Division of Real Estate Seeking Comments; Suggestions on Contracts and Forms

The Division of Real Estate and the Colorado Real Estate Commission are seeking your input on the 2013 Mandatory Real Estate Contracts and Forms. In an effort to streamline the process and reduce the num-ber of forms changes, licensees have the opportunity to offer sugges-tions on how to improve the forms. Comments and suggestions will be

accepted via email until March 1, 2013.You can submit your comments to: [email protected] compile multiple comments into one email submission to cut down on the number of cor-respondence that Division staff will need to review. Division staff will compile comments and recommendations and will then present proposed suggestions to the Commission’s Forms Com-mittee. It’s the goal of the Division and the Committee to have all forms ready for Commission approval in August, and finalized “DRAFT” forms posted and distributed to educators and publish-ers by October 1, 2013.

La Plata County Board of Equalization Hearing Referees

La Plata County is seeking individuals to serve as independent referees who are experienced in property valuation to conduct hearings related to property valuation disputes and to make findings and submit recommendations to the Board of County Commissioners acting as the Board of Equalization. Applicants must be experienced in the area of property taxation (such as registered, licensed or certified real estate appraisers, licensed real estate bro-kers, and/or licensed attorneys with experience in real estate matters.) Applicants will be required to participate in a one-day mandatory training session in June and must be available for protest hearings from 7/15/13 – 8/5/13 and quarterly abatement hearings. Compensation is $25.00 per hour. Submit letters of interest & summary of qualifications to: La Plata County c/o Jeanne Bignall, 1060 E. 2nd Ave., Durango, CO 81301 by March 1, 2013.

A PROCURING CAUSE QUESTION

Broker A shows his listing to Broker B and Broker B’s buyer. The home has been on the market for 90 days and Broker A has just increased the co-op commission. The house comes close to meeting the buyers needs but not close enough. Broker A mentions that he will be listing a property that very likely will meet the Buyers needs. Broker B says to let him know when the property is available. The next Saturday afternoon Broker A lists the property and calls Broker B. Broker A gives Broker B the lock box information and says that since the sellers will be out of town on Sunday morning for Broker B to feel free to show the house on Sunday morning.

Broker B shows the house on Sunday morning and the buyer LOVES it. Broker B writes a full price con-tract and delivers it to Broker A. Broker A meets with the sellers Sunday afternoon and the contract is accepted.

Well you guessed it. At closing Broker B receives no commission. Broker B files an arbitration. Who wins? You will find the answer in the Code of Ethics, Article Three, Standard of Practice 3-1.

The HOA Information and Resource Center

The HOA Information and Resource Center has been in operation since January 1, 2011. It was created in 2010 by the Colorado Legislature as a result of legislative and consumer concerns regarding homeowner’s associations in Colorado. The Office is organized within the Division of Real Estate under the Department of Regulatory Agencies. The HOA Office registers and collects information concerning homeowner’s associations, including an HOA’s contact information, and handles consumer inquiries and complaints from homeowners. The HOA Office provides assistance and information to homeowners, HOA boards, declarants and other interested parties concerning their rights and responsibilities pursuant to the Colorado Common Interest Ownership Act (“CCIOA”). The HOA Information Officer administers the HOA Office, and he reviews, analyzes, and presents the data and information collected in an annual report. The report presents data concerning the number and geographical concentration of HOA’s in the State, as well as inquiries and complaint types received. The HOA Office does not however, provide legal advice or mediate disputes with HOA’s or community association managers. Also, the Division of Real Estate and the HOA Office does not have the authority to conduct investigations, nor does it have regulatory oversight over homeowner’s associations or community association managers (who are not licensed real estate brokers). The HOA Office provides informational resource materials and referral information to consumers to assist them with their concerns. The HOA Office receives many inquiries and complaints concerning HOA’s, some of which pertain to:

- HOA managers/management companies; - Board member responsibilities; - Governing documents; - Meetings and elections; - Community maintenance; - Dues, fees, fines and rule enforcement; - Declarant issues; and - Disclosure and production of records.

The HOA Information and Resource Center’s goals for 2013 will be to:

Expand community outreach throughout the State; Utilize media and non-profit resources for the dissemination of HOA

information; Develop more educational information for HOA owners, managers, and

developers; Provide community presentations, forums, and workshops on HOA issues; Offer HOA educational classes for consumers and industry professionals; Have a greater Office website presence with practical HOA issue information and

materials, expanding FAQ’s, and providing useful resource links for additional assistance and referrals;

Streamline the HOA registration system in order to collect relevant HOA data; and

Empower the consumer with knowledge concerning their rights and responsibilities in an HOA.
