj Bagh. The bodies were identified to be those of Abdul Aziz Mir of Muran Tangwari, Chandoosa, Baramula district and Mushtaq Ahmad Chopan of Quilmuqam, Bandipora. Initial police investigation had revealed that Abdul Aziz Mir was run- ning a stationery shop at Boniyar Uri while Mushtaq Ahmad Chopan had failed to do poultry business and used to move in Kupwara to collect the money which retailers owed to him. During one such business trip, Mush- taq met Zahid Hussain Mir, alias Bitta of Dardpora Lolab, Kupwara, who lured him into transaction business. Mir promised one million Euro notes and a mysterious crystal of great value to him. Mushtaq Ahmad discussed the matter with Abdul Aziz Mir and both agreed to explore this business. Meanwhile, Zahid entered into a crim- inal conspiracy with three others, who posed as businessmen. It was decided that Rs 10 lakh would be paid as advance by Aziz and Mushtaq. Both were brought to Rajbagh by Mir, where other accused, who were working as servants and labourers in a Joinery Mill at Rajbagh, were present. The victims were given some seda- tive and strangulated. Their bodies were bundled into a van and thrown at Kursoo Bund. The accused were identified as Nazir Ahmad Thoker, his brother Manzoor Ahmad Thoker and Bashir Ahmad Mir. All belongings, including the cell phone of Aziz Mir (SIM No. 9419468541), of the victims were burnt by the culprits. However, it was with the help of the call details of this SIM number, that police was able to locate the landline number to which the victim had made a call to speak to the accused, so as to find out the exact location where they had to meet. This led to the arrest of the accused. DAK slams separatists for failing to set up Bait-ul-Maal IMRAN MUZAFFAR Srinagar, July 8: A lead- ing federation of medicos Tuesday slammed Kash- mir’s pro-freedom leader- ship for its failure to set up institution of Bait-ul-Maal in Kashmir, in the absence of which countless people were living – and dying – a life of utter penury. “Hazrat Umar Farooq (RA), despite being a Khal- ifa (Caliph), wore worn- out shoes, was usually clad with patched up garments and used to sleep on bare floor of Masjid,” said Dr Nisar-ul-Hassan, Presi- dent of Doctors Associa- tion Kashmir or DAK, in a statement. “Our leaders who preach teachings of Islam have a responsibility to create the institution of Bait-ul- Maal. They have to follow and practice wisdom of the holy Quran, life of Prophet Muhammad (S.A.W) and the wisdom of Khalifas for creating a successful Bait- ul-Maal.” The DAK statement comes after Greater Kash- mir exclusively reported on absence of Bait-ul-Maal in Kashmir and how destitute were suffering silently. On Tuesday, the Asso- ciation called for estab- lishment of Bait-ul-Maal in Kashmir to, what it said, serve the concept of ‘Haqooq-ul-Ibad,’ a funda- mental principle of Islam. The Association also called for institutionaliza- tion of the system “in order to introduce Islamic con- cept of public trusteeship and public ownership by transferring wealth from individuals to a social col- lective ownership.” The financial institution of Bait-ul-Maal, according to historical accounts, has existed and grown since the time of Prophet Muhammad (S.A.W). It was an independent economic institution during the time of Hazrat Umar Farooq (RA). Court acquits accused for lack of evidence

D A RASHID

Srinagar, July 8: A local court has acquitted four men accused of commit-ting murder of two persons at Rajbagh here in 2007.

Court of 1st Additional Sessions Judge Srinagar, Subash C Gupta acquit-ted Bashir Ahmad Mir, Nazir Ahmad Thoker, Manzoor Ahmad Thoker and Zahid Hussain Mir alias Bitta who were booked on the charges of murder of a duo, Abdul Aziz Mir and Mushtaq Ahmad Chopan, whose bodies were recovered from Kursoo Bund in Raj Bagh area of the city in 2007.

Observing that the prosecution has remained unsuccessful to prove the allegations of murder and destroying of evidence against the accused, the court acquitted them of the charges and ordered their release.

“Hence, accused deserve their acquit-tal for the commission of offence of murder punishable under section 302 RPC and of destroying of evidence relat-ing to same punishable under section 201 of RPC,” the court ruled in the judgement

it had reserved after hearing counsel for accused Muhammad Abdullah Pandit and the prosecution.

Initial police investigation had revealed that Abdul Aziz Mir was run-ning a stationery shop at Boniyar Uri while Mushtaq Ahmad Chopan had failed to do poultry business and used to move in Kupwara to collect the money which retailers owed to him.

During one such business trip, Mush-taq met Zahid Hussain Mir, alias Bitta of Dardpora Lolab, Kupwara, who lured him into transaction business. Mir promised one million Euro notes and a mysterious crystal of great value to him. Mushtaq Ahmad discussed the matter with Abdul Aziz Mir and both agreed to explore this business.

Meanwhile, Zahid entered into a crim-inal conspiracy with three others, who posed as businessmen. It was decided that Rs 10 lakh would be paid as advance by Aziz and Mushtaq. Both were brought to Rajbagh by Mir, where other accused, who were working as servants and labourers in a Joinery Mill at Rajbagh, were present.

The victims were given some seda-tive and strangulated.

DAK slams separatists for failing to set up Bait-ul-Maal

IMRAN MUZAFFAR

Srinagar, July 8: A lead-ing federation of medicos Tuesday slammed Kash-mir’s pro-freedom leader-ship for its failure to set up institution of Bait-ul-Maal in Kashmir, in the absence of which countless people were living – and dying – a life of utter penury.

“Hazrat Umar Farooq (RA), despite being a Khal-ifa (Caliph), wore worn-out shoes, was usually clad with patched up garments and used to sleep on bare floor of Masjid,” said Dr Nisar-ul-Hassan, Presi-dent of Doctors Associa-tion Kashmir or DAK, in a statement.

“Our leaders who preach teachings of Islam have a responsibility to create the institution of Bait-ul-Maal. They have to follow and practice wisdom of the holy Quran, life of Prophet Muhammad (S.A.W) and the wisdom of Khalifas for creating a successful Bait-ul-Maal.”

The DAK statement comes after Greater Kash-mir exclusively reported on absence of Bait-ul-Maal in Kashmir and how destitute

were suffering silently. On Tuesday, the Asso-

ciation called for estab-lishment of Bait-ul-Maal in Kashmir to, what it said, serve the concept of ‘Haqooq-ul-Ibad,’ a funda-mental principle of Islam.

The financial institution of Bait-ul-Maal, according to historical accounts, has existed and grown since the time of Prophet Muhammad (S.A.W). It was an independent economic institution during the time of Hazrat Umar Farooq (RA).

The DAK president added, “We have failed to create the institution so far because our preaching and sermons are contrary to what we practice.”
